“I don’t think it’s a secret that we inherited one of the worst, most incompetent and most ill-funded Department of Corrections in the country. . . [a]nd I don’t think it takes a leap to suggest that we should understand whether they are capable of carrying out the death penalty before we do it.” That is how Attorney General Kris Mayes described Arizona’s Department of Corrections, Rehabilitation & Reentry (“ADCRR”) less than two years ago. Ryan Thornell, director of the ADCRR, agreed, attesting in a declaration in 2023 that the ADCRR lacked “the necessary institutional knowledge and expertise to conduct …

Secrets Of The Killing State: The Untold Story Of Lethal Injection Introduction, Corinna Lain Jan 2025

Secrets Of The Killing State: The Untold Story Of Lethal Injection Introduction, Corinna Lain

Law Faculty Publications

Three hours. That’s how long it took the state of Alabama to kill Joe Nathan James by lethal injection in 2022, setting a new record for the longest execution in United States history. James’s autopsy showed puncture wounds and bruising at the knuckles and wrists, indicating that executioners had tried (and failed) to insert an IV in those locations. It revealed puncture wounds in his musculature, nowhere near the anatomical vicinity of a vein. And it documented a deep, jagged incision that pathologists suspect occurred when James flinched as executioners were attempting to perform a “cutdown”— a surgical incision used …

How Do You Solve A Problem Like Artistic Freedom In The American Theatre?: A Plea For Denying Copyright Protection To Staging Requirements, Michael Ecker Jan 2025

How Do You Solve A Problem Like Artistic Freedom In The American Theatre?: A Plea For Denying Copyright Protection To Staging Requirements, Michael Ecker

Cardozo Arts & Entertainment Law Journal

The note argues that extending copyright protection to theatrical stage directions would severely threaten the collaborative nature of American theater, stifling creativity and inclusivity. It contends that stage directions, as a unique aspect of dramatic works, should not be eligible for copyright protection under the Copyright Act of 1976, particularly due to the merger doctrine, which denies protection when ideas and their expression are inseparable. The note emphasizes the importance of preserving theater as a collaborative and interpretive art form, where the interplay between playwrights, directors, and performers is essential to its vitality.

When the citizens' trust in the Rule of Law weakens, the Rule of Law becomes fragile. In this article we examine the impact of emerging technologies on the citizens' trust in the Rule of Law. Our analysis is specifcally focused on the effect of systemic disinformation which is likely to worsen with the advent of Generative AI, algorithmic misgovernance, and the digitalization …

Can Commercials Be Art? An Analysis Of Intellectual Property Preawareness In The Barbie Era, Shreya Kalidindi Jan 2025

Can Commercials Be Art? An Analysis Of Intellectual Property Preawareness In The Barbie Era, Shreya Kalidindi

Cardozo Arts & Entertainment Law Journal

The note examines the evolution of advertising, particularly native advertising, and critiques the inadequacy of current regulatory frameworks in addressing its deceptive potential. It highlights how modern advertising practices, such as product placement in films like Barbie, blur the line between commercial speech and artistic expression, challenging the Federal Trade Commission’s (FTC) ability to protect consumers. The analysis argues that strengthening existing regulations is insufficient and advocates for empowering consumers to make informed decisions, as the legal system struggles to keep pace with innovative advertising strategies.

Looking Into Mirrors And Windows: School Librarians' Perspectives On Diverse Representation In Book Collections, Kimberly Reichenbach Krutka

STEMPS Faculty Publications

Librarian professional standards include the development of collections with diverse representation, and the study of multicultural literature is often part of masters programs. However, there is a lack of scholarship examining what multicultural literature signifies for librarians. In addition, the current landscape surrounding libraries has jeopardized students’ access to literature, furthering a narrative that attempts to exclude specific identities and portrays librarians as irresponsible and harmful. This study aimed to build a foundation of understanding and critical insights into this problem through a survey distributed to Texas school librarians. Data was analyzed through descriptive statistics and content analysis to understand …

STEMPS Faculty Publications

Educational and psychological research often involves comparing motivation across groups. It is critical to ensure that observed differences in motivation are true variations by group, not due to measurement biases. With a diverse sample of undergraduate students (N = 2200), this study measured internal consistency and gathered validity evidence based on the internal structure of five motivation scales. To compare motivation for biology between groups of undergraduate students, this study tested for measurement scalar invariance by group and, accordingly, conducted latent factor mean comparisons to understand true group differences. On average, female students held lower expectancy beliefs and self-efficacy …

Femoral Avascular Necrosis And Triptan Therapy: A Multicenter Retrospective Study, Joseph Bisiani, Francisco Martos Jr., Brian Lynch Jan 2025

Femoral Avascular Necrosis And Triptan Therapy: A Multicenter Retrospective Study, Joseph Bisiani, Francisco Martos Jr., Brian Lynch

Stony Brook Orthopaedic and Musculoskeletal Journal

Aims: Migraines are one of the most common neurological disorders that patients typically suffer from. One of the more common prescription medications for migraines are triptans, which can lead to vasoconstriction throughout the peripheral vasculature as a potential side effect. However, a possible risk of femoral avascular necrosis may arise from these treatments, as it has been well known that a lack of blood flow to the femur can arise due to this peripheral vasoconstriction. Therefore, research is warranted for whether taking anti-migraine medications is associated with a higher risk of developing avascular necrosis within the femur, an area highly …

Biomechanical Comparison Of Posterolateral Fibula Plating With Independent Syndesmotic Screw Fixation Versus Direct Lateral Plating With Syndesmotic Screw Fixation Through Plate, Dmitriy Butsenko, Zack Bonick, J Gary Bledsoe, Michael E. Doany

Stony Brook Orthopaedic and Musculoskeletal Journal

Syndesmotic fixation has been extensively investigated. Screw size, number, position, orientation, and flexible fixation options have all been investigated at length. There is however a lack of knowledge of any difference between an independent syndesmotic screw versus onethrough a lateral plate. The purpose therefore is to perform a biomechanical assessment of syndesmotic fixation comparing independent screw vs screw through plate combination, analyzing torsional strength of both constructs. To perform this, seven matched cadaveric through tibia-fibula lower leg specimens were prepared by creating an oblique fracture performing surgical syndesmotic disruption. The specimens were then randomized into the direct lateral through plate …
