Encouraging Expanded Producer Responsibility In Agricultural Labor Relations, Emma I. Scott
Encouraging Expanded Producer Responsibility In Agricultural Labor Relations, Emma I. Scott
William & Mary Environmental Law and Policy Review
Over two million farmworkers provide essential support to the country’s food system. As detailed below, their current working conditions, living conditions, and legal protections do not reflect the importance of their contributions. As regulations and enforcement have fallen short in securing their rights and economic position, public incentive schemes can encourage improvements and equip grower-employers to reverse the race to the bottom and instead become leaders in providing dignified work opportunities. This Article looks at recent attempts and opportunities to leverage federal policies and programs to incentivize this type of leadership. It proposes that the U.S. Department of Agriculture (USDA) …
Envisioning A Duty Of Directors To Link Executive Compensation To Climate Change: Lessons From Europe, Alberto R. Salazar V.
Envisioning A Duty Of Directors To Link Executive Compensation To Climate Change: Lessons From Europe, Alberto R. Salazar V.
William & Mary Environmental Law and Policy Review
The practice of tying executive compensation to climate change goals has gained some traction. However, designing a duty of directors to link executive pay to climate change objectives poses significant challenges. Some lessons can be drawn from countries attempting to establish such a duty. This Article examines Europe’s Corporate Sustainability Due Diligence Directive (CSDDD) and its negotiation process and draws insights for effectively crafting such a duty. The CSDDD, which entered into force on July 25, 2024, mandates large companies operating in Europe to conduct due diligence on human rights and environmental impacts with respect to their own operations and …

Illustration MFA Anthologies
What follows is a collection of twelve essays by the students of RISD’s Illustration Practice MFA programme, variously reflecting upon their thesis projects, or their creative practice more generally. It allows us an opportunity to chart the many themes and perspectives that inform their work—to notice moments of both overlap and divergence. This anthology not only offers us a window into their individual practices, but also provides a glimpse of the spirit and camaraderie that underscores their experience as a cohort. The very making of this anthology is a reflection of that collective spirit, and you will find many traces …
Race Centers As Critical Curriculum Spaces In U.S. Law Schools, Katheryn Russell-Brown, Vanessa Miller
Race Centers As Critical Curriculum Spaces In U.S. Law Schools, Katheryn Russell-Brown, Vanessa Miller
Mercer Law Review
This piece aims to amplify the role of law school race centers. In fact, these centers are central curriculum spaces for student teaching and learning about race. The discussion highlights the role of race centers in law schools, explores the scholarly potential of race centers, and proposes strategies for sustaining race centers. The piece examines the role of race centers in helping law schools meet American Bar Association Standard 303(c), which requires that law students are exposed to race‑related curriculum, such as bias, cross‑cultural competencies, or racism. Tracing the historical roots of modern‑day race centers to Black Culture Centers of …

Investigating The Separation Of Environmental Education And People With Mobility/Motor Disabilities In National Parks, Ariel Wapnick
School of Education and Leadership Student Capstone Theses and Dissertations
Accessibility in national parks is crucial for inclusive environmental education (EE) programs, yet significant barriers persist for individuals with physical disabilities. This study investigates how 4 educators at 4 national parks perceive and implement inclusive practices in outdoor educational programming for people with physical disabilities by answering the questions: How do educators at national parks describe their ability to include people with physical disabilities in outdoor educational programming? What have these educators found to be successful in delivering inclusive outdoor educational programs to people with physical disabilities? Drawing on study participants’ professional experiences, the study explores the current state of …

Peru: Indigenous Peoples and Globalization
This research focuses on the ways in which neoliberal policies and climate change are transforming water culture in indigenous communities of the Peruvian Andes. Specifically, the study explores how indigenous communities are responding to water scarcity through the ancestral practice of planting and harvesting water. Residents of Andean regions are some of the most vulnerable to the impacts of climate change; irregular rainfall and melting glaciers are creating an unprecedented loss of water sources. Furthermore, the water management of the Peruvian state, using a neoliberal model, is restricting the access to and use of water for indigenous communities. This research …
Plastics, Carbon, Politics, And Experimentation In Environmental Governance, Donald T. Hornstein
Plastics, Carbon, Politics, And Experimentation In Environmental Governance, Donald T. Hornstein
William & Mary Environmental Law and Policy Review
In this Article, I discuss new developments on waste reduction involving plastics and continued social experimentation in greenhouse gas (GHG) reduction, especially as framed in two just-concluded, major international negotiations. In doing so, I describe the search for next-generation policies on waste reduction, including, but not limited to, extended producer responsibility (EPR) programs, along with newly announced policies on carbon offset markets as they relate to GHG reduction. In each case, society is on the verge of what movie producers might call “remakes” with EPR and other waste-reducing programs replacing first-generation recycling efforts and newly designed carbon offset markets replacing, …

Connecting Cultures Through Nature Exploring Cross-Cultural Environmental Education And Global Citizenship At Hanoi Edufarm, Shreeya Patel
Vietnam: Culture, Social Change, and Development
This paper explores the role of cross-cultural, nature-based education in fostering intercultural understanding and environmental awareness among children through my internship completed at Hanoi EduFarm, a farm school located in the countryside of Hanoi, Vietnam. While initially intended to focus on sustainable and regenerative agriculture, the internship evolved into a teaching role, where I designed and led lessons in English centered on environmental topics, geography, and intercultural exchange.
Drawing from in-class participant observations, reflective journaling, and informal discussions with staff and faculty over 120 hours of the internship period for SIT Vietnam, this paper examines how shared experiences with nature …
The Climate Whisperers, Cale Jaffe
The Climate Whisperers, Cale Jaffe
Michigan Journal of Environmental & Administrative Law
Environmental groups and their allies have seen two of the bedrock statutes of modern environmental law (the Clean Air Act, Clean Water Act) eroded through recent decisions from the Supreme Court. At the same time, political polarization around climate policy- the gap between Republicans and Democrats on whether worsening global warming merits a response- is wider than it has ever been.
Despite these dispiriting headwinds, there are some encouraging counterpoints of recent climate progress in politically conservative communities. The heart of this essay is simply sharing these stories so we can learn from them. I label the advocates who succeeded …

Wildfire Smoke And U.S. Law, Michael B. Gerrard
Wildfire Smoke And U.S. Law, Michael B. Gerrard
Faculty Scholarship
Many of the most wicked feedback effects of climate change relate to wildfire smoke. In some places the greenhouse gases poured into the atmosphere by wildfires exceed the reductions achieved by all efforts to fight climate change. At the same time, climate change is a major reason why wildfires are becoming more frequent and intense. Climate change and wildfires feed each other. However, environmental law and climate policy have paid relatively little attention to wildfires. The smoke from these fires — a major cause of illness and death, even thousands of miles from the blazes — is mostly unregulated. Efforts …
Engagement In Generalist Social Work Practice: Exploring Conceptual Theory And Textbook Pedagogy, Alice C. Fischer
Engagement In Generalist Social Work Practice: Exploring Conceptual Theory And Textbook Pedagogy, Alice C. Fischer
Social Work Doctoral Dissertations
Social work has a distinctive orientation to engagement that sets it apart from other helping professions. Engagement occurs both at the beginning and throughout every stage of social work practice with client systems. Despite its inherent and almost synonymous nature with social work practice, the profession has found it challenging to establish a theoretical conceptualization of engagement in social work or a definition of engagement in social work.
This study explored existing literature to establish a construct of engagement and a description of its underlying concepts, variables, and attributes. The construct informed the development of a methodology for comparing how …

Corsets Of Empowerment, Dorsa Farzi
Department of Textiles, Merchandising and Fashion Design: Dissertations, Theses, and Student Research
This project explores the intersection of fashion and activism, using contemporary design to reflect on significant women’s rights movements from around the world. This exhibition presents four uniquely crafted corsets, each representing a pivotal movement, from the Suffragette era to the ongoing fight for gender equality in Iran. Through modern aesthetics, innovative construction, and symbolic details, this project transforms clothing into a medium for dialogue and advocacy. Fashion becomes more than just design—it becomes a powerful tool for storytelling, sparking awareness, and encouraging new perspectives on gender equality and activism.

Death Becomes Us: The Consumptive Body In Nineteenth-Century Gothic Literature, Jennifer Marie Mcmahon
Death Becomes Us: The Consumptive Body In Nineteenth-Century Gothic Literature, Jennifer Marie Mcmahon
All NMU Master's Theses
This thesis examines the impacts of nineteenth-century tuberculosis epidemics on gothic literature published between 1842 and 1872. In this period of time, tuberculosis was the leading cause of death in the United States and in Europe, killing an estimated one in seven people. Using theoretical lenses of psychoanalysis and material ecocriticism, this project considers borders between material bodies—specifically those between bacterial agents and humans—to be illusory and socially constructed. The first chapter focuses on the ways in which representations of tuberculosis, and its associated entanglement with the environment, appear in the work of two authors from the United States: Edgar …

Organic waste is oftentimes poorly managed and directed to landfill and incineration, as more sustainable alternatives such as traditional composting are not always accessible. Swarthmore College has a robust composting partnership offsite, however, it does not leverage avenues for waste stream circularity on campus to its full potential. Vermicomposting, composting that incorporates earthworms (Eisenia fetida), consists of a method to achieve small-scale and accessible composting. The goal of this project was to create an on-campus, low-maintenance, replicable, and sustainable vermicomposter to efficiently repurpose food waste from Swarthmore’s dining hall into nutrient-rich soil amendments for the adjacent Our Food Garden. …

Law In Bloom: The Roots Of Legal Consciousness And Negotiation In Philadelphia Community Gardens, Vanessa Amsinger , '25
Senior Theses, Projects, and Awards
This thesis examines how legal consciousness, self-governance, and social networks shape power, participation, and belonging in the Southwark Queen Village Community Garden in South Philadelphia, Pennsylvania. I draw on theories of legal pluralism and network theory to analyze archival documents, participant observation, and semi-structured interviews with garden members and leadership. I show that gardeners navigate overlapping formal rules and informal hierarchies, appearing in the form of bylaws, land trust agreements, social ties, and embodied practices, that together produce a complex web of legal consciousness inside the space. Mechanisms of self-governance, like plot assignments and leadership elections, often reinforce social hierarchies …

Disease And Deprivation: Care, Medical Pluralism, And Healthcare Experiences Of Diabetes Patients In Liberia, Prince U.D. Tardeh , '25
Senior Theses, Projects, and Awards
Equal access to healthcare continues to be a problem across the globe, with people from colonized nations suffering at an even higher rate. Infrastructures and healthcare resources’ limitations in developing nations like Liberia continue to limit how much care citizens, especially low income people can receive for their illnesses. This thesis combines ethnographic fieldwork, history, and quantitative data analysis to describe the issues of access to healthcare in Liberia and the circumstances that have shaped Liberia’s inability to provide adequate care for its citizens. The analysis in this thesis is rooted in weeks long in-depth interviews with healthcare professionals, herbalists, …

Cultivating My Social Work Identity: Integrating Past, Context, And Relationship, Jessica K. Kumm
Graduate Student Portfolios, Professional Papers, and Capstone Projects
My application to the Master of Social Work (MSW) program was sent as a means to move beyond the constraints of the classroom walls as teacher and provide meaningful and tailored support to individuals who were falling through the cracks of the system. My experience in this program was transformative, in ways that were expected and unexpected. I recognize significant expansion in my perspective alongside growing confidence in applying newly acquired skills, both clear indicators of my professional and personal development. The insights garnered from personal experiences, academic lectures, and practicum placements shifted my theoretical foundations and personal worldviews. What …
“Everybody Else Seems To Be Able To Get Help”: Rural Regulation, Access Loss, And Antigovernment Sentiment, Jennifer Sherman
“Everybody Else Seems To Be Able To Get Help”: Rural Regulation, Access Loss, And Antigovernment Sentiment, Jennifer Sherman
West Virginia Law Review
This Essay draws upon two decades of the author’s research on rural United States communities to explicate ways in which the regulatory state has intervened in rural areas and economies, often with the claim of protecting land, natural resources, and/or wildlife. The outcomes are frequently disastrous for the human populations of those communities and generally are not planned for or mitigated by policy. The Essay argues that rural distrust of and aversion to government oversight is not caused primarily by ideological or cultural stances, but rather is an outcome of experiences of abandonment by the agencies that are meant to …

Information For Environmental Governance: The Value Of State Of The Environmental Reports In A Polarized Era, Michael Vandenbergh, M. Caballero, Ethan I. Thorpe
Vanderbilt Law School Faculty Publications
The increasingly dysfunctional federal democratic process poses chal- lenges to effective, consistent responses to the most important environmental risks. Information about the state of the environment and the performance of environmental protection measures can play a surprisingly important role by providing the information necessary for the public and decision-makers to resist disinformation efforts and prioritize the responses to these threats. Until 1997 the White House Council on Environmental Quality (CEQ) produced annual State of the Environment (SOE) reports as required by Section 201 of the National Environmental Policy Act of 1969. In response to paperwork reduc- tion legislation adopted in …

Articles
This Article introduces the new interdisciplinary field of Environmental Geography and Law, which has deep roots in ecology, social science, and law. Environmental and natural resources laws are situated in specific times and places where the climate, ecosystems, history and political economy influence both the land and the law. These places drive and constrain the way law develops. In turn, the law shapes places, from the dispossession and forced migration of indigenous groups, to land development via railroad land grants, to patterns of resource extraction and infrastructure development. Past efforts to integrate law and geography have focused more on critical …

Cardozo Journal of Equal Rights & Social Justice
The Conservative Caution v. Progressive Originalism symposium, hosted by the Cardozo Journal of Equal Rights and Social Justice on March 7, 2025, brings together leading constitutional scholars to examine the emerging judicial philosophies of Justices Amy Coney Barrett and Ketanji Brown Jackson. Through three expert panels—presidential immunity, gun rights, and judicial ideology—the symposium analyzes how both Justices are shaping contemporary originalist discourse from opposing ends of the ideological spectrum. Panelists explore the Supreme Court’s watershed decision in Trump v. United States (2024), emphasizing its unprecedented expansion of presidential immunity and its implications for separation of powers and democratic accountability. Discussions …

Shaping Effective Food Action Groups: Participant Perspectives On Structure And Stakeholder Involvement In Regional And Remote Western Australia, Stephanie L. Godrich, Sarah Goodwin, Jess Doe, Melissa Stoneham, Amanda Devine
Research outputs 2022 to 2026
Issue Addressed: Food systems strongly influence food security outcomes. Food Action Groups (often termed Food Policy Councils/Coalitions/Networks internationally) offer a co-ordinated and collaborative approach to local food system issues. Their organisational structure and stakeholder membership significantly impact their focus and impact. Therefore, it is imperative to understanding community member and food system stakeholders' perspectives on how regional and remote Australian Food Action Groups should be structured to maximise their impact on local food systems, and identify the most appropriate stakeholders to facilitate and drive their action. Methods: A qualitative study using focus groups, was conducted in regional and remote townships …
