Colorblind And Color Mute: Words Unspoken In U.S. Supreme Court Oral Arguments, Chris Chambers Goodman
Colorblind And Color Mute: Words Unspoken In U.S. Supreme Court Oral Arguments, Chris Chambers Goodman
Washington and Lee Journal of Civil Rights and Social Justice
The U.S. Supreme Court holds oral arguments on 70 to 80 cases each year, with fewer than a dozen most years involving issues around race or ethnicity. When the salience of race is clear, Supreme Court observers would expect to hear racial terms used in the arguments by counsel, as well as in the Justice’s questions.
Surprisingly, this research study demonstrates that is not the case. These racial terms - such as color, discriminate, minority, race, and its various related terms like racial, racially, racist, as well as combinations like race-neutral, and race-blind - only sparsely appear in oral argument …
Reflections Of A Non-Abolitionist Admirer Of The Police Abolition Movement, Corey Stoughton
Reflections Of A Non-Abolitionist Admirer Of The Police Abolition Movement, Corey Stoughton
Washington and Lee Journal of Civil Rights and Social Justice
To acknowledge that the abolition movement made reform better is not to reduce the movement to that purpose. For the non-abolitionist, the end of reform is better policing. For the abolitionist, reform is at best “a strategy or tactic toward transformation,” meaning contesting and ultimately eliminating policing. These are not compatible visions. But even if the collaboration between holders of these visions is just a tactical alliance, it is a tactical alliance that is producing good results. Perhaps those good results will lay a foundation for abolition, or perhaps they will seed in abolitionists’ fertile imaginations a positive vision of …
Bivens And Beyond: Creating A Meaningful Remedy For Federal Prisoners In A Post-Boule Landscape, Hannah M. Wilk
Bivens And Beyond: Creating A Meaningful Remedy For Federal Prisoners In A Post-Boule Landscape, Hannah M. Wilk
Washington and Lee Journal of Civil Rights and Social Justice
For nearly 50 years, the Bivens action served as a vehicle to compensate individuals when their constitutional rights had been infringed on by a federal officer. Bivens actions operated as the federal equivalent of Section 1983 claims in state courts against state officers. But in June 2022, with a conservative majority in the U.S. Supreme Court, the Bivens framework was gutted by Egbert v. Boule. Boule held that if a Bivens claim is filed in a context that differs from the three previously accepted contexts (the Fourth, Fifth, and Eighth Amendments), the claim must fail, as Congress is better equipped …
Fitting A Block Into A Sphere Mold: The Inadequacy Of Current Data Privacy Regulations In Protecting Data Privacy Within The Blockchain Space, Jenny Yang
Washington and Lee Journal of Civil Rights and Social Justice
Despite global imposition of data privacy laws and regulations, data privacy is a nonexistent luxury amongst the data-charged world we live in. Data privacy has long been established as a fundamental right. Entities have successfully established robust methodologies around existing data privacy laws and regulations to utilize past consumer behavior to predict, impact and manipulate current and future consumer behaviors. This phenomenon has been commonly coined as “corporate surveillance.” Emerging spaces arising through technological developments have greater access into consumer data to impact economic choices. Specifically, the blockchain space, through its unique open-source and permanent traits, has been able to …
Skirting The Fourth Amendment: How Law Enforcement Agencies Abuse Technology And Constitutional Exceptions To Surveille The Public, Matthew Lloyd
Skirting The Fourth Amendment: How Law Enforcement Agencies Abuse Technology And Constitutional Exceptions To Surveille The Public, Matthew Lloyd
Washington and Lee Journal of Civil Rights and Social Justice
Existing Fourth Amendment law does not protect against law enforcement use of data gathered through the internet either by private companies who actively search their customer’s data and submit evidence of misconduct to law enforcement or from private companies who acquire the data on behalf of law enforcement. In an effort to pursue criminals, courts have permitted Fourth Amendment jurisprudence to develop in a manner that permits sweeping invasions of privacy without any probable cause through the private search doctrine or without any procedural protections through the third-party doctrine. It will require substantial judicial or legislative action to return the …
Standing Up To Bounty Laws: Examining State Standing Jurisprudence And Its Effect On Laws Enforced Through Private Rights Of Action, Olivia A. Luzzio
Standing Up To Bounty Laws: Examining State Standing Jurisprudence And Its Effect On Laws Enforced Through Private Rights Of Action, Olivia A. Luzzio
Washington and Lee Journal of Civil Rights and Social Justice
The Texas Heartbeat Act (SB 8) adopted a unique enforcement scheme that succeeded in circumventing Roe v. Wade’s protection of a woman’s right to abortion before viability. By prohibiting enforcement of the Act by public officials and instead authorizing enforcement solely through civil actions by “any person,” SB 8 effectively ended a women’s right to abortion after a fetal heartbeat is detected. The passage of this law placed the protection of other constitutionally endowed rights in jeopardy and facilitated the passage of similarly constructed legislation, such as California’s Senate Bill 1327, which authorizes “any person” to sue anyone who manufactures …
Effect Of Downregulating Lactate Dehydrogenase In Alzheimer’S Disease Using A Drosophila Model, Hannah Higgins
Effect Of Downregulating Lactate Dehydrogenase In Alzheimer’S Disease Using A Drosophila Model, Hannah Higgins
Honors Theses
According to the CDC, approximately 5.8 million Americans suffered from Alzheimer’s disease (AD) in 2020. AD is characterized by progressive memory loss and typically develops after the age of 60. There are many studies that suggest different causes of Alzheimer’s such as oxidative damage, amyloid plaque buildup, and metabolic dysfunction. Lactate Dehydrogenase (LDH) is an enzyme that is found in many tissues within the body and functions within cellular metabolism. The enzyme catalyzes the reversible reaction that converts lactate to pyruvate coupled with the reduction of NAD+ to NADH. Pyruvate is then used in the Krebs cycle to create ATP. …
Introducing Law Students To Transactional Practice: From Using Precedent To Closing The Deal, Ben Fernandez
Introducing Law Students To Transactional Practice: From Using Precedent To Closing The Deal, Ben Fernandez
UF Law Faculty Publications
My name is Ben Fernandez. I teach contract drafting at the University of Florida, Levin College of Law, and I'm going to talk about introducing students to transactional practice from using precedents to closing the deal. Basically, what I'm going to describe is things I do to supplement Tina Stark's Drafting Contracts: How and Why Lawyers Do What They Do. I'm going to give you a whole bunch of, I hope, useful, teaching ideas on how to do that.
Contract Drafting Classes Need To Devote More Consideration To The Law Applicable To "Boilerplate" Clauses, Ben Fernandez
Contract Drafting Classes Need To Devote More Consideration To The Law Applicable To "Boilerplate" Clauses, Ben Fernandez
UF Law Faculty Publications
The law applicable to “boilerplate” provisions is often given little attention in contract drafting classes because textbooks focus too much on the textbook author’s opinion of the best words to use for various contract provisions and how to format each clause (e.g., whether to use “shall” or “will” or “must” for a covenant or obligation, whether to write numbers numerically or in words (or both), whether to use “on or about” instead of “within” for a time period, whether to bold or underline definitions, or put them in quotes, etc.). Students need to learn to draft clearly and unambiguously; and …

New Genera And Species Of Caulobacter And Brevundimonas Bacteriophages Provide Insights Into Phage Genome Evolution, Bert Ely, Michael Hils, Aaron Clarke, Maegan Albert, Nadia Holness, Jacob Lenski, Tannaz Mohammadi
Faculty Publications
Previous studies have identified diverse bacteriophages that infect Caulobacter vibrioides strain CB15 ranging from small RNA phages to four genera of jumbo phages. In this study, we focus on 20 bacteriophages whose genomes range from 40 to 60 kb in length. Genome comparisons indicated that these diverse phages represent six Caulobacter phage genera and one additional genus that includes both Caulobacter and Brevundimonas phages. Within species, comparisons revealed that both single base changes and inserted or deleted genetic material cause the genomes of closely related phages to diverge. Among genera, the basic gene order and the orientation of key genes …

Autophagy And Ime2 Kinase In Regulation Of Meiotic Exit In Saccharomyces Cerevisiae, Somdutta Paul
Autophagy And Ime2 Kinase In Regulation Of Meiotic Exit In Saccharomyces Cerevisiae, Somdutta Paul
Dartmouth College Master’s Theses
Meiosis or gametogenesis is a specialized cell division that produces gametes in sexually reproducing organisms. The process of meiosis reduces the genetic content into half that of the progenitor cell. This reduction in the genetic content occurs over a set of two divisions: meiosis I and meiosis II. Because gametes are essential for propagation of life, meiosis operates under tight regulation ensuring the full functionality and viability of the gametes produced. The working principle of the regulatory network that restricts meiosis to only two divisions is not clearly understood. Budding yeast undergoes meiosis in response to starvation. Autophagy being a …

An Examination Of Adversity And The Unique Mental Health Needs Of Black Crossover Immigrant And Refugee Youth (Iry), Ngozi V. Enelamah, Rebecca L. Skahan, Sheryl Thompson
Journal of Family Strengths
Over 500,000 youths become involved with the Juvenile Justice System in the U.S. annually. More than half have experienced maltreatment resulting in child welfare system contact, a co-occurrence described as dual system involvement. Immigrant and refugee youth (IRY) are numbered among Black young adults who are disproportionately represented in the dual system. There is little knowledge about the unique experiences of Black IRY who are involved with the crossover or dual system, as child welfare organizations are not required to collect or report that information. Previous studies suggest that Black crossover IRY are at an increased risk for dual system …
Analyzing Quality Of Care In New Hampshire Nursing Homes In Relation To Ownership Status, M. J. Condon
Analyzing Quality Of Care In New Hampshire Nursing Homes In Relation To Ownership Status, M. J. Condon
Inquiry Journal Spring 2024
When I enrolled in UNH as an analytical economics major, I had no idea what economics was, what I could do with an economics degree, or if this degree was for me. Participating in undergraduate research through the Hamel Center for Undergraduate Research allowed me to investigate how my passions with data analytics, economics, and helping others intersect. I discovered through my fellowship the power of economics, and a passion for my major.
This research aimed to investigate whether a relationship exists between quality of care and ownership of nursing homes in the state of New Hampshire. I had the …

Unraveling A Ball Of Confusion: Layers Of Criminal Intent, Facebook, Rap, And Uncertainty In Elonis V. United States, 135 S. Ct. 2001 (2015), Cameron L. Fields
MC Law Review
“So, round and around and around we go. Where the world's heading nobody knows...Just a ball of confusion."
Elonis v. United States was a much-awaited case needed to clarify many questions within its realm. Part of the case's allure was its facts: threats, rap, and Facebook. While the alluring circumstances were well-presented, the potential for clarification was not realized. As the quotes from the various opinions above suggest, a song from the oldies had hinted at this ruling correctly when its lyrics said it's "just a ball of confusion." This Note seeks to unravel this ball of confusion to give, …

Open Educational Resources
This is a syllabus for a first year college writing course. This is also ZTC course (or "zero textbook cost" course). Course texts are only open-access materials and texts that are readily accessible online.
This course focuses on the power of language in our society. Students analyze the importance of rhetoric for both writers of language and consumers of language. They consider how language can be used to make meaning of the world, construct and express identity, persuade or manipulate others, and how language has evolved with technology. Students develop critical reading and academic writing skills through workshops and writing …
Phantasma, Grace Wright
Phantasma, Grace Wright
ALL - Honors Theses
This project, titled Phantasma, can be described as a queer retelling of Shakespeare’s Julius Caesar, in which Brutus is the central focus. It will interrogate the question of what draws readers back to that fateful day at the Roman Senate time and time again. It will also question what drew Shakespeare and his audience to it, as well as deconstruct the nuances of his recreation. The narrative will be greatly influenced by the structure of Shakespeare’s play, but will take on new forms as scenes are added in places where Brutus would ordinarily be “offstage”. Using queer theory as well …
How Does The Degree Of Remote Work Impact Perceptions And Productivity For Undergrad Accounting Workers?, Jonah Hauf
How Does The Degree Of Remote Work Impact Perceptions And Productivity For Undergrad Accounting Workers?, Jonah Hauf
ALL - Honors Theses
A recent development in the field of accounting is the concept of working remotely and being able to be part of a company without ever setting foot inside its doors. This concept has been accelerated by the recent pandemic that prevented companies from surviving financially if they did not adapt to allow employees to work remotely. As companies have recently been opening their doors back up to employees working in person, there is increasing dialogue about whether or not remote work should be embraced as a tool for success or rejected as a potential distraction.
This study will explore literature …

‘Making Of A Woman Minister’ Rev. Annis Ford Eastman And Elmira, New York, Mary Lemak
ALL - Honors Theses
This paper explores the life and career of one of the United States’ first female ministers, Rev. Annis Ford Eastman (1852-1910). Remembered today as being the author of Mark Twain’s eulogy and as the mother of American writer Max Eastman and co-author of the Equal Rights Amendment Crystal Eastman, the Reverend Eastman had a career that was exceptional in its own right. Reverend Eastman was ordained when it was practically unheard of for a woman to preach. Not only was she ordained but she was invited to speak at national conferences and was frequently published in religious and civic journals. …
Limb Stiffness Increases With Hopping Frequency And Sprinting Speed In Elite Sprinters, Laurent Dorvilier
Limb Stiffness Increases With Hopping Frequency And Sprinting Speed In Elite Sprinters, Laurent Dorvilier
ALL - Honors Theses
During sprinting and hopping, the lower limbs act as a mechanical spring as it compresses and recoils to store and release elastic potential energy during each step. This is important because for individuals such as high performing sprinters, the stiffer the spring acting limb is, the more efficient it will be for the sprinter to maintain maximal velocity and optimal performance. The basis of this experiment lies in the fact that the mechanics of the lower limbs are modeled using to the mechanics of a spring, therefore, to calculate an approximate limb stiffness, Hooke’s Law can be used. Hooke’s Law …

Chronic pain is a common problem, with more than one-fifth of adult Americans reporting pain daily or on most days. It adversely affects the quality of life and imposes substantial personal and economic costs. Efforts to treat chronic pain using opioids had a central role in precipitating the opioid crisis. Despite an estimated heritability of 25-50%, the genetic architecture of chronic pain is not well-characterized, in part because studies have largely been limited to samples of European ancestry. To help address this knowledge gap, we conducted a cross-ancestry meta-analysis of pain intensity in 598,339 participants in the Million Veteran Program, …
Decoding Molecular Recognition Mechanism Of Small Molecule Ligand-Rna Binding Pocket Systems Using Molecular Dynamics And Metadynamics, Zhixue Bai
Legacy Theses & Dissertations (2009 - 2024)
From my PhD research, under Amber99-Chen-Garcia force field, umbrella sampling and MD simulation helped us found that the 2’-5’ phosphodiester RNA backbone linkage modification on in vitro selected neomycin RNA aptamer can transfer it to ‘amikacin RNA aptamer’ by changing the conformation and backbone rigidity of the RNA binding pocket, which further influenced the binding mode and binding pathway of amikacin. Furthermore, under the same force field, metadynamics was found more powerful for simulating the binding pathway, binding mechanism and predicting binding modes of small molecule ligand recognizing its RNA target by filling up all energy basins on free energy …
Reconnect: The Importance Of Beauty Within Architecture, Rebekah Lueck
Reconnect: The Importance Of Beauty Within Architecture, Rebekah Lueck
Interior Design Capstones
In a world where secular design has become the norm, this project addresses the profound disconnect individuals experience in modern spaces. This research investigates the impact of contemporary design principles on user well-being and the built environment. It explores how secularism and modern design have contributed to this disconnect and alienation, and further how reforming a classical view and approach of architecture and design contribute to its remedy.
The integration of classical architecture not only offers an aesthetic and functional solution but also serves as a powerful response to the negative impacts of the fragmented view that has been embraced …
Administrative Law Judges And The Erosion Of The Administrative State: Why Jarkesy May Be The Straw That Breaks The Camel's Back, Nicholas D'Addio
Administrative Law Judges And The Erosion Of The Administrative State: Why Jarkesy May Be The Straw That Breaks The Camel's Back, Nicholas D'Addio
Catholic University Law Review
The Trump-era unitary executive movement sought to expand presidential
power and shrink the influence of the administrative state through deregulation.
This movement ripples into the present moment, as Trump’s overhaul of the
federal judiciary installed a comprehensive system to delegitimize
administrative agency action— a system that is certain to endure. The
independence and role of administrative law judges (ALJs) has proven a key
target of the movement. Most recently, in the 2022 case of Jarkesy v. Securities
and Exchange Commission, the Fifth Circuit held that the dual-tiered for-cause
removal protections of SEC ALJs violated the Take Care Clause of Article …
The Development And Initial Validation Of An Empathy Scale For Higher Education Instructors, Jennifer R. Bridenbaugh
The Development And Initial Validation Of An Empathy Scale For Higher Education Instructors, Jennifer R. Bridenbaugh
Dean's Leadership Council Library Research Prize
The relationship between a teacher and student can be an important part of student success, especially for students of higher education. One factor that may influence student outcomes is the level of empathy a teacher may demonstrate toward a student. Empathy is an important part of interpersonal relationships as it promotes a feeling or understanding of another’s emotions through taking on a different perspective. Empathy can also produce a response leading to altruistic behavior. According to some theoretical models the prosocial characteristic of empathy contributes to the social emotional competence (SEC) of a teacher or instructor. The higher the SEC …
Fostering Faith: Religion And Inequality In The History Of Child Welfare Placements, Elizabeth D. Katz
Fostering Faith: Religion And Inequality In The History Of Child Welfare Placements, Elizabeth D. Katz
Fordham Law Review
Each year in the United States, approximately 700,000 children live in foster care. Many of these children are placed in religiously oriented homes recruited and overseen by faith-based agencies (FBAs). This arrangement—as well as the scope and operation of child welfare services more broadly—is at a crucial moment of reckoning. Scholars and advocates focused on children’s rights and family integrity maintain that the child welfare system, increasingly termed the “family policing system,” harms children, families, and communities through unnecessary and racist child removal that is partly motivated by perverse financial incentives. Some call for abolition. Meanwhile, in a largely separate …

Evaluating The Impact Of Rapid Response Electroencephalogram In Post-Cardiac Arrest Patients, Lauren Lee Steffen
Doctor of Nursing Practice Scholarly Projects
Problem Statement: Timely diagnosis and treatment of nonconvulsive seizures (NCS) and nonconvulsive status epilepticus (NCSE) are critical for improving patient outcomes after a cardiac arrest. However, NCSE can only be confirmed with an electroencephalogram (EEG), which is either considerably delayed or unavailable in the Emergency Department and Intensive Care Unit (ICU). Purpose: This project aimed to describe the impact of a rapid response electroencephalogram (rrEEG) brain monitor on improving time- to- acquisition and length of stay in the Intensive Care Unit for post-resuscitated cardiac arrest survivors; additionally, does rrEEG increase nurse's knowledge and confidence in managing complex seizure patterns? Was Job Righteous Or Self-Righteous? Job 1 And The Reliability Of The Narrator, Fabio Javier Colorado
Was Job Righteous Or Self-Righteous? Job 1 And The Reliability Of The Narrator, Fabio Javier Colorado
Jesuit School of Theology Dissertations
The Book of Job has generated pages and pages of discussion over its meaning, ranging from the overall meaning of the book to the meaning of one specific word. New ways and methods to analyze the Book of Job have opened new possibilities to understand and apply the teachings in the contemporary world. Nevertheless, one of the most accepted facts is that Job is innocent.
In literary studies an unreliable narrator is one whose credibility is compromised. An unreliable narrator will lie, deceive or exaggerate the facts of a story to push their own agenda or interpretation. Even though the …
