And it came to him then that it should never be taken lightly, the essential loneliness of people, that the choices they made to keep themselves from that gaping darkness were choices that required respect. —Elizabeth Strout, Olive, Again

It’s Thanksgiving Day in the 1980s. At ten or eleven, I’m skinny, long limbed, and hovering in the space between the deserted dining room table and my uncle’s glass-doored gun cabinet, hoping to sneak another slice of banana cream pie. Instead, I overhear my grandma and my aunt arguing in the tired kitchen behind the yellowing Formica countertop.

“Please eat,” my husband will beg me. “Can I make you a sandwich?” I wish it were as simple as a sandwich. Nobody wishes more than me. I look at him and say, “I can’t.” I say, “Not right now.”

A Backpack In The River, Shamae Budd

That morning, we awoke to the silence of snow—the first snowfall that winter, like white gauze, an inch thick on the cars and lawn and pavement, exhilaratingly blank after the red and yellow color-chaos of autumn. I looked out the window and pulled my winter boots from the closet, tugging my husband to join me for a walk before breakfast. Two months married, we bundled ourselves into knitted hats and scarves and gloves and made our way to the river trail, listening to the muffled sound of our feet leaving prints in the snow.

I lay in bed a few weeks ago, admiring the flatness of my stomach, grieving in advance the lack-of-flatness I can expect when my husband and I decide to start growing children of our own, and I found myself wondering, strangely, how snakes are born. Do they hatch from eggs, or are they born live and wriggling?

“This is going to be your only helicopter ride. Too bad you can’t look out the window.” I didn’t understand why the guy thought I’d never go on another helicopter. Of course, I also wasn’t sure why I was on this one. My head was strapped to a backboard, and I had a hazy memory of trying to unbuckle my seatbelt and not being able to move my arm. Of firemen peeling the top of my car open like a tin can. Otherwise, the day was black.

God Is A Poet, Matthew Wickman

Why do we need literature? Certainly, there is much to admire in thoughtful, beautifully crafted narratives, poems, and plays, in gripping stories, layered characters, and poignant turns of phrase. But need is more intense than admiration, more desperate than mere affection. A graduate school friend and Church member once remarked to me, astutely, that if one surveys all the world’s civilizations over the course of known history, one can find plenty of examples of societies that had no concept of private property or insurance industries or professional sports teams or universities or lawyers or finance capitalists or plastic surgeons (and …

The Belt And Road Initiative: Conflict Of Laws And Dispute Resolution, Veltrice Tan

Purpose: This paper aims to determine the adaptability of China’s legal system in recognizing and enforcing foreign judgements in China. Design/methodology/approach: Academic articles, case law and books are examined as are relevant reports by various regulatory authorities and organizations. Findings: Historically, Chinese courts have strictly adhered to “de facto reciprocity”, which made it difficult for foreign judgements to be recognized and enforced in China. Fortunately, Chinese courts have since abandoned their rigid adherence to de facto reciprocity, and have instead, used flexible tests of reciprocity such as de jure reciprocity, reciprocal commitment and reciprocal understand/consensus. Accordingly, this would facilitate the …

Clinicians’ Attitudes Towards Using Cognitive Restructuring With Individuals At The End-Of-Life, Daniel H. Lydon

Theses and Dissertations

This cross-sectional study involving 156 clinicians explores the influence of personal factors on psychotherapy interventions and clinicians’ decisions to engage with individuals at the end-of-life (EOL) in psychotherapy. Extending qualitative research on perceived barriers to applying CBT in cancer care, this quantitative investigation delves into death anxiety, attitudes toward Cognitive Behavioral Therapy (CBT), and clinician distress tolerance in predicting the use, comfort, and confidence in applying cognitive restructuring (CR) with individuals at the EOL. Clinicians read a vignette of a terminally ill patient who is presenting as distressed and reporting several different irrational beliefs. Clinicians were then asked about their …

The Adult Rights-Bearing Archetype And How It Stifles Young People’S Equal Protection, Catherine E. Smith Jan 2024

The Adult Rights-Bearing Archetype And How It Stifles Young People’S Equal Protection, Catherine E. Smith

Scholarly Articles

American constitutional law is defined by a rights-bearing archetype that prioritizes adults—and the Equal Protection Clause is no exception. The Supreme Court has recognized children as constitutional persons and proclaimed that “neither the Fourteenth Amendment nor the Bill of Rights is for adults alone,” but courts mostly see autonomous, rational, individualistic, income-generating grown people as rights-bearers. For the first time, this article reveals six adult-rights-bearing analytical traps that limit children’s equal protection, and proposes jettisoning the rigid Carolene Products test in favor of a nascent youth-based framework. Instead of shoehorning children’s rights into a web of laws and principles designed …

Loan Debt Burden, Student Experiences, And Livelihood: A Study Examining Relationships Between Students’ Education Costs, Financial Viability, And Life Impact, Christa A. Reid

Master's Theses and Doctoral Dissertations

This dissertation investigates the complex connections among loan debt burden, student experiences, and post-bachelor’s outcomes, situated within the framework of systemic disparities in educational funding and opportunities. It identifies declines in state funding across educational levels as a systemic and politicized issue, disproportionately affecting students in underserved and underresourced school districts. The study emphasizes the impact of systemic racism and policymaking in perpetuating poverty through higher education, emphasizing the need for equitable policy establishment. Economic downturns and reduced higher education funding necessitate the exploration of alternative revenue streams, such as endowed funds and fundraising efforts, to prevent increased tuition costs …

The Trajectory Of Romance Scams In The U.S., Ld Herrera, John Hastings

Research & Publications

Romance scams (RS) inflict financial and emotional damage by defrauding victims under the guise of meaningful relationships. This research study examines RS trends in the U.S. through a quantitative analysis of web searches, news articles, research publications, and government reports from 2004–2023. This is the first study to use multiple sources for RS trend analysis. Results reveal increasing public interest and media coverage contrasted by a recent decrease in incidents reported to authorities. The frequency of research dedicated to RS has steadily grown but focuses predominantly on documenting the problem rather than developing solutions. Overall, findings suggest RS escalation despite …

The Purpose And Practice Of Precedent: What The Decade Long Debate Over Stare Decisis Teaches Us About The New Roberts Court, Russell A. Miller Jan 2024

The Purpose And Practice Of Precedent: What The Decade Long Debate Over Stare Decisis Teaches Us About The New Roberts Court, Russell A. Miller

Scholarly Articles

The Supreme Court’s tectonic decision in Dobbs v. Jackson Women’s Health upended the Doctrine of Substantive Due Process by radically reinterpreting the doctrine of stare decisis. The Court’s established practice regarding stare decisis should have operated to preserve the fifty-year-old abortion jurisprudence. But we should have seen this change coming. Although there has been an intense and involved debate over the purpose and practice of precedent for generations, that debate shifted at the beginning of 2018. Four approaches to stare decisis emerged along a continuum, from complete abandonment of the doctrine and incremental erosion to modernized adherence to precedent. This …

Proper Names And Political Claims: Semitic Echoes As Foundations For Claims To The Nephite Throne, Lyle H. Hamblin

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

The Book of Mormon contains examples of phonemes in character names that resemble Semitic root words. The possible meanings of the names and their timing in the Book of Mormon narrative provide a deeper level of context to the Nephite political challenges in the books of Mosiah through 3 Nephi. Specifically, the English phonemes for the Hebrew and Arabic root- word for “king,” M-L-K, appear in character names in the Book of Mormon narrative when the people of Zarahemla, who were descended from Mulek, the last king of Judah, are discovered by the Nephites in the book of Omni. “King” …

The Trouble With Technology, John O'Connor Jan 2024

The Trouble With Technology, John O'Connor

Conference Papers

In contemporary education, technology is either hailed as the panacea for affordable mass education or dreaded as a threat to our humanity. At the European Culture and Technology Laboratory, technology is understood in the context of the Ancient Greek origin of the word: technē—meaning a system or a method of making or doing, an art or a craft; a technique or a practice, even a way of thinking. The tools humans use are not merely a means of intervention in our environment but also a way of becoming human and thus, technology has a fundamental impact on our identity and …

Navigating The Labyrinth: An Analysis Of Gender Bias In Leadership Development Using Natural Language Processing, Michael Schwendeman Jan 2024

Navigating The Labyrinth: An Analysis Of Gender Bias In Leadership Development Using Natural Language Processing, Michael Schwendeman

Wayne State University Dissertations

This study employs a multi-trait, multi-method approach to investigate gender bias in leadership development evaluations in an organizational setting by combining traditional quantitative analyses with natural language processing (NLP) methodologies. Specifically, analysis of 360-degree ratings of leader competency revealed a null effect of leader gender on ratings of Agency and Communion when controlling for leader level, leader work region, rater gender, and rater source. These secondary variables, with the exception of rater gender, demonstrated small yet significant effects on competency ratings. Moreover, dictionary-based NLP and structural topic modeling analyses on narrative developmental feedback comments revealed minimal gender differences in feedback …
