Corn War: A Trade Fight Between The United States And Mexico, Ernesto Hernández-López Jan 2024

Corn War: A Trade Fight Between The United States And Mexico, Ernesto Hernández-López

Cardozo Law Review de•novo

An international fight grows over corn. The United States claims that México’s ban on genetically modified (GMO) corn violates the United StatesMexico-Canada Agreement (USMCA). México prohibits GMO corn for human consumption. American arguments focus on Sanitary and Phytosanitary (SPS) measures, covered in Chapter 9 of the USMCA. A trade panel will review these.

This Essay first describes SPS arguments and relevant trade rules. The United States’ complaints emphasize that México’s ban is excessive, is not consistent with international standards, and mishandles risks. Second, the Essay identifies the obstacles American positions face: weak mandates and deference to México. Chapter 9 of …

Expanding Homicide Liability For A Parent’S Omission, Monu Bedi Jan 2024

Expanding Homicide Liability For A Parent’S Omission, Monu Bedi

Cardozo Law Review de•novo

Earlier this year, Jennifer and James Crumbley were convicted of manslaughter and sentenced to 10-15 years for not stopping their teenage son, Ethan, from killing four students at his high school. This is the first known occurrence of an American prosecutor obtaining a homicide conviction relying on a parental omission—or failure to act—where the victim was not the parent’s own child. Parental omissions historically have only triggered homicide charges if the parent fails to protect their child, not others, from harm. Unlike the general population, parents owe a special duty to their child because they are the ones tasked to …

Blackened Faces: Unearthing The Political Shift Behind Illinois' Response To Racialized Labor Violence During The Virden Affair And Coal Wars Of 1898-1899, Jonathan C. Yegge Jan 2024

Blackened Faces: Unearthing The Political Shift Behind Illinois' Response To Racialized Labor Violence During The Virden Affair And Coal Wars Of 1898-1899, Jonathan C. Yegge

Graduate Thesis and Dissertation post-2024

This thesis investigates the relationship between politics, law, race, mobility, and violence in 1890s Illinois to highlight the socio-political causes of a temporary pro-labor shift in Republican policy. It centers on Illinois Governor John R. Tanner’s atypical response to racialized labor violence during the Virden Affair and the broader Coal Wars of 1898-1899. This research builds on socio-economic and cultural studies of the labor movement and Black strikebreaking. It introduces state politics and law, two essential lenses of analysis which the historiography has largely neglected in favor of economics and bottom-up history. In lieu of the typical pro-labor accounts of …

The End Of Consent: Data And The Corporate-Consumer Relationship, Faisal Hijjawi Jan 2024

The End Of Consent: Data And The Corporate-Consumer Relationship, Faisal Hijjawi

LL.M. Essays & Theses

Consumer data is largely regulated through the notice-and-choice approach in the United States, which relies on consumer consent. The notice-and-choice approach is rooted in the control theory of information privacy. This paper will argue that the control theory is limited due to its reliance on property law, its breadth, as well as it reinforcing the ‘no privacy in public’ concept. Further, the notice-and-choice approach relies on consent being both free and informed. However, consent cannot be considered free due to the lack of choice and the manipulation exerted on the consumer. Also, consent is not informed as the consumer lacks …

Fair Use V. Free Use: A Comparative Study Of American And Russian Copyright Exemptions, Eduard Bershitskiy Jan 2024

Fair Use V. Free Use: A Comparative Study Of American And Russian Copyright Exemptions, Eduard Bershitskiy

LL.M. Essays & Theses

Many U.S. lawyers are under the well-deserved, but still not entirely accurate, impression that copyright infringement in Russia is a huge free-for-all. This comparative paper, which juxtaposes Russian and American copyright exemptions, seeks to partially refute that skeptic view by showing that, in fact, Russian copyright law has developed a relatively coherent system of exceptions and limitations to exclusive rights. This paper begins with a brief overview of Russian copyright law and general remarks on its exemptions. It then focuses on statutory and, where appropriate, case-law comparison of particular copyright exemptions in the Part 4 of the Russian Civil Code …

Can Community Festivals Make Urban Places More Hospitable?, Bernadette Quinn Jan 2024

Can Community Festivals Make Urban Places More Hospitable?, Bernadette Quinn

Articles

Cultivating places and spaces to encourage sociality and foster sociocultural inclusion is a very pertinent societal challenge. Community festivals are often marshalled in the interest of making cities more hospitable for the increasing numbers of migrants, refugees, remote workers and tourists internationally on the move. This study investigates if and how community festivals are constructing hospitality through their practices. The findings are drawn from a qualitative study of two community festivals in Dublin's North East Inner City, an ethnically diverse area characterized by social disadvantage. They suggest that community festivals can make places more hospitable. However, the approaches taken to …

Social Problem-Solving, Stress, Social Support As Predictors Of Distress Among First-Generation Students, Marisa Leib Jan 2024

Social Problem-Solving, Stress, Social Support As Predictors Of Distress Among First-Generation Students, Marisa Leib

PCOM Psychology Dissertations

First-generation students are steadily increasing in the United States, and currently comprise one third of today’s college undergraduate population (Stebleton & Jehangir, 2020). First-generation students are more likely to face various academic, social, economic, and cultural challenges when transitioning to higher education. The culmination of these stressors put first-generation students at risk for developing mental health conditions. Social problem-solving (SPS) is one variable that has been shown to buffer against the negative effects of stress among the general college student population. The purpose of the current study was to examine how specific variables contribute to psychological distress among the population …

Journal Articles: Epidemiology

INTRODUCTION: Health systems including mental health (MH) systems are resilient if they protect human life and produce better health outcomes for all during disease outbreaks or epidemics like Ebola disease and their aftermaths. We explored the resilience of MH services amidst Ebola disease outbreaks in Africa; specifically, to (i) describe the pre-, during-, and post-Ebola disease outbreak MH systems in African countries that have experienced Ebola disease outbreaks, (ii) determine the prevalence of three high burden MH disorders and how those prevalences interact with Ebola disease outbreaks, and, (iii) describe the resilience of MH systems in the context of these …

Combining The Concrete Representational Abstract Framework And Video Modeling To Increase Basic Addition Skills Among First Grade Students, Sara Ebner Jan 2024

Combining The Concrete Representational Abstract Framework And Video Modeling To Increase Basic Addition Skills Among First Grade Students, Sara Ebner

Theses and Dissertations--Educational, School, and Counseling Psychology

Proficiency in mathematics is fundamental for academic success and is linked to numerous skills that are essential for success in the real-world. Despite its importance, many students struggle with math, leading to nationwide declines in math proficiency. This decline highlights the need for effective interventions that are accessible, able to be individualized, and feasible for implementation across settings. In the present study, a single case multiple probe across participants design was used to assess the efficacy of a concrete-representational-abstract (CRA) framework with video modeling intervention on the basic addition problem-solving accuracy of three first-grade students. Results show that participants’ accuracy …

Self-Defense And Political Rage, Erin L. Sheley Jan 2024

Self-Defense And Political Rage, Erin L. Sheley

Faculty Scholarship

This Article considers how American political polarization and the substantive issues driving it raise unique challenges for adjudicating self-defense claims in contexts of political protest. We live in an age where roughly a quarter of the population believes it is at least sometimes justifiable to use violence in defense of political positions, making political partisans somewhat more likely to pose a genuine threat of bodily harm to opponents. Furthermore, the psychological literature shows that people are more likely to perceive threats from people with whom they politically disagree and that juries tend to evaluate reasonableness claims according to their own …

Teaching Children Consent Skills Through The Lens Of Personal Boundaries And Bodily Autonomy, Prerana Atreya Jan 2024

Teaching Children Consent Skills Through The Lens Of Personal Boundaries And Bodily Autonomy, Prerana Atreya

University of the Pacific Theses and Dissertations

Sexual violence is a public health and safety problem affecting many children across the United States. One preventative tool the public health department uses to mitigate the high prevalence rates and harm of sexual violence is teaching consent skills to children. Previous research has demonstrated that behavior analytic principles effectively teach other important safety skills (e.g., abduction prevention, gun safety, and poison safety). Thus, it is possible that using behavioral technologies to teach consent skills will show similar effectiveness as teaching safety skills. The current study’s purpose was to evaluate the effectiveness of using behavioral skills training (BST), video modeling, …

Utilizing Internet Memes In Senior High School Biology To Improve Gen Z’S Academic Achievement, Attitude, And Self-Efficacy, Alyanna Nicole Carlos, Emmanuel D. Delocado

Biology Faculty Publications

Generation Z learners’ short attention span challenges educators to design engaging teaching methods that capture their interest. This quantitative study investigates the effect of memes, which are popular internet media, on non-STEM Gen Z high school students’ academic achievement, attitude, and self-efficacy in biology. Two groups of Grade 11 participants (n=243) were taught cellular division and genetics lessons through two different approaches. The results demonstrate that the experimental group which was taught using meme-infused materials had statistically significantly higher post-test scores (21.46 ± 4.41 out of 30; independent t-test = 0.00) than students who were taught with materials with no …

A Prototype Of A Conversational Virtual University Support Agent Powered By A Large Language Model That Addresses Inquiries About Policies In The Student Handbook, Joseph Benjamin R. Ilagan, Jose Ramon Ilagan

Quantitative Methods and Information Technology Faculty Publications

Universities gain a competitive advantage by deliberately improving overall service, student, faculty, and staff experience, leading to attractiveness, retention, and improved outcomes. Quality services are achieved partly by addressing employee satisfaction, specifically in the work environment. This paper presents a prototype study of a virtual university support agent, a system grounded in a Large Language Model (LLM) engineered to address inquiries from university students, faculty and staff related to the student handbook. The study investigates the integration of generative artificial intelligence and natural conversation properties inherent in LLMs to overcome customer service shortcomings identified in previous chatbot applications. The LLMs' …

Synthesis And Bioevaluation Of Piperazine-Based Compounds As Anti-Cancer Agents In Pancreatic Cancer, Holly E. Moots

Graduate Thesis and Dissertation 2023-2024

Pancreatic cancer is the sixth leading cause of cancer-related death and new therapies are needed. In this investigation two piperazine-based compound classes were discovered with anticancer activity against human pancreatic cancer cells. The use of piperazine moieties in medicinal chemistry has garnered increased interest because FDA-approved anticancer piperazine derivatives (i.e. Imatinib) have demonstrated significant impact in cancer treatment.

The first half of this study describes the discovery of a class of piperazine-based compounds that function as far upstream binding protein 1 (FUBP1) inhibitors. FUBP1 is a single-stranded DNA/RNA binding protein that functions as a master regulator of various genes, including …

A Chat Analysis Of The Use Of Educational Video Games To Teach Physical Science To Middle School Girls, Stephen G. Petit

Graduate Thesis and Dissertation 2023-2024

As students transition into middle school science courses, their interest and engagement in the subject declines. This decline is most significant among girls, particularly for topics in physical science. While several factors have been identified that contribute to the decline, one area that is emerging as a new way to help improve girls' view of science is the use of educational video games to improve engagement and interest in science content, particularly as video games have been steadily rising in popularity with girls. This study used Cultural Historical Activity Theory to understand how middle school girls engage with an educational …

Nonprofit Compliance: Perceptions Of Small Nonprofit Leaders To Be Compliant, Andrea C. Ortega Jan 2024

Nonprofit Compliance: Perceptions Of Small Nonprofit Leaders To Be Compliant, Andrea C. Ortega

Graduate Thesis and Dissertation 2023-2024

Small nonprofit organizations (NPOs) are at higher risk of having their IRS tax-exempt status revoked due to a lack of funding, governance, and structure. Organizations that fail to file an annual information return or notice for three consecutive years automatically lose their tax-exempt status by revocation. In May 2020, the IRS revoked the status of more than 30,000 NPOs for failing to file tax returns. This research contributes to the very limited number of qualitative studies on nonprofit leaders' knowledge of federal compliance, which is unknown and may contribute to small nonprofits losing their IRS-exempt status. This qualitative study examines …

Predicting Post-School Outcomes Of Transition Aged Students With High Incidence Disabilities, Jacob Brewer Jan 2024

Predicting Post-School Outcomes Of Transition Aged Students With High Incidence Disabilities, Jacob Brewer

Graduate Thesis and Dissertation post-2024

This dissertation explores predictive modeling to forecast post-school outcomes for transition-aged students with high-incidence disabilities, such as Specific Learning Disabilities (SLD) and Other Health Impairments (OHI). Transitioning from secondary to post-secondary environments is critical for students with disabilities, significantly impacting their independence, self-confidence, and employability (Morningstar et al., 2017; Carter et al., 2021). Through a mixed-methods approach, this study integrates Office of Special Education Programs (OSEP) indicators to determine which factors most effectively predict post-secondary enrollment and graduation. Key variables such as parental involvement, socio-economic status (SES), and self-determination skills are analyzed using logistic regression and machine learning techniques, including …

A Comparison Of Combined Scoring And Standard Setting Approaches Applied To An Interim Assessment In Predicting Statewide Assessment Performance, Michelle Paul

Graduate Thesis and Dissertation post-2024

The validity of score interpretation and application for specific purposes is dependent upon both the appropriate assignment of test scores and the methods through which those scores are given meaning by defining performance benchmarks. This study seeks to examine the combined utility of various scoring (i.e., number correct, two-parameter logistic, and nominal response model) and standard setting methods in accurately predicting performance on an external assessment. The study will highlight the implementation of the embedded standard setting method, a newer standard setting procedure that is not yet well represented in the literature. Embedded standard setting will be compared to a …
