Federalism, The Environment And The Charter In Canada, Dayna Scott Jan 2018

Federalism, The Environment And The Charter In Canada, Dayna Scott

Articles & Book Chapters

This Chapter reviews the key jurisprudential developments in relation to the division of powers in Canada, exploring how the shared jurisdiction over the “environment” created by sections 91 and 92 of the Constitution has historically and continues to shape environmental law and policy. In addition to this federal-provincial struggle, the chapter considers the current trend towards local regulation of environmental matters according to the principle of ‘subsidiarity’, and the growing recognition of the ‘inherent jurisdiction’ of Indigenous peoples. The contemporary dynamics are explored through two critical policy case studies highlighting barriers to environmental justice: safe drinking water on reserves, and …

Essays On Environmental Economics And Policy, Mehdi Nemati

Theses and Dissertations--Agricultural Economics

Environmental goals such as urban water conservation and pollution control regulations are typically achieved through price and non-price methods. This dissertation offers an analysis of the non-price approaches, including the rationing of water for particular users, installation of particular technologies, and adoption of particular certifications to achieve environmental goals. To begin, an analysis of California’s 2015 urban water conservation mandate was performed. Results indicate that the average welfare loss of the mandate is $6,107 per acre-foot of restriction in Northern California and $2,757 per acre-foot of restriction in Southern California. In terms of monthly household-level willingness-to-pay (WTP) to avoid the …

Reduced Culpability Without Reduced Punishment: A Case For Why Lead Poisoning Should Be Considered A Mitigating Factor In Criminal Sentencing, Eleanor Kittilstad

Journal of Criminal Law and Criminology

The water crisis in Flint, Michigan, where residents discovered dangerous levels of lead in their water supply in 2015, has continued to unfold over the past three years and has brought the damaging effects of lead exposure to national attention. When developing children are exposed to even low levels of lead, they are at risk of developing cognitive impairments—disorders that cause aggressive behavior and diminished intellectual functioning. This Comment seeks to bring criminal law into the conversation about lead exposure and its damaging effects. Researchers have found that children exposed to lead have a higher risk of engaging in criminal …

Petroleum acids, often called 'Naphthenic Acids' (NA), enter the environment in complex mixtures from numerous sources. These include from Produced and Process-Affected waters discharged from some oil industry activities, and from the environmental weathering of spilled crude oil hydrocarbons. Here, we test the hypothesis that individual NA within the complex mixtures can induce developmental abnormalities in fish, by screening a range of individual acids, with known chemical structures. Sixteen aromatic NA were tested using a Thamnocephalus platyrus (beavertail fairyshrimp) assay, to establish acute toxicity. Toxicities ranged from 568 to 8 μM, with the methylbiphenyl acid, 4-(p-tolyl)benzoic acid, most toxic. Next, …

Marketing The Myth: The Racial Commodification And Reclaiming Of Aunt Jemima, Holly Robinson

Electronic Theses and Dissertations

Through an analysis of print advertisements and of research gathered at the Jim Crow Museum of Racial Memorabilia, this thesis intends to explore how the Aunt Jemima brand from the early 1890’s to the present day has utilized multiple marketing strategies in order to garner consumer attention. Focusing specifically on Karen Cox’s notion of the “southern tableau,” M. M. Manring’s investment in Aunt Jemima as a Slave in A Box, and Patricia Yaeger’s theory of the “throwaway body,” this thesis will look at how elements of print advertising, the Aunt Jemima pancake-box, and racist memorabilia intersect. In order to experiment …

Whose Sustainability? An Analysis Of A Community Farming Program's Food Justice And Environmental Sustainability Agenda, Sarah Davenport Jan 2018

Whose Sustainability? An Analysis Of A Community Farming Program's Food Justice And Environmental Sustainability Agenda, Sarah Davenport

Honors Undergraduate Theses

As the 1960s Environmental movement has grown, sustainability and justice discourses have come to the fore of the movement. While environmental justice discourse considers the unequal effects of environmental burdens, the language that frames "sustainability" is often socially and politically neutral. This thesis critically examines sustainability initiatives and practices of an urban farming organization in Florida. Based on ethnographic fieldwork in 2017, I explore the extent to which these initiatives incorporate race, ethnicity, and socioeconomic class when working to provide sustainably grown food in diverse communities. I argue that the organization's focus on justice for the environment, rather than for …

Wild Abandon: Postwar Literature Between Ecology And Authenticity, Alexander F. Menrisky Jan 2018

Wild Abandon: Postwar Literature Between Ecology And Authenticity, Alexander F. Menrisky

Theses and Dissertations--English

Wild Abandon traces a literary and cultural history of late twentieth-century appeals to dissolution, the moment at which a text seems to erase its subject’s sense of selfhood in natural environs. I argue that such appeals arose in response to a prominent yet overlooked interaction between discourses of ecology and authenticity following the rise and fall of the American New Left in the 1960s and 70s. This conjunction inspired certain intellectuals and activists to celebrate the ecological concept of interconnectivity as the most authentic basis of subjectivity in political, philosophical, spiritual, and literary writings. As I argue, dissolution represents a …

The Effect Of Mosquito Ditching On Carbon Sequestration In Mangrove Ecosystems And Associated Management Implications, Race Stryker Jan 2018

The Effect Of Mosquito Ditching On Carbon Sequestration In Mangrove Ecosystems And Associated Management Implications, Race Stryker

Theses & ETDs

Mangroves are coastal wetlands that are critical to the global carbon cycle. Mangroves account for about 10-15% of the carbon sequestered by forests while only occupying 0.5% of the total forested area on the planet. Many mangrove ecosystems in the state of Florida suffer from the historic impacts of ditches that were created to reduce viable breeding grounds for mosquitoes. Unfortunately, the full effects of these ditches on rates of carbon sequestration have yet to be investigated or understood. This thesis presents an exploration of the policies that lead to mosquito ditching in Florida; provides an assessment of the impacts …

The Sabine Block, Gulf Of Mexico: Promontory On The North American Margin?, Peter D. Clift, Paul Heinrich, Dennis Dunn, Andrew Jacobus, Jerzy Blusztajn

Faculty Publications

© 2017 The Authors. The crust underlying the northern coast of the Gulf of Mexico, known as the Sabine block, is largely unknown as far as its origin and age are concerned. We date zircons in granite xenoliths and from pyroclastic rocks from the Prairie Creek lamproite pipe that penetrates the block. Zircons from the granites show U-Pb ages ranging from 1800 to 1600 Ma, quite different from adjacent Grenville or Gondwana-affiliated blocks. This age range correlates with rocks in the Yavapai-Mazatal terrane of North America, implying that the Sabine block could be a promontory to the continental core. The …

Coal-To-Liquid Technology: A Look At The Geopolitical Tension Behind China's Energy Strategy, Kaela Cote-Stemmermann Jan 2018

Coal-To-Liquid Technology: A Look At The Geopolitical Tension Behind China's Energy Strategy, Kaela Cote-Stemmermann

Scripps Senior Theses

As interest in renewable energy development continues to rise around the globe, the alignment of China’s capabilities and incentive to invest in the green energy sector position the country in a leading role. However, China’s recent investment in coal-to-liquid (CTL) technology raises questions as to the direction of China’s energy policy and reflects broader geopolitical tensions within the Chinese government. Although CTL technology has been widely criticized as being environmentally unfriendly and economically unsustainable, China continues to invest in it at an astounding pace. Research proposes several possible explanations, such as corruption or local conflicts of interest, however, a critical …

How The U.S. Supreme Court Deemed The Workers' Compensation Grand Bargain 'Adequate' Without Defining Adequacy, Michael C. Duff

All Faculty Scholarship

During the second and third decades of the twentieth century, the U. S. Supreme Court issued a handful of opinions rejecting 14th Amendment constitutional challenges by employers to implementation of workers’ compensation statutes in the United States. Unknown to many, the statutes were largely the fruit of privately-sponsored investigations, principally by the Russell Sage Foundation and the National Association of Manufacturers, of European workers’ compensation systems during the first decade of the twentieth century. Some of those systems had been in existence since the 1870s and 1880s, and many employers preferred them to newly-emerging American employer liability statutes that retained …

Improving Microbiological Safety And Quality Characteristics Of Wheat And Barley By High Voltage Atmospheric Cold Plasma Closed Processing, Agatha Los, Dana Ziuzina, Simen Akkermans, Daniela Boehm, Patrick J. Cullen, Jan Van Impe

Articles

Contamination of cereal grains as a key global food resource with insects or microorganisms is a persistent concern for the grain industry due to irreversible damage to quality and safety characteristics and economic losses. Atmospheric cold plasma presents an alternative to conventional grain decontamination methods owing to the high antimicrobial potential of reactive species generated during the treatment, but effects against product specific microflora are required to understand how to optimally develop this approach for grains. This work investigated the influence of ACP processing parameters for both cereal grain decontamination and grain quality as important criteria for grain or seed …

An Environmental And Cost Comparison Between Polypropylene Plastic Drinking Straws And A "Greener" Alternative: An Oberlin Case Study, Madeline Elyse Moran Jan 2018

An Environmental And Cost Comparison Between Polypropylene Plastic Drinking Straws And A "Greener" Alternative: An Oberlin Case Study, Madeline Elyse Moran

Honors Papers

Plastic straws are one of the most abundant items found in oceans and coastal cleanups around the United States and internationally. Plastic does not decompose over time, so all the plastic we have ever made is still around, affecting every ecosystem on the planet. Drinking straws are made of 100% recyclable material, but because of their small size most recycling plants are not able to process them so they are sent to landfills. Petroleum-based plastic production is also a large source of greenhouse gas (GHG) emissions, making up 1-3% of the United States’ carbon emissions alone. By considering green alternatives …
