Sex and morals have often been factors in custody disputes. Courts have felt that giving custody of children to homosexual parents would create an environment not in the best interest of the child. Many mental health professionals argue that these decisions have been based on prejudice and homophobia. The purpose of this study was to evaluate research on the sexual orientation of children raised by homosexual parents and review data on the mental/psychosexual health of these children. These studies revealed no difference between children raised by gay/lesbian parents versus those raised by heterosexual parents on IQ scores, gender identity, or …

Woman, Utopia And Ideology: A Case Study In Sociology Of Knowledge, Margaret M. M. Vanderbroek

This study utilizes the perspective of the sociology of knowledge to examine the interrelationships between the characterization of woman in the utopian genre and attitudes toward woman in those Western societies where this literary form flourished. The history of the genre from early Greece to the present century traces interconnections and dependencies of form and intent. In chronicling the sociology of utopia, this study describes and analyzes the process by which utopian literature may be seen as a reflexive critique of the society which produced it. The Roman conquest of the eastern Mediterranean (264-100 B.C.) was one of the more important events in Roman history. The expansion of Carthage had been brought to a halt when the genius of the Roman general Scipio enabled the Romans to defeat the Carthaginians decisively on their own ground, at Zama in North Africa. With Carthage subdued, Rome set out systematically forestalling the rise of any potentially dangerous rival in Greece or the Near East. Rome gradually filled the power vacuum left by the disintegrating Hellenistic states and for the first time in history, the whole Mediterranean area was to …

The Avowed Lesbian Mother And Her Right To Child Custody: A Constitutional Challenge That Can No Longer Be Denied, Marilyn Riley
San Diego Law Review
The custody determinations involving Lesbian mothers raise constitutional issues which must be examined against our society's strongly anti-homosexual background. Generally, problems the women face result from Western culture's ancient homophobia—a combination of fear, hatred and ignorance—which has produced a heritage of persecution directed at homosexuals. Because anti-homophile attitudes are so deeply rooted and widely accepted, they of course influence legislative and judicial responses to the homophile's demands for equal rights. Therefore, before considering the relevant constitutional issues, this Note will discuss the history and development of Western homophobia.

The fall of Rome did not, as many contemporaries had expected, preface the end of the world. Rather, it was the end of a world, of a way of life which had characterized the Mediterranean basin for centuries. Amid the ruins of Greco-Roman Civilization, three new civilizations arose in the old imperial territories and their borderlands. One of these new civilizations -- the Western - is our major interest and its first phase -- the medieval -- will here demand our closer attention. Provisions for the settling of conflicts constitute the greater part of any legal system. These conflicts are not entirely governed by self interest and the idea of ethical duty does not disappear from them: it asserts itself in the shape of the balance to be established ·by the court: while every litigant presses for the satisfaction of his own claims society is called upon to adjudicate fairly between the parties: the moral notion of justice appears as the impartial attribution of what everyone in society ought to have by right.
