(1) Stablecoins should be regulated in the same way as bank deposits. …

Information Regulation As Antidiscrimination, Naomi Schoenbaum Jan 2026

Information Regulation As Antidiscrimination, Naomi Schoenbaum

GW Law Faculty Publications & Other Works

Employment discrimination law is under sustained retrenchment, nowhere more so than in hiring, the gateway to work and the foundation of equal employment opportunity. A recent executive order declared the disparate impact theory—a key doctrine of hiring equality—unconstitutional and barred its use by the federal government. The Supreme Court’s curtailment of race-conscious admissions has cast serious doubt on the future of affirmative action in employment. Enforcement agencies have redirected their efforts, abandoning disparate impact suits, scrutinizing employers’ diversity initiatives, and soliciting claims by white men. These developments further weaken a regime that has long struggled to redress discrimination at the …

This is an amicus brief in support of a petition for rehearing (and rehearing en banc) in Syneren Technologies Corp., et al, v. United States (No. 2024-1424). Amici are law professors interested in ensuring that bedrock principles of administrative law, including Administrative Procedure Act (“APA”) standards, are applied to ensure that federal agencies act with integrity, accountability, and engage in fair and regular processes that do not subject contractors to arbitrary and capricious government action.

The brief advocates for U.S. Federal Circuit en banc rehearing on the issue of whether a federal agency can unilaterally, and without leave of the …

The Gsa’S Draft Ai Clause Is Governance By Sledgehammer, Jessica Tillipman Jan 2026

The Gsa’S Draft Ai Clause Is Governance By Sledgehammer, Jessica Tillipman

GW Law Faculty Publications & Other Works

The General Services Administration's proposed contract clause, GSAR 552.239-7001, attempts to embed AI governance into federal procurement through a single default instrument applied across GSA's commercial buying channels. The clause addresses real gaps in federal AI acquisition, including inadequate transparency, weak exit rights, insufficient testing authority, opaque supply chains, and unchecked vendor dependency. But it responds by aggregating buyer protections, operational control, sourcing mandates, and politically derived performance conditions into one overburdened clause. This essay examines what the draft gets right, where it overreaches, and why the federal government's rapid shift from an AI governance vacuum to a sweeping, politically …

Taking Legal Pluralism Seriously: Federalism, Diversity Jurisdiction, And The Erie Doctrine, Paul S. Berman, Emma Bjeldanes Jan 2026

Taking Legal Pluralism Seriously: Federalism, Diversity Jurisdiction, And The Erie Doctrine, Paul S. Berman, Emma Bjeldanes

GW Law Faculty Publications & Other Works

The U.S. Supreme Court’s watershed decision in Erie Railroad Co. v. Tompkins is sometimes read to require federal judges hearing claims based on federal diversity jurisdiction to apply state law, essentially as if the case were being decided in a state court. The doctrine therefore appears to create a categorical rule disempowering federal courts from ever departing from state law, despite the Constitution’s grant of federal jurisdiction. However, as the Court’s 2026 Erie case, Berk v. Choy, makes clear, sometimes the Erie analysis is used to empower federal courts to override clear state policy choices embodied in state law simply …

Erie And The Constitution's Constraints On General Law, Anthony J. Bellia Jr., Bradford R. Clark Jan 2026

Erie And The Constitution's Constraints On General Law, Anthony J. Bellia Jr., Bradford R. Clark

GW Law Faculty Publications & Other Works

The Constitution of 1787 was the instrument by which the people of the States made a partial and conditional transfer of sovereign authority to a new federal government. To preserve the States’ residual sovereignty, the Constitution established a system of conditional federal supremacy. Specifically, it made the federal government’s ability to displace of state law contingent on compliance with specific structural and procedural safeguards. The Supremacy Clause identifies only three sources of “the supreme Law of the Land”—the Constitution, laws enacted pursuant to it, and treaties made under its authority. For each of these sources of law, the Constitution specifies …

Misinformation In Parental Alienation Discourse Can Mislead Courts And Endanger Children, Joan S. Meier Jan 2026

Misinformation In Parental Alienation Discourse Can Mislead Courts And Endanger Children, Joan S. Meier

GW Law Faculty Publications & Other Works

Common social science assertions by parental alienation proponents – in expert opinions, judicial trainings and scholarship – can persuade judges that parental alienation is both so real and so destructive that it requires the draconian remedies of removal of children from a loving, physically safe parent and/or forcing them into contact with a parent they fear. These assertions are typically stated as though they are research-based or well-established. Review of cited or other relevant research, however, shows that these assertions are misinformation, unsupported by and/or contrary to established research. This article explores two such claims: first, that children’s fear or …

Brief Amicus Curiae Of Administrative And Constitutional Law Professors In Support Of Petitioners, Alan B. Morrison, Robert L. Glicksman, Richard J. Pierce Jr, Peter Strauss, Jeffrey Lubbers

GW Law Faculty Publications & Other Works

This amicus brief was filed in DOL v. Sun Valley Orchards by Professors Alan Morrison, Rob Glicksman, Richard Pierce, Peter Strauss and Jeffrey Lubbers. Amici argue that the Supreme Court should reverse the Third Circuit’s decision that DOL lacks the power to adjudicate disputes involving the safety and adequacy of the housing, food, and transportation provided by employers to non-citizen temporary agricultural workers. The Third Circuit’s holding was based on its belief that the constitution confers the power to adjudicate such disputes exclusively on Article III courts.

Amici argue that the dispute at issue falls squarely within the scope of …

Promoting Firearm Industry Accountability For Civil And Human Rights Abuses In The United States Through Strategic Transnational Litigation, Arturo J. Carrillo, Jonathan E. Lowy, Emily Fallin Jan 2026

Promoting Firearm Industry Accountability For Civil And Human Rights Abuses In The United States Through Strategic Transnational Litigation, Arturo J. Carrillo, Jonathan E. Lowy, Emily Fallin

GW Law Faculty Publications & Other Works

The United Nations Guiding Principles on Business and Human Rights (UNGPs) have made substantial in-roads across a range of industries, but the firearm industry is not one of them. The United States is the largest producer of firearms for civilian acquisition in the world, yet U.S. firearm manufacturers, sellers, and distributors remain generally impervious to regulation. Moreover, federal and state legislation provides unique legal protections for firearm industry actors, rendering them largely shielded from accountability for contributing to gun deaths and injuries. This creates a paradox that fuels the endemic gun violence crisis in the United States and throughout the …

Two Heads Are Better Than One: Integrating International Law And Global Public Health Approaches To Firearm Violence To Promote Public Safety And Human Rights, Arturo J. Carrillo, Jonathan E. Lowy

GW Law Faculty Publications & Other Works

In his Advisory of June 25th, 2024, the U.S. Surgeon General, Vivek H. Murthy, declared firearm violence a public health crisis and presented a damning picture of the widespread deaths, injuries and trauma caused by gun violence in the United States. A critical feature of the firearm violence crisis in the United States that the Surgeon General did not expressly address in his report–or even mention–is the role of the manufacturers, distributors, and dealers of firearms, collectively referred to as “the gun industry.” It is an open secret that the U.S.-based firearm industry engages in manufacturing, marketing, distribution and sale …

Private Standards As Liability Shields: A Pro-Innovation Artificial Intelligence Regulatory Approach For States, Gary E. Marchant, Jordan Buckwald Jan 2026

Private Standards As Liability Shields: A Pro-Innovation Artificial Intelligence Regulatory Approach For States, Gary E. Marchant, Jordan Buckwald

Minnesota Journal of Law, Science & Technology

States face a dilemma. The federal government is not regulating artificial intelligence (AI), and is threatening states that regulate the technology with preemption and funding restrictions. Moreover, piecemeal state regulation with different substantive requirements risks impeding AI innovation and harming our national interest and security. And yet, AI creates a whole host of problems relating to accuracy, safety, security, bias, transparency, privacy, and autonomy that needs to be governed. This Article presents a solution to this dilemma that can protect against AI risks without harming innovation and the national interest. The proposal is for states to provide a liability shield …

Creative Destruction For The Patent System? Impact Of Generative Ai, Henry H. Perritt Jr. Jan 2026

Creative Destruction For The Patent System? Impact Of Generative Ai, Henry H. Perritt Jr.

Minnesota Journal of Law, Science & Technology

AI raises the provocative possibility that patents could one day become obsolete. AI has the ability both to generate inventions and to simulate the perspective of a person having ordinary skill in the art (PHOSITA). This article explores the transformative impact of generative artificial intelligence (AI) on the United States patent system. The article supports a scenario in which everything becomes invented—and simultaneously, everything becomes obvious—thus challenging a foundational criterion for patentability. These developments can occur within established principles of inventorship, obviousness, and subject matter eligibility under U.S. patent law. Using a narrative case study and a test invention, the …

The Right To Share: Affording Americans Meaningful Control Over Their Data, Kevin Frazier Jan 2026

The Right To Share: Affording Americans Meaningful Control Over Their Data, Kevin Frazier

Minnesota Journal of Law, Science & Technology

Americans today face unprecedented opportunities to leverage their personal data for health, education, and economic benefit; yet state and federal privacy laws increasingly restrict their ability to do so. This Article argues that the prevailing regulatory paradigm—rooted in paternalism, behavioral assumptions, and a deep distrust of both firms and individuals— has produced a system that paradoxically denies people meaningful control over their own information. As artificial intelligence tools grow more capable, the inability of individuals to share data freely threatens to entrench inequities, concentrate access to high-quality AI systems among the wealthy, and accelerate the formation of an “AI abyss” …

Occupational Exposure To Pesticides Increases The Risk Of Amyotrophyc Lateral Sclerosis: A Systematic Review And Meta-Analysis, France Labrèche, Pamela Prudhomme, Maryse Gagnon, Nicolas Dupré, Sabrina Gravel Jan 2026

Occupational Exposure To Pesticides Increases The Risk Of Amyotrophyc Lateral Sclerosis: A Systematic Review And Meta-Analysis, France Labrèche, Pamela Prudhomme, Maryse Gagnon, Nicolas Dupré, Sabrina Gravel

Études primaires

Objective To systematically review the evidence on the association between occupational exposure to pesticides and the risk of amyotrophic lateral sclerosis (ALS).

Methods A systematic search, conducted in eight bibliographic databases for publications between 1990 and 2025, identified observational studies estimating the risk of ALS after occupational pesticide exposure. Study quality was assessed using the WHO Risk of Bias (RoB) assessment instrument for systematic reviews, with the ROBINS-E (RoB in non-randomised studies of exposure) tool domains of bias. Pooled risk estimates were produced using random-effects models with restricted maximum likelihood, heterogeneity was assessed with I² statistics, and meta-regressions and publication …

Microsolvation Effects Of 1,1-Dimethyl-Biguanide (Metformin), Jasmine L. Sanders Jan 2026

Microsolvation Effects Of 1,1-Dimethyl-Biguanide (Metformin), Jasmine L. Sanders

Honors Theses

The microsolvation of a 1,1-dimethyl-biguanide hydrochloride molecule in the presence of water molecules illustrates the initial interactions between the common drug metformin and water. This explicit water-solvation approach employs coupled-cluster theory with an explicit-correlation F12 correction and the cc-pVTZ-F12 basis set to determine the optimalgeometry of the molecule and to observe intermolecular interaction energies. 1,1-dimethyl-biguanide hydrochloride (an antidiabetic agent, metformin) is constantly in contact with water molecules in the human body, where it reduces intestinal glucose absorption, lowers hepatic glucose sensitivity, and improves overall insulin sensitivity to lower blood-glucose concentration. The B3LYP method with an aug-cc-pVTZ basis set is used …

Lgbtq People's Experiences With Crime, Victimization, And The Criminal Legal System, Vanessa R. Panfil Jan 2026

Lgbtq People's Experiences With Crime, Victimization, And The Criminal Legal System, Vanessa R. Panfil

Sociology & Criminal Justice Faculty Publications

The ebb and flow of social control efforts aimed at LGBTQ people necessitate a thorough investigation into their experiences. This review of the literature is organized around four key themes that characterize LGBTQ people's experiences with crime, criminalization, victimization, and the criminal legal system—including police, courts, and carceral facilities. LGBTQ people experience excessive rates of arrest and incarceration and have higher rates of victimization, which illustrate disproportionality. Their experiences differ from those of their cisgender and heterosexual counterparts and are conditioned by age, race, class, gender, and sexual orientation, illustrating intersectionality. The two primary, interrelated mechanisms driving LGBTQ criminalization and …

Land Use And Land Cover Simulation Via Integrated Modelling With Gis Techniques For Sustainable Land Utilization Development In The Northeast Khong Subwatershed Of Thailand, ฺBanchongsak Faksomboon, Thipphaphone Keoviyavong

Applied Environmental Research

Land utilization is an important indicator of socioeconomic and environmental changes caused by both natural and man-made factors. Land use and land cover (LULC) simulation is a critical tool for monitoring and predicting LULC and is essential for sustainable development, land resource management and planning. The cellular automata (CA) Markov model is the basis for the current study’s prediction of LULC changes in the Northeast Khong Sub Watershed (NKSW). Landsat data from 2013 to 2023 were used to investigate LULC classification and determine the spatiotemporal distributions of LULC. In addition, LULC data from 2013 and 2023 were used to generate …

Applied Environmental Research

In this study, the accumulation of heavy metals (Cd, Cr, Cu, Fe, and Pb) in water, suspended sediments, sediments, and seagrass in Kalase Bay, Trang Province, Thailand, during the 2024 dry season was investigated. These findings indicate that the enrichment factor (EF) for all the metals was less than 1, suggesting that anthropogenic contamination is not a significant concern in the area. The translocation factor (TF) values were less than 1 for all the metals except Cu, whose TF was greater than 1; however, these values were not statistically significant, indicating limited phytoextraction capacity. The bioconcentration factor (BCF) values for …

Partial differential equations (PDEs) play a central role in scientific and engineering analysis, with applications spanning fluid dynamics, heat and mass transfer, electromagnetism, quantum mechanics, and financial modeling, where they are used to describe diffusion processes, wave propagation, and the evolution of complex systems over space and time. Solving multidimensional partial differential equations (PDEs) is a computationally challenging problem, even for the most advanced classical systems. Over the past decade, quantum computing has attracted significant interest as a potential approach for solving complex computational problems, including multidimensional PDEs. Although a variety of approaches have been proposed for solving PDEs, most …

Json-Ld 1.2 And Beyond: Extensions For Machine Learning Data Exchange, Muntaser Syed, Marius Silaghi, Sheikh Abujar, Rwaida Alssadi, Sharun Akter Khushbu

Electrical Engineering and Computer Science Faculty Publications

JSON-LD has become the dominant format for structured data on the web, underpinning schema.org markup, Verifiable Credentials, and knowledge graph serialization. However, the rapid integration of machine learning into data pipelines exposes critical limitations: JSON-LD lacks native mechanisms to express prediction confidence, model provenance, temporal validity, or vector embeddings—metadata essential for trustworthy AI-to-AI and AI-to-human data exchange. Additionally, context injection attacks and unbounded recursion vulnerabilities pose security risks in production deployments. This paper presents a systematic gap analysis of JSON-LD 1.1 against the requirements of modern AI systems, identifying 12 limitation categories spanning security vulnerabilities, performance bottlenecks, validation deficiencies, and …

Making Sovereigns Pay, Daniel Mandell Jan 2026

Making Sovereigns Pay, Daniel Mandell

Minnesota Journal of International Law, Vols. 28:2 onward (2019-present)

International law needs more teeth. This conclusion has been made painfully clear over the last four years as Russia has continued its war against Ukraine. Despite the fact that Russia’s actions blatantly violate international law’s prohibition on the use of force, and may violate additional provisions of the law of armed conflict, neither the International Court of Justice nor the international community have been able to end Russia’s assault through the non-military coercive measures allowed under international law. The international community has thus been placed in a Catch-22: either stand-by while international law is violated, or violate international law themselves …

Defining The Field Of Law And Macroeconomics: A Framework From International Monetary Law, Nikita Aggarwal, Adam Feibelman Jan 2026

Defining The Field Of Law And Macroeconomics: A Framework From International Monetary Law, Nikita Aggarwal, Adam Feibelman

Minnesota Journal of International Law, Vols. 28:2 onward (2019-present)

This Article proposes an analytical framework for defining the contours of the emerging field of law and macroeconomics drawing on the International Monetary Fund’s principle of “macro-criticality.” Such a framework can help steer scholarly debate toward a clearer understanding of the relationship between law and the economy and inform policymaking within that domain. In its native context, the macro-criticality principle limits the IMF’s jurisdiction to policy areas that are critical for member countries’ domestic and external stability. The IMF’s approach distinguishes between a core set of macrocritical policies and other non-core policies that are contextually macrocritical. Over time, the IMF …

An Exploratory Mixed-Method Study Of Systems For Adhd Accommodation Implementation In New York State Middle Schools, Stacie Fenn Smith Jan 2026

An Exploratory Mixed-Method Study Of Systems For Adhd Accommodation Implementation In New York State Middle Schools, Stacie Fenn Smith

Electronic Theses & Dissertations (2024 - present)

This mixed-method study examined organizational structures for ADHD accommodation implementation in New York State middle schools. While extensive research documents the effectiveness of specific ADHD accommodations, limited scholarly attention has focused on how educators organize themselves to deliver these supports consistently across multiple classroom settings. This study addressed that gap by investigating how educational leaders, teachers, and support staff structure systems for accommodation implementation. Grounded in Ecological Systems Theory (Bronfenbrenner, 1979) and Organizational Behavior Theory (Robbins & Judge, 2017), the study examined implementation across three organizational levels: building leaders, coordinators, and classroom teachers and support staff.

Data collection included a …

Climate And Environmental Controls On Forest Soil Organic Matter Cycling, Genevieve Goebel Jan 2026

Climate And Environmental Controls On Forest Soil Organic Matter Cycling, Genevieve Goebel

Dartmouth College Ph.D Dissertations

Climate change factors act on the soil environment in complex ways, known to disturb soil organic carbon (C). Rising global temperatures and alterations to regional precipitation and nitrogen deposition regimes may contribute to the intensification of global change by accelerating the rate of biological decomposition and CO2 efflux to the atmosphere. The magnitude and endurance of the disturbance to soil organic C across landscapes and throughout time that climate change factors may pose to soil C cycling are not comprehensively understood. These knowledge gaps in our field make it challenging to anticipate how soil environments and the vast ecosystems that …
