Copyrighting Style, Christopher Buccafusco Jan 2025

Copyrighting Style, Christopher Buccafusco

Faculty Scholarship

Does copyright law protect an artist’s style? The federal courts that have considered the question are equally split. They all agree, however, that the answer to the question resides in copyright law’s idea/expression distinction. According to this doctrine, ideas, techniques, and methods cannot be copyrighted, but expressions of ideas can be. The question courts have faced, then, is whether artistic style is an idea or a matter of expression. The answer, perhaps unfortunately, is that style is both.

This is unfortunate because, this Article argues, copyright law’s idea/expression distinction is inadequate to the task of determining the copyrightability of style. …

The U.S. Supreme Court’s groundbreaking 2008 decision in District of Columbia v. Heller ushered in a new era for the Second Amendment: one in which the right to keep and bear arms, long dormant as a matter of practical impact and even “embarrassing” as a matter of legal scholarship, vaulted into the front ranks of constitutional law. The Court itself has only revisited the Amendment a few times since then—albeit once by revolutionizing the doctrine. Meanwhile, lower courts have issued thousands of decisions giving shape to the right, while scholars have generated work that is increasingly deep, diverse, and challenging. …

Offline Guessing Games With Two Numbers, Justin Sciullo, Lisa Shen, Sarah Zaske Jan 2025

Offline Guessing Games With Two Numbers, Justin Sciullo, Lisa Shen, Sarah Zaske

Mathematics Undergraduate Research

In an offline guessing game, there is a player called the Questioner and a player called the Responder. The Responder first picks two distinct numbers from the set {1, 2, 3, . . . , n}. The Questioner then creates a set of questions of the form “How many of your numbers are in the set qi ⊆ {1, 2, 3, . . . , n}?” and sends them to the Responder who answers them. The Questioner wins if they can guess the Responder’s numbers no matter which numbers the Responder chose. The Responder wins otherwise. We …

Department of Design and Architecture

Launched by China in 2013, the Belt and Road Initiative (BRI) aims to enhance trade connectivity between Asia and the global market while fostering mutually beneficial economic cooperation among participant countries. While previous research has highlighted the positive effects of the BRI on trade between China and its partner nations along the Belt and Road (B&R), there is limited understanding of its impact on trade among B&R countries themselves. This study seeks to fill this gap by examining bilateral apparel trade patterns, specifically focusing on clothing exports from China and 21 Asian B&R countries/cities to the United States (US). To …

Measuring Resistivity With Low-Cost 3-D Printed Four-Point Probe, Benjamin Siens

SPARK Symposium Presentations

Resistivity is an intrinsic property that determines how strongly electrical current is resisted. Measurement of the resistivity of materials is vital for many fields of science and engineering. This is easily accomplished with a four-point probe. However, commercial probes can be costly. Using 3-D printing and based on the design in Lu et al. (J. Chem. Educ. 2017), a functional four-point probe has been built at a much lower cost in materials. Additionally, the probe design has been simplified for easier construction and better compatibility with Belmont University’s 3- D printers. ITO glass was used to determine the accuracy of …

Coaching Authors With Generative Ai, Christopher J. Smiley

AADEJ - The Communicator

This paper outlines a systematic methodology for dental editors to coach authors in the ethical use of generative artificial intelligence (GAI). By adopting "AI-First" or "Write-First" strategies, editors can help authors refine their thesis statements and improve logical flow while maintaining human oversight and intellectual integrity. Dr. Smiley asserts that GAI should be used as a tool to enhance communication rather than replace human creativity, ensuring authors remain accountable for their final expressions.

The Federal Government Cannot Prohibit The Exercise Of A Core State Sovereign Function: Haaland V. Brackeen And Expanding The Anticommandeering Doctrine, George Bach Jan 2025

The Federal Government Cannot Prohibit The Exercise Of A Core State Sovereign Function: Haaland V. Brackeen And Expanding The Anticommandeering Doctrine, George Bach

UC Law Constitutional Quarterly

The Tenth Amendment’s anticommandeering doctrine limits the ability of the federal government to issue directives to state legislative bodies and executive officials. While the Supreme Court’s path through the Tenth Amendment has been less than direct, New York v. United States and United States v. Printz clarified that the federal government cannot “commandeer” state legislatures or executives to implement federal policy. While the core of the Court’s approach to anticommandeering remains focused on halting congressional efforts to press state agents into implementing federal regulatory programs, the Haaland v. Brackeen decision may be read to expand the anticommandeering principle. That is, …

Sex Crimes And Progressive Prosecution: Reimagining Sex Offenses And Sorn Laws As An Opportunity For Criminal Justice Reform, Kana Turley Jan 2025

Sex Crimes And Progressive Prosecution: Reimagining Sex Offenses And Sorn Laws As An Opportunity For Criminal Justice Reform, Kana Turley

Journal of Criminal Law and Criminology

As progressive efforts to reform the U.S. criminal legal system continue to take form, one category of crime has been consistently overlooked: sex offenses. While the carceral system is often condemned for its excessive punitiveness, severe punishments for sex offenders remain largely unchallenged and even popular. A primary example of these punishments is sex offender registration and notification (SORN) laws, which significantly constrain the lives of sex offenders after they have served their time in prison. Though subject to decades of empirical criticism from scholars, much of which has found that SORN laws have no significant impact on sex offender …

Last-Minute Coordination: Adapting To Demand To Support Last-Mile Operations, Kedong Chen, Hung-Chung Su, Kevin Linderman, William Li Jan 2025

Last-Minute Coordination: Adapting To Demand To Support Last-Mile Operations, Kedong Chen, Hung-Chung Su, Kevin Linderman, William Li

Information Technology & Decision Sciences Faculty Publications

In the highly competitive e-commerce industry, customer-facing warehouses are crucial as the “order penetration points” for e-commerce last-mile operations. This research examines how warehouses use last-minute coordination, an unstructured mechanism, to ensure sufficient inventory at the order penetration points. Previous research has focused on structured mechanisms like contracts and inventory management systems to enhance warehouse performance. However, these mechanisms can be ineffective when faced with unforeseen local contingencies. To adjust inventory and adapt to changes in supply and/or demand, warehouses need to engage in unstructured, last-minute coordination with other warehouses. Using coordination and loose coupling theories, we find that coordinating …

A Spoofing Speech Detection Method Combining Multi-Scale Features And Cross-Layer Identification, Hongyan Yuan, Linjuan Zhang, Baoning Niu, Xianrong Zheng Jan 2025

A Spoofing Speech Detection Method Combining Multi-Scale Features And Cross-Layer Identification, Hongyan Yuan, Linjuan Zhang, Baoning Niu, Xianrong Zheng

Information Technology & Decision Sciences Faculty Publications

Pre-trained self-supervised speech models can extract general acoustic features, providing feature inputs for various speech downstream tasks. Spoofing speech detection, which is a pressing issue in the age of generative AI, requires both global information and local features of speech. The multi-layer transformer structure in pre-trained speech models can effectively capture temporal information and global context in speech, but there is still room for improvement in handling local features. To address this issue, a speech spoofing detection method that integrates multi-scale features and cross-layer information is proposed. The method introduces a multi-scale feature adapter (MSFA), which enhances the model’s ability …

Cryo-Em Reveals The Mechanochemical Cycle Of Reactive Full-Length Human Dynein-1, Pengxin Chai Jan 2025

Cryo-Em Reveals The Mechanochemical Cycle Of Reactive Full-Length Human Dynein-1, Pengxin Chai

Yale Graduate School of Arts and Sciences Dissertations

Dynein is a microtubule-based motor protein complex that generates force and drives movement toward the minus ends of microtubules. Despite extensive structural, biochemical, and biophysical studies, key questions remain about how dynein achieves its unidirectional stepping and force-generating powerstroke through its ATP-dependent mechanochemical cycle. In this dissertation, I leverage recent advances in cryo-electron microscopy (cryo-EM) and develop novel cryo-EM image processing methods to elucidate the atomic-level details of the mechanochemical cycle of full-length cytoplasmic dynein-1. I directly visualize the conformational landscape of dynein both on and off microtubules, uncovering several novel and important reactive intermediates. These findings include the discovery …

Cognition Is Associated With Daily-Life Mobility In People With Parkinson’S Disease, Pablo Burgos Jan 2025

Cognition Is Associated With Daily-Life Mobility In People With Parkinson’S Disease, Pablo Burgos

Faculty Publications - College of Physical Therapy

Introduction: Cognitive impairment is common in people with Parkinson’s disease (PD). Mobility is also impaired in people with PD and functional mobility often requires cognitive dual-tasking to navigate complex environments in daily life. We hypothesized that visuospatial and executive cognitive dysfunction in people with PD will be associated with digital measures of mobility in daily life. Since freezing of gait (FoG) is associated with both cognitive dysfunction and mobility impairments, we also examined the influence of FoG on the cognitionmobility relationship. Here, we investigated, for the first time, the association between cognition and dailylife mobility in PD and the influence …

Responsiveness Of Promis Measures For Hip, Knee, And Shoulder Arthroplasty, Ryan Jacobson

Faculty Publications - College of Physical Therapy

Objectives: In hip, knee, and shoulder arthroplasty, there is evidence that using a broader set of Patient-Reported Outcomes Measurement Information System (PROMIS) measures beyond Physical Function and Pain Interference might improve assessment of patient outcomes. However, the utility and responsiveness of PROMIS domains measuring anxiety, fatigue, sleep, and social participation have been minimally investigated in arthroplasty. This retrospective study aimed to determine the 1) responsiveness of seven PROMIS domains and 2) association between change scores for all seven domains and MCID improvement in Physical Function and/or Pain Interference.

Methods: PROMIS domains of Physical Function, Pain Interference, Depression, Anxiety, Fatigue, Sleep …

Personalized Versus Fixed Tactile Cueing In Parkinson’S Disease: Protocol For A Randomized Controlled Trial On Gait Automaticity, Pablo Burgos Jan 2025

Personalized Versus Fixed Tactile Cueing In Parkinson’S Disease: Protocol For A Randomized Controlled Trial On Gait Automaticity, Pablo Burgos

Faculty Publications - College of Physical Therapy

Background

Gait automaticity, the ability of the brain to control locomotion with minimal use of executive-attentional resources, is altered in people with Parkinson’s disease (PD). Recently, we showed that step-synchronized tactile cueing improved gait regularity and freezing of gait in PD; however, it is not known if this cueing mode also improves gait automaticity. Thus, this study investigates the effects of step-synchronized tactile cueing (versus fixed cueing) on gait automaticity in the laboratory and during daily life.

Methods

This is a pilot, randomized, double-blinded study where sixty participants with PD will be randomized into one of two, cueing interventions: 1) …
