Metamorphosis And Fairy Tale Tropes In Christa Wolf’S Patterns Of Childhood, B. E. Lara
Metamorphosis And Fairy Tale Tropes In Christa Wolf’S Patterns Of Childhood, B. E. Lara
Master's Theses and Doctoral Dissertations
This study is a sociohistorical analysis of East German writer Christa Wolf’s use of fairy tale tropes in her novel Patterns of Childhood, first published in German in 1976 in East Germany as Kindheitsmuster. Wolf uses fairy tale tropes to explore themes that she could not write about openly under East German censorship, which prohibited East German authors from exposing their culpability for prior acts committed under the Nazi Regime. Furthermore, Wolf introduces metamorphosis to explore the intrinsic evil and subsequent guilt of her child protagonist, and she uses the child’s capacity for evil to illustrate the German people’s similar …

The New Constitutional Challenge To Qui Tam, Emily Mitchell
The New Constitutional Challenge To Qui Tam, Emily Mitchell
Emory Law Journal
Following the June 2023 Supreme Court decision in United States ex rel. Polansky v. Executive Health Resources, Inc., the ability of qui tam relators to litigate False Claims Act actions faces renewed challenges on multiple constitutional grounds. Specifically, in his Polansky dissent, Justice Thomas raises a novel Article I concern that Congress does not have the authority to partially assign the government’s litigation claim to relators, thus leaving them without standing to sue. Defendants in False Claims Act cases have already begun raising Thomas’s constitutional arguments in federal courts. What is heralded as the government’s most effective tool to …
Rethinking Misdemeanor Incompetence, Susan A. Mcmahon
Rethinking Misdemeanor Incompetence, Susan A. Mcmahon
Emory Law Journal
The competence to stand trial system is a “slow-moving tsunami” that has grown exponentially in recent years, capturing far more people than jurisdictions have the capacity to handle. As a result, individuals who are incompetent become trapped in pretrial competence purgatory, often detained in jail for months or even years. The harms of this system can be tragic. Competence detainees have died by suicide, starvation, and beatings. They are placed in solitary confinement, experience neglect and abuse, and deteriorate mentally and physically while confined. Often, these individuals are accused of misdemeanors. Often, they go through the competence process only to …

Pitching For Reform: Cangrejeros' Push To Level The Legal Playing Field By Challenging Baseball's Antitrust Exemption, Justin P. Chaljub
Fordham Journal of Corporate & Financial Law
For over one-hundred years, professional baseball has enjoyed an antitrust exemption unique among American major sports leagues, stemming from Supreme Court decisions in Federal Baseball and its progeny. This exemption has significantly influenced the evolution and structure of Major League Baseball (MLB). Despite extensive criticism and challenges for judicial and legislative reform, the exemption persists today.
However, new efforts have emerged to comprehensively disrupt this framework. In 2023, Nostalgic Partners was brought and structured to reach the U.S. Supreme Court. Plaintiffs anticipated they would lose at the lower court levels and garnered widespread support for the Court to grant a …
The Federal Reserve’S Fight Against Covid-19: A Study Of The Corporate Bond Intervention, Noah Seilgson
The Federal Reserve’S Fight Against Covid-19: A Study Of The Corporate Bond Intervention, Noah Seilgson
Fordham Journal of Corporate & Financial Law
In response to the COVID-19 pandemic, the Federal Reserve (Fed) embarked on an unprecedented mission to stabilize the U.S. economy as businesses shut down. One emergency Fed facility, the Secondary Market Corporate Credit Facility (SMCCF), was used to purchase corporate bonds and corporate bond exchange-traded funds (ETFs) in the secondary market. This extraordinary measure, which injected liquidity into the corporate bond market, aimed to mitigate economic fallout for large companies. Purchasing corporate bonds marked a departure from previous Federal Reserve interventions, but the statutory authority was the same as had been used in past crises: Section 13(3) of the Federal …
Company Districts, C.J. Suglia
Company Districts, C.J. Suglia
Fordham Journal of Corporate & Financial Law
Special districts that are owned or controlled by private entities and act almost uniformly like a company town can be dubbed a “company district.” These special districts, similar to historical company towns, have autonomy over the districts, control the local government, and only have to answer to the state government. Historical company towns like Pullman, Illinois and Hershey, Pennsylvania had almost canonical command over the land within their boundaries. Company districts operate their business similar to a company town—in a city that the private entity controls, but do not have employees living on-site. Company districts benefit by being immune to …

In Re Firstenergy Corp. Securities Litigation: Where Macquarie Meets Affiliated Ute, Elizabeth Cosenza, Amanda M. Payne
Fordham Journal of Corporate & Financial Law
The central question this Article seeks to address is whether there is any world in which the Affiliated Ute presumption can still apply to cases under Rule 10b-5(b) after the Supreme Court’s decision in Macquarie? Put differently, if only half-truths and affirmative misrepresentations remain actionable under Rule 10b-5(b), is the Basic presumption the only pathway left for securities plaintiffs? The U.S. Court of Appeals for the Sixth Circuit will likely be the first court to address this issue in In re FirstEnergy Corp. Securities Litigation. The case will test the availability of the Affiliated Ute presumption post-Macquarie in cases based …
How To Evaluate Non-Majority Control: What History And Statutes Tell Us, J. Travis Laster
How To Evaluate Non-Majority Control: What History And Statutes Tell Us, J. Travis Laster
Fordham Journal of Corporate & Financial Law
Under American law, a person who controls a corporation is a fiduciary. Since the nineteenth century, American law has treated a person who wields a majority of the voting power as having control. For almost as long, American law has recognized that holding a majority of the voting power is sufficient but not necessary for control. During the past two decades in Delaware, two schools of thought co-existed regarding non-majority control. One school took a formal approach that (i) shifted from examining control over the business affairs of the enterprise to control over the board, (ii) discounted sources of influence …
The Political Commitment Of The Supreme Court Of Texas To Protecting Controlling Equity Owners, Val Ricks
The Political Commitment Of The Supreme Court Of Texas To Protecting Controlling Equity Owners, Val Ricks
Fordham Journal of Corporate & Financial Law
The Supreme Court of Texas has revealed a political commitment to protecting controlling equity owners—e.g., shareholders, LLC members, limited partners—from liability related to their equity ownership. The Court does not say this, of course. The commitment the Court intends to reveal is a legal one. The political commitment must be teased out of what the Court does. The purpose of this article is to tease. Its method is to examine how the Supreme Court of Texas, in cases involving controlling or significant equity owners, extends the reasoning of its opinions out beyond law, and sometimes in conflict with it. When …
Reviving Shareholder Voice By Redefining Pre-Suit Demand, Wendy Gerwick Couture
Reviving Shareholder Voice By Redefining Pre-Suit Demand, Wendy Gerwick Couture
Fordham Journal of Corporate & Financial Law
This Article diagnoses, and seeks to cure, an undertheorized dynamic relationship between two levers of shareholder influence in the modern public corporation: suit and voice. This Article demonstrates that, under current Delaware law, a shareholder must stifle its voice in order to retain the ability to pursue a viable derivative claim, thus inhibiting the shareholder’s monitoring and information-sharing roles. In particular, the onerous “demand made” litigation pathway disincentivizes pre-suit demand, and the expansive definition of pre-suit demand captures shareholder communications to the board seeking corrective action other than litigation. To avoid this collision between suit and voice, this Article proposes …
The Intended And Resulting Interpretations Of Article 9 Considering The Rise Of Textualism, Cat Gassiot
The Intended And Resulting Interpretations Of Article 9 Considering The Rise Of Textualism, Cat Gassiot
Fordham Journal of Corporate & Financial Law
This Article is the first to examine the interpretive choices of judges for Article 9 of the UCC. Textualism has become one of the predominant methods of interpretation for courts across the state and federal systems in the United States. While there is a great deal of academic work on what this means for traditional statutes, there is limited discussion of the interpretive effects of textualism on the UCC, much less Article 9, which governs secured transactions. The continuity and uniformity of secured transactions jurisprudence is fundamental as it underlies bankruptcy proceedings, debt and credit financing, and commercial transactions more …

Introduction: Individuals with Down syndrome (DS) face a significant risk of neurodegeneration, and gait variability may serve as a clinical biomarker of neurological health. This longitudinal parent substudy aimed to explore relationships between gait, white matter (WM) integrity, and cognitive function in DS.
Methods: The associations were investigated between magnetic resonance imaging diffusion tensor imaging (DTI), cognition, and self-paced gait data from 22 DS participants (mean age ± SD 37 ± 7.5 years).
Results: DTI measures, such as lower fractional anisotropy (FA) and higher mean diffusivity, were correlated with greater step time variability but not normalized velocities. Lower cognitive scores …

Sanders-Brown Center on Aging Faculty Publications
While cerebrovascular dysfunction and reactive astrocytosis are extensively characterized hallmarks of Alzheimer's disease (AD) and related dementias, the dynamic relationship between reactive astrocytes and cerebral vessels remains poorly understood. Here, we used jGCaMP8f and two-photon microscopy to investigate calcium signaling in multiple astrocyte subcompartments, concurrent with changes in cerebral arteriole activity, in fully awake 7- to 8-month-old male and female 5xFAD mice, a model for AD-like pathology, and wild-type (WT) littermates. In the absence of movement, spontaneous calcium transients in barrel cortex occurred more frequently in astrocyte somata, processes, and perivascular regions of 5xFAD mice. However, evoked arteriole dilations (in …
Confronting The Duty To Capitalize In Veil-Piercing, Douglas C. Michael
Confronting The Duty To Capitalize In Veil-Piercing, Douglas C. Michael
Law Faculty Scholarly Articles
In corporate law, the doctrine of “piercing the corporate veil” allows courts to hold shareholders personally liable for corporate obligations. The doctrine—which now also applies to entities other than corporations—has been widely criticized as imprecise and unworkable. I respond to that criticism in the area of veil-piercing law which remains most intractable—the case of the tort victim who remains unsatisfied after exhausting corporate assets. Although most commentators have eschewed talk of any duty owed by the business owner to vest the business with sufficient assets, I argue that courts and legislatures should recognize—confront—such a duty. I look to negligence law …
The Migration Of Abolition Theory, Matthew Boaz
The Migration Of Abolition Theory, Matthew Boaz
Law Faculty Scholarly Articles
This Article considers whether and how theories of abolition developed by criminal law scholars are transferrable to the realm of immigration enforcement. A key question is how abolitionist principles might be employed in support of critiques of the United States’ immigration regulatory regime in the same way that these principles have been deployed in denouncing racialized policing and an injurious, industrialized prison system.
This Article makes two contributions: First, it identifies and illuminates a methodology adopted by critical and decarceral criminal law scholars: (i) denouncing the harms of a structural system, (ii) identifying the normative justification(s) for this system, and …

The Cognition Of Emotion: How Cognitive Control And Working Memory Underly Emotion Regulation Strategy Differences, Nathan Chabin
The Cognition Of Emotion: How Cognitive Control And Working Memory Underly Emotion Regulation Strategy Differences, Nathan Chabin
Pitzer Senior Theses
Working memory is crucial for comprehensively grasping the dynamics of emotion regulation (ER) and cognitive control, as it serves as a foundational cognitive resource that influences how individuals manage their thoughts, emotions, and behaviors. This research aimed to examine the role working memory capacity (WMC) has on Frontal Midline Theta (FMT), an EEG marker for cognitive control, during two common ER strategies: emotional suppression and cognitive reappraisal. Participants performed both an Operation Span working memory task and an ER task, where they viewed a series of negative and neutral images across three conditions. First, participants were instructed to passively view, …
Beyond The Bin: Transforming Relationships With Waste Through A Collaborative Inquiry-Based Environmental Education Curriculum, Kaylee V. Morris
Beyond The Bin: Transforming Relationships With Waste Through A Collaborative Inquiry-Based Environmental Education Curriculum, Kaylee V. Morris
Pitzer Senior Theses
This thesis presents Beyond the Bin, a collaborative inquiry-based environmental education curriculum designed to transform how young learners understand and interact with waste. Motivated by the limitations of current downstream waste education—focused primarily on consumer behavior and individual disposal practices—this project argues for an upstream approach that identifies the underlying cause of these prevalent systems of disposability. Grounded in environmental education theory, affective learning, and ecological literacy, the curriculum encourages students to rethink waste as a material with creative potential rather than something to discard. Through creative engagement, experiential learning, and community-based initiatives, the curriculum fosters collaboration between students, teachers, …
Public Land And Political Identity: Problematizing Open Space Preserves In Marin County, California, Samantha Gottsegen
Public Land And Political Identity: Problematizing Open Space Preserves In Marin County, California, Samantha Gottsegen
Pitzer Senior Theses
This thesis is an interdisciplinary exploration of the role of protected natural areas—namely county-run open space preserves—in shaping political identity in Marin County, California. I critically examine the politicization of public lands and the sociorelational dynamics that emerge within local communities surrounding protected open space. I seek to deconstruct dominant understandings of landscape and nature as apolitical, neutral, or untouched, instead approaching public land as a site of ongoing meaning-making, identity formation, and power negotiation. I further place emphasis on the role of the state, through county governing bodies and affiliated organizations, in mediating access, constructing narratives of ownership, and …
Untangling The Classification Of Surfaces: An Accessibility-Centered Perspective On Topology, Charlotte N. Richards
Untangling The Classification Of Surfaces: An Accessibility-Centered Perspective On Topology, Charlotte N. Richards
Pitzer Senior Theses
Mathematics has clear benefits in education, from preparing students for future careers to teaching them how to problem-solve. While mathematics achievement has been falling in recent decades, students claim that the problem is not the mathematics itself, but the ‘boring’ classroom material that feels removed from real life. More advanced mathematics topics, such as topology, could offer a solution, as their applications lie in countless fields. However, topology has been restricted to upper-level mathematics, disregarding the potential benefits of making this material broadly reachable for a junior high-school audience. In this paper, we analyze five different proofs of the theorem …
The Requirements Of A Nuclear Propulsion System For The Human Exploration Of Mars, Scotia Rollins
The Requirements Of A Nuclear Propulsion System For The Human Exploration Of Mars, Scotia Rollins
Pitzer Senior Theses
This thesis investigates the propulsion requirements for a crewed mission to Mars, focusing on how mission architecture, particularly the choice between opposition- and conjunction-class trajectories, influences the selection between nuclear thermal propulsion (NTP) and nuclear electric propulsion (NEP). By applying the Tsiolkovsky rocket equation, the Delta-V (∆V) needed for efficient interplanetary transfers is shown to exceed the performance limits of chemical propulsion, motivating the need for nuclear alternatives. An engineering comparison of NTP and NEP systems evaluates key parameters including specific impulse, thrust, propellant mass fraction, system mass, and power-to-mass ratios. NTP provides high thrust but moderate efficiency, making it …

The Americans With Disabilities Act And Academic Library Workers, Katie Quirin Manwiller
Educational Leadership & Higher Education Administration Faculty Publications
The Americans with Disabilities Act (ADA) established the legal requirement for equal access to employment for disabled Americans, but the processes for inclusion established by the law are rarely discussed in the workplace. This chapter will outline the requirements under Title I of the ADA for employment related to discrimination in the workplace and reasonable accommodations. Crucially, it provides practical recommendations for navigating these processes to help disabled academic library workers advocate for themselves and others. Lastly, it provides tips for library supervisors on how to creative inclusive environments that go beyond the bare minimum of accessibility required by the …

Impact Of Hiv-2 Rod9 Vpx Mutations On Samhd1 Degradation And Vpx Nuclear Trafficking, Tolulope R. Oladimeji
All Graduate Theses, Dissertations, and Other Capstone Projects
Human Immunodeficiency Virus (HIV) is a leading cause of death in many parts of the world. HIV-2, endemic to West Africa, has infected over 2 million people globally. A key difference between HIV-2 and the more widespread HIV-1 is the HIV-2 protein Vpx, which facilitates infection in non-dividing cells by targeting SAMHD1, a host innate immune protein, for proteasomal degradation. This research aims to identify specific amino acid residues in HIV-2 ROD9 Vpx that are essential for mediating SAMHD1 degradation by the proteosome. I hypothesize that amino acid residues located in the C-terminal region of Vpx play a critical role …
The Impact Of Class Size On Students’ Learning Outcome And Educational Experience: A Comprehensive Examination Of Students At Msu, Mankato, Yakubu Ali
All Graduate Theses, Dissertations, and Other Capstone Projects
The topic of class size and its relationship to students' learning outcomes and educational experiences has been extensively examined in the field of education. While prior research has explored associations between class size and academic performance, less is known about how class size shapes professor-student and student-peer interactions and how these interactions relate to students' perceived learning outcomes and overall educational experiences. Using a mixed-methods approach, this study conducted a comprehensive examination of undergraduate students at MSU, Mankato, combining quantitative survey responses with qualitative reflections. Findings suggest that class size is closely tied to patterns of engagement, with smaller classes …
