Can Play-Based Learning Provide Adequate Learning Experiences For Young Children?, Rachel Bienemann

Master's Theses & Capstone Projects

This research study was conducted due to my curiosity in the effectiveness of play-based learning for academic and social emotional growth. I am in my 14th year of teaching preschool at a small Lutheran school. I used my afternoon classroom of 19 students to conduct the study. Screeners in five different areas were conducted before the eight-week data collection period. During the eight weeks, students participated in play-based learning activities to introduce and practice academic and social emotional skills. After the eight-week period, the same screeners were given to the students. Findings from the study revealed student growth in both …

Fine Motor Matters - A Plan To Improve Fine Motor Skills At The Early Childhood Level, Natasha Slater

Master's Theses & Capstone Projects

Fine motor skills at the early childhood level have been well-researched. The early childhood years have proven to be vital years of growth and development in a child's life. Studies have also found that fine motor skills have a direct correlation to other areas of development, such as literacy, math, gross motor, etc. Research conducted at Rock Valley Community School District suggests that fine motor skills are an area that needs improvement. This school improvement plan describes in detail the process needed to implement a fine motor program for students in grades Preschool through Kindergarten. With successful implementation, the fine …

The Expanding Expression Tool's Impact On Expressive Language In Preschool, Jill Owens

Master's Theses & Capstone Projects

Action research for this project was selected to meet a need for more effective vocabulary instruction in the researcher's classroom and teaching site. Current literature supports the need for more effective vocabulary instruction in early childhood. The intervention used the Expanding Expression Tool (EET) as an instructional strategy to support expressive language development in the researcher's preschool classroom. Eighteen students in a four-year-old classroom participated in an intervention using explicit instruction during large group, small group, and sharing (show and tell). Standardized and researcher created measures were used to determine significance of the outcomes. Findings showed an increase in expressive …

Financial Challenges And Capacity Among African Refugees In The Southern Usa: A Study Of Socio-Demographic Differences, Njeri Kagotho, Jennifer Scott, Mckenzie M. Ketchum, Youn Kyoung Kim, Arati Maleku, Younghee Lim Apr 2022

Financial Challenges And Capacity Among African Refugees In The Southern Usa: A Study Of Socio-Demographic Differences, Njeri Kagotho, Jennifer Scott, Mckenzie M. Ketchum, Youn Kyoung Kim, Arati Maleku, Younghee Lim

Faculty Publications

Refugees’ successful integration into US society requires adaptation to economic, financial and social norms. Despite the importance of considering financial challenges (financial stress and financial anxiety) and financial capacity (financial literacy and financial self-efficacy) in reaching personal financial goals, literature examining the relationship between financial challenges and capacity—critical in refugee resettlement and integration—is sparse and fragmented. This study explored financial challenges and capacity amongst resettled African refugees (N ¼ 130) in the southern USA using data from a larger community-based participatory research study that used a mixed-methods approach. We explored socio-demographic differences in financial stress, financial anxiety, financial literacy and …

Guthrie's Guide To Better Legal Writing, 2nd Ed, Hannah Steeves Apr 2022

Guthrie's Guide To Better Legal Writing, 2nd Ed, Hannah Steeves

Articles, Book Chapters, & Popular Press

The second edition of Guthrie’s Guide to Better Legal Writing is Neil Guthrie’s revised anthology of email queries and blog posts. The scope of the book is in its title: it offers practical tips and advice to legal writers. Guthrie’s definition of “legal writing” addresses written communication between lawyers, law students, and the layperson, although legal drafting is addressed intermittently. The book is not intended to be a comprehensive review of grammar and punctuation. Instead, it has an approximate agenda that is enhanced by the author’s personal narrative.

The author follows their own advice as outlined in the suggestions for …

Before the Perseverance rover landing, the acoustic environment of Mars was unknown. Models predicted that: (1) atmospheric turbulence changes at centimetre scales or smaller at the point where molecular viscosity converts kinetic energy into heat1, (2) the speed of sound varies at the surface with frequency2,3 and (3) high-frequency waves are strongly attenuated with distance in CO2 (refs. 2,3,4). However, theoretical models were uncertain because of a lack of experimental data at low pressure and the difficulty to characterize turbulence or attenuation in a closed environment. Here, using Perseverance …

Improving Heart Failure Patient Referrals To The Center For Advanced Heart Failure & Pulmonary Vascular Disease At Hartford Hospital: A Quality Improvement Project, Dawn M. Surprenant

DNP Projects

Significance and Background: According to the Health Resources & Services Administration (2021), health literacy is the degree to which individuals have the capacity to process and understand basic health information to make appropriate health decisions. Low health literacy is prevalent in populations such as older adults, minorities, and in individuals with lower socioeconomic status and living in medical underserved areas. Recommendations are to access health literacy in cardiac patients, especially in the acute care setting to improve health outcomes upon discharge.

Purpose: To determine whether a health literacy assessment in hospitalized congested heart failure patients, before discharge, will affect referral …

Non-Opioid Pharmacologic Agents In The Treatment Of Non-Cancer Chronic Pain In The Outpatient Setting, Diane Eannotti Apr 2022

Non-Opioid Pharmacologic Agents In The Treatment Of Non-Cancer Chronic Pain In The Outpatient Setting, Diane Eannotti

DNP Projects

Opioid prescription related overdose deaths have increased substantially with evidence demonstrating only modest short-term benefits in chronic pain and thus represents the need to identify alternative treatments to opioids. A needs assessment performed for a federally qualified community health center revealed patients presently taking non-opioid pharmacologic agents in the treatment of chronic non-cancer pain (CNCP) needed additional education in managing multiple non-opioid medications. A targeted approach at improving patient experience and population health supporting the quadruple aim was undertaken with this project.

Purpose: The purpose of this quality improvement project consisted of performing medication management visits for 28 referred patients …

Constitutional Cautions Post-Covid-19: A Proposal For 5th Amendment Protection From Police Power Overreach, Ethan Finster, Jessica Dofelmire, Editor Apr 2022

Constitutional Cautions Post-Covid-19: A Proposal For 5th Amendment Protection From Police Power Overreach, Ethan Finster, Jessica Dofelmire, Editor

Brigham Young University Prelaw Review

The invocation of police powers by state governments throughout the Covid-19 pandemic to restrict business activity created a legal protection around government action that prevents 5th Amendment claims. This protection persists whether or not those actions fit within precedential criteria for takings. While police powers are certainly an important aspect of governance in times of crisis, the infringement of individuals’ constitutional rights that accompanied their utilization must be addressed. Moreover, their use during the pandemic set a potentially dangerous precedent for their use in future emergencies. Considering the growing concern surrounding the adequacy of Takings Clause precedent for preventing government …

Adult Conservatorship In The United States: Flaws And Proposed Solutions To The Legal System, Margaret Sheffield, Alex Stevens Apr 2022

Adult Conservatorship In The United States: Flaws And Proposed Solutions To The Legal System, Margaret Sheffield, Alex Stevens

Brigham Young University Prelaw Review

Despite attempts to protect incapacitated adults in the United States, financial exploitation of the elderly and disabled remains a serious problem. Adult conservatorships are often established to offer incapacitated adults protection. However, many cases of adult conservatorships lead to increased abuse due to lack of accountability from conservators. This paper provides a brief overview of abuse towards incapacitated adults and proposes a solution in the form of a federal office entitled the Office of Adult Conservatorship and Guardianship Enforcement (OACE) which would be established under the United States Department of Health and Human Services.

Making The Case For Paid Parental Leave In The United States, Jane Johnson, Sarah Calvert Apr 2022

Making The Case For Paid Parental Leave In The United States, Jane Johnson, Sarah Calvert

Brigham Young University Prelaw Review

Despite being one of the most influential countries in the world, the United States is still one of only three developed countries that does not mandate paid parental leave on a federal level. Although some federal legislation does offer unpaid leave, these laws are insufficient to meet the needs of working parents. This paper examines existing parental leave laws to highlight the duration of leave and methods of funding used by some U.S. states and other countries worldwide. We also review multiple studies that demonstrate benefits of paid parental leave for both parents and children. This paper ends with a …

Crime And Unequal Punishment: Proving Discriminatory Intent In Felony Disenfranchisement, Abel Huskinson, Kaitlyn Long Apr 2022

Crime And Unequal Punishment: Proving Discriminatory Intent In Felony Disenfranchisement, Abel Huskinson, Kaitlyn Long

Brigham Young University Prelaw Review

Felony disenfranchisement, or barring convicted felons from voting, is a punishment used in almost every state. Although states differ in their severity of felony disenfranchisement, these laws resulted in 5.1 million Americans being unable to participate in the 2020 national election. The Supreme Court found in Hunter v. Underwood that felony disenfranchisement laws would violate the Equal Protection Clause of the Fourteenth Amendment if they contained “both [an] impermissible racial motivation and racially discriminatory impact.” Recent scholarship has found felony disenfranchisement to disproportionately affect marginalized racial groups. As such, it becomes the burden of felony disenfranchisement constitutional challenges to prove …

The Constitutionality Of The Title Ix Religious Exemption, Madelyn Jacobsen, Rebecca Batty, Editor Apr 2022

The Constitutionality Of The Title Ix Religious Exemption, Madelyn Jacobsen, Rebecca Batty, Editor

Brigham Young University Prelaw Review

Petitioners in Hunter v. Department of Education questioned the constitutionality of the Title IX religious exemption as the basis of their 2021 class-action lawsuit. They claimed that more than 30 religious schools maintained discriminatory policies against LGBTQ students under the exemption. The religious exemption, often painted as unconstitutional discrimination, permits religious schools' adherence to sincerely held religious beliefs—and promotes a distinctive religious education that secular schools lack. This paper examines legal precedents relevant to religious freedom, higher education, and discrimination that demand the Title IX religious exemption remains in effect.

How Social Media’S Rhetoric Shapes The Social Identity Of Online Groups: Forming, Confirming And Reinforcing And The Algorithmic Role, Crystal Rose Apr 2022

How Social Media’S Rhetoric Shapes The Social Identity Of Online Groups: Forming, Confirming And Reinforcing And The Algorithmic Role, Crystal Rose

Departmental Honors & Graduate Capstone Projects

The world has become integrated with technology at a rapid rate. The rhetoric of online platforms, due to technology integration, allows people to connect, converse, and meet others who have common character traits. Eyman (2015) defines rhetoric as an action that intends to persuade and form meaning. These platforms are referred to as "social media," which are online networks made by people who use rhetoric to form, confirm, and reinforce the connections of platform users with common character traits: Hobbies, thoughts, race, gender, or religion. These common character traits make up one's social identity. This study details the findings of …

The "Divisive Concepts" Laws And Americans Of Asian Descent, Ilhyung Lee Apr 2022

The "Divisive Concepts" Laws And Americans Of Asian Descent, Ilhyung Lee

SMU Law Review Forum

In the past year, a number of states have enacted laws that prohibit public schools from teaching certain lessons about race. The main target of these laws appears to be “critical race theory,” once a theory advanced in legal academia that has now become a “catchall term” for discussions of race and racism. The states mean business and seek to enforce their new or proposed laws by prohibiting state funding for teaching the banned content, withholding funding to local educational agencies or schools in violation, subjecting offending teachers to disciplinary action, and allowing those aggrieved to bring an action at …

The Ping-Pong Olympics Of Antisuit Injunction In Frand Litigation, King Fung Tsang, Jyh-An Lee Apr 2022

The Ping-Pong Olympics Of Antisuit Injunction In Frand Litigation, King Fung Tsang, Jyh-An Lee

Michigan Technology Law Review

In the past two years, antisuit injunctions (ASIs) and subsequent legal proceedings associated with standard-essential patents (SEPs) subject to fair, reasonable, and nondiscriminatory (FRAND) commitments have proliferated in multiple jurisdictions. This phenomenon reveals not only the transnational nature of technical standards and FRAND-encumbered SEPs but also the jurisdictional tension between different national courts. This Article explains the emergence of ASIs in FRAND scenarios and recent developments in six jurisdictions with major interests in standard development and adoption. Countries have developed different approaches to ASIs based on their own domestic rules and interests. We believe that to promote technical compatibility and …

The shell bound by the Karman line at a height of ~80–100 km above the Earth’s surface and geosynchronous orbit at ~36,000 km is defined as the orbital space surrounding the Earth. It is within this region, and especially in low Earth orbit, where environmental issues are becoming urgent because of the rapid growth of the anthropogenic space object population, including satellite ‘mega-constellations’. In this Perspective, we summarize the case for considering the orbital space around the Earth as an additional ecosystem, subject to the same care and concerns, and the same broad regulations as the oceans and the atmosphere, …
