The Indecisions Of 1789: Inconstant Originalism And Strategic Ambiguity, Jed H. Shugerman
The Indecisions Of 1789: Inconstant Originalism And Strategic Ambiguity, Jed H. Shugerman
Faculty Scholarship
The unitary executive theory relies on the First Congress and an ostensible “Decision of 1789” as an originalist basis for unconditional presidential removal power. In light of new evidence, the First Congress was undecided on any constitutional theory and retreated to ambiguity in order to compromise and move on to other urgent business.
Seila Law’s strict separation-of-powers argument depends on indefeasibility (i.e., Congress may not set limits or conditions on the president’s power of civil removal). In fact, few members of the First Congress defended or even discussed indefeasibility. Only nine of fifty-four participating representatives explicitly endorsed the presidentialist view …

This article presents the Brazilian Portuguese-Russian (BraPoRus) corpus, whose goal is to collect, analyze, and preserve for posterity the spoken heritage Russian still used today in Brazil by approximately 1,500 elderly bilingual heritage Russian–Brazilian Portuguese speakers. Their unique 100-year-old variety of moribund Russian is disappearing because it has not been passed to their descendants born in Brazil. During the COVID-19 pandemic, we remotely collected 170 h of speech samples in heritage Russian from 26 participants (Mage = 75.7 years) in naturalistic settings using Zoom or a phone call. To estimate the quality of collected data, we focus on two methodological …

If N. T. Wright Is Right, How Then Shall We Do Theology?, Howard A. Snyder
If N. T. Wright Is Right, How Then Shall We Do Theology?, Howard A. Snyder
The Asbury Journal
In November of 2022, theologian N.T. Wright gave a series of lectures for the Centennial Celebration of Asbury Theological Seminary. In this response from Asbury Theological Seminary’s Howard Snyder, the implications of Wright’s lectures are explored and expanded. In particular, Snyder explores the meaning of Scriptural Theology as opposed to Systematic Theology. He explores how Systematic Theology came to be the dominant way of reading scripture, and then proposes ten principles for doing theology rooted in scripture instead of any human system.

Psalm 1a–B (1:1–2:12 As Combined And A Chiasm): What Yhwh Knows About People’S Paths And Plans That Will Perish, W. Creighton Marlowe
The Asbury Journal
This article seeks to explore whether a division really exists between Psalm 1 and Psalm 2. The author argues that the presence of a chiasm which extends throughout the two psalms gives potential further evidence for the argument that the two psalms where once part of one continuous literary creation. The themes involve the laws of YHWH and the consequences of breaking these laws both for individuals and for nations.

Holiness missions is an area of mission history that is often understudied, yet it can provide insight into the growth of the Church in various parts of the world. This article examines the life of Sidney W. Edwards, a Holiness missionary who was a key part of H. C. Morrison’s missionary efforts. He served as the missionary of a mission H. C. Morrison founded in Cuba, as one of the first Holiness missions in the Caribbean. He then went on to serve in Puerto Rico with the Methodist Episcopal Church in planting churches in some of the mountainous regions of …
Dr. David Reese And The Three Errors Of Phrenology: Religion, Anatomy, And Moral Insanity, Philip Hardt
Dr. David Reese And The Three Errors Of Phrenology: Religion, Anatomy, And Moral Insanity, Philip Hardt
The Asbury Journal
Today, phrenology is a mostly-forgotten and thoroughly medically disgraced theory of human behavior. Yet, in its mid-nineteenth century heyday, it not only claimed to explain one’s personality based on the size of the bumps on one’s head but also (scarily) attempted to push prison reform in a less punitive direction. Somewhat surprisingly, as phrenology crossed the Atlantic in the 1820s, a number of doctors, professors, and ordinary citizens accepted and promoted its rather startling claims. At the same time, traditionalists response is exemplifies by Dr. David M. Reese, a highly regarded physician in Manhattan who opposed its attack on (mainly …
Dispositions For Christian Witness Among Theravada Buddhists, Stephen Bailey
Dispositions For Christian Witness Among Theravada Buddhists, Stephen Bailey
The Asbury Journal
This article reflects on communicating the Christian gospel appropriately and effectively among Southeast Asian Theravada Buddhists (SEATB). It is concerned with contextualizing the means of communication rather than theological concepts. Contextualization is often discussed with little reference to the level of contextualization, including: the content of the gospel, liturgical forms, social rules for relating, and dispositions shaped by Buddhist virtues used in communication. Examples are given of contextualization among SEATB, and then descriptions of how communicators of the gospel can use dispositions shaped by key Buddhist virtues. An argument is made that among SEATB, the means of communicating the gospel …

Exploring Professional Dispositions With Preservice Teachers Assignment Description, David Wolff
Open Educational Resources - Teaching and Learning
The dispositions needed to be an educator is vast. Some dispositions come naturally to teacher candidates and others are nurtured by teacher education programs. According to the National Council for Accreditation of Teacher Education (2008), professional dispositions expected of teacher candidates include “the ideal of fairness and the belief that all students can learn (p. 22). This assignment provides teacher candidates an opportunity to explore, analyze, and discuss various professional dispositions needed by educators using six examples of children’s literature, all of which by the author, Patricia Polacco.

Creating A Gifted-Friendly Classroom, David Wolff
Open Educational Resources - Teaching and Learning
The goal of undergraduate teacher preparation programs is to equip future teachers to work with all learners. Gifted and talented learners are likely found in every classroom regardless of where they reside. According to Rinn et al. (2022), Kansas, Missouri, Oklahoma, Colorado, and Nebraska do not require undergraduate teacher candidates to take university coursework on gifted education. The goal of this presentation is to provide a general overview of gifted education specific to Kansas. This presentation aims to address myths and misconceptions about gifted education and gifted learners, characteristics of gifted learners, a basic overview of a general identification process, …

Open Educational Resources - Teaching and Learning
The Journey “Box” allows preservice teachers to explore and share their own historical narrative as they different aspects of their own family’s journey to America. The Journey “Box” first asks preservice teachers to explore themes by reading children’s literature and then positions preservice teachers as interviewers as they seek out different facets of their family’s historical narrative from members of their family. Preservice teachers then use their experience with a Journey “Box” to design an inquiry that could be used in their field experience. The Journey “Box” integrates social studies standards and best practices with ELA standards.

The Bias Report: An Automated News Aggregator For Political Bias Classification And News Summarization, Anant Joshi
Master's Projects
Political polarization is on the rise in the US, driven in large part by divisive news that goes viral on the Internet. Specifically, many media outlets use slanted language and publish misinformation in order to drive user traffic and engagement. Almost 80% of US citizens get their news from online sources, but there is a lack of public safeguards against biased news. A large amount of news is published online every day by media organizations, and it is impossible to manually analyze this amount of data. There is a clear need for automated, public-facing solutions in the current political climate …

As the number of cancer diagnoses continues to increase and is expected to keep rising, it becomes imperative to explore avenues to optimize patient education. Research has consistently demonstrated that effective education plays a crucial role in improving patient outcomes. Through my previous experiences in various outpatient oncology infusion centers, I have observed significant variations in the methods employed for delivering patient education across different facilities. In this literature review, I explored the effects of standardized chemotherapy education and individualized chemotherapy education on patients in outpatient oncology clinics. The predominant themes across these studies encompass patient awareness of anticipated symptoms, …

Unlearning Hidden Bias Between Refugees : An Initial Empirical Investigation, Akshay Sunil Gurnaney
Master's Projects
The challenges that refugees in various regions encounter are common knowledge. One such challenge is a bias among refugees on ethnocentric grounds. In particular, there are various articles that have pointed out the struggles faced by Syrian refugees in countries like Europe as a result of implicit bias. In fact, the media coverage of Syrian crises and the government responses to the same shed negative light on the refugees themselves. On the contrary, the media coverage of Ukrainian crises is very different with lesser restrictions from the governments.
This research attempts to identify the extent of implicit bias between Ukrainian …

Ensemble Transformer Architecture For Efficient And Real Time Sign Language Translation, Sumeet Ghegade
Master's Projects
Sign language is a form of visual language that uses face expression and hand gestures to communicate thoughts and concepts. The term refers to multiple visual languages that share some common visual cues but differ in their grammar and syntax. Sign language translation (SLT) is a crucial step in closing the communication gap between hearing and hearingimpaired people. The study of SLT using machine learning has gotten a lot of interest during the last three years but despite progress, SLT research is still in its early phases. Most of the previous approaches first convert the signs to glosses and then …

Wirecard And Potential U.S. Audit Issues, Benoit Boyer, Danny A. Pannese, Paul N. Iannone
WCBT Faculty Publications
The German company Wirecard saga is yet to be fully written. Similar in scope to Enron and others in the early 2000’s, many lessons will be learned for company executives, regulators, and especially auditors worldwide. For U.S. companies and auditors, the PCAOB (Public Company Accounting Oversight Board) has promulgated comprehensive audit standards and procedures designed for public companies, but these standards also could have ancillary application to private companies for auditors when planning the audit engagement. The red flags and audit issues that manifested in the Wirecard events will provide the financial and academic communities with robust case studies as …

Autonomous Archaeological Authority: The Future Of Drone Use And Privacy Laws In Cultural Heritage Preservation, Kara Anderson
Autonomous Archaeological Authority: The Future Of Drone Use And Privacy Laws In Cultural Heritage Preservation, Kara Anderson
Journal of Air Law and Commerce
Since ancient times, humanity has placed high value on natural and cultural phenomena, with Philo of Byzantium recording the first list of the “Seven Wonders of the Ancient World” as early as 225 B.C.E. Similarly, modern world leaders continue to recognize the value of these and more sites through preserving them as United Nations Educational, Scientific, and Cultural Organization (UNESCO) World Heritage sites. With the advancement of drone technology, researchers now employ drones to aid preservation efforts since drones can enter dangerous and humanly-inaccessible spaces, provide detailed images of sites the human eye cannot see, and assist governments in identifying …
Meta-Analysis Of Factors Impacting Reading Impairment Rates In Studies Of Children With Developmental Language Disorder (Dld), Kayla Dewey
Theses and Dissertations
Purpose - Developmental language disorder (DLD) is a common yet underdiagnosed disorder centered on difficulties with oral language, and often associated with word reading and reading comprehension difficulties. Numerous studies have documented high rates of reading impairment in children with DLD, but the specific rates vary widely across studies. The purpose of this meta-analysis was to help provide accurate prognostic information about this disorder by determining the average proportion of participants with DLD who also had reading impairment, and to determine whether variability in the rate of reading impairment was significantly influenced by studies’ methodological features, including recruitment method, type …

Daily Activities And Routines: A Comparative Case Study Of The Home Language And Literacy Environment Of Spanish-Speaking Toddlers With And Without Older Siblings, Eugenia Crosby-Quinatoa
Theses and Dissertations
The purpose of this study was to identify malleable practices in the homes of Spanish-speaking toddlers prior to school enrollment. This was achieved by examining daily activities and routines and the role older siblings played in these interactions to obtain a more comprehensive understanding of the home language and literacy environment and practices. Additionally, this study aimed to explore, through the narratives and responses of mothers, the home experiences, beliefs, values, and goals associated with toddlers’ development, particularly early language and literacy. This study included four Spanish-speaking families with toddlers, two of which did not have an older sibling residing …

Secrecy And Transparency In Substantive Due Process Litigation, Dustin B. Benham
SMU Law Review
A few years before the recomposed Court rejected abortion rights in Dobbs, it sustained several healthcare providers’ challenge to Louisiana abortion restrictions in June Medical. History will remember that 5–4 decision mostly as one of the last major cases to interpret and apply the Casey framework.
But in the little-noticed background of the June Medical litigation, a significant dispute over sealed court records boiled over. On one side, plaintiff physicians sought anonymity and confidentiality in light of potential threats to their physical safety and patient privacy. On the other side, Louisiana asserted the public’s longstanding right to access court records …

State Constitutional Rights, State Courts, And The Future Of Substantive Due Process Protections, Jonathan L. Marshfield
SMU Law Review
By most accounts, the Supreme Court’s ruling in Dobbs v. Jackson Women’s Health Organization signaled a broader stagnation (and perhaps retrenchment) of federal substantive due process protections. As a result, there is now great interest in the role that state constitutions and courts might play in protecting and expanding reproductive and privacy rights. This Article aims to place this moment in state constitutional development in broader context. It makes two core claims in this regard. First, although state courts are free to interpret state constitutions as providing broader individual rights protections than those contained in the Federal Constitution, state constitutions …

From Liberation To (Re)Criminalization: Dobbs V. Jackson Women’S Health Organization, Bodily Autonomy, And The Expansion Of State Rights, Robin S. Maril
SMU Law Review
For more than a generation, the U.S. Supreme Court recognized the constitutionally protected right to an abortion, and, in turn, the dignity-affirming power of reproductive autonomy and its role in designing one’s own destiny. The Court’s endorsement of the liberatory value of bodily autonomy in Roe v. Wade, as later affirmed in Planned Parenthood of Southeastern Pennsylvania v. Casey, rejected attempts to justify restrictive prohibitions on abortion as valid exercises of state police powers. However, the Court’s 2022 decision in Dobbs v. Jackson Women’s Health Organization threatens to fundamentally redefine the boundaries between the rights of individuals and those of …
