Is There Life In The Ruins? A Look At Post-Sveen Contract Clause Jurisprudence, James W. Ely, Jr.

Seven years ago, in Sveen v. Melin, the Supreme Court applied the prevailing multipart test and rejected a contract clause claim. The result was hardly a surprise. The Court has not invoked the contract clause to invalidate a state law in more than forty years. The decision broke no new ground and seemingly signaled that the Court was content with the current multipart test, one that appears calculated to uphold state regulatory authority rather than vindi- cate the rights of contracting parties. Do Representative Payments Matter?, Brian T. Fitzpatrick, Colton Cronin

For many decades, courts have awarded the representative plaintiffs who bring class actions an extra payment when the actions recover something for the class. It has long been thought that the payments are necessary to induce a class member to step forward and serve as a representative, and, without them, many class actions would go away. Indeed, we show that the payments had become all but ubiquitous in non-securities class actions. In 2020, however, the United States Court of Appeals for the Eleventh Circuit became the only circuit to hold the payments unlawful. We test whether the Eleventh Circuit's decision …

Perioperative identification of ischemic-hypoxic tissue is essential for reducing the risk of mastectomy skin flap necrosis (MSFN), a major complication following mastectomy. Implant-based breast reconstruction is jeopardized in the presence of MSFN. However, existing technologies are limited by depth insensitivity, dye-related risks, the need for contact sensors, and an inability to simultaneously assess both blood flow and oxygenation. A multi-wavelength speckle contrast diffuse correlation tomography (MW-scDCT) system was developed for noncontact, dye-free, and depth-sensitive imaging of tissue hemodynamics in a rat model incorporating four distinct flap scenarios: sham (SH), implant (IM), half necrosis (HN), and full necrosis (FN), representing varying …

Apps for our smartphones are ubiquitous. Free apps usually require exchanging personal information. Mobile payments in the U.S. are expected to almost double by 2027. Peer-to-peer (P2P) payment apps are a subcategory of said apps. Venmo is a P2P payment app that gathers user data from their smartphone and publicizes user transactions. A between-subject survey shows respondents are concerned about privacy with P2P payment apps, even when only describing what the app does. Clusters are identified when examining involvement with P2P payment apps. Learning Camp, Language Of Instruction, And Education Outcomes: Evidence From A Field Experiment In Malawi, Hyuncheol Bryant. Kim, Kim

We conducted a randomized experiment to study the impacts of a summer learning camp and the language of instruction on education outcomes. The program, covering social studies and mathematics, provided additional high-quality learning time for 4th and 5th graders in Malawi. The program significantly increased test scores in social studies and mathematics (0.24–0.36 standard deviations). We find suggestive evidence that the impact on test scores in social studies was greater for students instructed in Chichewa, the local language, than for those instructed in English. However, we find no such evidence of differential impacts on test scores in mathematics by the …

This paper discusses pitfalls in two way fixed effects (TWFE) regressions when the outcome variables contain nonlinear and possibly stochastic trend components. If a policy change shifts trend paths of outcome variables, TWFE estimation can distort results and invalidate inference, especially in a context of evolving policy decisions. A robust solution is proposed by allowing for dynamic club membership empirically using a relative convergence test procedure. The determinants of respective club memberships are assessed by panel ordered logit regressions. Since the 1980s, Turkiye has implemented numerous initiatives to adapt to the global liberalization process following a period of import substitution policies. These initiatives were carried out with the assistance of international organizations such as the World Trade Organization (WTO).
