From The Right To Choose To The Virtuous Victims? Advocating For Reproductive Justice In The United States After Dobbs, Carole J. Petersen Sep 2025

From The Right To Choose To The Virtuous Victims? Advocating For Reproductive Justice In The United States After Dobbs, Carole J. Petersen

Denver Journal of International Law & Policy

Since Dobbs, advocacy for reproductive justice in the United States has increasingly focused on the “virtuous victims” of state abortion bans—women who wanted to give birth but suddenly required emergency abortion care to preserve their lives or health. These cases now play a prominent role in strategic litigation but may inadvertently promote stereotypical views of women’s role in society. The political fallout may also lead Republicans to propose compromise legislation, with a wider range of compassionate exceptions but increased restrictions on abortion pills. This could have devastating impacts on women who are currently obtaining abortion pills for self-managed abortions. The …

Advancing Reproductive Equality Through Anti-Discrimination Law, Rebecca J. Cook Sep 2025

Advancing Reproductive Equality Through Anti-Discrimination Law, Rebecca J. Cook

Denver Journal of International Law & Policy

This article explores various understandings of anti-discrimination law and how different national apex courts, regional human rights tribunals and international human rights treaty bodies have applied them in abortion decisions, particularly in the Global South. Recent jurisprudential and theoretical innovations in anti-discrimination law range from direct discriminatory treatment against individuals to indirect discrimination resulting in disparate impact on groups to systemic forms of discrimination that address underlying gender hierarchies and prejudicial constructions of women, girls and pregnant persons. Whatever form of anti-discrimination law is applied, they all have a role in improving access to essential abortion services and improving the …

Alpine Plants And Climate Change: Tracking Community Shifts In Yosemite National, Brooke L. Wallasch Sep 2025

Alpine Plants And Climate Change: Tracking Community Shifts In Yosemite National, Brooke L. Wallasch

Master's Theses

As climate change progresses, alpine plant communities are predicted to shift upslope as they track temperature over time. Relative to lowland environments, alpine areas are experiencing a faster rate of temperature change due to a phenomenon referred to as elevation-dependent warming. A common approach for tracking plant communities shifts over time, is to conduct resurveys of the same area at several time points, as the Global Observational Research Initiative in Alpine Environments (GLORIA) has done on mountain summits around the world since 2001. In 2011-2013, GLORIA developed a supplemental survey method whereby belt transects were established downslope of summits in …

Build, Buy, Or Both?: On The Antitrust Laws' Supposed Preference For "Internal Growth" Over Acquisitions, Geoffrey A. Manne, Justin (Gus) Hurwitz Sep 2025

Build, Buy, Or Both?: On The Antitrust Laws' Supposed Preference For "Internal Growth" Over Acquisitions, Geoffrey A. Manne, Justin (Gus) Hurwitz

Nevada Law Journal

This Article challenges recent claims by antitrust enforcers that the U.S. antitrust laws embody a preference for “internal” or “organic” growth over external expansion through acquisition. It begins by examining the modern use of this claim in speeches, enforcement actions, and the 2023 Merger Guidelines issued by the Federal Trade Commission and Department of Justice. It then considers the legislative history of the 1950 Celler-Kefauver and 1976 Hart-Scott-Rodino Acts, which are frequently cited as showing congressional support for internal growth. Careful reading of these Acts, however, shows that Congress’s central goal was to close a loophole regarding asset acquisitions, and …

Bars To Asylum For Disabled And Criminalized Noncitizens: Particularly Serious Crimes And Mental Health Evidence In Immigration Court After Matter Of B-Z-R-, Elizabeth Jordan

University of Arkansas at Little Rock Law Review

A criminal conviction can prohibit a noncitizen from accessing certain forms of relief from deportation in immigration court. Notably, certain convictions may bar a noncitizen from asylum. But what happens when that conviction is based on the manifestation of mental health disabilities? This Article is the first to explore and critique the current immigration law framework for accounting for the criminalization of a noncitizen’s mental health disability, focusing primarily on the Attorney General’s recent decision In re B-Z-R- and the missed opportunity it represents to ensure that criminalized, disabled noncitizens are still able to access justice in the form of …

Economics Faculty Works

Exposure to extreme weather events and other adverse shocks has led to an increasing number of humanitarian crises in developing countries in recent years. These events cause acute suffering and compromise future welfare by adversely impacting human capital formation among vulnerable populations. Early and accurate detection of adverse shocks to food security, health, and schooling is critical to facilitating timely and well-targeted humanitarian interventions to minimize these detrimental effects. Yet monitoring data are rarely available with the frequency and spatial granularity needed. This paper uses high-frequency household survey data from the Rapid Feedback Monitoring System, collected in 2020–23 in southern …

Receptions Of Mental Health Emergency Services In New York City, Daniel R. Samost

Dissertations, Theses, and Capstone Projects

Mental health emergency response has become a highly scrutinized topic following the Black Lives Matter movement and several notable incidents of mental health emergency service users being killed by police responders. Qualitative interviews were conducted with mental health emergency service users to better understand the experience of using mental health emergency services, garner critical feedback of the service, and explore recommendations to improve future response. A total of 23 participants conducted interviews and detailed 40 incidents of mental health emergency service utilization. These interviews were then coded and analyzed. There were a few major findings from the data. Just over …

The Weight Of Complicity: A Network Analysis Of Ecocide In Palestine, Marilyn Moy Sep 2025

The Weight Of Complicity: A Network Analysis Of Ecocide In Palestine, Marilyn Moy

Dissertations, Theses, and Capstone Projects

This paper combines multi-criteria decision analysis (MCDA) with a network graph visualization to examine corporate and institutional involvement in ecocide in Palestine from 1917 to the present. Using a weighted sum model based on UN human rights principles and UNEP guidelines, actors are evaluated across three criteria: directness, scale, and duration of harm. A dataset of 50+ entities, including Caterpillar, Elbit Systems, and the Jewish National Fund, reveals a dense network of responsibility, with major enablers in the construction, tech, and military sectors. Findings highlight the severe impacts of the 2023–present assault on Gaza and demonstrate that ecocide is a …

Imagined Empires: Roman And Chinese Constructions Of One Another In Antiquity, Elizabeth S. Tsang Sep 2025

Imagined Empires: Roman And Chinese Constructions Of One Another In Antiquity, Elizabeth S. Tsang

Dissertations, Theses, and Capstone Projects

This thesis examines how the Roman and Han Chinese empires conceptualized one another during the first centuries CE, despite never establishing sustained direct contact. It argues that mutual perceptions were shaped less by firsthand experience than by mediated reports, commodities, and the political interests of intermediaries. The study proceeds in four parts. The first explores how Roman authors employed the ethnonym Seres to frame China as a land of wonder, wealth, and alterity. The second analyzes the Chinese designation Da Qin, showing how it projected Han imperial ideals outward by casting Rome as a mirror-image polity. The third turns to …

Teaching And Technology: "You Can't Just Do The Same Thing Online", Sakina Laksimi Sep 2025

Teaching And Technology: "You Can't Just Do The Same Thing Online", Sakina Laksimi

Dissertations, Theses, and Capstone Projects

This dissertation examines how faculty at the City University of New York navigated the abrupt transition to online teaching during the COVID-19 pandemic, revealing how pedagogy is shaped by technological, institutional, and social conditions. Drawing on twenty-two interviews with twelve faculty across eight disciplines, I use a grounded theory approach to analyze how instructors adapted courses, reimagined assessment, and sustained connection with students amid crisis. Three overlapping pedagogical orientations emerged: improvisational, relational, and design-based teaching. These approaches highlight how faculty balanced responsiveness, care, and intentional course design in environments mediated by digital platforms and marked by inequity. The study situates …

The Architecture Of Exclusion: Disability, Race, And The History Of New York City’S 600 Schools, Francine Almash Sep 2025

The Architecture Of Exclusion: Disability, Race, And The History Of New York City’S 600 Schools, Francine Almash

Dissertations, Theses, and Capstone Projects

This dissertation investigates the largely erased history of New York City’s 600 schools—segregated public schools created to house students labeled as emotionally disturbed or socially maladjusted. These institutions, operating throughout the mid-20th century, disproportionately served Black and Puerto Rican youth, many of whom were placed in these schools under vague behavioral criteria and with little to no pathway for return to general education settings.

Combining archival research, longitudinal policy analysis, historical media review, and critical race and disability studies frameworks—including DisCrit (Disability Critical Race Theory)—this project situates the 600 schools at the intersection of institutional racism and ableism. It argues …

Online Resources For Oral Communication Courses, Sean P. Palmer Sep 2025

Online Resources For Oral Communication Courses, Sean P. Palmer

Dissertations, Theses, and Capstone Projects

Online resources focusing on oral communication skills are lacking, even as online education itself expands. While I was aware of this lack, I didn’t realize its severity until LaGuardia Community College went fully remote during the 2020 global pandemic, and I was looking for online tutoring aids for oral communication. Furthermore, the information presented online is frequently unsuitable for the purposes of online pedagogy due to its specialized and jargony mode of presentation. Also, many existing assignments involving oral communication assume public speaking as the default model, despite the growing importance of emergent digital modes of oral performance, like podcasting …

Prerogative In Common: On The Emancipatory Potential Of Radical Mutuality Amid Sovereign Decisionism, Matthew Builes Sep 2025

Prerogative In Common: On The Emancipatory Potential Of Radical Mutuality Amid Sovereign Decisionism, Matthew Builes

Dissertations, Theses, and Capstone Projects

In times of crisis, liberal democracies resort to authoritarian measures that undermine core democratic values. Dominant thought in the study of emergency-era law and politics appeal to a dichotomy of normal and exceptional times, to critique or justify the turn to sovereign decisionism. While this strategy seems clear-cut, the persistence of exceptional spaces and the crises that supposedly generate them challenge existing frameworks by blurring the line between norm and exception. This project explores the prospect of radical mutual aid, as a transformative response to the enduring crisis of modernity.

Crisis Narratives And The Vicissitudes Of Haitian Foodways: A Critical Comparison Of Three Food Items, Marc S. Gabriel Sep 2025

Crisis Narratives And The Vicissitudes Of Haitian Foodways: A Critical Comparison Of Three Food Items, Marc S. Gabriel

Dissertations, Theses, and Capstone Projects

Polities and media external to Haiti direct a lot of narrative focus on the country being the source of its own protracted crises. This represents a powerful narrative hegemony that casts the post-colonial nation as a zone of perpetual disasters or crisis. To maintain that narrative domination over Haiti, opportunistic observers of Haiti’s media spectacles of crisis only need to atomize the country’s newest crisis or natural disaster from the history that situates it. The elision of the Haitian memory – a memory of structural adjustment programs, systematic displacement, foreign-sponsored paramilitary violence, erosion of peasant foodways and agriculture – from …

Underrepresentation Of African American Women Superintendents In The Public Schools Of Texas: Descriptions Of Their Lived Experiences, Shani R. Wyllie

Electronic Theses and Dissertations

The problem addressed through this study was the underrepresentation of African American women superintendents in the public-school districts of Texas, despite women making up a majority of the public-school workforce. The purpose of this transcendental phenomenological study was to describe the lived experiences of African American women superintendents regarding the support and barriers they encountered as they navigated their journeys to the position of public school district superintendent in Texas. The study was grounded in the Black feminist thought framework. Five semistructured interviews were conducted with currently serving African American women superintendents in Texas. The participants had been in the …

The Philippine Agricultural Scientist

The Philippines has 7,641 islands, most of which are small and underdeveloped. While studies have been done on topics such as poverty reduction, climate change, and economic development, there is no integrated research and development (R&D) agenda for small islands. Furthermore, literature points to the lack of consensus on the definition of small islands. As such, the study wove together existing bodies of knowledge and stakeholder perspectives on small islands in the country using a qualitative research design. Data were collected through a desk review, workshops, and key informant interviews. Four categories of small islands were proposed, namely micro-island, small …

Temporal Evolution Of Workforce Fatality-Linked Factors In The Transportation Construction Sector, Mariam Elazhary, Islam H. El-Adaway Sep 2025

Temporal Evolution Of Workforce Fatality-Linked Factors In The Transportation Construction Sector, Mariam Elazhary, Islam H. El-Adaway

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Despite advancements in safety measures, fatalities in the transportation sector remain disproportionately higher than in other industries. Transportation sector fatalities arise from a combination of demographic, environmental, and occupational factors that amplify the overall risk. While strides have been made in understanding the factors contributing to fatalities, there remains a critical gap in research focused on their temporal evolution. The goal of this study is to investigate the temporal evolution of fatality-linked association factors in the transportation construction sector. The methodology encompassed three stages. Stage 1 was preprocessing the data: the US Census of Fatal Occupational Injuries, covering 3,792 fatality …

Labor Productivity Losses Across Construction Trades: A Machine Learning Approach, Tamima Elbashbishy, Islam H. El-Adaway Sep 2025

Labor Productivity Losses Across Construction Trades: A Machine Learning Approach, Tamima Elbashbishy, Islam H. El-Adaway

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Labor productivity is a major concern in the construction industry. Existing research on construction labor productivity (CLP) within specific trades has produced inconsistent findings due to differences in the factors analyzed. This lack of consistency makes it difficult to identify the most critical drivers of productivity losses across trades. To address this gap, this study adopts a cross-trade analytical approach to systematically identify and evaluate the inefficiencies impacting labor productivity in multiple construction trades. Specifically, the study (1) identified common organizational and project-level inefficiencies that influence labor performance; (2) conducted an expert-based survey to measure the frequency and perceived impact …

A Mobility Data-Driven Approach To Analyzing And Modeling Park Accessibility Inequities And Use In U.S. Cities, Michaelmary Chukwu Sep 2025

A Mobility Data-Driven Approach To Analyzing And Modeling Park Accessibility Inequities And Use In U.S. Cities, Michaelmary Chukwu

Graduate Theses and Dissertations

Urban Park accessibility inequities have been a longstanding issue globally and the United States in particular. Despite the benefits that urban parks provide, use and access is not equitably distributed among the population, often favoring historically privileged populations over others (disadvantaged). Fortunately, improvements have been made in recent years to promote balanced park distribution in some cities; however, evidence still shows that most cities are behind. Interestingly, the rise in human mobility data has facilitated the study of human behavior and use of activity spaces. This thesis advances the existing studies on park accessibility and emerging human mobility to study …

Sound Decisions: The Impact Of Music Genre In Fashion Advertising On Consumer Perceptions And Purchase Intention, Cassandra Thomas Sep 2025

Sound Decisions: The Impact Of Music Genre In Fashion Advertising On Consumer Perceptions And Purchase Intention, Cassandra Thomas

Graduate Theses and Dissertations

This study examines how music genre, brand type, and the perceived congruency between the two influences consumer perceptions of fashion advertising. Guided by Congruity Theory and Attitude Theory, this study employed a 3x3 experimental design in which 252 participants viewed one of nine advertisement conditions varying by music genre (pop, hip-hop, electronic) and brand type (activewear, fast fashion, luxury). A series of one-way ANOVAs, bivariate correlations, and regression analyses were conducted to interpret the effects of music genre, brand type, and perceived congruency on attitudes toward 1) the advertisement and brand, 2) credibility of the advertisement and brand, and 3) …
