Language, Hip Hop, And Identity Work On Youtube, Matt Garley, Cecelia Cutler Jan 2024

Language, Hip Hop, And Identity Work On Youtube, Matt Garley, Cecelia Cutler

Publications and Research

As hip hop has evolved into the dominant form of global popular music, YouTube has become a locus of fan-artist interaction. This chapter examines how hip hop artists and fans produce their identities and engage with hip hop culture on YouTube. This identity work centers around establishing credibility, glocal and ethnic positioning, and signaling stances of resistance and simultaneous alignment with ultralocal and global hip hop personae. Building on a background of research about language and identity in hip hop, particularly in the Internet sphere, the chapter summarizes the state of the art and then highlights the authors’ own explorations …

In the latest portable electronic devices, 5th generation double data rate small outline dual in-line memory modules (DDR5 SODIMMs) are more and more used and have been identified as one of the critical electromagnetic interferences (EMI) noise sources that could cause RF desensitization. In this paper, the radiation mechanism of DDR5 SODIMM deployed in a laptop is identified and investigated based on near-field scanning. It was found that a cavity formed by the SODIMM and the main board can generate strong radiation around 2.4 GHz due to their dimensions, which overlap with the Wi-Fi band. To quantify the radiation from …

The Neurological Consequences of Combat Blast-Induced Neurotrauma (BINT) Pose Important Clinical Concerns for Military Service Members and Veterans. Previous Studies Have Shown that Low-Intensity Blast (LIB) Results in BINT with Multifaceted Characteristics in Mice Exposed to Open-Field Blast in Prone Position. Although the Prone Position is Natural for Rodents, Experimental Models of Blast using This Position Do Not Represent Common Scenarios of Human Standing While Being Exposed to Blast during Deployment or Military Training. in This Study, We Used Our Previously Developed BINT Mouse Model of Open-Field LIB with Mice in an Upright Position and Then Used Quantitative Proteomics and …

Wrongful Convictions, Wrongful Prosecutions And Wrongful Detentions In India, Kent Roach Jan 2024

Wrongful Convictions, Wrongful Prosecutions And Wrongful Detentions In India, Kent Roach

National Law School of India Review

The first part of this article examines wrongful convictions in India. In part because of the absence of a jury, appellate courts, including the apex court, are more willing to evaluate whether the evidence for a conviction is sufficient than appellate courts in other common law systems. From 2016 to 2022, the High Courts and the Supreme Court have acquitted over two hundred accused in death penalty cases alone. The willingness of appellate courts to acquit is a strength of the Indian system that should be maintained. At the same time, remedied wrongful convictions in India likely represent only the …

An Empirical Assessment Of The Indian Supreme Court’S Use Of Law Review Articles (1950-2020), Varun Garg, Apurva Singhi

National Law School of India Review

The Indian Supreme Court is considered one of the most powerful courts in the world. At a little over 70 years old, the Court has achieved a strong reputation as being one of the most activist courts in the world. At the same time, academic writing, especially law reviews, has exponentially grown in India and established its impact on the law. A question that has emerged is whether academic writing is losing touch with the practice of law. Some commentators have attributed the apparent decline in the courts’ use of legal scholarship to the increasingly theoretical and impractical nature of …

From Idea To Act: The Indian Legislative Process, Vasudev Devadasan, Sunil Nandraj, Vineet Chawdhry, Kamala Ram Mohan

National Law School of India Review

Beyond the formal steps prescribed by the Constitution and Parliamentary manuals, little is known about the law-making process in India. Without a baseline consensus on what legislating in India involves, future analyses and proposed reforms of Indian legislative processes may be rendered speculative. Opaqueness surrounding the legislative process also hinders the ability of citizens to meaningfully influence the laws that govern them. This article aims to provide an account of how legislation is conceived, drafted, and enacted in India using the case studies of the Clinical Establishments Act, 2010 and the Kerala Clinical Establishments Act, 2018. Beginning with these two …

The Trials Of Bail: Pre-Trial Presumption Of Innocence Under The Unlawful Activities (Prevention) Act, 1967 And General Criminal Laws, Radhika Chitkara Jan 2024

The Trials Of Bail: Pre-Trial Presumption Of Innocence Under The Unlawful Activities (Prevention) Act, 1967 And General Criminal Laws, Radhika Chitkara

National Law School of India Review

The crisis of undertrial prisoners in India, constituting three-fourths of the total prison population, has occasioned a normative recognition of the relationship between bail and the presumption of innocence (‘PoI’). The same recognition, however, does not extend to special criminal laws such as the UAPA, where almost every single prisoner is an undertrial on account of provisions prohibiting grant of bail. With a focus either on outcomes (prison population) or exceptions (national security considerations), the jurisprudential relationship between bail and PoI per se remains underexplored under both the general and special criminal legal regimes. At issue is the ‘thin’ conception …

How To Build The Tower Of Babel: The Kannada Language Comprehensive Development Act, 2022 And ‘Language Law’ In India, Aditya Prasanna Bhattacharya, Ritwika Sharma

National Law School of India Review

This paper serves as a critical analysis of the Kannada Language Comprehensive Development Act, 2022 and also as the identification of a novel field within constitutional law - ‘language law’. In so doing, a detailed overview of the history of the law and politics surrounding language in India has been provided. The Kannada Act has also been compared to other state-level language legislations - providing a detailed description of the state of play of language law in India. The paper concludes that although the Kannada Act may appear similar to other such legislations, it seeks to impose and not develop …

“Spread Your Wings And Fly Away” – Reimagining Customary International Law Jurisdiction In Investor- State Disputes, Harshad Pathak Jan 2024

“Spread Your Wings And Fly Away” – Reimagining Customary International Law Jurisdiction In Investor- State Disputes, Harshad Pathak

National Law School of India Review

A common assumption in investor-state dispute settlement (ISDS) is that subject to the language of the arbitral provision invoked, an arbitration tribunal can only decide claims that allege a breach of the substantive obligations articulated in the instrument from which it derives jurisdiction. Over time, this assumption has come under challenge, including in cases where an ISDS tribunal derives jurisdiction from a municipal law source, such as an investment contract or legislation. The article addresses this issue by critiquing the Decision on Jurisdiction in Cambodia Power Company v. Cambodia, wherein an ICSID tribunal constituted pursuant to related investment contracts concluded …

Theorising Extraterritorial Jurisdiction: The Travails Of Twail, Muthucumaraswamy Sornarajah Jan 2024

Theorising Extraterritorial Jurisdiction: The Travails Of Twail, Muthucumaraswamy Sornarajah

National Law School of India Review

Discussion of extraterritoriality focussing on capitulation theories looks backwards at an historical period. The present need is to study extraterritoriality used by hegemonic states both in an oppressive manner to advance their national interests and in a manner that protects common interests. As hegemonic power of the United States recedes, new actors like China and India will come to use extraterritoriality largely in an offensive manner. Preoccupation with the past is inapposite in a field in which the rapid developments are taking place. A theory must be found that permits defensive extraterritoriality that promotes community interests while curbing the offensive …

A New Research Programme For International Relations And International Law: Jurisdiction, Capitalism, And Imperialist Infrastructures, Maïa Pal Jan 2024

A New Research Programme For International Relations And International Law: Jurisdiction, Capitalism, And Imperialist Infrastructures, Maïa Pal

National Law School of India Review

This article argues that Chimni’s proposed framework for historically and theoretically reconceptualising jurisdiction in ‘The international law of jurisdiction: A TWAIL perspective’ has important implications for a much-needed renewed encounter between the disciplines of International Law and International Relations. It begins by summarising the contribution of Chimni’s article in terms of its two historical and theoretical contributions. It then focuses on the theoretical reconceptualization of jurisdiction as structurally interdependent with capitalism and sovereignty, rather than territory and sovereignty as found in mainstream and liberal approaches. Moreover, Chimni’s article fills gaps in critical approaches by thinking of jurisdiction in more material …

Extra-Territoriality And Solidarity, Vasuki Nesiah Jan 2024

Extra-Territoriality And Solidarity, Vasuki Nesiah

National Law School of India Review

Bhupinder Chimni calls for a subaltern internationalism that stands in contrast to and challenges extraterritorial jurisdiction by imperial and capitalist forces. We have a productive instantiation of subaltern internationalism in the jurisprudence on jus standi at the International Court of Justice.1 A sovereign that is not the injured party may still legitimately represent injured peoples if the representation is grounded in a commitment to those peoples’ self- determination; the court’s admissibility jurisprudence has come to recognize this commitment as a legitimate erga omnes partes claim. Its most recent and spectacular expression was South Africa’s representation of Palestinians with a genocide …

Colonies And International Labour Organization: A Subaltern Outlook, Aathira Raju Jan 2024

Colonies And International Labour Organization: A Subaltern Outlook, Aathira Raju

National Law School of India Review

This paper put forward a subaltern perspective to outline the conditions of colonial labour during the interwar era. It is argued that despite the efforts of postcolonial international legal scholars to make the subaltern class visible, the latter’s voice remained scanty. One of the reasons is the paradox of international law. As noted by Chimni, “It is an instrument of subjugation and of liberation, of exploitation and possible emancipation”. This dichotomy can be witnessed in the transactions of international institutions, notably the International Labour Organization (‘ILO’). On the one hand, the ILO was regarded as the pacesetter for labour interests; …

Third World Statehood Before The ‘Third World’: Imperialism, Sovereignty, And The Making Of Latin America, Eric Loefflad Jan 2024

Third World Statehood Before The ‘Third World’: Imperialism, Sovereignty, And The Making Of Latin America, Eric Loefflad

National Law School of India Review

Engaging BS Chimni’s claim that the genealogies of colonial capitalism are vital to uncovering the substantive realities that animate formalistic conceptions of jurisdiction, I argue that the independence of Latin America forms an important, yet under- theorised, site for articulating these genealogies. This is especially significant given the general lack of materialist analysis of this history in both Latin American International Law (LAIL) and Third World Approaches to International Law (TWAIL’). Filling this lacuna, I argue that while Latin American polities emerged as bounded territorial states, their recognition as such must be understood in relation to how Europe and the …

Variation-Aware Non-Linear Mapping For Honey-Memristor Based Neuromorphic System, Harshvardhan Uppaluru, Md Mehedi Hasan Tanim, Md Omar Faruque, Mohammed Rafeeq Khan, Zoe Templin, Feng Zhao, Jinhui Wang

Electrical and Computer Engineering Faculty Research & Creative Works

Natural organic memristors are promising synapse candidates for neuromorphic systems due to their significant benefits, such as environmental sustainability, low production and disposal cost, non-volatile storage capability, and bio/CMOS-compatibility. In this paper, experimental evaluations of a neuromorphic system based on honey-memristors are reported. First, honey-memristors are manufactured and tested based on our in-house technology, and then the non-linear characteristics inherent to honey-memristors, which causes inaccurate weight updates and reduces the inference accuracy, are explored. A non-linear mapping (NMP) method is applied to mitigate the effects of non-linearity in honey-memristor, under different scenarios including multiple cycle-to-cycle variations and Analog-to-Digital Converter (ADC) …

Prohibiting More Subsidies: The Trilateral Statement Vis- À-Vis The Scm Agreement, Manya Gupta, Uravi Pania Jan 2024

Prohibiting More Subsidies: The Trilateral Statement Vis- À-Vis The Scm Agreement, Manya Gupta, Uravi Pania

National Law School of India Review

This article critically examines the 2020 Joint Trilateral Statement by the US, EU, and Japan proposing additions to the list of prohibited subsidies under the WTO’s Agreement on Subsidies and Countervailing Measures (SCM Agreement). It argues that the proposal to include unlimited guarantees, subsidies to insolvent enterprises, subsidies in sectors with overcapacity, and certain debt forgiveness as prohibited subsidies is problematic for several reasons. First, there is a lack of economic rationale and evidence for blanket prohibition of these subsidies. Second, the language used in defining the proposed subsidies is vague and uncertain, leading to potential misinterpretation and implementation challenges. …

Molecular imaging has undergone significant development in recent years for its excellent ability to image and quantify biologic processes at cellular and molecular levels. Its application is of significance in cardiovascular diseases, particularly in diagnosing them at early stages. Atherosclerosis is a complex, chronic, and progressive disease that can lead to serious consequences such as heart strokes or infarctions. Attempts have been made to detect atherosclerosis with molecular imaging modalities. Not only do imaging modalities develop rapidly, but research of relevant nanomaterials as imaging probes has also been increasingly studied in recent years. This review focuses on the latest developments …

Magnetic Separation Of Lunar Regolith Simulants With Applications To In Situ Resource Utilization On The Moon, Peter Bachle, Jeffrey Smith, Fateme Rezaei, David Bayless, William Schonberg, Daoru Han Jan 2024

Magnetic Separation Of Lunar Regolith Simulants With Applications To In Situ Resource Utilization On The Moon, Peter Bachle, Jeffrey Smith, Fateme Rezaei, David Bayless, William Schonberg, Daoru Han

Chemical and Biochemical Engineering Faculty Research & Creative Works

The development of in situ resource utilization (ISRU) for metal extraction is imperative as a steppingstone for habitation construction in lunar and non-terrestrial environments. Separation of minerals by chemical composition is important to optimize metal and oxygen liberation from lunar ore. To this effect, devices capable of separating aluminum bearing minerals from iron-bearing minerals from the lunar regolith simulants have been developed. Twenty-eight different simulants have been used in this study. A dual-belt separator was designed to reduce middling. Para-magnetic minerals were reliably separated using a neodymium N52-magnet-separator system. Effective separation of aluminum-bearing minerals from iron-bearing minerals was greater than …

The Uber Conundrum: Analysing The Worker Rights Of Uber Drivers In India, Shantanu Braj Choubey Jan 2024

The Uber Conundrum: Analysing The Worker Rights Of Uber Drivers In India, Shantanu Braj Choubey

National Law School Journal

This article analyses the impact of the proposed labour codes and the UK Supreme Court judgement in Uber BV vs Aslam to assess the legal status of Uber drivers under Indian labour laws. Uber is one of the biggest cab aggregators in India, both in terms of revenue and the number of drivers associated with it. However, the labour rights of such drivers still fall in the shadows. This has led to several instances of dispute between the drivers, governments and the company. While the law concerning the legal status of drivers with respect to Uber is increasingly being settled …

Gender In The Making Of The Constitution: Proposals For A Feminist Inquiry Into Indian Constitutional History, Achyut Chetan

National Law School Journal

A feminist inquiry into the framing of the Indian Constitution must retrieve and see the interventions of the women members of the Constituent Assembly for what they historically represent, namely, a feminist authorial voice that was developed over a period of time by the pre-Independence women’s movement in India. For a proper understanding of this voice, we must understand the gendered character of the Constituent Assembly, its architecture, its procedures, the dynamics of the gendered relations among its members, and above all, the performative aspects of the debates. This inquiry must also investigate the language employed by the members and …
