Crying Wolf: Neo-Patriots, Critical Race Theory, And The Constitutional Protection Of "Dangerous" Ideas, Bryan K. Fair Jan 2023

Crying Wolf: Neo-Patriots, Critical Race Theory, And The Constitutional Protection Of "Dangerous" Ideas, Bryan K. Fair

Articles

Most Americans do not realize that, notwithstanding the First Amendment's free speech guarantee, for most of our nation's history, judges sent men and women to prison for expressing ideas considered too "dangerous." It was not until the late 1960s that the Supreme Court rejected the clear and present danger doctrine, insisting that statutes banning speech must draw a distinction between advocacy of ideas and advocacy of imminent lawless action. The Court held that under that constitutional norm, the government could not send a Klansman to prison for expressing racist, anti-Semitic, or otherwise dangerous or offensive ideas. Since then, banning the …

Comparing The Thermal Conductivity Of Three Artificial Soils Under Differing Moisture And Density Conditions For Use In Green Infrastructure, Paul H. Lunt, Kate Fuller, Matthew Fox, Steve Goodhew, Thomas R. Murphy Jan 2023

Comparing The Thermal Conductivity Of Three Artificial Soils Under Differing Moisture And Density Conditions For Use In Green Infrastructure, Paul H. Lunt, Kate Fuller, Matthew Fox, Steve Goodhew, Thomas R. Murphy

School of Geography, Earth and Environmental Sciences

Abstract Soil-based green infrastructure has the potential to improve building thermal performance and contribute to sustainable buildings. This study compares thermal conductivity response to soil moisture of three peat-free artificial soils to evaluate their potential use within green roofs and living walls. Thermal conductivity was measured with changing soil moisture and density. All soils showed higher thermal conductivity measures with increases in soil moisture. The ‘Biochar-coconut coir compost’ had the lowest thermal conductivity measures which displayed negligible response to density changes and exhibited the highest water holding capacity. When uncompacted, ‘FabSoil’ had low thermal conductivity measures, but when compacted, its …

Intersectionality Of Black Women Managers' Experiences With Gendered Racism In Corporate Finance, Venessa Marie Perry Jan 2023

Intersectionality Of Black Women Managers' Experiences With Gendered Racism In Corporate Finance, Venessa Marie Perry

Walden Dissertations and Doctoral Studies

Experiences of Black women with gendered racism remain a challenge in corporate America. Limited studies explore how Black women experience gendered racism due to the intersectionality of their dual identities. Black women experience chronic stress, burnout, and racial trauma. Disparities among Black women in management positions have gained traction and increased awareness; however, they remain underrepresented in corporate America. This qualitative study involved understanding Black women managers’ experiences with gendered racism in corporate finance. The generic qualitative study used intersectionality theory to illuminate the challenges of the intersecting identities of being a Black woman in corporate finance. Thirteen participants were …

School of Geography, Earth and Environmental Sciences

The accumulation of fallout radionuclides (FRNs) from nuclear weapons testing and nuclear accidents has been evaluated for over half a century in natural environments; however, until recently their distribution and abundance within glaciers have been poorly understood. Following a series of individual studies of FRNs, specifically 137Cs, 241Am and 210Pb, deposited on the surface of glaciers, we now understand that cryoconite, a material commonly found in the supraglacial environment, is a highly efficient accumulator of FRNs, both artificial and natural. However, the variability of FRN activity concentrations in cryoconite across the global cryosphere has never been assessed. This study thus …

Smart Water Metering As A Non-Invasive Tool To Infer Dwelling Type And Occupancy – Implications For The Collection Of Neighbourhood-Level Housing And Tourism Statistics, A. Newing, O. Hibbert, J. Van-Alwon, S. Ellaway, A. Smith Jan 2023

Smart Water Metering As A Non-Invasive Tool To Infer Dwelling Type And Occupancy – Implications For The Collection Of Neighbourhood-Level Housing And Tourism Statistics, A. Newing, O. Hibbert, J. Van-Alwon, S. Ellaway, A. Smith

School of Geography, Earth and Environmental Sciences

The international rollout of advanced metering infrastructure (AMI) in the residential water supply sector affords tremendous benefits in driving water-use efficiencies, accurate billing and network management (e.g. leak detection). AMI, using ‘smart meters’ fitted at a dwelling level, record water consumption at high temporal resolution. Since water is typically only consumed when householders are present, these data could offer a non intrusive means of inferring dwelling occupancy patterns. These insights could have a range of benefits dependent upon the spatiotemporal scale and the intended application – our interest is in the potential of these data to identify dwelling type, specifically …

Voices From The Field: Brexit, Citizenship And Agricultural Labour, Richard Yarwood, Gina Kallis, Leonie Boland

School of Geography, Earth and Environmental Sciences

Drawing on a case-study of Cornwall in the South-West of England, this paper has three main aims. First, it seeks to listen to the voices of migrant workers and, in doing so, learn more about their experiences of moving to, and working in, the British countryside. Second, it evaluates the impact of Brexit on their lives and, in particular, how it influences their decision to work in the UK or elsewhere. Finally, consideration is given to the significance of citizenship to their lives, both as a formal contract with the EU and as a lived experience.

Cross-Sectional Collaboration In Florida's Emergency Management System, Christopher Stephen Kirkland Jan 2023

Cross-Sectional Collaboration In Florida's Emergency Management System, Christopher Stephen Kirkland

Walden Dissertations and Doctoral Studies

Florida faces a unique set of emergency management hazards prompted by the state’s geography, high volume of tourism, and position as a hub of international trade. The state has developed a highly adaptive emergency management system to deliver humanitarian assistance to Floridians affected by natural and other disasters. Despite the importance of collaboration in delivering humanitarian goods and services to Floridians in times of crisis, little is known as to how collaboration occurs, what impediments exist, and how organizations adapt to the dynamics of natural and other disasters. In this qualitative case study, the integrative framework for collaborative governance was …

Antenatal depression, or depression during pregnancy, is a mental health concern in the United States that impacts mothers and their infants. This study examined the associations between psychosocial, obstetric, lifestyle factors, and antenatal depression. This study was guided by social cognitive theory, specifically the reciprocal determinism construct. Secondary data from the 2007–2018 National Health and Nutritional Examination Survey (NHANES) were used in this quantitative cross-sectional study. Every participant of the NHANES completed the Patient Health Questionnaire-9 depression screening form. The study sample consisted of 274 women who were pregnant at the time of participating in the NHANES, approximately 28.8% of …

Paul R. Williams At Work In Photographs: Tarrying With Cites/Sights/Sites Of Trouble, Denise M. Johnson Jan 2023

Paul R. Williams At Work In Photographs: Tarrying With Cites/Sights/Sites Of Trouble, Denise M. Johnson

CGU Theses & Dissertations

Ariella Azoulay and W. J. T. Mitchell have called for a new users’ manual for photographs, urging that theory finally wrest itself from the authoritative singular gaze of the patriarchal imperial photographer so that the plurality inherent within the ontology of viewing photographs be engaged. Azoulay cogently argues that the photographer is not the only person to act when a photographic event takes place. By turning critical analysis to the photographic subject and advising viewers to both watch and listen to photographs rather than gaze, a space of appearance is activated in which the photographic subject engages in dialogue with …

As Below So Above: Reconstructing The Neo-Babylonian Worldview, Heather Marie Burrow Jan 2023

As Below So Above: Reconstructing The Neo-Babylonian Worldview, Heather Marie Burrow

CGU Theses & Dissertations

To add to our knowledge about a Near Eastern culture, this project examines through textual evidence how the early first millennium BCE Neo-Babylonians thought, reasoned, and wrote in order to partially reconstruct the shared, generally held worldview of the Neo-Babylonian people using the transdisciplinary approach of worldview analysis. Worldviews are what we use to think with, not what we think about. Underlying surficial cultural behaviors are deeper levels of cognition regarding how to reason, perceive the world, prioritize values, prescribe behavior, and explain all of life. Specifically, this work examines the language and logic reflected in the textual archive, believing …

California Community College Presidents’ Leadership: Serving Latinx Students At Hispanic Serving Institutions, Christina Joy Ryan Rodríguez Jan 2023

California Community College Presidents’ Leadership: Serving Latinx Students At Hispanic Serving Institutions, Christina Joy Ryan Rodríguez

CGU Theses & Dissertations

This qualitative case study examined how California Community College Presidents (CCCPs) make meaning of leading a Hispanic Serving Institution (HSI) to evaluate how CCCPs respond to Latinx student success gaps and support initiatives at their campuses. Minority Serving Institutions (MSIs) have been more visible within community college literature, but what remains unclear is specifically how leaders at HSIs enact their leadership and direct their efforts to serve Latinx students. This dissertation addressed the gap in MSI scholarship to explicitly focus on the role of CCCPs at HSIs and their service to Latinx students. The study applied Eddy’s Multidimensional Leadership Model …

The Failed Federalism Of Affordable Housing: Why States Don't Use Housing Vouchers, Noah Kazis Jan 2023

The Failed Federalism Of Affordable Housing: Why States Don't Use Housing Vouchers, Noah Kazis

Articles

This Article uncovers a critical disjuncture in our system of providing affordable rental housing. At the federal level, the oldest, fiercest debate in low-income housing policy is between project-based and tenant-based subsidies: should the government help build new affordable housing projects or help renters afford homes on the private market? But at the state and local levels, it is as if this debate never took place. The federal government (following most experts) employs both strategies, embracing tenant-based assistance as more cost-effective and offering tenants greater choice and mobility. But this Article shows that state and local housing voucher programs are …

Built For Business: The Commercial Need For Aggregate Litigation, Jack Zarin-Rosenfeld Jan 2023

Built For Business: The Commercial Need For Aggregate Litigation, Jack Zarin-Rosenfeld

Hofstra Law Faculty Scholarship

Commercial actors long have argued that class actions are bad for business. But for even longer, business groups have supported other types of aggregate litigation that closely resemble class actions, such as expansive federal bankruptcy. While critics have successfully limited national aggregation via class actions, they have not even attempted to criticize aggregation via bankruptcy.

Why have business groups attacked aggregate litigation in some cases and supported it in others? This Article provides an answer by examining aggregation's origins and development, and what emerges, it turns out, is very much the opposite of what aggregation's pro-business critics would have us …

Implicit Racial Bias: A Human Computer Interaction Study Using Eye Tracker, Wenfan Zhang Jan 2023

Implicit Racial Bias: A Human Computer Interaction Study Using Eye Tracker, Wenfan Zhang

Master's Projects

Contemporary Human-Computer Interaction (HCI) research has an increasing emphasis on reducing ethnicity bias. The study presents a new method to explore and reduce biases using detailed experiments. The experimental procedure involves presenting participants with images of ethnically diverse characters across three conditions. The study's results significantly illuminate ethnicity bias in character selection dynamics. Participants exposed to targeted training interventions displayed a significant shift in preferences for characters engaged in intellectual activities. Notably, this shift was influenced by the ethnicity of the characters involved. Interestingly, the eye-tracking data unveiled distinct patterns of cognitive load, characterized by slower response times and greater …

The study …

Outsourcing Interruptions And The Emergence Of Reshoring, Enrico Castillo Santos Jan 2023

Outsourcing Interruptions And The Emergence Of Reshoring, Enrico Castillo Santos

Walden Dissertations and Doctoral Studies

Over the last 25 years, offshore outsourcing has been accepted as a standard business practice, primarily for the cost advantage of operating in lower costs offshore locations. Lately, the trend is reversing; business leaders are moving their manufacturing operations back home despite the near-term negative impact of the reversal decision. This qualitative multiple case study aimed to understand the factors that influenced manufacturing business leaders of U.S.-based companies to reverse previously made offshoring decisions and reshored at a high reversal rate. In this study, I applied the conceptual framework proposed by Fratocchi et al. (2016). Data were collected from five …

The University of Michigan Law School’s Law and Mobility Program (LAMP), a resource for scholarship about the legal implications of emerging transportation technology with a particular focus on connected and automated vehicles (CAVs), hosts an annual conference. The topic of the LAMP Annual Conference 2023 considered how we might reimagine transportation technology in a way that combats the systemic vulnerabilities that leave certain populations more likely to experience forced labor. This topic was selected because there are multiple lenses through which to consider the transportation equity outcomes for users, industry workers, and society at large; forced labor is just one …

Comparison Of Middle Woodland Settlement Models In Georgia And Ohio, Bryan A. Moss* Jan 2023

Comparison Of Middle Woodland Settlement Models In Georgia And Ohio, Bryan A. Moss*

Symposium of Student Scholars

During the Middle Woodland period (200 BC – AD 400), there was an increase of cultural complexity and the rise of a mortuary cult throughout much of eastern North America. This cult included a wide interaction network called the Hopewellian Interaction Sphere, which dates to the Middle Woodland period in the Mid-West. This interaction, which reached into the Southeast, involved the exchange of information between groups in both regions. This project uses spatial analysis through Geographic Information Systems (GIS) to identify patterns in site layout and organization by comparing settlements in both regions. The focus of testing will be between …

The Moving Target: Brazilian Pardo Identity And Its Constitution Of Racial Space, Megan Salmon Jan 2023

The Moving Target: Brazilian Pardo Identity And Its Constitution Of Racial Space, Megan Salmon

Undergraduate Research (Journal)

In the field of Critical Race Studies, Brazil continually proves to be a unique case with its diverse population, incredible nuanced racial classification system, and claim to “racial democracy” and transcending its history of racism and slavery. At the heart of these claims is a large pardo, or mixed race, population that is often characterized as the apex of Brazilianness and multiraciality. The mixed-race body is romanticized and the entire Brazilian populous is placed in a racialized “third space” beyond the recognized system of Black and white identities. How do pardo people conceptualize themselves in this idealized world of racial …

A Peculiar Institution: White Supremacy And The Black Guides Of Mammoth Cave, Seth Garcia

Libraries Award for Undergraduate Scholarship

Intensive tourist operations at Mammoth Cave began in 1838 when Frank Gorin purchased the cave property. He brought with him Stephen Bishop, an enslaved person who would become famous across the Western world for his explorations of the cave and his knowledge of its geology. Gorin would also lease Nicholas and Matterson Bransford, and these three men would begin a 100-year history of black guides at Mammoth Cave. This essay utilizes source material written by white visitors in diaries, guidebooks, and travelers’ accounts to better understand white supremacy during the mid to late 19th century. The guides were in a …
