Sovereign Immunity Tests Bankruptcy’S Least Contested Axioms, Deborah L. Thorne, Luke L. Sperduto Jan 2023

Sovereign Immunity Tests Bankruptcy’S Least Contested Axioms, Deborah L. Thorne, Luke L. Sperduto

Emory Bankruptcy Developments Journal

Section 106 of the Bankruptcy Code expressly abrogates the sovereign immunity of governmental units with respect to fifty-nine other provisions of the Code. There are currently two distinct issues splitting circuit courts over the meaning of this provision. First, does section 106 waive the sovereign immunity of the Internal Revenue Service in avoidance actions brought against it by a bankruptcy trustee under section 544(b)? Second, are Native American Indian Tribes “governmental units” within the meaning of section 101(27), such that their sovereign immunity is abrogated to the extent set forth in section 106? Invoking conventional canons of statutory construction, this …

Bound To A Mast: Matelotage And The Queer Contract In Shakespeare's Twelfth Night And The Tempest, Agnese Palumbo Jan 2023

Bound To A Mast: Matelotage And The Queer Contract In Shakespeare's Twelfth Night And The Tempest, Agnese Palumbo

Comparative Literature M.A. Essays

Analyzing the language of a 1699 matelotage contract and locating that same terminology in Shakespeare’s maritime plays, this essay argues that there is a thematic and genealogical link between the contractual forms of homosocial union that existed during the premodern and early modern periods and the bonds shared by male characters in those plays where a “sea change” occurs. First, the essay delineates a history of matelotage and of contractual bonds; then, it establishes this homosocial dynamic as an additional point of inquiry for male relationships in Shakespeare. Critical attention has largely overlooked this queer contract, and prioritized a focus …

Inhumanity Restored: Digital Play & Poetic Drama, Ali Emir Dağlar Jan 2023

Inhumanity Restored: Digital Play & Poetic Drama, Ali Emir Dağlar

Comparative Literature M.A. Essays

This essay addresses the relationship of digital games to absurdism through a comparison of the 2011 video game Dark Souls with Samuel Beckett’s absurdist play Waiting for Godot. Staked in this comparison is the rhetoric not only of Dark Souls but of the contemporary digital game as a medium; establishing an analogy that speaks to the broader genealogy of modern media, my argument implicates the underemphasized yet critically meaningful kinship of computer games and poetic theater. I argue that understanding the digital game vis-a-vis absurdism means explicating how the 20th century stage, particularly that of Beckett, prefigures contemporary digital worlds …

Colonial Translation Turned Vietnamization: Phạm Quỳnh And The Discourse Of Transculturation, Camellia Pham Jan 2023

Colonial Translation Turned Vietnamization: Phạm Quỳnh And The Discourse Of Transculturation, Camellia Pham

Comparative Literature M.A. Essays

Vietnam during French colonialism (1861-1945) was a site of hybrid enunciations that displayed tensions with multiple languages (Chinese, Vietnamese, French) and multiple scripts (classical Chinese, Nôm script, Quốc Ngữ, and French) while existing under the influence of various powers (the Nguyễn feudal dynasty, the French colonial government, and the nascent Democratic Republic of Vietnam). The array of choices reflected a state of confusion in which every decision made by Vietnamese translators was inherently political. This eccentric hybridity is well exemplified in translations by Phạm Quỳnh 范瓊 (1892-1945), a late Nguyễn dynasty monarchist and early French colonial collaborator.

Intercontinental Comparisons Of Subterranean Host-Parasite Communities Using Bipartite Network Analyses, Altangerel Tsogtsaikhan Dursahinhan, Sebastian Botero-Cañola, Scott L. Gardner

Scott L. Gardner Publications

Rodents living in a subterranean ecotope face a unique combination of evolutionary and ecological pressures and while host species evolution may be driven by the selective pressure from the parasites they harbour, the parasites may be responding to the selective pressures of the host. Here we obtained all available subterranean rodent host-parasite records from the literature and integrated these data by utilizing a bipartite network analysis to determine multiple critical parameters to quantify and measure the structure and interactions of the organisms present in host-parasite communities. A total of 163 species of subterranean rodent hosts, 174 parasite species, and 282 …

Osc-Co2: Coattention And Cosegmentation Framework For Plant State Change With Multiple Features, Rubi Quiñones, Ashok Samal, Sruti Das Choudhury, Francisco Muñoz-Arriola

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Cosegmentation and coattention are extensions of traditional segmentation methods aimed at detecting a common object (or objects) in a group of images. Current cosegmentation and coattention methods are ineffective for objects, such as plants, that change their morphological state while being captured in different modalities and views. The Object State Change using Coattention-Cosegmentation (OSC-CO2) is an end-to-end unsupervised deep-learning framework that enhances traditional segmentation techniques, processing, analyzing, selecting, and combining suitable segmentation results that may contain most of our target object’s pixels, and then displaying a final segmented image. The framework leverages coattention-based convolutional neural networks (CNNs) and …

Pathways Of Density Dependence And Natural Selection In Modern Humans, John Delong Jan 2023

Pathways Of Density Dependence And Natural Selection In Modern Humans, John Delong

School of Biological Sciences: Faculty Publications

Living things depend on a flow of energy and materials to grow, reproduce, and maintain their bodies. Populations are aggregations of individuals, so they too depend on resources. Humans use many fuels derived from the Earth’s photosynthetic energy, which in turn support a population that often occurs at unusually high densities for a mammal. Like most populations, growing human populations may experience negative feedbacks from population size unless the socio-economic system in which the population lives grows fast enough to maintain resource flows to individuals and to limit the downsides of high density. I map out a simple view of …
