Black Liberty In Emergency, Norrinda Brown Nov 2023

Black Liberty In Emergency, Norrinda Brown

Northwestern University Law Review

COVID-19 pandemic orders were weaponized by state and local governments in Black neighborhoods, often through violent acts of the police. This revealed an intersection of three centuries-old patterns— criminalizing Black movement, quarantining racial minorities in public health crises, and segregation. The geographic borders of the most restrictive pandemic order enforcement were nearly identical to the borders of highly segregated, historically Black neighborhoods.

The right to free movement is fundamental and, as a rule, cannot be impeded by the state. But the jurisprudence around state power in public health emergencies, deriving from the 1905 case Jacobson v. Massachusetts, has practically resulted …

Racism As A Threat To Financial Stability, Cary Martin Shelby Nov 2023

Racism As A Threat To Financial Stability, Cary Martin Shelby

Northwestern University Law Review

This Article draws from several theoretical frameworks such as critical race theory, law and economics, and rule of law conceptions to argue that the Financial Stability Oversight Council (FSOC) should formally recognize racism as a threat to financial stability due to its interconnectedness with recent and projected systemic disruptions. This Article begins by first introducing a novel model created by the author through which to dissect this claim. This “Systemic Disruption Model” provides a theoretical depiction of how racism drives every phase along the life-cycle continuum of a systemic disruption.

First, with respect to the Model’s “Introduction” phase, this Article …

Archaeology In 2022: Counter‐Myths For Hopeful Futures, M Berihuete‐Azorín, Chelsea Blackmore, Lewis Borck, James L. Flexner, Catherine J. Frieman, Corey A. Herrmann, Rachael Kiddey

School of Law, Humanities and Social Sciences

Archaeology in 2022 features more calls than ever for a socially and politically engaged, progressive discipline. Archaeologists increasingly respect and integrate decolonizing and Indigenous knowledge in theory and practice. They acknowledge and embrace the fluidity and diversity of sexes and genders, past and present. They document patterns of migration, ancient as well as contemporary, to combat retrograde and racist narratives that remain pervasive in the public sphere. At the same time, the field has a deep‐seated conservative bastion toward which many scholars retreat, arguing for an “objective” past that is free of political implications or interpretive ambiguity. As anarchist archaeologists, …

Climate Futures: Classroom Engagements For Imagining Otherwise, Elaine Alvey Nov 2023

Climate Futures: Classroom Engagements For Imagining Otherwise, Elaine Alvey

Faculty and Staff

Given the realities currently at hand, it is easy to imagine the worst-case scenario climate futures, to become paralyzed by climate grief or to disengage all together. Inspired by pedagogical engagements with imagination and drawing on foundational geography skills, this three-day mini-unit invites secondary students to first analyze localized impacts of climate change, and then look to examples of positive climate futures before finally imagining for their own community’s resilient climate future.

Fostering A Sense Of Online Community: Faculty Reflections Through Narratives, Brittany D. Anthony

USF Tampa Graduate Theses and Dissertations

This qualitative study will explore how MSW faculty describe a community in online courses and what strategies they use in fostering a sense of community within courses from an online Master of Social Work program at the University of South Florida. There is an imperative need to ensure online courses provide a sense of community to support students for success. During the timespan of an online course, strategic pedagogical approaches to fostering a community are essential to enriching the overall learning experience for students. Many studies tend to focus on the challenges faced when building an online community. Still, the …

Judicial Activism As A Pathway To Environmental Justice In Africa’S Mining Industry: The Case Of Nigeria And South-Africa, Onyekachi Eni Dr, Dr. Ngozi Chinwa Ole Nov 2023

Judicial Activism As A Pathway To Environmental Justice In Africa’S Mining Industry: The Case Of Nigeria And South-Africa, Onyekachi Eni Dr, Dr. Ngozi Chinwa Ole

Biennial Conference: The Social Practice of Human Rights

Africa’s mining industry embodies the tension between socio-economic development, and environmental protection. On account of their abundant mineral resource endowments, Nigeria and South-Africa constitute Africa’s mining hub with the attendant environmental burdens evident in the distortion of natural environmental equilibrium, disruption of ecosystem services and dislocation of the people from their cultural moorings contrary to extant global and regional instruments on development and human rights. Notwithstanding the negative externalities of mining, the incidence of poverty and the absence of basic amenities in many mining communities often combine to frustrate the effort of mining-affected persons to obtain redress for the violation …

Concerted Civic Administration, Peter M. Shane Nov 2023

Concerted Civic Administration, Peter M. Shane

Fordham Law Review

With the benefit of hindsight, the Roberts Court’s decision in Free Enterprise Fund v. Public Company Accounting Oversight Board marked the arrival in the U.S. Supreme Court of what has aptly been called the “separation-of-powers counterrevolution.” For the first time in history, the Court voided statutory criteria limiting the removability of a subordinate officer by a principal officer within the executive branch. Since then, the Court has crafted an increasingly complex separation-of-powers jurisprudence aimed at protecting the President’s supposed Article II authority to control subordinate administrators. Underlying this jurisprudence is the Court’s supposition that, constitutionally speaking, executive branch administrators “wield …

Factors Impacting Adoption Of And Experience With Point-Of-Use Activated Carbon Faucet Mount Water Filters, Aubrey Gilliland, Victoria Peluso, Corisandra Leyton-High, Susanne Straif-Bourgeois, Kari Brisolara, Greg Pierce, Kelsey Pieper, Adrienne Katner

Journal of the Louisiana Public Health Association

Introduction: Public health officials increasingly rely on point-of-use drinking water filters (POUs) to reduce waterborne lead exposures, and upcoming regulatory changes will soon require utilities to distribute POUs under certain conditions. While POUs are generally a costeffective measure for reducing lead exposure, they may not be adoptable by all households. To promote sustained adoption of POUs, we need to understand the situational and technical factors which may facilitate or impede adoption. Methods: Study participants were interviewed before and after field-testing of activated carbon faucet mount POU filters to identify factors impacting adoption in New Orleans and Enterprise, Louisiana, both sites …

Representative Rulemaking, Jim Rossi, Kevin Stack Nov 2023

Representative Rulemaking, Jim Rossi, Kevin Stack

Vanderbilt Law School Faculty Publications

The dominant form of lawmaking in the United States today-—notice-and-comment rulemaking—-is not a representative process. Notice-and-comment simply invites public participation, leaving the overall balance of engagement with the proposed regulations to the choices of individuals, public interest groups, trade groups, and regulated businesses. The result is a predictable one: In most rulemakings, industry voices dominate, and in many rulemakings, there is no participation by citizens or public interest groups. This representation deficit must be taken seriously. The basic rationales for a notice-and-comment rulemaking process depend upon some level of representation for those affected. The goal of providing the agency with …

The Exploration Of Biochemistry Laboratory Activity: Study On Higher Education In Mataram, Yunita Arian Sani Anwar, Muti’Ah Muti'ah

Jurnal Inovasi Pendidikan IPA

As the core of science learning, laboratory work is inseparable from learning chemistry, including biochemistry. However, the implementation of laboratory work needs reconstruction, especially in higher education, so an initial study is needed to understand the problems in laboratory work at universities. This article was a study of the working conditions of the biochemistry laboratory at the University of Mataram. This study included quantitative research with students (N = 250), lab work assistants (N = 36), laboratorium staff (N = 4), and biochemistry lecturers (N = 4) as respondents. Techniques for obtaining data through participatory observation and questionnaires. Supporting data …

“Scandalously Bifurcated Garments”: Ecocriticism, American Pioneers, And Novelizing Women Of The West, Gillian Gauer, Elizabeth E. Tavares Oct 2023

“Scandalously Bifurcated Garments”: Ecocriticism, American Pioneers, And Novelizing Women Of The West, Gillian Gauer, Elizabeth E. Tavares

International Journal of Undergraduate Research and Creative Activities

While the Western novel is typically associated with cowboys and overarching masculine accomplishments of “settling,” the representation of women’s work beyond narratives of being “tamed” and the settling-down of motherhood has been overlooked by writers and ecocritics alike. Ecofeminist scholarship of the late 1980s and ‘90s, primed to take up such questions, focused primarily on the relationship between women and nature in abstract terms rather than on regionally-specific interpretations. This thesis, therefore, examines the representation of female-identifying protagonists in pioneer narratives of North America in three popular novels of the last century: Zane Grey’s posthumous Woman of the Frontier (1940/1998), …

Extended Producer Responsibility And Trade Flows In Waste: The Case Of Batteries, Marco Compagnoni, Marco Grazzi, Fabio Pieri, Chiara Tomasi

Fondazione Eni Enrico Mattei Working Papers

In the debate on international waste trade, the focus on resource efficiency and recycling has gradually begun to accompany the focus on negative environmental externalities. In this context, we examine the impact of Extended Producer Responsibility (EPR) on the export of waste batteries (WB). EPR is considered as a key policy for the “marketization of waste”. On the other hand, WB are a hazardous waste that also contain a high concentration of critical raw materials. As such, they are of strategic importance for the recovery of critical resources, while at the same time requiring proper environmental management. Therefore, it is …
