"Where Will My Family Go?" The Financial, Housing, And Health Challenges Of Families Facing Eviction, Natalie J. Cholula, Alex Farrington, Lisa K. Bates, Marisa A. Zapata, Jacen Greene

Urban Studies and Planning Faculty Publications and Presentations

To better understand how eviction affects families with children, the Evicted in Oregon team conducted focus groups with 74 tenants from Baker, Lincoln, Linn, Marion, Multnomah, and Washington counties in Oregon. During focus group discussions, we asked participants whether they had children in the household at the time of eviction and how it impacted them. Parents reported that their children’s well-being was their main concern during the eviction process. They also described how eviction led to disruptions in their children’s education, health and medical treatments, and living arrangements. Based on our findings, we provide a set of policy and program …

Social Murder And The Antisocial Contract, Marissa Jackson Sow Jan 2025

Social Murder And The Antisocial Contract, Marissa Jackson Sow

Law Faculty Publications

Social murder is widely understood as the reckless and calculated killing by the State of people who are considered surplus and thus made redundant by the State. It is not merely an outcome, however; social murder, is an antidemocratic process, and—certainly as it is manifesting in the United States under the second Trump Administration—is also an anti-constitutionalist project aimed at destroying society, eliminating social goods, and renegotiating an American social contract that is, definitionally, antisocial. Social murder is as much about the elimination of social life as it is about the interruption of physical life. And it is fueled by …

Crypto And The Fiduciary Investor, Eric D. Chason Jan 2025

Crypto And The Fiduciary Investor, Eric D. Chason

Faculty Publications

Without much aid from MPT [modern portfolio theory], how should courts approach claims of imprudent investment in cryptocurrency? Courts might take this lack of aid as itself relevant. If MPT cannot place cryptocurrency in a portfolio, then perhaps fiduciary investors should refrain from doing so. Taking this approach would, however, overextend the prudent investor rule’s reliance on MPT. While the creators of the prudent investor rule certainly relied on MPT, the prudent investor rule does expressly adopt it. Moreover, courts should be wary of fixing investment practices in place. It would be ironic if the prudent investor rule, which intended …

Fatigue is a common problem in individuals with multiple sclerosis (MS).

Objective

The objective was to evaluate the effects on fatigue of having 4 weeks of

access to audio recordings of therapeutic hypnosis (HYP) and mindfulness meditation

(MM) practices.

Methods

A total of 333 individuals with MS and fatigue were randomly assigned to

one of the three treatment conditions for 28 weeks: (1) access to therapeutic HYP audio

recordings, (2) access to MM audio recordings, or (3) no access to recordings

(treatment as usual or TAU). Fatigue impact (primary outcome) and other outcomes

were assessed at 4, 16, and …

Interrogating Miranda's Custody Requirement, Lauren E. Clatch Jan 2025

Interrogating Miranda's Custody Requirement, Lauren E. Clatch

Law Faculty Publications

Interrogating officers need only issue Miranda warnings in “custodial” settings, and a significant degree of psychological coercion makes a setting custodial. This Article asks a question at the heart of Miranda caselaw: Have courts applied Miranda’s custody trigger consistent with people’s real experiences of police questioning? If not, courts are allowing, and justifying, the admission of unwarned self-incriminating statements by deeming those interrogations “noncustodial” even when there is a significant element of compulsion. To compare courts’ custody decisions to civilians’ perceptions of coercion in interrogations, I surveyed laypeople across two studies using forty interrogation scenarios from jurisdictionally diverse cases spanning …

Regulating The Forever Wild, Edward W. De Barbieri Jan 2025

Regulating The Forever Wild, Edward W. De Barbieri

SMU Law Review

Communities in rural areas regularly come into conflict with government bodies regarding the use of protected lands. From New York, to Alaska, to Nevada—and many places in between—a common question emerges: who should have authority to regulate human activity on and around wilderness lands? It is not a new phenomenon for urban dwellers, often controlling money and political power, to use influence and a specter of conservation to control what is permitted in rural spaces. Resulting unrest among rural residents may be the result of the exclusion of poor, racially underrepresented, indigenous, and other residents who earn their livelihood from …

Improving Regulatory Notice, Joshua Ulan Galperin, E. Donald Elliott Jan 2025

Improving Regulatory Notice, Joshua Ulan Galperin, E. Donald Elliott

SMU Law Review

Effective notice of law is the cornerstone of any legal system, and yet many federal administrative agencies do not give small businesses, NGOs, and interested citizens notice of the vast amount of new or modified law they produce. They merely publish the text in the Federal Register, which works tolerably well for larger enterprises but not their smaller competitors and citizens’ groups. Despite these facts, few scholars have explored how agencies provide notice of the law. Even fewer have proposed ways that agencies could improve the methods they use for giving more effective notice of significant regulatory changes and …

The Homeowner Strikes Back: The Rise Of Antisquatter Laws, Sam Fowler Jan 2025

The Homeowner Strikes Back: The Rise Of Antisquatter Laws, Sam Fowler

SMU Law Review

Beginning in 2024, a host of states across the country began enacting or considering new laws targeting squatting that seek to expedite the removal of squatters. Generally, these antisquatting laws create criminal penalties for squatters, allow sheriffs to remove squatters, and shorten the time for eviction. This wave of legislation is generally attributed to several viral videos and news stories about squatters that seem to game the system by moving into unattended homes, even those where the rightful owners or tenants are living, and then claiming they have a lease. The owners will generally call the police, who are unable …

Title 18’S Property Conundrum, Karen E. Woody, Joshua L. Clardy Jan 2025

Title 18’S Property Conundrum, Karen E. Woody, Joshua L. Clardy

SMU Law Review

“Property,” in legal terms, carries significant weight. Once an object is heralded as “property,” that object becomes a step closer to being afforded the protections of the Constitution, offered equitable remedies at a court’s disposal, or even subjected to taxation by the state or federal government. Defining an object as “property” also puts it within the reach of the Title 18 property fraud statutes. Title 18’s fraud statutes have been often lauded by federal prosecutors for their “extraordinary utility.” In their current iteration, these statutes criminalize schemes to defraud “money,” “property,” and “the intangible right of honest services.” But what …

The Persistence Of Common Law Limits On Armed Travel In The Early Republic: Surety And Affray Laws In Historical Context, Saul Cornell Jan 2025

The Persistence Of Common Law Limits On Armed Travel In The Early Republic: Surety And Affray Laws In Historical Context, Saul Cornell

SMU Law Review

In New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court abandoned the two-step test that had emerged after its landmark, but controversial ruling in District of Columbia v. Heller. The new approach announced in Bruen rejected the second prong of this test, casting aside means end scrutiny, or balancing, in favor of a “text, history, and tradition” approach. More recently, in United States v. Rahimi, the Court clarified some of the confusion over its Bruen test. One ongoing problem that lawyers and judges face when implementing this framework flows from the nature of materials …

Second Amendment Originalism, “General Law,” And Rahimi’S Two-Fold Failure, Nelson Lund Jan 2025

Second Amendment Originalism, “General Law,” And Rahimi’S Two-Fold Failure, Nelson Lund

SMU Law Review

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

New York State Rifle & Pistol Association v. Bruen (2022), set out a bold new standard of review for Second Amendment cases. The Court rightly repudiated the intermediate-scrutiny approach adopted by the circuit courts after District of Columbia v. Heller (2008). Bruen purported to require that any gun regulation falling within the plain text of the Amendment be upheld only if the government can demonstrate that the regulation is consistent with America’s historical …

Levels Of Generality, The Limits Of Originalism, And The Supreme Court’S Second Amendment Jurisprudence, Amanda L. Tyler Jan 2025

Levels Of Generality, The Limits Of Originalism, And The Supreme Court’S Second Amendment Jurisprudence, Amanda L. Tyler

SMU Law Review

Just how originalist is the Court’s Second Amendment jurisprudence after United States v. Rahimi? This is perhaps one of the biggest questions left in the decision’s wake. As it turns out, the answer is not altogether clear post-Rahimi. This is because the case produced some seven separate opinions, many of which—even though they agree as to the bottom line—get there by very different paths. This Article suggests that Rahimi, perhaps more than any other recent decision by the Court, underscores the crucial role that levels of generality in constitutional interpretation play, while illustrating the problems with …

Encouraging Self-Regulation In An Online University Course For Preservice Teachers: An Intervention Study, Karen T. Arnesen, Charles R. Graham, Heather Leary, Alison I. Mcmurry Jan 2025

Encouraging Self-Regulation In An Online University Course For Preservice Teachers: An Intervention Study, Karen T. Arnesen, Charles R. Graham, Heather Leary, Alison I. Mcmurry

Faculty Publications

Although self-regulation (SR) has long been seen as an important educational concept, we know little about how to foster it in higher education online student populations. This research addresses this need by introducing an SR intervention into a preservice teacher course. The 30 students who participated used an intervention consisting of weekly student goal setting and self-reflection. Using data collected from a self-regulation survey, weekly reflections, final exam reflections, and interviews, all but one student indicated that the process of setting a goal weekly and especially reflecting on their actions during the week increased their self-regulation abilities. More than half …

The Ever-Present Nature Of Christ In The Title Of Jehovah, Dan Belnap Jan 2025

The Ever-Present Nature Of Christ In The Title Of Jehovah, Dan Belnap

Faculty Publications

In January 2000 the First Presidency and the Quorum of the Twelve Apostles of The Church of Jesus Christ of Latter-day Saints bore testimony to the world of the reality, humanity, and divinity of Jesus Christ in a document titled “The Living Christ: The Testimony of the Apostles.” Among its many truths was the following: “He [Christ] was the Great Jehovah of the Old Testament.”1 Though this was not the first time Church leadership had declared Christ to be Jehovah, the pronouncement does reemphasize this teaching. It also emphasizes the centrality of Christ in the Old Testament. In fact, the …

Virginia Woolf And The Lesbian Literary Tradition, Hunter Candrian-Velez Jan 2025

Virginia Woolf And The Lesbian Literary Tradition, Hunter Candrian-Velez

English and Creative Writing | Senior Theses

Modernist English authors, such as Virginia Woolf in her novel Orlando: A Biography, built upon a pre-existing and long tradition of underground lesbian literature dating back to Sappho in Ancient Greece. Before Woolf, female writers of the 19th century continued this tradition by establishing the literary trope of the “Victorian Romantic Female Friendship,” which would later take on different shapes and connotations with discoveries made in the early 1900s related to sexology and homosexual inversion. These discoveries would lead writers to code their work in the hopes of avoiding censorship and government punishment. Writers such as Virginia Woolf, Elizabeth Gaskell, …

Unraveling The Impacts Of Online Secondhand Resellers On Brick-And-Mortar Thrift Stores, Neely Connor Jan 2025

Unraveling The Impacts Of Online Secondhand Resellers On Brick-And-Mortar Thrift Stores, Neely Connor

Honors Theses - Providence Campus

The purpose of this study is to provide insight into the current online controversy debating the effects of online secondhand resellers on brick-and-mortar thrift stores. While this debate has been featured in consumer media sources (e.g., Heydari, 2022), there is a lack of scholarly research on this topic. This study seeks to fill that gap by examining the effects of online secondhand resellers on brick-and-mortar thrift stores, particularly concerning price increases, product availability, and quality of items. Online qualitative surveys and interviews were conducted to develop an understanding of the perceptions on this topic held by both online resellers and …

Everything New Is Old Again: The Coming Metaverse, Platforms As Premises, And Addressing Harms That Occur Behind The Veil Of Scale, Lara Putnam, Jena Martin Jan 2025

Everything New Is Old Again: The Coming Metaverse, Platforms As Premises, And Addressing Harms That Occur Behind The Veil Of Scale, Lara Putnam, Jena Martin

Faculty Articles

Increasingly, social media companies have engaged in the creation, development, and deployment of "worlds" within a virtual reality setting, leading to significant interactions among users within these engineered spaces. However, this expansion has also been accompanied by harms. While some harms are unique to immersive reality technology, many mirror harms that occur in the analog environment, including fraud, theft, verbal abuse, and child sexual exploitation. Others replicate harms that have already exploded in non-immersive online spaces, including image-based sexual exploitation, cyberstalking, and invasion of privacy. Unfortunately, the architecture and infrastructure of these spaces has created what we coin here to …

2025 Environmental Flows Report, Adrian Oglesby, Anjali Bean, Martha Cooper, David Pílz

Publications

A selection from the 2025 Environmental Flows Workshop Report's Introduction:

The term environmental flows means different things to different people. For example, environmental flows might refer to the science underpinning instream flow recommendations; or environmental flows might refer to the tools used to legally allocate water to rivers; or it might most broadly refer to the question, “how much water does a river need to stay alive?” Workshop presentations and discussions covered all these topics and others.

A Bibliometric Analysis Of Ai-Driven Healthcare Literature Containing Kos Keywords: Trends, Themes, And Gaps, Julaine Clunis, Eric Asare Jan 2025

A Bibliometric Analysis Of Ai-Driven Healthcare Literature Containing Kos Keywords: Trends, Themes, And Gaps, Julaine Clunis, Eric Asare

STEMPS Faculty Publications

As artificial intelligence (AI) becomes increasingly embedded in healthcare applications, concerns have emerged around the trustworthiness, interpretability, and context-awareness of these systems. Knowledge Organization Systems (KOS) hold considerable potential to address these challenges by supporting semantic standardization, explainability, and domain alignment. This study presents a bibliometric analysis of scholarly publications referencing both AI and healthcare concepts to examine how KOS are positioned within this evolving discourse. The findings indicate that while early literature frequently and explicitly referenced KOS—such as ontologies, controlled vocabularies, and classification systems—their visibility has declined relative to newer paradigms such as machine learning and large language models. …

How District Administrators Further The Book Banning Agenda, Kim Reichenbach Krutka Jan 2025

How District Administrators Further The Book Banning Agenda, Kim Reichenbach Krutka

STEMPS Faculty Publications

Book banning and censorship in school libraries remain a significant barrier to intellectual freedom. Drawing on ten years of experience as a Texas school librarian, this opinion article highlights how district policies and grievance procedures empower individuals to exclude books representing marginalized identities, particularly queer and Black experiences. Using Critical Race Theory (CRT), specifically the tenets of whiteness as property and counter storytelling, the article explains how these policies uphold white privilege and dominant narratives while silencing counter-stories that validate diverse student identities. The grievance process allows a single hearing officer to overturn committee decisions without transparent reasoning, often restricting …

Effects Of Fiber Concentrations And Fermentation Rates On Reproductive Performance, Nutrient Digestibility, Immune Response, And Microbiota Of Lactating Sows, Tao Wang, Pieter Langendijk, Paula Azevedo, Lluis Faba, Bin Zuo, Jiangchao Zhao, Chengbo Yang Jan 2025

Effects Of Fiber Concentrations And Fermentation Rates On Reproductive Performance, Nutrient Digestibility, Immune Response, And Microbiota Of Lactating Sows, Tao Wang, Pieter Langendijk, Paula Azevedo, Lluis Faba, Bin Zuo, Jiangchao Zhao, Chengbo Yang

Animal Science Faculty Publications and Presentations

Certain types of fiber inclusion in sow diets can offer benefits such as promoting a healthy microbiome, improving intestinal health, and enhancing welfare through satiety mechanisms. While most research has focused on gestating sows, studies on lactating sows, especially regarding fiber types, levels, and fermentation rates, are limited. This study explored how fiber inclusion and fermentation rate affect lactation performance, nutrient digestibility, immune response, and microbiota. The study involved 136 lactating sows (Landrace x Large White) assigned to four dietary treatments with varying total dietary fiber (TDF) levels and proportions of fast-fermentable fiber. Diets 1 and 2 had low TDF …

The Future Of War: Kill-Chain Supremacy And Ukraine's Lessons, Ashley Ruiz Jan 2025

The Future Of War: Kill-Chain Supremacy And Ukraine's Lessons, Ashley Ruiz

Journal of Strategic Security

The war in Ukraine has reshaped contemporary understandings of how wars are fought and sustained. This article argues that the defining characteristic of modern warfare is not only the compression of kill chains – the sequence linking detection, decision, and destruction – but their diversification and resilience under continuous disruption. Drawing on empirical evidence from Ukraine’s integration of unmanned systems, digital battle management tools, and artificial intelligence, the analysis demonstrates how technological acceleration can yield short-term tactical advantages while exposing long-term structural vulnerabilities. Russia’s extensive use of electronic warfare, hybrid attacks, and adaptive countermeasures reveals that kill-chain supremacy is both …

Slava Ukraini! Solving Ukraine’S Present With The Past, Daniel Armes Jan 2025

Slava Ukraini! Solving Ukraine’S Present With The Past, Daniel Armes

Journal of Strategic Security

Ukraine desires to be a free state, drawing on over one thousand years of history to legitimize a national identity consisting of a distinct culture, language, and religion. While this is an achievable goal, the country faces challenges based on competing claims to Ukraine’s historical legacy. This article will analyze the roots of the current conflict over Ukraine’s national identity beginning with the religious divide between Eastern and Western Christianity in the Great Schism of 1054 and the Rus diaspora caused by the Mongol invasion of eastern Europe in 1240. A millennium of history and conflict are relevant today because …
