The Once And Future Clean Air Act: Impacts Of The Inflation Reduction Act On Epa's Regulatory Authority, Nicholas Bryner
The Once And Future Clean Air Act: Impacts Of The Inflation Reduction Act On Epa's Regulatory Authority, Nicholas Bryner
Journal Articles
The Clean Air Act is one of Congress's greatest success stories. The major piece of legislation, passed in the context of environmental and public health crises, has driven technological change through regulation that has dramatically improved air quality even in a prolonged period of economic growth. In the context of climate change, however, despite many efforts since the 1990s, the Clean Air Act has not proven to be a successful legislative tool. Instead, the Act has faced complex obstacles in the statutory language and a trend in Supreme Court jurisprudence-leading up to and including the June 2022 decision in West …

21st-Century Environmental Challenges And Revitalizing Epa Enforcement, David Uhlmann
21st-Century Environmental Challenges And Revitalizing Epa Enforcement, David Uhlmann
Articles
This is a profound moment for environmental protection efforts in our country. Over the past half-century, under presidents of both parties, we have made great progress addressing the challenges that led to the enactment of our environmental laws during the 1970s. Our air is cleaner, our rivers and streams are healthier, and we have far fewer hazardous waste sites. We have achieved those successes because of conscientious companies across America who meet their environmental obligations and the vigilance of the U.S. Environmental Protection Agency (EPA) and the Justice Department when companies break the law and put their profits before the …
The Role Of Care Webs In Sustaining Engagement And Well-Being Among Marginalized Emerging Adults Involved In Climate Justice Activism, Vincent Boisclair
The Role Of Care Webs In Sustaining Engagement And Well-Being Among Marginalized Emerging Adults Involved In Climate Justice Activism, Vincent Boisclair
Theses and Dissertations (Comprehensive)
The settler-caused climate crisis poses severe global threats, driving action from youth and emerging adults. Prior to COVID-19 lockdowns, youth-led climate organizations were highly active, but social distancing has hindered youth engagement and exacerbated psychological distress among marginalized emerging adult climate justice activists. Previous research indicates that well-being and social participation are interrelated. Guided by the critical transformative paradigm, this qualitative research examines the effects of care webs on the well-being and sustained engagement of marginalized emerging adults in climate justice activism. Care webs, informed by disability justice, are de-professionalized, non-hierarchical, reciprocal, and anti-oppressive systems of care. Participants were asked …

A Legal Whirlwind: An Exploration And Evaluation Of Legal Claims Relating To The South Fork Wind Farm And Revolution Wind Project, Sarah Mikolay, Ava Cafasso, Aryanna Clasby, Elizabeth Erwin, Maigen Leach
ENV 334 Environmental Justice
With the Biden Administration’s national goal of net-zero emission by 2050 and Rhode Island’s state goal of carbon-neutrality by 2035, progressive steps towards renewable energy goal are critical. As the state adopt more renewable energy practices, public and private organizations voice concern over offshore wind farm projects and their adherence to local, state, and national laws. Through extensive research it has been determined that many of these claims are misguided. However, this skepticism emphasizes key issues regarding the transparency of the permitting process. Steps towards streaming and uniting the legal processes of wind farm construction, such as the COLLABORATE Act, …

Employment And Industry Implications Of The Offshore Wind Projects In Rhode Island, Sarah M. Benoit, Anna Dwyer, Andrew Senecal, Aidan Tucker, Michael Keating
ENV 334 Environmental Justice
Offshore wind farms will have beneficial long-term effects on Rhode Island's industry and employment. While locals have expressed mixed opinions about the wind farm projects, fishermen have been the most concerned. Many of their fears are not founded in the reality of offshore wind farms. Impacts on the fishing industry could be slightly negative during construction with disruption from the pipeline (Becker 2024). After implementation, they should increase biodiversity with the artificial reef effect (Gill et al. 2020; Perry and Heyman 2020; Van Hoey et al. 2021). In the long-term, the fossil fuel industry has and will be more harmful …

Energy Claims For The Wind Farm Off Newport’S South Coast, Karen J. Figueroa, Megan Trafford, Emma Wilson, Ava Brunnock, Casey Maeve Bermingham
ENV 334 Environmental Justice
Revolution Wind will be constructing a Wind Farm off of Newport's South Coast. The community is extremely mixed on their reaction to the project, but there is a lot of misinformation concerning the project and wind turbines in general. The main focus is to address community concerns while informing the public of wind farms and wind turbines, with a specific focus on the energy aspect.
The Roads Less Traveled: A Metaresearch Analysis Of Local Histories In Racial Health Equity Research, Devin Trévion Brown
The Roads Less Traveled: A Metaresearch Analysis Of Local Histories In Racial Health Equity Research, Devin Trévion Brown
Public Health Theses
While it is important that racial health equity research receive growing attention in theUnited States, doing so must involve a thorough recognition and interrogation of the role that structural racism plays in creating different outcomes for Black communities. History aids in making clear the process through which race can become biology as structural racism is embodied by members of Black communities. Guided by Táíwò’s conceptualization of “resource distribution and accumulation” as well as Carter’s discussion of “racialized local biologies”, this cross-sectional meta-research analysis sought to investigate when and how racial health equity research after 2020 utilized local history to understand …
Emerging Contaminants In Long Island Public Drinking Water, Clare Loughlin
Emerging Contaminants In Long Island Public Drinking Water, Clare Loughlin
Public Health Theses
Thousands of federally unregulated ‘emerging’ contaminants are entering and persisting in our environment, potentially adversely impacting public health. Drinking water is a major exposure pathway for some of these emerging contaminants. In 2020, New York State set maximum contaminant level (MCL) drinking water standards for three emerging contaminants: 1,4-dioxane: 1 ppb, perfluorooctanoic acid (PFOA): 10 ppt, and perfluorooctanesulfonic acid (PFOS): 10 ppt. Databases of public drinking water exist but generally do not contain comprehensive and ancillary data reported by annual public drinking water reports, or the data may not be aggregated or readily available in a format suitable for data …
Exploring The Connections Between The Arts And Mental Health In The Face Of Climate Change, Marla Joy Minkoff
Exploring The Connections Between The Arts And Mental Health In The Face Of Climate Change, Marla Joy Minkoff
Public Health Theses
Objective: This study aims to explore how engagement with art may shape emotions related to the climate crisis and expand the conception of art as a mechanism of public health practice. Background: Climate change impacts human health not only physically but also psychologically, manifesting in symptoms of climate emotions (e.g., ecological grief, eco-anxiety, eco-paralysis) that arise as a result of changes to the earth and our relationship to the natural world. These symptoms are among the pressing mental health effects of climate change. Methods: A qualitative approach utilizing the Rapid Assessment Process (RAP) was employed to conduct semi-structured interviews (N=10) with …
Sociodemographic And Health Characteristics Of Communities Located Near U.S. Ports: A Distributive Environmental Justice Study, Sophia Mara Ptáček
Sociodemographic And Health Characteristics Of Communities Located Near U.S. Ports: A Distributive Environmental Justice Study, Sophia Mara Ptáček
Public Health Theses
Background:Globalization has spurred substantial growth in international maritime trade, with shipping emerging as the most efficient mode for transporting large quantities of goods. This growth comes at an environmental cost. Maritime transport contributes to local air pollution, with pollutants such as particulate matter (PM2.5 and PM10), black carbon, nitrogen oxides (NOx), sulfur oxides (SOx), volatile organic compounds (VOCs), ozone (O3), and carbon monoxide (CO) disproportionately affecting coastal and port communities. Despite extensive evidence of the adverse health effects of these pollutants, comprehensive analyses of distributive environmental justice related to port communities remain scarce, prompting this study's investigation into the sociodemographic …
Greening And Mental Distress: Effect Modification By Housing Tenure, Saira Prasanth
Greening And Mental Distress: Effect Modification By Housing Tenure, Saira Prasanth
Public Health Theses
Access to high-quality residential greenspace is associated with improved long-term health, particularly mental health. However, many interventions to promote “greening” or increased greenspace in urban areas have been shown through numerous qualitative studies to exacerbate environmental and health inequities, primarily through green gentrification. Our objective was to quantify the association between greenspace and mental distress in the U.S. as well as evaluate whether the association between greenspace and mental distress is modified by housing tenure. We hypothesized that increased greenspace was associated with reduced mental distress, and that this effect was more protective among homeowners than non-homeowners. Mental distress and …
Behind The Produce Curtain: Exploring Occupational Health Of Connecticut Migrant Farmworkers In A Changing Climate, Nicole-Kristine Limlingan Smith
Behind The Produce Curtain: Exploring Occupational Health Of Connecticut Migrant Farmworkers In A Changing Climate, Nicole-Kristine Limlingan Smith
Public Health Theses
Due to climate change exacerbating high heat days, it is speculated that farmworkers will bear the brunt of this in the fields. High heat is only one of many consequences of climate change but was chosen as the occupational exposure of study due to its lack of literature in northeastern states like Connecticut. This study has three aims. The first aim is to explore the health impacts of extreme and prolonged heat exposure in Connecticut migrant farmworkers. Second, understand the current awareness among health care providers and the intervention methods that are being taken, if any. Finally, understand what barriers …

Child And Adolescent Exposure To Environmental Chemicals And Mental Health Outcomes: A New Haven Study, Yunyue Shi
Public Health Theses
Child and adolescent mental health disorders, including anxiety, depression, and behavioral problems, contribute significantly to the global health burden. Exposure to toxic air contaminants such as semi-volatile organic compounds (SVOCs)—especially polycyclic aromatic hydrocarbons (PAHs) and phthalates—during critical developmental periods can have detrimental impacts on children’s brain development and function. This study aimed to identify potential associations between children and adolescents’ chemical exposure and mental health outcomes. The objectives were: 1) to characterize the distribution of individual environmental chemical exposures among children and adolescents using Fresh Air samplers and 2) to determine the association between chemical exposures, particularly PAHs and phthalates, …

Urban communities in environmentally sensitive areas face escalating challenges due to climate change and inadequate infrastructural support, particularly in underserved regions like southside Norfolk, Virginia. This area, characterized by its vulnerability to flooding and a predominantly low-income population, lacks equitable inclusion in broader urban flood protection plans. This research focuses on the development of community-centered resilience strategies through active engagement and collaboration with local residents. The methodology centered around building trust and understanding within the community through a series of interactions and events. This approach facilitated a two-way exchange of information, enabling the research team to gather crucial insights on …

Legal Hurdles And Pathways: The Evolution (Progress?) Of Climate Change Adjudication In Canada, Camille Cameron, Riley Weyman, Claire Nicholson
Articles, Book Chapters, & Popular Press
Citizens, civil society, and environmental organisations throughout the world are increasingly turning to courts to find solutions to the perils of climate change. In July 2023, the United Nations Environment Programme (“UNEP”) reported that as of November 2022, there were 2,180 climate change litigation cases underway throughout the world, that this number is 2.5 times higher than it was five years ago, and that the number of jurisdictions involved has grown from 24 in 2017, to 39 in 2020, to 65 in 2023. The authors of this report describe climate litigation as “a frontier solution to change the dynamics of …

This is a conversation among Ronald W. Cox, Bryant Sculos and Daniel Skidmore-Hess about how the left in the U.S. should analyze the broader societal and political ramifications of the 2024 presidential election. Each of the authors contributes separate essays that reflects both complementary and differing views regarding how those on the left should vote in this election and why.
Modern Disaster Fragmentation, Abigail E. André
Modern Disaster Fragmentation, Abigail E. André
Fordham Law Review
Natural disasters test us. They exist at the intersection of nature, law, and society to show us where our systems are failing. Beyond physical damage, they magnify weaknesses in our socioeconomic and legal systems. In an attempt to leverage the lessons disasters bring, this Article analyzes the administrative institutions that govern disaster relief from the perspective of law, history, equity, and institutional design. This intersectional analysis uncovers a system fragmented by centuries of disorganization and infused with socioeconomic discrimination. Minor revisions cannot fix our federal approach to disaster relief: an institutional overhaul is required to achieve good governance.
The Role Of Altered Cell-Cell Communication Between Glia And Neurons In Alzheimer’S Disease, Tabea Marga Soelter
The Role Of Altered Cell-Cell Communication Between Glia And Neurons In Alzheimer’S Disease, Tabea Marga Soelter
All ETDs from UAB
Alzheimer’s disease is the most prevalent neurodegenerative disease and is characterized by progressive memory loss and cognitive decline, affecting behavior, speech, and motor abilities. The neuropathology includes the formation of extracellular amyloid-β plaques and intracellular neurofibrillary tangles of phosphorylated tau. Additionally, neurons become functionally impaired before degenerating and dying. While neuronal loss is a disease hallmark, glia maintain neuronal health and homeostasis through cell-cell communication with neurons. Cellular crosstalk is mediated through the release of chemical intermediates (i.e., ligands), which are taken up by cell surface membrane receptors. Previous studies have shown dysregulation of global cell-cell communication patterns and communication …

Selected Social Change Portfolios in Prevention, Intervention, and Consultation
Goal Statement: To reduce the prevalence of eco-anxiety in adolescents and young adults from Chicago’s western neighborhoods and close suburbs Significant Findings: Eco-anxiety, “a chronic, [pervasive] unspecfied fear of environmental doom” (Dodds, 2021, p. 22) is emerging as a mental health issue among youth and young adults worldwide. Spurred by global warming, 53 percent of Americans are now “very” or “extremely” concerned about climate change (Leiserowitz, et al., 2023). Chicagoans are encountering more storms, poorer air quality, more health problems, and higher rates of high school depression and age-adjusted drug overdose (e.g., National Weather Service, n. d.; Chicago Department of …
Environmental Justice Beyond 2°C, Clifford Villa
Environmental Justice Beyond 2°C, Clifford Villa
Faculty Scholarship
In the last four decades, average temperatures have risen significantly across the United States, with Alaska and New Mexico among the fastest warming states. Since 1970, average temperatures in New Mexico have risen 3.5 degrees Fahrenheit (°F)—or nearly 2 degrees Celsius (°C). The international scientific community has urged world leaders to contain global warming above pre-industrial levels to 1.5°C ideally, and to 2°C at worst. Current trajectories, however, suggest we may shoot past 2°C of global warming this century and enter a world of 3-4°C or beyond... The “trade offs” and “letting go” as we confront the looming 4°C world …
A New Day For Environmental Justice At The U.S. Epa, Clifford Villa
A New Day For Environmental Justice At The U.S. Epa, Clifford Villa
Faculty Scholarship
September 24, 2022, was a big day in the history of the EPA. On this day, EPA Administrator Michael Regan signed an order creating a new Office of Environmental Justice and External Civil Rights (“OEJECR”) within the EPA. We’re very excited about our new office of environmental justice at the EPA. However, the EPA takes environmental justice seriously across all the offices, including my own Office of Land and Emergency Management (“OLEM”).
In this lecture, we will begin with some early history of environmental justice, how we realized the existence of environmental injustice in the first place. Then we’ll talk …
Standing In The Way Of Environmental Justice, Lauren Cormany
Standing In The Way Of Environmental Justice, Lauren Cormany
Utah Law Review
Private citizens need an avenue for justice through the judicial system on the siting of hazardous facilities. The health impacts of exposure to toxic facilities—like cancer, respiratory illnesses, and birth defects—are severe and victims deserve their day in court. While initiatives by government agencies and grassroots organizations provide influential roads to improvement, the judiciary stands to only bolster the efficacy of the work in the environmental justice field. The most effective way to include the courts is through the legislature creating a cause of action targeting the issues that communities face. Solutions to the issue of citizen standing in challenging …
Old And New Environmental Racism, Tseming Yang
Old And New Environmental Racism, Tseming Yang
Utah Law Review
Over the past five decades, the U.S. Environmental Protection Agency (“EPA”) moved from purposeful disregard of environmental racism to a public embrace of environmental justice as an organizational priority. Unfortunately, its efforts to address environmental discrimination remain a work-in-progress. This Article posits that the Agency’s core difficulties have arisen out of its reluctance to accept the continuing salience of race and the substantive implications for its regulatory work. It has blinded the Agency to the evolving manifestations of environmental discrimination and associated harms. The effect has been to impede the aggressive enforcement of antidiscrimination laws, particularly the discriminatory effects regulations …
