Teaching Firearms Law: One Big Opportunity And Three Pedagogical Challenges, Joseph Blocher, Jacob D. Charles, Darrell A.H. Miller Dec 2025

Teaching Firearms Law: One Big Opportunity And Three Pedagogical Challenges, Joseph Blocher, Jacob D. Charles, Darrell A.H. Miller

William & Mary Bill of Rights Journal

The U.S. Supreme Court’s groundbreaking 2008 decision in District of Columbia v. Heller ushered in a new era for the Second Amendment: one in which the right to keep and bear arms, long dormant as a matter of practical impact and even “embarrassing” as a matter of legal scholarship, vaulted into the front ranks of constitutional law. The Court itself has only revisited the Amendment a few times since then—albeit once by revolutionizing the doctrine. Meanwhile, lower courts have issued thousands of decisions giving shape to the right, while scholars have generated work that is increasingly deep, diverse, and challenging. …

Show And Tell: Writing Constitutional Law Casebooks When The Law Doesn't Matter, William D. Araiza Dec 2025

Show And Tell: Writing Constitutional Law Casebooks When The Law Doesn't Matter, William D. Araiza

William & Mary Bill of Rights Journal

Writing a constitutional law casebook today presents significant challenges. One reason among several stands out: law matters less—indeed, sometimes very little—to those charged with interpreting our constitutional law and implementing our constitutional system.

This Essay examines this challenge and explains how my contribution to the constitutional casebook genre attempts to answer it. It argues that the current moment requires instructors, and the books they use, to “show”—that is, to demonstrate to their students both the handiwork of those interpreters and implementers and alternative pathways. Sometimes, however, practical considerations preclude such showing. In those situations, “telling” may be required. But regardless …

Coping With A Court One Disagrees With, Randy E. Barnett, Josh Blackman Dec 2025

Coping With A Court One Disagrees With, Randy E. Barnett, Josh Blackman

William & Mary Bill of Rights Journal

Part I of this Essay focuses on our approach to teaching the constitutional canon. This part is adapted from the Preface to our constitutional law casebook. Part II traces the evolution of our casebook from the First Edition to the Fourth Edition, and the forthcoming Fifth Edition. We demonstrate that the constitutional canon has changed, but remains remarkably stable. Part III addresses how we, and other like-minded law professors, managed to teach decisions that we fundamentally disagreed with.

This abstract has been taken from the authors' introduction.

What Should A Constitutional Law Casebook Be?, William Funk Dec 2025

What Should A Constitutional Law Casebook Be?, William Funk

William & Mary Bill of Rights Journal

What is the purpose of a “casebook”? It is not a “hornbook,” designed to summarize or explain the law in a specific area, generally aimed at law students or lawyers to provide a straightforward statement of the law. It is not a “treatise,” a comprehensive, systematic exposition of the law in a particular field, involving an in-depth analysis and interpretation of the law. And it is not a “study aid,” supplementary material designed to help students do better in their classes. It is the book used by professors in their classes. For professors of constitutional law, it is a tool …

Intellectual Integrity, Collaboration, And The Market, Mark Tushnet Dec 2025

Intellectual Integrity, Collaboration, And The Market, Mark Tushnet

William & Mary Bill of Rights Journal

My reflections are those of someone who co-edited/co-authored two casebooks that were commercially and intellectually successful and one that was intellectually but not commercially successful. I start with the assumption that people decide to do a casebook because they find that existing materials don’t do some things they think ought to be done in the course (and do some things that aren’t really necessary for teaching purposes). That is, doing a casebook is at the outset an intellectual project.

Executing that project runs up against some constraints almost immediately. A simple one is that you might well think that you …

What Belongs In A Constitutional Law Casebook?, Ernest A. Young Dec 2025

What Belongs In A Constitutional Law Casebook?, Ernest A. Young

William & Mary Bill of Rights Journal

This Essay argues that constitutional law cannot (and should not) be an autonomous subject within the legal curriculum. This argument echoes a long-standing debate about whether law itself is an autonomous scholarly discipline. The answer to that question is surely, as Allan Farnsworth put it, “sometimes YES and sometimes NO.” But this Essay does not focus on law’s autonomy from other disciplines, such as political science, psychology, or economics. Rather, I consider the extent to which constitutional law should overlap with other legal subjects, such as legal history, administrative law, or statutory interpretation. My conclusion is that, at least in …

Generational Impact: How U.S. Government Generative A.I. Use Reinvigorates Copyright-Based Takings Concerns, Sophia Tully Dec 2025

Generational Impact: How U.S. Government Generative A.I. Use Reinvigorates Copyright-Based Takings Concerns, Sophia Tully

William & Mary Bill of Rights Journal

This Note argues (1) that the unique character of government copyright infringement supports a copyright holder’s use of the Takings Clause of the Fifth Amendment, as opposed to reliance on the Copyright Act for downstream Gen A.I. suits; (2) that Gen A.I. developers may wage similar claims once asserting authorship rights and copyright over their outputs; and (3) that the viability of federal government copyright infringement as a regulatory taking could change the way legal actors deal with copyrighted material. More modestly assessed, an answer on whether the Takings Clause protects copyrights would offer much needed guideposts as intellectual property …

Uncovering Conserved Biosynthetic Gene Clusters And Interbacterial Interactions Of Myxobacteria In Polymicrobial Communities, Shailaja Khanal Pokharel Dec 2025

Uncovering Conserved Biosynthetic Gene Clusters And Interbacterial Interactions Of Myxobacteria In Polymicrobial Communities, Shailaja Khanal Pokharel

Electronic Theses and Dissertations

Myxobacteria are prolific producers of specialized metabolites and key contributors to microbial interactions within soil and other environments, yet fundamental questions remain about the conservation of their biosynthetic capacities and the dynamics that shape their coexistence with neighboring microorganisms. This dissertation addresses these gaps through three integrated research directions. In Chapter 2 we utilized a pan-genome framework across eleven genera and 195 sequenced genomes, including ten newly reported isolates, and found five BGCs were identified as the conserved BGCs across the Myxococcota. These clusters encode metabolites with established ecological functions, none of which are known toxins, suggesting selective maintenance of signaling …

An Integrated Study Of Instrument Performance And Scientific Yield: Evaluation Of The Grape Design, Karla Georgina Onate Melecio Dec 2025

An Integrated Study Of Instrument Performance And Scientific Yield: Evaluation Of The Grape Design, Karla Georgina Onate Melecio

Doctoral Dissertations

This dissertation presents the end-to-end development, characterization, and in-flight validation of the 3-dimensional Gamma-Ray Polarimeter Experiment (GRAPE), a wide-field-of-view (FoV) Compton polarimeter designed for high-energy astrophysics. The primary scientific motivation is to address unresolved questions in the physics of Gamma-Ray Burst (GRB) jets, for which gamma-ray polarimetry is a critical diagnostic. GRAPE is designed to measure the degree and angle of $\gamma$-ray polarization within a targeted energy band of \SIrange{50}{500}{keV} to cover the peak energy output (E$_{pk}$) of observed GRB spectra. This work establishes the instrument's scientific readiness through two principal contributions. First, the instrument's fundamental low-energy response was characterized …

Relationships Among Institutional Betrayal, Adverse Healthcare Experiences, And College Student Health, Saba Mustafa Dec 2025

Relationships Among Institutional Betrayal, Adverse Healthcare Experiences, And College Student Health, Saba Mustafa

Honors Theses

Institutional betrayal is defined as the trauma experienced by an individual who feels that their trust in the ability of an institution to keep the individual safe is broken. Healthcare-related institutional betrayal has primarily been explored among working adults, individuals with chronic conditions, and individuals from racially diverse backgrounds. However, healthcare-related institutional betrayal has seldom been explored in college student samples, who may have different healthcare needs compared to other patient populations. The present study explored college students’ experiences with institutional betrayal due to negative healthcare experiences. Survey data were gathered from 157 college students. Measures included healthcare provider trust, …

Public Perceptions Of Sexual And Dating Violence: How Attitudes On Sexual Education, Pornography, And Masculinity Relate To Rape Myth Acceptance, Bailey Lane Saldana Dec 2025

Public Perceptions Of Sexual And Dating Violence: How Attitudes On Sexual Education, Pornography, And Masculinity Relate To Rape Myth Acceptance, Bailey Lane Saldana

Dissertations

Rape myths are false beliefs that explain sexual violence, and uphold current beliefs on sexual violence (Payne, Lonsway, & Fitzgerald, 1999). These myths can be learned and reinforced through a variety of sources, including formal school-based sexual education programs, pornography consumption, and peers. Through two studies, sexual education and rape myth were examined. In the first study, an exploratory content analysis of state sexual education guidelines was completed to better understand what information and guidance is provided by states to those providing sexual education. In the second study, a sample of 420 U.S. adults completed a factorial survey experiment wherein …

Advancements In Visualization, Post-Processing And Ai-Enhanced Modeling Of Multi-Scale Micromechanics For Composite Materials, Joao Guilherme Brites Rei Dec 2025

Advancements In Visualization, Post-Processing And Ai-Enhanced Modeling Of Multi-Scale Micromechanics For Composite Materials, Joao Guilherme Brites Rei

Masters Theses

This study addresses some of the primary deficits of a localization/homogenization workflow for composite materials by focusing on the visualization and enhancement of models based on GMC and HFGMC, with emphasis on their implementation within the NASMAT ecosystem.

This thesis details the development of two dynamic, ParaView-based plugins that convert large hierarchical simulation outputs into interactive insights. While NASMATDiscreteElement systematizes RUC creation with transparent parametrization in a reproducible GUI, NASMATExplorerRUC enables the inspection of deeply nested datasets through accurate cell picking and synchronizes comparisons between parent and child views. Additionally, a shallow U-Net neural network is optimized on HFGMC data …

Enhancing Facial Expressiveness For Games Through Procedural Animation, Abhijit Varanasi Dec 2025

Enhancing Facial Expressiveness For Games Through Procedural Animation, Abhijit Varanasi

All Theses

Facial animation is one of the most important parts of bringing characters to life in video games and virtual experiences. This thesis explores a new approach to creating more expressive facial animations using procedural techniques and blended facial performance for more flexibility. The project uses FACS (Facial Action Coding System), which breaks down facial expressions into small, measurable muscle movements. By building a facial rig based on these muscle units, the character’s face can be animated in a way that reflects real human emotion. The animation in this work is not just pre-recorded, though it can respond in real-time to …

Editable 4d Gaussian Splatting: Scalable And Consistent Video Editing Via Uv-Texture Decomposition, Shuai Lyu Dec 2025

Editable 4d Gaussian Splatting: Scalable And Consistent Video Editing Via Uv-Texture Decomposition, Shuai Lyu

All Theses

Dynamic 3D videos are now widely used in VR, AR, and telepresence, where users often want to change the style or appearance of objects such as clothing over a whole sequence. However, editing such dynamic 3D content is still hard, because appearance, geometry, and motion are tightly coupled, so even a simple color change must stay consistent in all views and at all time steps. Existing editing methods based on 4D Gaussian Splatting often work in a frame-by-frame way, which is slow and makes it difficult to keep temporal and multi-view consistency.

This thesis proposes Editable-4DGS, a representation-centric framework that …

From Directory To Database, Simeon A. Betapudi Dec 2025

From Directory To Database, Simeon A. Betapudi

SPARK Symposium Presentations

Using Optical Character Recognition (OCR) technology, I attempted to scrape Memphis City Directories images into text and to sort that data into an organized data table. While the project was ultimately unsuccessful, the purpose of the project extended beyond an organized data table. Incorporating interdisciplinary elements - in this project, a data science skillset - into historical research has become a useful, if not essential, aspect of the discipline of history. The second half of the presentation deals with the idea of the changing role of history after the advent of big data.

The Spiritual Care Of Hospice Patients With Cognitive Deficits, Shane Sullivan Dec 2025

The Spiritual Care Of Hospice Patients With Cognitive Deficits, Shane Sullivan

Doctor of Ministry Theses and Dissertations

ABSTRACT How can a hospice chaplain know whether their presence and ministry make a meaningful difference when visiting patients with dementia or other serious cognitive impairments? This project thesis seeks to answer that question conclusively. The theological foundation of this project centers on the doctrine of the imago Dei—the image of God—as it relates to individuals who are dying with cognitive deficits. Specifically, it explores how a person who is helpless and near death continues to reflect the image of God. The project intervention described here is the creation of a specialized training guide for hospice chaplains at Bridge Hospice …

University Athletic Subsidies Connections To Various Campus-Wide Outcomes, Daniel Vainner Dec 2025

University Athletic Subsidies Connections To Various Campus-Wide Outcomes, Daniel Vainner

Dissertations

This study examines the relationship between university athletic subsidies and outcomes for the broader undergraduate student population. The athletic subsidy, referred to as an athletic tax, is defined as institutional and student fees used to support athletics. Although athletics are often viewed as enhancing institutional prestige and recruitment, most universities depend heavily on subsidies to sustain their programs. In 2019, National Collegiate Athletic Association (NCAA) institutions spent over $18.8 billion on athletics, with $8.3 billion, or 44 percent, coming from institutional and student sources rather than athletic revenue (NCAA, 2019a). This research explores whether such subsidization predicts measurable differences in …

Real Laws From Imagined Facts: The Formative Role Of Assumption In Prison Litigation Reform Act Exhaustion Doctrine, Katrina T. Goto Dec 2025

Real Laws From Imagined Facts: The Formative Role Of Assumption In Prison Litigation Reform Act Exhaustion Doctrine, Katrina T. Goto

University of Chicago Law Review

In Woodford v. Ngo, the Supreme Court made explicit the judicial assumption that most prisons have effective internal grievance procedures, firmly cementing that assumption within Prison Litigation Reform Act (PLRA) exhaustion doctrine. Reliance on this assumption has contributed to doctrinal rules that map poorly onto the factual realities of prisons and require constant clarification by the Supreme Court. Indeed, the Supreme Court has been called upon twice in the past decade to sort out the mess of doctrinal rules governing PLRA exhaustion, first in Ross v. Blake and again this year in Perttu v. Richards. Examining the Court’s path to …

Teachers found it useful for lesson planning and administrative tasks. However, challenges such as plagiarism risks (15% of cases), occasional inaccuracies and cultural insensitivities especially in idiomatic and formal language use require ethical guidelines and human oversight. For example, Asian participants noted mismatches …

The Blackstone Ratio, Modified, Murat C. Mungan Dec 2025

The Blackstone Ratio, Modified, Murat C. Mungan

Faculty Scholarship

In his discussion of evidentiary policies, Blackstone famously noted that ‘it is better that ten guilty persons escape than that one innocent suffer’ (Blackstone 1769). The conventional wisdom among lawyers, judges as well as academics holds that accepting this statement as a maxim necessitates the adoption of pro-defendant evidentiary rules. It is also commonly believed that costs associated with false convictions being greater than those associated with failures to punish offenders due to the presence of punishment costs provides a utilitarian rationale for Blackstonian principles. After formalizing Blackstone ratios (either as marginal rates of substitution or, alternatively, as the ratio …

The Iron Pyramid: Expanding The Iron Triangle To Integrate Safety As A Fundamental Dimension Of Construction Success, Laura Cooley Dec 2025

The Iron Pyramid: Expanding The Iron Triangle To Integrate Safety As A Fundamental Dimension Of Construction Success, Laura Cooley

All Theses

For more than fifty years, construction project success has been judged by staying on schedule, remaining within budget, and completing the planned scope of work—an approach commonly known as the “Iron Triangle” (Barnes, Ph.D., 2006). While these measures are important, they do not capture the full range of factors that determine whether a project truly succeeds.

This study introduces the “Iron Pyramid” (Cooley, 2025), a model that expands the traditional framework by adding a fourth dimension: safety. Safety is understood not simply as regulatory compliance or the absence of injuries, but as a holistic construct encompassing project culture, leadership practices, …

Digital Solutions For Bridging Language Barriers: Designing And Testing An App For Construction Spanish Safety Communication On Construction Jobsites, Adrian Cappella Dec 2025

Digital Solutions For Bridging Language Barriers: Designing And Testing An App For Construction Spanish Safety Communication On Construction Jobsites, Adrian Cappella

All Theses

Language barriers between English-speaking supervisors and Spanish-speaking workers create safety risks on U.S. construction jobsites. Hispanic workers face higher injury and fatality rates, with miscommunication being a major contributing factor. Existing translation tools lack the accuracy, cultural context, and jobsite relevance needed for effective safety communication.

In this study a mobile application with construction-specific safety phrases in English and Spanish was designed and field tested. The research included a literature review, phrase collection and validation with industry experts, application development and design with a computer science collaborator, and usability testing with supervisors and workers. Surveys and field trials measured navigation, …

Reliable-Data-Split (Rds): Maximizing Model Potential With Reinforced Selection Strategy, Hoang D. Nguyen, Xuan-Son Vu, Quoc Tuan Truong, Duc-Trong Le

Research Collection School Of Computing and Information Systems

The nexus between data characteristics and parametric models is fundamental for developing effective and reliable artificial intelligence (AI) systems. Mismatches in data properties for model development may lead to deleterious effects on AI model performance in machine learning practice. This paper proposes a Reliable Data Split (RDS) procedure to learn how to select data points that will generalise the target domain adequately by employing prior knowledge of the data generative process. We introduce a reinforced selection strategy using deep reinforcement learning with diverse black box predictors in maximising ensemble rewards as the proxy of model performance potential while maintaining an …

Effective Transfer Of Tumor Annotations From Hematoxylin And Eosin To Fluorescence Images Of Breast And Lung Tissues, Tianling Niu, Emi Ampo, Julie M. Jorns, Mollie Patton, Tongtong Lu, Dong Hye Ye, Tina Yen, Bing Yu Dec 2025

Effective Transfer Of Tumor Annotations From Hematoxylin And Eosin To Fluorescence Images Of Breast And Lung Tissues, Tianling Niu, Emi Ampo, Julie M. Jorns, Mollie Patton, Tongtong Lu, Dong Hye Ye, Tina Yen, Bing Yu

Biomedical Engineering Faculty Research and Publications

Significance: Accurate transfer of annotations from histological images to fluorescence images is essential in developing deep learning (DL)-based optical imaging systems for intraoperative assessment of tumor margins. Manual annotation is time-consuming, prone to interobserver variability, and impractical for large-scale datasets.

Aim: We present a semi-automated method that can effectively transfer tumor annotations from pathologist-annotated hematoxylin and eosin (H&E) images to fluorescence images captured using microscopy with ultraviolet surface excitation (MUSE). This method is not intended for intraoperative use but rather to facilitate the creation of annotated datasets for DL model development.

Approach: Our semi-automated method consists of nonrigid image registration, …

Plant Community Responses To Wildfire, Timber Thinning, And Bison Reintroduction On The Northern Great Plains, Ethan H. Van-Derpoel

All Theses

The Northern Great Plains (NGP) is one of the largest intact grasslands remaining in the world. These two studies examine a few of the ecological concerns on the NGP today. First, the woody encroachment of conifers into grasslands and the effects of wildfires. Second, the effects of bison (Bison bison) reintroduction on plant communities. In Chapter 1, this study aims to examine the effects of wildfire and mechanical timber thinning, using a two-by-two factorial design, on plant community responses and forage quality in the Bull Mountains area of central Montana, USA. We found that our treatments had varying …

Unloved Ecologies, Ellen Griffin Dec 2025

Unloved Ecologies, Ellen Griffin

All Theses

Unloved Ecologies is an exhibition of ceramic sculptures that stage encounters between human and nonhuman bodies. Through it, I investigate the intersections of queer identity and ecology to reevaluate what society often deems “unlovable.” By working with the language of Queer Ecology, I explore the tensions between protection and vulnerability, as well as between cultivated order and wild resistance. Ceramic sculpture is my mode for examining moments of transformation, repair, and growth, and natural processes function as metaphors for the ways external pressures shape individuals. My overall goal is to explore the ecological processes of change and examine how our …

Locomotion And Balance Control In A Biped Robot With Continuum Legs And A Kangaroo-Inspired Tail, Gavin A. Platt Dec 2025

Locomotion And Balance Control In A Biped Robot With Continuum Legs And A Kangaroo-Inspired Tail, Gavin A. Platt

All Theses

This thesis work presents the design, testing, and validation of a continuum-legged biped robot equipped with a kangaroo inspired tail for enhanced stability and adaptability. Unlike traditional rigid link robots, this one expands on soft-legged robots and utilizes tendon-driven continuum robots to mimic octopus and kangaroo behavior for locomotion. The robot uses a hierarchical hybrid control framework to implement walking, obstacle avoidance, vaulting, and push recovery behaviors. To test the performance of the robot four sets of experiments were conducted to validate these systems and evaluate how they performed. The results demonstrate stable walking with rhythmic tail load transfer, effective …
