An Imperfect Explication Of An Ambiguous Constitution: The Federalist Papers, Ian J. Penner Oct 2025

An Imperfect Explication Of An Ambiguous Constitution: The Federalist Papers, Ian J. Penner

History Senior Capstone

With the rise of originalism as a viable legal philosophy, American legal scholars have seen an increased appeal to writings contemporary to 1787 -- first among these sources being the Federalist Papers. However, it may be time for a critical study of Hamilton, Madison, and Jay's essays in order to prevent over-citation of the papers. By understanding the context of the papers, who wrote them, and what the intention of Publius were, legal scholars and historians can both learn the proper place of the Federalist papers as valid, yet conditioned source of Constitutional meaning.

Sports Evangelism On Wheels: An Evaluation Of The Efficacy And Development Of Athletic Evangelism, Keira B. Martin Oct 2025

Sports Evangelism On Wheels: An Evaluation Of The Efficacy And Development Of Athletic Evangelism, Keira B. Martin

History Senior Capstone

This thesis includes how sports evangelism operates and develops conceptually, evaluating the program Wandering Wheels as a qualitative case study. Wandering Wheels was a cycling program that began in Upland, IN in 1964 to illustrate the toughness of the Christian life. Drawing on oral histories, archival records, and documentary material, it argues that community, activism, athletic maturation, and personal spiritual growth were pivotal to Wandering Wheels' model. This evaluation demonstrates the extent to which this program exemplified the concept of sports evangelism.

An Analysis Of Mergers In The Presence Of Uncertainty In Renewable Energy Integration Costs, Wassim Daher, Jihad Elnaboulsi, Mahelet G. Fikru, Luis Gautier Oct 2025

An Analysis Of Mergers In The Presence Of Uncertainty In Renewable Energy Integration Costs, Wassim Daher, Jihad Elnaboulsi, Mahelet G. Fikru, Luis Gautier

Economics Faculty Research & Creative Works

This study examines how uncertainty in renewable integration costs affects the profitability of mergers among energy producers. As the energy sector shifts toward decentralized renewables, centralized producers face industry-wide and firm-specific cost uncertainties due to the variable and intermittent nature of distributed generation. Although previous models have examined mergers in the presence of greener energy, they have largely assumed deterministic costs and ignored the impact of the dual sources of uncertainty on merger profitability. This study incorporates both industry-wide and private shocks into renewable integration costs, using two theoretical models – without and with uncertainty – to identify how these …

Structurally Harmless: Why Brecht Should Apply On Collateral Review Of Structural Errors, Jaden M. Lessnick Oct 2025

Structurally Harmless: Why Brecht Should Apply On Collateral Review Of Structural Errors, Jaden M. Lessnick

Notre Dame Law Review Reflection

Even when a prisoner has overcome all of AEDPA’s requirements and the Supreme Court’s equitable bars to relief, the writ of habeas corpus may issue only as “law and justice” require. The Court has recognized in recent Terms that the habeas statute thus confers on courts discretion to deny relief notwithstanding the satisfactions of the statutory and equitable preconditions. This discretion, the Court has said, is not boundless. A judge may grant the writ only after considering the principles of finality and federalism. Whatever else that includes, the Supreme Court has made clear that a judge must apply Brecht’s …

The Best We Can Hope For: The Irony Of The Best Interest Standard, Alesondra Cruz Oct 2025

The Best We Can Hope For: The Irony Of The Best Interest Standard, Alesondra Cruz

Notre Dame Law Review Reflection

Laws are often designed with an eye toward precision. Specific words are chosen, others deliberately removed, with each revision seeking to bring a rule closer to its intended purpose. Despite this deliberate process, even the most curated laws at times fail to serve their intended ends, and instead become sources of harm. This reality, unfortunate and unavoidable, is the irony of law.

This tension is particularly evident in the context of family law, where negative ramifications are felt personally and intimately, and in child custody cases, where the stakes are incredibly high. The best interest of the child standard was …

Identifying And Addressing Barriers To Long Term Follow Up Care Of Patients With Hepatitis C In A Rural Southern Appalachian Clinic, Sarah M. Brown Oct 2025

Identifying And Addressing Barriers To Long Term Follow Up Care Of Patients With Hepatitis C In A Rural Southern Appalachian Clinic, Sarah M. Brown

Doctoral Projects

This project addressed the issue of loss to follow-up (LTFU) among patients infected with hepatitis C virus (HCV), a significant barrier to achieving sustained virologic response (SVR) and improving outcomes. LTFU is particularly critical among marginalized and rural populations who face socioeconomic barriers, stigma, and other social determinants of health (SDOH) that affect treatment adherence. Grounded in the Social Ecological Model (SEM), this project examined systemic, community, interpersonal, and individual factors influencing LTFU (Ahmed et al., 2022; Al-Khazraji et al., 2019; Kilanowski, 2017).

This Doctor of Nursing Practice (DNP) quality improvement initiative sought to improve patient retention in HCV care …

Cultivating A Student-Centered Approach To Peer Review Through Pre-Flection And Reflection, Jennifer P. Gray, Stephanie B. Conner

Journal of Response to Writing

Asking students to reflect on their learning experiences during a first-year course may not be a radical idea; however, asking them to pre-flect and then reflect on their experiences is an approach that can help set the scene for an effective learning moment. In our Teaching Tip, we detail an activity used in a first-year English Composition course that encourages students to think and pre-flect first, prior to a peer-review activity, which contributes to a more thorough student learning experience. Taking time for pre-flection and reflection can help students question their own contributions in the classroom community (Bean, 2011) and …

Technical Appendix: Analysis Of Innovation Applications And Value Driven By Aigc Technology—An Early Investment Perspective In The Chinese Market, Siyuan Ma, Mengyu Wang, Tianyi Zhang

Sim Kee Boon Institute for Financial Economics

Following the introduction of generative AI/AIGC concepts and applications, it is necessary to clarify two related technical concepts: machine vision (CV) and convolutional neural networks (CNN). Computer Vision (CV) is a discipline that studies how to convert inputs such as images, sounds, and videos into a language that computers can understand. Taking 2D images as an example, all images can be broken down into very small pixels, each of which can be converted into a number (based on grayscale) or a combination of numbers. The number represented by each pixel is the feature of that pixel, and combining these numbers …

The Teaching Librarian's Role In College Reading, Lori Spradley Oct 2025

The Teaching Librarian's Role In College Reading, Lori Spradley

The Southeastern Librarian

Reading is an essential function for everything people learn. The main goal of reading is for readers to interpret, comprehend, and receive meaning from the text. Academic reading differs from standard reading. It is a complex form implemented throughout all subjects in higher educational institutions. Academic reading involves a detailed and critical approach, whereas standard reading is casual and typically involves briefly skimming over information. Students entering college are often unprepared to comprehend the complicated reading materials and manage the heavy reading load required for their class assignments. To be successful in college, students must understand different terminology and styles …

Postmortem: Understanding The Life And Death Of A Multi-Year Writing Program In An Academic Library, Catherine Bowers

The Southeastern Librarian

A shared interest in a month-long novel writing event inspired two reference and instruction librarians to develop a serialized program built around writing and research. Through leveraging resources and partnerships, the librarians planned to foster creativity and confidence in research writing skills within an ethos of community. This project relied on multiple forms of outreach and assessment with an intention that would be meaningful and valuable to the students. The goal from the beginning was to develop an event that incorporated the Association of College & Research Libraries (ACRL) Framework for Information Literacy in Higher Education, fit the library’s mission, …

Competitive Harms Of Unfair Commercial Practices In The E-Commerce Platforms Market: The Way Forward For Asean, Mei Fei Lee, Tze Chin Ong

Yearbook of Antitrust and Regulatory Studies

The intricacies of unfair commercial practices within the e-commerce platforms market highlight a critical and urgent necessity for an evolution in both consumer protection and competition laws. As new consumer vulnerabilities emerge or existing ones are exacerbated in e-commerce, effective rules are needed to better protect consumers, govern businesses and regulate a healthy competitive dynamic in the market. This article examines the interplay between consumer protection law and competition law in addressing unfair commercial practices of e-commerce platforms. The large-scale deployment of unfair commercial practices by e-commerce platforms may result in anti-competitive effects, thereby undermining fair and effective market competition. …

The Catholic Church As A Model Of Minority Religious Relations In Morocco, Valli Pendyala Oct 2025

The Catholic Church As A Model Of Minority Religious Relations In Morocco, Valli Pendyala

Morocco: Human Rights, Social Justice, and Cultural Transformation

In recent years, religious identity has become a locus of increasing contention as societies around the globe become more diverse. This issue has become increasingly prominent in Morocco as its population of non-Muslim migrants and foreign residents has grown and begun to challenge its many constitutional provisions limiting complete freedom of religion. The largest religious minority is Roman Catholics, but there has been minimal research on the Catholic community in Morocco. However, by analysing discrimination against Christians as defined by the Religion and State Minorities dataset and by interviewing Catholics in Morocco, I aim to address this research gap by …

The Changing Roles Of Women In Amazigh Heritage Preservation In Agadir, Madeleine Hunt Oct 2025

The Changing Roles Of Women In Amazigh Heritage Preservation In Agadir, Madeleine Hunt

Morocco: Human Rights, Social Justice, and Cultural Transformation

Amazigh culture in Morocco has frequently been conceptualized as a rural phenomenon due to the repression of  “Amazighness” in urban settings. However, Agadir, a Southern city boasting a rich Amazigh cultural life where public symbols of Indigenous identity flourish, offers a challenge to this dichotomy. This is especially true following the King’s recognition of Amazigh national heritage, the establishment of the Royal Institute of Amazigh Culture, and the officialization of the Tamazight language, recent changes which have increasingly propelled Amazigh culture into the public and urban spheres. While past scholarship has emphasized the role of rural women as guardians of …

Embedded Aid And Organizational Vulnerability: Usaid’S Withdrawal And Moroccan Civil Society, Elsie Prince Oct 2025

Embedded Aid And Organizational Vulnerability: Usaid’S Withdrawal And Moroccan Civil Society, Elsie Prince

Morocco: Human Rights, Social Justice, and Cultural Transformation

This study examines the consequences of the United States’ 2025 dismantling of the U.S. Agency for International Development (USIAD) and its effects on Moroccan nongovernmental organizations (NGOs). While debates within the United States increasingly frame foreign aid as wasteful or misaligned with domestic priorities, USAID has historically served as a core instrument of U.S. geopolitical strategy and a central source of financial, technical, and institutional support for local civil society abroad. The research investigates how long-term donor-recipient relationships shape organizational vulnerability and resilience when a dominant donor abruptly withdraws. Based on qualitative fieldwork conducted in Morocco in 2025, the study …

Access In Context: A Comparative Study Of Refugee And Asylum-Seeking Child Immunization In Uganda’S National System And Chad’S Humanitarian System, Maya Lunt Oct 2025

Access In Context: A Comparative Study Of Refugee And Asylum-Seeking Child Immunization In Uganda’S National System And Chad’S Humanitarian System, Maya Lunt

Switzerland: Global Health and Development Policy

Vaccinations and child immunizations are widely recognized as a safe and effective public health tool to stop preventable deaths of children and eliminate disease. Refugees and asylum-seeking children are often more vulnerable and have a greater risk of having incomplete immunization. This is due to a wide variety of barriers that refugees can face, which can be unique to different health system designs or country policies. Chad and Uganda are two lower-middle-income countries that have different refugee health system designs. Chad has a health system design where a parallel system is run for refugees, which heavily involves humanitarian aid from …

Student-Athletes, Universities, And Society: Balancing The Symbiosis, Casey Faucon Oct 2025

Student-Athletes, Universities, And Society: Balancing The Symbiosis, Casey Faucon

Vanderbilt Journal of Entertainment & Technology Law

Elite student-athletes at prominent sports schools are locked in a symbiotic relationship with their universities and with society’s consumers of college sports. For most student-athletes, receiving the benefits of a college education and professional development in exchange for providing their skills and services through athletic participation is mutually beneficial. For these student-athletes, their relationship to the university is still, at its core, educational and professional development based. For the rarefied student-athletes in popular sports, more akin to professional athletes, the nature of their relationship to the university is not always educational. For some of these student-athletes, they attend college and …

Beyond “A Purely Passive Servitude”:Antonio Oblitas, Casta, And Afro-Descendants In The Rebellion Of TúPac Amaru Ii, Tacuma Peters

Publications and Research

This article examines the contributions of Afro-descendants to the Túpac Amaru II rebellion in Peru. It argues that although historians have recognized the importance of race and casta in the rebellion, they have been insufficiently attentive to the complex roles that those of African descent have played. It argues that the most famous Afro-descendant, Antonio Oblitas, has often been ignored, misidentified, and minimized in his aesthetic and visual contributions to the uprising. This problematic historical approach extends to other free and enslaved men because scholars place them within the paradigm of passive (and enslaved) servitude. Furthermore, the article contends that …
