Models Of Judicial Interpretation: From Marshall To Kavanaugh And How The Umpire Model Changed The Game, Beau Sullivan
Models Of Judicial Interpretation: From Marshall To Kavanaugh And How The Umpire Model Changed The Game, Beau Sullivan
Ohio Northern University Law Review
The three predominant modes of judicial interpretation are living constitutionalism, originalism, and the umpire model. The living constitutionalist believes the Constitution is a living document that must change and adapt over time. The living constitutionalist considers the history, text, precedent, and policy when deciding a case. This is in contrast to the originalist, who considers the history and text of the document when deciding a case. The originalist favors judicial restraint and seeks to limit the role of the judge. The devotee of the umpire model champions the independent judge whose function is to the law and does not consider …
“Major Questions” Malarkey: An Arbitrary And Capricious New Doctrine For Vetoing Controversial Agency Rules, Lars Noah
St. John's Law Review
(Excerpt)
In 2022, after years of hinting at the idea, the United States Supreme Court officially adopted the “major questions” doctrine in West Virginia v. EPA. Commentators have already spilled plenty of ink trying to make sense of what this might portend, but so far seemingly everyone has accepted at face value the Court’s framing of the issue that it confronted in that case. This essay offers a slightly different perspective on the decision and suggests that closer attention to the precise nature of the question posed therein might reveal a distinctive flaw at the heart of the majority’s newfangled …

British Latino: Investigating Discourse-Stylistic Variables And The Construction Of Persona Within Podcasting, Jonathan A. Pye
International Journal of the Linguistic Association of the Southwest
This study expands upon previous work (McIlwaine et al., 2011; McIlwaine & Bunge, 2016) by analyzing how the Latin American community in the UK constructs identity through podcasting. The sociolinguistic construct of the persona (Campbell-Kibler, 2008; Coupland, 2007; D’Onofrio, 2020; Eckert, 2019; Podesva, 2007) is operationalized to understand how the persona of the British Latino is discursively constructed in the podcast of the British Latino Network. Using qualitative discourse analysis and values coding (Saldaña, 2013), this analysis finds that the British Latino persona is indexed in the podcast as a bricolage of four principal attributes: (1) aspirational, (2) educated, …

Advances in Clinical Medical Research and Healthcare Delivery
This is a case report of a patient who presented with left sided hearing loss. The patient was found to have mixed conductive and sensorineural hearing loss of the left ear and restrictive hearing of the right ear. Subsequent imaging demonstrated evidence of bilateral otosclerosis. Otosclerosis is characterized by progressive pathological bone remodeling in the otic capsule, resulting in hearing loss. Given the disease burden of otosclerosis and the corresponding effects on quality of life, providers must have knowledge of the disease to incorporate it into working differential diagnoses for patients presenting with hearing loss. With increasing recognition of otosclerosis …

Agricultural Drought Prediction From Multispectral Image Processing Using Deep Learning Models, Gowri L
Theses and Dissertations
Accurate and timely prediction of agricultural droughts is fundamental to the management of ecosystems, preservation of biodiversity, and environmental sustainability. It helps to reduce environmental exploitation, promotes eco-friendly irrigation techniques, and tackles climate change efficiently. Its social implications include food safety and financial stability through continuous rural employment. Drought prediction guarantees social progress and sustainability by ensuring zero hunger/poverty and effective water management. A multi-sensor image pre-processing framework that incorporates data from various satellite platforms like Landsat (30 metres), Sentinel-2 (10 metres, 20 metres, 30 metres), and MODIS (500 metres) is used to monitor and assess agricultural drought effectively.

Assessing Post-Fire Damage In Concrete Structures: A Comprehensive Review, Eneye A. Ibrahim, Dale Goff, Ali Keyvanfar, Mohammad Jonaidi
Faculty Articles
Bridge fires present unique challenges due to their potential for catastrophic structural failures, leading to extensive traffic disruptions, economic losses, and, in some cases, loss of life. In the aftermath of a fire incident, assessing the structural integrity and future viability of concrete bridges has become a paramount concern for civil engineers and safety inspectors. The critical decision to rehabilitate or demolish a fire-damaged structure hinges on accurately assessing the extent of damage incurred. Enhancing the fire resilience of concrete structures is a critical endeavor within civil engineering, necessitating accurate evaluation methods to analyze conditions after fire exposure. Focusing on …
The Road Ahead: Emerging Therapies For Primary Iga Nephropathy, Edward J. Filippone, Rakesh Gulati, John Farber
The Road Ahead: Emerging Therapies For Primary Iga Nephropathy, Edward J. Filippone, Rakesh Gulati, John Farber
Division of Nephrology Faculty Papers
Primary IgA nephropathy (IgAN) is the most common form of primary glomerulopathy. A slowly progressive disease presenting in the young to middle-aged, most patients with reduced eGFR or proteinuria will progress to end-stage kidney disease (ESKD) in their lifetimes. The pathogenesis involves increased production of galactose-deficient IgA1 (Gd-IgA1) that forms immune complexes that deposit in the glomerulus, eliciting mesangial cell proliferation, inflammation, and complement activation. The backbone of therapy is supportive, including lifestyle modifications, strict blood pressure control, and renin-angiotensin system inhibition targeting proteinuria < 300 mg/day. Sodium-glucose transporter 2 inhibitors are indicated for persisting proteinuria or declining eGFR. Sparsentan is indicated for persisting proteinuria. Immunosuppression should be considered for all patients at risk for progression (persisting proteinuria and/or declining eGFR). To reduce Gd-IgA1 production, targeted-release budesonide is approved. Agents targeting B cell survival factors APRIL or BAFF/APRIL have significantly reduced Gd-IgA1 production and proteinuria in phase 2 trials but await phase 3 data for approval. To reduce inflammation, high-dose steroids are ineffective and toxic in Caucasian patients, although lower-dose regimens may be effective in Chinese patients. Complement inhibition is being actively studied. The factor B inhibitor iptacopan has conditional approval. The terminal pathway inhibitors cemdisiran and ravulizumab show promise in phase 2 studies. Our current approach for those requiring immunosuppression involves combining the reduction of Gd-IgA1 (nefecon) with suppressing the effects of inflammation (iptacopan). The optimal duration of such therapy is uncertain. Clearly, there is more to be learned with many trials underway.

The Military Order Of The Serpent And Philippine War Memory, 1904-1974, Eric Jason Kriner
Student Theses and Dissertations
The Military Order of the Serpent (M.O.S.) was an American anti-Filipino minstrel fraternity and veterans' organization comprised of members of the United Spanish War Veterans. To commemorate the Philippine-American War, the group dressed in Filipino blackface and paraded around the United States from 1904 to 1974. Publicly, the group’s narrative arc posited that Filipinos, by virtue of their contact with the United States Military, underwent a rapid, three-phased evolution from savage to civil. Privately, they celebrated one of the war’s atrocities, and expressed their racist hostilities and amalgamationist anxieties. During the 1920s, when Filipino emigration to the United States began …

Determining Spatial Responses Of Fishers (Pakania Pennanti) To Mechanical Treatments Of Forest Stands For Fuel Reduction, Tessa R. Smith, Eric M. Gese, R. David Clayton, Patricia A. Terletzky, Kathryn L. Purcell, Craig M. Thompson
Wildland Resources Faculty Publications
Historical forestry practices (e.g., fire suppression, heavy timber logging) have contributed to a discernable change in stand composition of western forests in the U.S., which now comprise a tinderbox mixture of increased surface and ladder fuels, dense stands, and fire-intolerant species. Forest managers are mitigating this concern by implementing silviculture practices (e.g., selective logging, thinning, prescribed burning) to reduce fuel loads and improve stand resiliency. Concern for habitat specialists, such as the fisher (Pekania pennanti), have arisen as they may be negatively influenced in the short-term by modifications to their environment that are needed to ensure long-term habitat …
