Why The Multilateral Investment Court Is A Bad Idea For Africa, Akinwumi Ogunranti
Why The Multilateral Investment Court Is A Bad Idea For Africa, Akinwumi Ogunranti
Dalhousie Law Journal
The UNCITRAL Working Group III (WG III) is discussing procedural reforms in the investor state dispute settlement system (ISDS). The ISDS framework is criticized on various grounds, including arbitrator bias, lack of transparency, and inconsistent arbitral decisions. One of the recent reform proposals before the WG III is the possibility of a multilateral investment court (MIC). This proposal is championed by European Union states and supported by Canada. The proposal recommends replacing ISDS’ Ad hoc investment tribunals with an established and permanent court where states appoint judges. This paper examines the MIC reform option and argues that replacing the ISDS …
What We Pretend To Be: Codifying A Right To A Religious Advisor In The Execution Chamber, Claire R. Jenkins
What We Pretend To Be: Codifying A Right To A Religious Advisor In The Execution Chamber, Claire R. Jenkins
William & Mary Journal of Race, Gender, and Social Justice
Over the last fifty years, the Supreme Court has moved the pendulum both toward religious accommodation and away from it. After a decade of oscillating Court decisions, multiple attempts at corrective action by Congress, and widespread social activism, the Religious Land Use and Institutionalized Person’s Act, or RLUIPA, was passed in 2000. RLUIPA was designed to fortify the rights of incarcerated persons and provide clarification to the Religious Freedom Restoration Act. As of 2024, the Supreme Court has granted certiorari in only a few RLUIPA cases—and has decided even less about the application of the law to death row inmates. …
Cherry-Picking History: Witchcraft, The Common Law, And The Weaponization Of Substantive Due Process, Sarah E. Bradley
Cherry-Picking History: Witchcraft, The Common Law, And The Weaponization Of Substantive Due Process, Sarah E. Bradley
William & Mary Journal of Race, Gender, and Social Justice
In 2021, the Supreme Court sharply altered its substantive due process analysis in Dobbs v. Jackson Women’s Health Organization, reversing the 49-year-old decision in Roe v. Wade to establish abortion access as a constitutional right. The Court reframed its substantive due process analysis as a two-step test, requiring a right to be narrowly framed and “deeply rooted in history and tradition” before it could be analyzed as “implicit in the concept of liberty,” instead of its previous balancing test that involved a broad description of the right. In the Dobbs majority opinion, the Court cherry-picked elements of common law …

Materiality In The Long Now: Navigating The Intersection Of Decision-Making, Time, And Strategy, Daniel M. Labovitz, Alexander Kontoleon
Materiality In The Long Now: Navigating The Intersection Of Decision-Making, Time, And Strategy, Daniel M. Labovitz, Alexander Kontoleon
Dickinson Law Review (2017-Present)
Existing formulations of materiality in the federal securities laws contain an inherent limitation because they don’t adequately account for how risks and opportunities change over time. This can mislead investors looking to understand how well a company is poised to avoid long-dated risks and take advantage of evolving opportunities because those risks and opportunities don’t neatly fit into the rubric of “likelihood of occurrence times magnitude of harm equals materiality.” This is because the likelihood of any long-dated risk occurring within a short reporting time frame will always approach zero, which means the traditional model of materiality will always classify …
Keeping Your Eye On The Esg Sustainable Development Ball, Richard J. Sobelsohn
Keeping Your Eye On The Esg Sustainable Development Ball, Richard J. Sobelsohn
Dickinson Law Review (2017-Present)
Environmental, Social, and Governance (“ESG”) mandates were originally aspirational sound-bites, but now they have become a part of many companies’ mandates. Most recently with some backlash against ESG directives, most organizations are still complying with their original goals, because the economic arguments for having an ESG protocol is still valid. This article discusses what ESG is, how it relates to different types of companies, and most importantly, what legal issues pertain to it.
This Article examines how ESG guidelines pertain to different types of entities, and how these protocols affect everything from contract drafting, construction of a property, operations and …
Cleaning Up Space Junk: Applying The Models Of U.S. Domestic Environmental Law To Regulate The Creation Of Orbital Debris By Private Actors, Sara Henry
Dickinson Law Review (2017-Present)
The commercial space flight industry has grown rapidly in recent decades, and Congress has implemented a “learning period” to prevent heavy regulations on the industry. This learning period has led to the proliferation of orbital debris in space. The learning period is set to lapse in 2024, and now is the proper time to implement regulations to mitigate the creation of more debris. These regulations should be modeled after federal environmental law, including simplifying the current permit system and setting up a trust fund to finance research into active debris removal.

Role Of Mechanoregulation In Mast Cell-Mediated Immune Inflammation Of The Smooth Muscle In The Pathophysiology Of Esophageal Motility Disorders, Raj Goyal, Satish Rattan
Role Of Mechanoregulation In Mast Cell-Mediated Immune Inflammation Of The Smooth Muscle In The Pathophysiology Of Esophageal Motility Disorders, Raj Goyal, Satish Rattan
Division of Gastroenterology and Hepatology Faculty Papers
Major esophageal disorders involve obstructive transport of bolus to the stomach, causing symptoms of dysphagia and impaired clearing of the refluxed gastric contents. These may occur due to mechanical constriction of the esophageal lumen or loss of relaxation associated with deglutitive inhibition, as in achalasia-like disorders. Recently, immune inflammation has been identified as an important cause of esophageal strictures and the loss of inhibitory neurotransmission. These disorders are also associated with smooth muscle hypertrophy and hypercontractility, whose cause is unknown. This review investigated immune inflammation in the causation of smooth muscle changes in obstructive esophageal bolus transport. Findings suggest that …
Reducing Employee Burnout: The Mediating Role Of Creativity, Salvatore Anthony Leone
Reducing Employee Burnout: The Mediating Role Of Creativity, Salvatore Anthony Leone
Psychology Theses, Dissertations, and Student Creative Activity
Employee burnout represents both a significant financial cost for organizations, and a significant health detriment for society. Scholars estimate that burnout costs the U.S. economy over $125 billion dollars yearly and other researchers attribute over 120,000 worker deaths each year to workplace accidents or medical conditions associated with burnout. The present study explores the role that creativity plays in reducing employee burnout by identifying two highly relevant creativity constructs: creative adaptability and creative process engagement (CPE). A sample of 436 working adults were recruited to respond to two survey batteries separated by a lag of three weeks. The results of …

X And Tesla: The Effect Of Elon Musk’S Posts On Tesla’S Stock Price, Andrew Rachek
Gabelli School of Business Honors Thesis Collection
This research paper investigates the relationship between Elon Musk’s X posts and Tesla’s stock price movements. The study builds upon prior research focusing on the relationship between social media and financial markets. Our research focused on whether Elon Musk’s posts influenced TSLA’s stock volatility, returns, or investor attention. To conduct the analysis, we conducted various statistical tests to determine our conclusions, including regression tests and comparisons of statistical data. While we did not find an influence on investor attention or stock returns, we found that Elon Musk’s posts about Tesla impacted TSLA’s trading volatility. Our results showed that there was …

The goal of this research is to critique current bias detection and reduction methods in predictive healthcare artificial intelligence algorithms by looking at whether the accuracy of algorithms designed to predict breast cancer survival can be increased by including sensitive attributes – such as race, origin, socioeconomic status, marital status, and income – that are typically removed or altered by these bias detection and reduction methods. The research questions guiding this study are: Can including biases that represent disparities in the overall population in training datasets produce more accurate predictions in predictive breast cancer algorithms? How can we use these …
Making Financial Sense Of The Movies: How Streaming And Covid-19 Have Distorted The Theatrical Window, Sebastian Martinez-Canedo
Making Financial Sense Of The Movies: How Streaming And Covid-19 Have Distorted The Theatrical Window, Sebastian Martinez-Canedo
Gabelli School of Business Honors Thesis Collection
The research assesses the viability of the multibillion-dollar theatrical exhibition business by examining two key parts: the theatrical window and the theatrical run. First, the research explores how each one has changed over time, particularly in light of streaming and the COVID-19 pandemic. Second, it looks at the statistical relationship between the two. The findings are that the theatrical exhibition business is unviable due to the shortening of the theatrical window. Furthermore, a weak correlation between the run and window signals a fraught relationship between studios and theaters which negatively impacts the financial viability of both. As such, the future …

Pharmacy compounding of drugs for companion animals and humans is as old as time. For hundreds of years, pharmacists created these drugs using active pharmaceutical ingredients, otherwise known as bulk drug substances, to address the medical needs of these patients. Congress recognized this longstanding practice when it enacted the Food, Drug, and Cosmetic Act (“FDCA”), with lawmakers then noting that while pharmacists, physicians, and veterinarians were already highly regulated by the states, mass-producing drug manufacturers were not regulated. The FDCA would regulate such manufacturers.
Thereafter, pharmacy compounding from bulk drug substances continued for decades after the FDCA’s enactment and without …
