Fighting The Giants: Efforts In Holding Corporation Responsible For Environmental Damages In Indonesia, Arie Afriansyah, Anbar Jayadi, Angela Vania

Hasanuddin Law Review

This paper focuses on examining environmental cases before the Indonesian courts from the past ten years. To be specific, this paper will study four major cases with regard private law, six major cases with regard to criminal law, and class action cases in Indonesia. This period of time explains trending increase of environmental cases before the courts. In this regard, Alternative Dispute Resolution (ADR) becomes the main preference of settling the environmental disputes. However, ADR seems not able to bring justice to the fullest especially when it comes to the corporations. It is not justice to the fullest in the …

Navigating The Hidden Politics Of Water Resource Bureaucracies In Indonesia: Mapping Issue-Elements And Alliances, Muhammad Alif K. Sahide, Micah R. Fisher, Nurul Hasfi, Emban Ibnurusyd Mas'ud, Ahsan Yunus, Fatwa Faturachmat, Siti Halimah Larekeng, Ahmad Maryudi

Hasanuddin Law Review

Water resource politics are often overlooked for jurisdictional perspectives, or difficult to comprehend for the politics unfolding behind the scenes. Using Indonesia as a case study, we synthesized all water-related bureaucracies to generate a list of “Water resource Issue-Elements,” which served as a framework for translating actor-centered power dynamics. The data is based on policies reviewed from 2014 to 2017, coinciding with the beginning of a new presidential administration with heightened interests in water resource management. The study found that while the central coordinating and planning bureaucracies wield the strongest network power, two sectoral bureaucracies hold tremendous influence in guiding …

Hasanuddin Law Review

The government has established various policies regarding mining in Indonesia. Still, an important question that needs to be asked is whether these policies have provided benefits, justice, and balance for indigenous and tribal peoples. This study aims to analyze the impact of Indonesian mining regulations on the protection of indigenous peoples. This is a normative legal research effort. The literature review gathers information from document analysis, which is analyzed qualitatively. Data analysis is descriptive-analytic in nature. The study results show that the impact of mining regulations still needs to reflect the recognition and protection of the rights of indigenous peoples. …

Taking Back Control: Using The Takings Clause To Hold Animal Agriculture Responsible For Its Waste Problem, Rowan Aragon Jan 2025

Taking Back Control: Using The Takings Clause To Hold Animal Agriculture Responsible For Its Waste Problem, Rowan Aragon

Northwestern University Law Review

Between the mid-twentieth century and modern day, the animal-agriculture model has shifted from small farms to industrial operations. During that evolution, the negative externalities of animal-farming practices have intensified. One of those externalities—animal waste—has become particularly problematic. Because of the sheer number of animals raised in the United States for slaughter and dairy production, the magnitude of animal waste produced is overwhelming. To deal with this problem, animal farmers often liquefy the animal waste and then spray it onto open fields. In that spraying process, liquefied animal waste carries through the air and reaches nearby homes, coating those properties with …

The Healing Power Of Antitrust, Theodosia Stavroulaki Jan 2025

The Healing Power Of Antitrust, Theodosia Stavroulaki

Northwestern University Law Review

Millions of Americans live in hospital deserts—communities where people lack geographic access to hospitals and primary care physicians. People living in these deserts often miss doctor appointments, delay necessary care, and stop adhering to their treatment. In this way, hospital deserts exacerbate the health disparities plaguing America. This Article demonstrates that hospital deserts are not inevitable but the result of several business strategies—including noncompete agreements and merging with competitors—and antitrust enforcers’ unwillingness to recognize these harmful practices as antitrust violations. To cure the issue of hospital deserts, this Article makes three proposals. First, antitrust enforcers and the courts should expand …

Climate Conversations: An Intergenerational Artistic Exploration With Family, Julia A. Craven Jan 2025

Climate Conversations: An Intergenerational Artistic Exploration With Family, Julia A. Craven

Pursuit - The Journal of Undergraduate Research at The University of Tennessee

This cross-generational study explores perceptions of climate change through interviews and visual art from three generations: the author, their grandparents, and their aunt. Guided by questions such as “Whose responsibility is it to address climate change?” and “How has climate change affected you?,” the interviews were used to create three art pieces that explore different aspects of climate change. The first art piece, titled “Eco-Anxiety,” visually represents the author's anxiety about climate change through the detangling of hair in their hands that "pull" at relevant climate news articles in the background. The second piece, “Beauty’s in the Eye of the …

Mosaicos De La Comunidad (Mosaics Of The Community): Community-Engaged Participatory Muraling With Madres Emprendedoras, Jesica S. Fernandez, Laura A. Nichols

Ethnic Studies

In this paper, we describe a collaborative community-based research project that centered on community members’ lived experiences, which led to the identification of key community issues that resulted in a representative art project in the form of a public mural. Eleven mothers who were long-time residents of the community were the drivers of the issue identification and mural creation. The issues identified, and subsequently depicted in the mural, revealed the importance of the environment in neighborhoods, with residents dealing with encampments, illegal dumping, prostitution, eviction, and gentrification. In the mural Mosaicos de la Comunidad (Mosaics of the Community), a group …

Community-Engaged Research Projects In School Settings: Science Teachers’ Practices And Reflections, Won Jung Kim

Teacher Education

Community-engaged research (CER) is a justice-oriented research paradigm that emphasizes equitable and reciprocal knowledge co-production with community members and organizations, sharing power, benefits, contributions, and responsibilities among all participants. This study explores nine teachers’ cases of facilitating CER projects in their respective school settings, aimed to support students’ critical consciousness and action for environmental issues and injustices. This study contributes to educational research by adapting an existing framework for CER for environmental justice that can guide K-12 teaching and research on it. By analyzing data from teacher community meetings and individual interviews in the CER framework, this study articulates classroom …

Geospatial Analysis Of Social Variables Of The Health Opportunity Index And Stroke Prevalence In Health And Human Services Region 3, Wanderimam R. Tuktur Jan 2025

Geospatial Analysis Of Social Variables Of The Health Opportunity Index And Stroke Prevalence In Health And Human Services Region 3, Wanderimam R. Tuktur

Walden Dissertations and Doctoral Studies

Disparities exist in stroke prevalence and outcome. There is sparsity of ecological studies at the census tract level that elucidate neighborhood predictors of stroke prevalence in states across U.S. Health and Human Services Region 3 (HHS Region 3: Delaware, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia). This study was conducted to explore the geospatial relationship between the 13 indicators of the Health Opportunity Index (HOI) and stroke prevalence at the census tract level in HHS Region 3 using four HOI indicator profiles: (a) neighborhood and built environment profile, (b) social and community context profile, (c) resource profile, …

Restoring The AhupuaʻA: Community-Based Resource Management And Resilience In KauaʻI, Jeffrey W. Walbridge Jr. Jan 2025

Restoring The AhupuaʻA: Community-Based Resource Management And Resilience In KauaʻI, Jeffrey W. Walbridge Jr.

Environmental Studies Senior Theses

This thesis analyzes Kauaʻi’s evolving resource management practices, examining the intersections of historical governance frameworks, modern legal systems, and indigenous knowledge. Utilizing the traditional ahupuaʻa system, Kauaʻi’s approach once promoted holistic stewardship across water, land, and energy resources. However, colonial policies, corporate influence, and economic pressures have gradually shifted this framework toward a market-driven model, often prioritizing tourism and development over ecological resilience. Key policy shifts as they fight to return to an ahupua'a based model – from the Great Mahele’s introduction of private land ownership to water diversions for plantation agriculture – help examine how these changes continue to …

Influence Of Socio-Demographic Factors And Environmental Justice Issues On Vulnerable Populations Exposed To Pollution, Aishwarya Kaushal

All ETDs from UAB

As climate change intensifies environmental hazards and pollution impacts across the U.S., Alabama’s socio-demographically diverse regions face unique and disproportionate vulnerabilities. This dissertation investigates the intersection of socio-demographic factors, environmental justice, and the disproportionate impact of pollution and flood risks on vulnerable populations in Alabama. The first study assesses the role of elevation and socio-economic factors in influencing susceptibility to flooding in Jefferson County, revealing that low-income and minority groups are more likely to reside in high-risk flood zones. A detailed spatial analysis using 2D flood modeling identifies neighborhoods with high flood exposure, emphasizing the racial and economic disparities that …

Militarization Of Anti-Peasant Forest Conservation: The Case Of The Amazon Forest Reserve Zone (Afrz) After The Colombian 2016 Peace Agreement, Angie L. Durán, Luz A. Rodríguez

Forest and Society

In 2016, the Colombian government signed a peace agreement with the Fuerzas Armadas Revolucionarias de Colombia (FARC) that included the implementation of a Comprehensive Rural Reform (CRR) with the purpose to allocate and formalize land for peasant populations. In parallel, Colombia was committed to implement the global environmental agendas, including efforts to mitigate greenhouse gas emissions (GHG) by reducing deforestation in the Amazon. Campesino communities in Colombia have historically been marginalized and pushed into forested lands and protected areas. This study seeks to understand the configuration of land-use conflicts in the Amazon Forest Reserve Zone (AFRZ) - a land management …

Labor And Environment Entwined: A Radical Green New Deal And Just Transition In Applachia, Anne Marie Lofaso, Nicholas F. Stump Jan 2025

Labor And Environment Entwined: A Radical Green New Deal And Just Transition In Applachia, Anne Marie Lofaso, Nicholas F. Stump

Faculty Articles and Other Publications

In this Article, Professor Lofaso and Professor Stump propose a genuinely transformative Green New Deal and Just Transition in Appalachia. The Article opens by tracing the long history of the Appalachian labor and environmental movements. Next, the Article interrogates the common contention that the Appalachian environmental and labor movements are opposed. While this contention has substantial truth, more complex forces have been at work in the region. Fossil fuel industry elites, for instance, have wielded exaggerated “jobs versus environment” rhetoric to maximize profits and quash emergent solidarities among local workers, residents, and activists.

This Article contends that a key solution …

The Impact Of Coral Degradation On Coastal Communities In Southeast Asia, Paige Smith Jan 2025

The Impact Of Coral Degradation On Coastal Communities In Southeast Asia, Paige Smith

Ballard Brief

Coral reefs across the globe are in decline, but reefs in Southeast Asia are among some of the most threatened in the world. Climate change, triggered by fossil fuel emissions, raises sea water temperatures and lowers the ocean’s pH, contributing to coral bleaching and inhibiting coral growth. Local threats also particularly affect reefs in Southeast Asia, such as destructive fishing techniques and marine and inland sources of pollution. Coastal communities in Southeast Asia are especially vulnerable to the degradation of coral reefs due to economic reliance on these reefs and their proximity to them. Declining coral reefs can damage the …

Does Land Conservation Financially Harm Renters?, Corey Lang, Jarron Vanceylon Jan 2025

Does Land Conservation Financially Harm Renters?, Corey Lang, Jarron Vanceylon

Environmental and Natural Resource Economics Working Papers

Environmental public goods and hazards are unequally distributed, with minority and low-income communities faring far worse. While environmental improvements are likely to benefit disadvantaged groups, these improvements can increase the desirability of neighborhoods and increase housing prices. For homeowners, this yields a gain in equity but can negatively impact renters through increased housing costs. This paper seeks to evaluate how rental prices respond to gains in land conservation relative to owner-occupied home values using a panel of census and conservation data from the United States. We employ a first-difference regression model and use propensity score matching as a pre-processing method …
