Rethinking Commercial Law’S Uncertain Boundaries, Steven L. Schwarcz Jan 2024

Rethinking Commercial Law’S Uncertain Boundaries, Steven L. Schwarcz

Faculty Scholarship

Although it is an essential part of business law, commercial law has uncertain boundaries. That uncertainty creates significant legal ambiguities and inconsistencies, confusing lawyers and courts and causing misinterpretations that disrupt commerce and reduce efficiency. This Article hypothesizes and tests possible explanations for the uncertainty, including that commercial law’s development has been path dependent, ad hoc, and lacking well-defined normative purposes. The Article then analyzes what those boundaries should be, arguing that commercial law should cover all business-related transfers of property, subject to exceptions needed to reduce transaction costs and otherwise increase economic efficiency. The Article also compares its proposed …

Correlation Of Social Media Use And Symptoms Of Anxiety And Depression Among College Students, Christy Burns, Dylan Gunter, Jasmine Ivy, April Johnson, Ramona Turner Jan 2024

Correlation Of Social Media Use And Symptoms Of Anxiety And Depression Among College Students, Christy Burns, Dylan Gunter, Jasmine Ivy, April Johnson, Ramona Turner

MSN Research Projects

There is a new epidemic on the rise affecting college students. Social media use in college students is correlated to increased symptoms of anxiety and depression (Lippold, 2020). Studies show that prolonged symptoms of anxiety and depression can lead to hopelessness, which may make adolescents more prone to committing suicide (Tartakovsky, 2022). The Center of Disease Control and Prevention (CDC) reports that the second leading cause of death in young adults is suicide (Centers for Disease Control and Prevention, 2023). Therefore, the present study was conducted through a quantitative correlational research design using a survey to evaluate social media use …

Who Do I Want To Be Now That I’M Here? Refugee Entrepreneurs, Identity, And Acculturation, Lisa Jones Christensen, Arielle Newman Jan 2024

Who Do I Want To Be Now That I’M Here? Refugee Entrepreneurs, Identity, And Acculturation, Lisa Jones Christensen, Arielle Newman

Faculty Publications

This article focuses on a subset of refugees who engage in entrepreneurship shortly after relocating to a new host community; it explores identity-related antecedents and integration consequences of different entrepreneurship strategies in the new location. It draws from acculturation psychology and founder identity theory to argue that, post-arrival, new refugees consider (a) how to prioritize the identity associated with their former life and (b) the degree of connection they desire in the host community. For some, these preferences drive heterogeneous entrepreneurial behaviors associated with different acculturation outcomes—including marginalization, separation, integration, and assimilation. Specifically, we describe two refugee entrepreneur identity management …

The Role Of Trauma-Informed Care In Sustaining The Well-Being Of Refugee Entrepreneurs, Arielle Badger Newman, Lisa Jones Christensen Jan 2024

The Role Of Trauma-Informed Care In Sustaining The Well-Being Of Refugee Entrepreneurs, Arielle Badger Newman, Lisa Jones Christensen

Faculty Publications

Many international aid organisations encourage refugees to engage in entrepreneurship after relocation to a new host country. Yet, this encouragement may be based on data about entrepreneurship from non-refugee populations, particularly those who do not experience the common traumas of forced relocation. This chapter addresses the topic of trauma and refugee entrepreneurship by asking the following question: How can support organisations encourage well-being (or mitigate ill-being) for entrepreneurial refugees? In doing so, we propose how organisations supporting refugee entrepreneurship can incorporate trauma-informed practices. Specifically, there are four “Rs” to being trauma-informed, which correspond to: realisation, recognition, response, and resistance to …

Translation Of: Trembley À Réaumur, Abraham Trembley, Morgan Mclaughlin Jan 2024

Translation Of: Trembley À Réaumur, Abraham Trembley, Morgan Mclaughlin

Biology: Student Scholarship & Creative Works

While examining a jar filled with aquatic plants and animals, Abraham Trembley, a young tutor working for Count William Bentinck in the Netherlands, noticed tiny, green, tube-shaped organisms attached to aquatic plants. Uncertain whether they were plants or animals, he devised a brilliant series of experiments to understand their biology. He observed them contract when disturbed and take steps towards a light, gathering in front of a chevron-shaped opening in a piece of cardboard. Nearly convinced they were animals, he cut one in half expecting to see it die. Instead, it regenerated two perfectly formed bodies from the severed halves. …

Coleoptera Of Brazil: What We Knew Then And What We Know Now. Insights From The Catálogo Taxonômico Da Fauna Do Brasil, Edilson Caron, Marcela L. Monné, Geoffrey Morse, Et Al.

Biology: Faculty Scholarship

In 2000, Cleide Costa published a paper presenting the state of knowledge of the Neotropical Coleopte ra, with a focus on the Brazilian fauna. Twenty-four years later, thanks to the development of the Coleoptera section of the Taxonomic Catalog of the Brazilian Fauna (CTFB - Catálogo Taxonômico da Fauna do Brasil) through the collaboration of 100 coleopterists from all over the globe, we can build on Costa’s work and present an updated overview of the state of knowledge of the beetles from Brazil. There are currently 35,699 species in 4,958 genera and 116 families known to occur in the country, …

The Influence Of Higher Education Study On Practitioners In The Field Of Outdoor And Adventure Education, Katy Hensby Jan 2024

The Influence Of Higher Education Study On Practitioners In The Field Of Outdoor And Adventure Education, Katy Hensby

School of Law, Humanities and Social Sciences Theses

This thesis sets out to answer whether higher education (HE) study specific to outdoor and adventure education (OAE) influences the practice of OAE practitioners in the field of OAE. From my own experience in the field of OAE and the field of HE, the reasons why a practitioner should study an OAE degree were under-researched. The current work is set in the context of the current body of knowledge surrounding the field of OAE. It recognises the limited evidence base that acknowledges the impact of OAE HE on practitioners in the field. The theoretical framework used in this research is …

Understanding Dyslexia In Secondary Schools: Perspectives Of Students (With And Without Confirmed Diagnosis) And Educators, Kerissa Nelson

School of Law, Humanities and Social Sciences Theses

The United Nations Sustainable Development Goal 4 seeks high quality education for all (UNSDG4). This requires classrooms to have improved access and opportunity for all students including those with dyslexia. Research regarding dyslexic students’ experiences and inclusive education have not yet been thoroughly investigated. This research specifically addressed the experiences that both shape and are shaped by one’s own perspectives and those of others in their environment. The study’s objectives were to create knowledge and promote understanding of the experiences of students with dyslexia and to gain educators’ perspectives on classroom practices. The study drew on these different perspectives using …

‘The More Empowered I Feel, The More Vulnerable I Become’: Exploring The Entanglements Of Human Rights Education (Hre), Legal Discourses And Notions Of Agency And Vulnerability Amongst Human Rights Educators In Colombia, Claudia Blandon Jan 2024

‘The More Empowered I Feel, The More Vulnerable I Become’: Exploring The Entanglements Of Human Rights Education (Hre), Legal Discourses And Notions Of Agency And Vulnerability Amongst Human Rights Educators In Colombia, Claudia Blandon

School of Law, Humanities and Social Sciences Theses

In the 21st century, notions of human rights are symbols of dignity, freedom, and equality (UNDHR, 1948) and equated with notions of empowerment. Simultaneously, in an epoch of recurrent waves of displacement, international instruments of protection are failing to safeguard displaced people and those who provide sanctuary. By the end of 2022, 104 million people had been forcibly displaced globally because of conflict and human rights violations (UNHCR, 2023). Against this global backdrop, empowering women through human rights education and legal discourses has become a priority, (Bajaj et al., 2017, Altinova et al., 2019). With a firm conviction that the …

Evidence-Based Teaching: Discourses Of Pedagogy And Positionality, Jacklyn Barry Jan 2024

Evidence-Based Teaching: Discourses Of Pedagogy And Positionality, Jacklyn Barry

School of Law, Humanities and Social Sciences Theses

This critical discourse analysis (CDA) addresses the gap in research about teachers’ identities in primary schools (Rushton et al., 2023: 15). It does so by drawing upon aspects of Bernstein’s theories of the pedagogic device to explore the impact of evidence-based training practices on teachers’ positionalities in primary schools in one MAT in the South West of England. Using the prompt of brain-based interventions, how the use of research evidence might affect the ongoing development of teachers’ pedagogies was explored. Through interviews with 15 stakeholders in four primary schools, and a document analysis of ten resources related to the themes …

Many studies have been conducted into the lives of newly arrived communities. Generally, these studies tend to focus on their early years in the UK …

How Does Living In A Rural Location Affect Experiences Of Acquired Vision Impairment?, Rebecca Woods Jan 2024

How Does Living In A Rural Location Affect Experiences Of Acquired Vision Impairment?, Rebecca Woods

School of Law, Humanities and Social Sciences Theses

This research explores the lived experiences of adults with acquired sight loss who live in rural areas in Southwest England. There is a scarcity of published academic research with this group. Vision impaired people who live in rural locations are therefore unrecognised sources of vision impairment rehabilitation knowledge. The research is conducted in an interpretivist paradigm. The research is guided by phenomenological understanding, rooted in Merleau-Ponty’s concepts of perception, the centrality of tool-use, and human embodiment. Attention is centred on the process of adapting to sight loss in a domestic setting, placing this research in an experiential, community-based educational context. …

The Statutory Assessment Of Children And Young People With Special Educational Needs: A Bourdieusian Analysis, Blanche Gibson Jan 2024

The Statutory Assessment Of Children And Young People With Special Educational Needs: A Bourdieusian Analysis, Blanche Gibson

School of Law, Humanities and Social Sciences Theses

Research since the Children and Families Act (2014) and the SEND Code of Practice 0-25 (DfE & DoH, 2015) has focused upon new processes for statutory assessment, the quality of Education, Health and Care plans and the success and/or failures of the bureaucratic systems put in place to administer these. This research uses the thinking tools of the French sociologist Pierre Bourdieu (1930 - 2002), to consider how statutory assessment is perceived within the field of SEND. A conceptual framework, influenced by Bourdieu’s field theory (1984) and Crossley’s social movement fields (2003), is employed to examine participants responses to questions …

University Sustainability In Times Of Uncertainty: The Impact Of Brexit On Eu Staff And Students, Diane Stanley

School of Law, Humanities and Social Sciences Theses

The Brexit referendum in June 2016, which led to the UK’s decision to leave the European Union (EU), generated significant concern and anxiety within the United Kingdom's (UK) Higher Education (HE) sector. The potential impact on EU student and staff recruitment, EU research funding, and collaborations with Europe was uncertain, as many Brexit policies and procedures had not been considered by the government when the Leave outcome was announced. EU staff and students working and studying in UK Higher Education Institutions (HEIs) were left contemplating their future in the UK. This thesis examines the impact of Brexit through Charles Wright …

Co-Making And Prototyping Community Housing Futures, Alejandro Veliz Reyes, Alexandra Carr, Timothy Crabtree

School of Art, Design and Architecture

An emerging area of research on automated futures is that of digital equity- how to innovate and develop digital products, services, and experiences which promote equality of access, and align with the lived experiences of communities they are expected to benefit. In this chapter, we outline a research project focused on the adoption of digital fabrication technologies by a rural community in Bridport, United Kingdom. Their challenge is that of housing futures not only in terms of stock demand, but more broadly in terms of sustainable forms of housing construction (i.e., modern methods of construction) using local materials and skills. …

Climate Change Concerns And Mortgage Lending, Tinghua Duan, Frank Weikai Li Jan 2024

Climate Change Concerns And Mortgage Lending, Tinghua Duan, Frank Weikai Li

Research Collection Lee Kong Chian School Of Business

We examine whether beliefs about climate change affect loan officers’ mortgage lending decisions. We show that abnormally high local temperature leads to elevated attention to and belief in climate change in a region. Loan officers approve fewer mortgage applications and originate lower amounts of loans in abnormally warm weather. This effect is stronger among counties heavily exposed to the risk of sea-level rise, during periods of heightened public attention to climate change, and for loans originated by small lenders. Additional tests suggest that the negative relation between temperature and approval rate is not fully explained by changes in local economic …

Shadow Bank, Risk-Taking, And Real Estate Financing: Evidence From The Online Loan Market, Xiaoying Deng, Chong Liu, Eng Seow Ong Jan 2024

Shadow Bank, Risk-Taking, And Real Estate Financing: Evidence From The Online Loan Market, Xiaoying Deng, Chong Liu, Eng Seow Ong

Research Collection Lee Kong Chian School Of Business

This paper examines whether and how individual risk-taking behavior affects real estate financing through shadow banks. Using the loan data from an online platform in China, we show that riskier households tend to employ online loans to meet the increasing down-payment in their home purchase. Individual investors are likely to fund riskier real estate loans with higher expected returns. Real estate loans experience higher ex-post default rates than other types of loans. The effect is more pronounced during the period of credit constraints.

The Effects Of Language-Related Misunderstanding At Work, John Fiset, Devasheesh P. Bhave, Nilotpal Jha Jan 2024

The Effects Of Language-Related Misunderstanding At Work, John Fiset, Devasheesh P. Bhave, Nilotpal Jha

Research Collection Lee Kong Chian School Of Business

Demographic, technological, and global trends have brought the language used at the workplace to the forefront. A growing body of research reveals that language could result in misunderstanding at work, and influence employees' performance and attitudinal outcomes. Language at work encompasses standard language (e.g., English) as well as several hybrid forms of language (non-native accents, code-switching, and jargon). We delineate how these forms of language could result in misunderstanding. We then identify relational, affective, and informational mechanisms that underlie the relationship between language-related misunderstanding and employees' performance and attitudinal outcomes, and highlight key boundary conditions. In doing so, we uncover …

Market For Manipulable Information, Hui Chen, Jian Sun Jan 2024

Market For Manipulable Information, Hui Chen, Jian Sun

Research Collection Lee Kong Chian School Of Business

We study how investors, firms, and information sellers interact in a market with manipulable information. To better predict the firm characteristics they care about, investors can buy a score from a monopolistic information seller, which aggregates signals that are subject to firm manipulation. The average degree of signal manipulability has no effect on the equilibrium, while the uncertainty about manipulability becomes a new source of noise. Its contribution depends on firms' incentive to manipulate the signals, which in turn depends on the equilibrium price sensitivity to the score. The optimal design of the score weighs signal precision against the endogenous …
