Congolese Refugee Narratives Of Belonging, Grief, And Cultural Continuity In Appalachia, Kayla Davis
Congolese Refugee Narratives Of Belonging, Grief, And Cultural Continuity In Appalachia, Kayla Davis
Theses and Dissertations
This research examines the communicative challenges that Congolese refugees face after resettlement, particularly as they strive to reconstruct a sense of belonging in the United States that reflects their experiences in either their home country or secondary countries where they endured protracted displacement in refugee camps. Narrative qualitative research methods were used to conduct interviews with five Congolese refugees in Appalachia. Through qualitative thematic and lexical analysis derived from the interviews, the study reveals patterns of linguistic isolation, community continuity, and emotional displacement. A key finding is that participants often conceptualize community not as a geographic entity, but as an …
Judicial Accountability, Anya Bernstein
Judicial Accountability, Anya Bernstein
Faculty Scholarship
Judicial decisions are moving ever more authority over regulatory statutes away from agencies and to courts instead. One justification offered for this power transfer: agencies lack the accountability of courts. This Article takes up that claim, assessing the institutions’ relative capacities for accountability in their authoritative interpretations of regulatory statutes—agency regulations and court rulings. I take accountability to involve actors undertaking reasoned decisionmaking grounded in publicly recognized values and facts and justifying their decisions to others who can evaluate, influence, or override those judgments. Accountability thus involves a give and take: it gives an account of government reasoning to a …

‘Preventing Births’ As A Gender-Neutral Harm: Making Sense Of Reproductive Violence In South Africa’S Genocide Case Against Israel, Heidi Matthews
‘Preventing Births’ As A Gender-Neutral Harm: Making Sense Of Reproductive Violence In South Africa’S Genocide Case Against Israel, Heidi Matthews
Articles & Book Chapters
Abstract In its genocide case against Israel at the International Court of Justice, South Africa alleges that, in the period since October 7, 2023, Israel has imposed measures intended to prevent births within the Palestinian group in Gaza. To the extent that South Africa’s case for ‘preventing births’ relies on the traditional framing of reproductive justice, wherein violations are conceptualized in terms of restrictions on reproductive (read: women’s) health and capacity, it risks advancing the human rights of ‘women and children’ at the expense of a more progressive development of the law of genocide. This article uses the ongoing genocidal …

Light Touch (LT) has been known to improve standing balance without mechanical support by providing sensory information about the movement of the body. Inspired by this, this work developed a Virtual Cane (VC) which gives no physical support but provides other sensory information that a physical cane would. The VC is developed with a distance sensor and vibration actuators to provide cane tip-to-ground distance information to the user. The extent to which this haptic feedback improves standing balance was assessed in a human experiment. 10 healthy young participants underwent a standing balance experiment with tandem stance and eyes closed, using …

Infectious disease plays a key role in shaping marine communities, including in seagrass meadows, which form biodiverse coastal habitats. Eelgrass (Zostera marina) is the most widespread seagrass species and is susceptible to seagrass wasting disease, caused by the protist Labyrinthula zosterae. As a foundation species, eelgrass strongly influences ecosystem structure, function and services; recent work has begun to explore the links between critical community interactions and seagrass wasting disease. Here, we highlight recent advances about how the eelgrass community regulates and responds to seagrass wasting disease, from the microbiome to herbivores and filter feeders. We further show …
The Role Of Post-Cloacal Gland Biofluorescence In Male-Male Communication In Plethodon Cinereus, Kasey Watterson
The Role Of Post-Cloacal Gland Biofluorescence In Male-Male Communication In Plethodon Cinereus, Kasey Watterson
Masters Theses
Biofluorescence is increasingly recognized as a potentially important form of visual communication across a wide range of taxa, yet its ecological and behavioral function remains largely untested in many terrestrial species. In the red-backed salamander (Plethodon cinereus), fluorescence is a sexually dimorphic trait most strongly expressed in males, particularly around the cloacal region and ventral side of the tail, areas that are often displayed during territorial contests and courtship. Rival males also direct behaviors like cloacal investigation toward these fluorescent regions, suggesting a potential signaling function. Since fluorescence is often displayed during territorial contests, I hypothesized that fluorescence in male …

Bruen: The Court's Announcement Of The Historical Analogy Test And The Aftermath Thereof, Michael Partrick
Wyoming Law Review
The United States Supreme Court’s history of analyzing firearms restrictions has seemingly always led to ambiguities and confusion in lower courts. This was especially true after 2008, when the Court decided District of Columbia v. Heller, 554 U.S. 570 (2008). In the years following Heller, lower courts across the country applied different standards to determine the constitutionality of firearms restrictions. The Court granted certiorari in New York State Rifle & Pistol Ass’n v. Bruen, 597 U.S. 1 (2022) to establish the proper test for determining whether a firearm regulation is constitutional. This test is based on U.S. …

Legislating Morality: The Historical Consequences Of The Mann Act On The American Public, Chance J. Harper
Wyoming Law Review
The Mann Act, officially titled the “White Slave Traffic Act of June 25 1910,” was a product of a time of immense social, ethnic, and political change. The Mann Act was presented as the solution to “white slavery”— an imagined crisis where white-American girls were forced into prostitution. This crisis was attributed to the influx of traditionally “othered” ethnic groups, which shocked the nation and prompted sweeping action by politicians to protect white-American values and culture in the name of stopping forced prostitution. In addition to perceived threats to American values, fears of immigrant power as a voting block and …
Can We Ever Arrive At A Conclusive Interpretation Of Scripture?, Jarrod Julian Lee
Can We Ever Arrive At A Conclusive Interpretation Of Scripture?, Jarrod Julian Lee
Obsculta
The Church today is highly fragmented, with thousands of denominations. Unsurprisingly, there is much disagreement on how to interpret Scripture, even within the Catholic Church. This piece examines if an objectively right answer on how to interpret Scripture is possible, focusing on the Gospels, especially Luke’s, and three candidates that can play such an arbitration role between competing interpretations – historical truth, experts and the author’s intention. While no conclusive answer can be obtained, radical skepticism is not an inevitability; the broad parameter that is our community’s intuitions can play a ‘loose’ arbitration role.
