Decistifying Trans And Gender Diverse Inclusion In Library Work: A Literature Review, Stephen G. Krueger, Keahi Adolpho

This comprehensive review illuminates the current state of scholarly literature on trans and gender diverse inclusion in libraries, with the intention to provide a foundation and identify gaps for further research. Covering 50 works published between 2002 and 2023 in the areas of general inclusion, public libraries, academic libraries, experiences of library workers, archives, information behavior, and cataloging, we found that, with the exception of works on archives and cataloging, little scholarly literature goes beyond introductory talking points on basic information about trans and gender diverse people. Innocent until proven guilty? For some who have walked through the criminal justice system, this American adage did not seem to ring true. The criminal justice system has produced many wrongful convictions, which is an unthinkable injustice. These individuals must then fight for compensation to get back on their feet in society after spending years, if not decades, unjustly behind bars. Ohio’s wrongful conviction compensation statute perpetuates this injustice by categorically excluding exonerees who pled guilty to a crime they did not commit from receiving compensation from the State, with no exceptions. Public Accommodations And The Right To Refrain From Expressing Oneself, Mark Strasser

Cleveland State Law Review

The United States Supreme Court has been unable to articulate a coherent position when addressing the right of individuals to refrain from expressing themselves. The Court has applied various tests inconsistently—emphasizing principles in some cases, ignoring them in subsequent cases, and then emphasizing them again in later cases as if those principles had always been applied. The Court’s approach is incoherent, offering little guidance to lower courts except to suggest that public accommodations laws may soon be found inconsistent with First Amendment guarantees.

Regulations imposed on air quality have a direct impact to respiratory health. The relationship of particulate matter to respiratory health has been improving and the link to health problems has only grown stronger. The purpose of this investigation was to quantitatively study and monitor air quality trends of particulate matter using low cost air quality sensors in Northwest Indiana (NWI) and evaluating the PurpleAir sensors for use in the community. Unlike liquids and crystalline solids, glassy materials exist in a constant state of structural nonequilibrium. Therefore, a comprehensive understanding of material kinetics is critical for understanding the structure-property-processing relationships of polymeric materials. Amorphous materials universally display low-frequency Raman features related to the phonon density of states resulting in a broad disorder band for Raman shifts below 100 cm-1, which is related to the conformational entropy and the modulus. This disorder band is dominated by the Boson peak, a feature due to phonon scattering because of disorder and can be related to the transverse sound velocity of the material, and a …

Reassessing Administrative Finality: The Importance Of New Evidence And Changed Circumstances, Gwendolyn Savitz

Administrative finality of agency action is generally thought of as a method of avoiding premature judicial review—a claim that the review is too early. But it is also used to prevent judicial review by claiming that the review has now come too late. There are two primary exceptions to this prohibition: new evidence and changed circumstances. However, courts and agencies are reluctant to permit challengers to use these exceptions as often as should be statutorily allowed, an area that scholarship has been neglected.

How do Republican candidates demonstrate their conservative identity to appeal to Republican primary voters? Recent scholarship finds that ascendant groups within the Republican Party have changed the party’s platform, moved to the extreme right, and redefined the American conservative identity. This paper hypothesizes that former President Donald Trump is advantaged in the 2024 Republican primary as the party’s standard bearer. I explore the presence of gender bias in the judicial confirmation process by turning to the number of judicial philosophy questions asked of lower federal court nominees. Prior research on the subject has found that the Senate uses judicial philosophy, an ideologically-based idea of justices’ interpretations of the law and Constitution, as a measure of competence for appointees to the courts and has been found to ask disproportionate percentages of judicial philosophy questions of female candidates to the Supreme Court, especially if nominated by a President dissimilar in ideology to the majority of the Senate. The expansion of female labor force participation has a strong, positive effect on economic growth. Maternity leave policies aim to support women’s employment continuity through a reduction of labor tradeoffs. Variation in maternity leave policies between countries spotlights the effect of maternity leave on female labor force participation, as shown in a comparison of countries in Southern Europe. This thesis provides an empirical analysis of maternity leave policy and female labor force participation rates in Spain, Italy, Portugal, and Greece. ATP dependent chromatin remodelers have pivotal roles in transcription, DNA replication and repair, and maintaining genome integrity. SWI/SNF remodelers were first discovered in yeast genetic screens for factors involved in mating type switching or for using alternative energy sources therefore termed SWI/SNF complex (short for SWItch/Sucrose NonFermentable). The SWI/SNF complexes utilize energy from ATP hydrolysis to disrupt histone-DNA interactions and shift, eject, or reposition nucleosomes making the underlying DNA more accessible to specific transcription factors and other regulatory proteins. In two recent cases, Google LLC v. Oracle America, Inc. (“Google v. Oracle”), and Andy Warhol Foundation for the Visual Arts v. Goldsmith (“Warhol”), the Supreme Court ratified its 1994 holding that transformative use is the appropriate analytical framework for applying copyright law’s fair use provision. In doing so, the Court withstood significant pressure from industry participants in these cases to change course. This Article argues that the Court’s decisions, which represent one third of the Court’s total merits decisions on fair use, are historic. Treating functional GI disorders (FGIDs) caused by abnormal gut-brain interactions requires an understanding of individual GI pathophysiology as well as the patient’s behaviors. Many physicians frequently struggle to manage these patients due to a lack of knowledge regarding the patient’s pathophysiology and behaviors. Many digital tools for collecting and recording patients’ health information, which also include patient communication, are available to assist the physician in better understanding the patient. The Intraosseous (IO) needle was developed in 1920s to access the vascular system via the bone marrow cavity. Around the 2010s, there was widespread interest in IO after the American Heart Association (AHA) recommended that intraosseous access is an optional route when intravenous (IV) access cannot be obtained quickly. IO had a higher success rate (99.6%), was faster to perform (15-24 seconds), had a nearly equal flow rate (1-5L/hr), and had almost equal drug bioavailability to IV. In principle, railroad workers have a legal right to engage in strikes in the United States, just like a majority of other workers. In practice, however, they are ostensibly forced into compulsory arbitration where Congress legislates their contract even if they vote to strike. The government’s justification for overriding the workers’ right to strike in this way is that a full-scale strike could have serious economic impacts to the national economy. Overriding railroad workers’ right to strike still raises ethical concerns, because the right to strike is crucial for workers to protect their interests.
