Who’S In Charge Here?: Collegiate Athletics After The House Settlement, Pamela Ko Jan 2026

Who’S In Charge Here?: Collegiate Athletics After The House Settlement, Pamela Ko

Touro Law Review

The House v. NCAA settlement, which was approved in June 2025, paved the way for groundbreaking changes to the National Collegiate Athletic Association (NCAA) and the implementation of its rules and regulations related to athlete rights, including transformative levels and types of student-athlete compensation that have never been permitted in the history of college sports. These changes fundamentally altered the relationship between many Division I student-athletes, educational institutions, athletic conferences, and the NCAA. This Article will discuss both the short and long-term impacts of the House settlement while analyzing both the continuing role of the NCAA and the role of …

Titletown Madness: Title Insurance Through The Lens Of Tribal Jurisdiction And The Lasting Legacy Of Allotment, Nicholas Stamates Jan 2026

Titletown Madness: Title Insurance Through The Lens Of Tribal Jurisdiction And The Lasting Legacy Of Allotment, Nicholas Stamates

Marquette Law Review

American Property Law and Federal Indian Law have a conjoined history going back to Johnson v. MʻIntosh, 21 U.S. (8 Wheat.) 543 (1823), where the Supreme Court ruled that private citizens could not purchase aboriginal title from Indians. Decades later, the Dawes General Allotment Act of 1887 resulted in non-Indian fee simple landowners purchasing what the Federal Government deemed “surplus” federal land in the un-allotted former Indian land, which is still part of the Reservation’s legal jurisdiction. An unintended consequence of this process, which resulted in a checkerboard pattern of land title in Indian Reservations across the country, has recently …

The Boundaries Of Law And Politics: Disputes Over Wisconsin's Maps For Political Districts Have A Long History, But The Last Few Years Have Brought Especially Intense Court Battles, John D. Johnson

Marquette Law Review

Wisconsin’s 2020 redistricting cycle was long, bitterly contested, and subject to dramatic reversals of fortune. Yet perhaps the most unusual feature of the whole process was how it ended in 2024: with a legislative redistricting plan passed by Republican legislators and signed by a Democratic Governor. Redistricting of the Wisconsin Legislature by divided political branches had occurred only three times prior in state history—in 1852, 1856, and 1971.

Redistricting may once have seemed a matter primarily of interest to political insiders. But the boundaries of legislative districts have great impact on politics and power, as the events of the last …

Justified: Reasonable Beliefs, True Beliefs, And Self-Defense, Michael D. Cicchini Jan 2026

Justified: Reasonable Beliefs, True Beliefs, And Self-Defense, Michael D. Cicchini

Marquette Law Review

A defendant is charged with criminal battery and asserts self-defense at trial. The defense calls witnesses who would testify that, about ten minutes before the fight, the alleged victim said he was going to “find” the defendant and “end him.” But the trial judge excludes the testimony because the threat, while heard by several witnesses, was not communicated to the defendant. Therefore, the judge says, the threat cannot be relevant in determining whether the defendant “reasonably believed” he was in imminent danger at that time.

This Article explores the theoretical foundation for this common ruling and demonstrates why it is …

Toward A Framework For A Law Of Electronic Intangibles Liability, James M. Beck, Alexander M. Deguire Jan 2026

Toward A Framework For A Law Of Electronic Intangibles Liability, James M. Beck, Alexander M. Deguire

Marquette Law Review

Products liability law was built for a world of gears, levers, and physical failure. It now confronts a marketplace dominated by software, data, algorithms, and artificial intelligence—objects that do not break, shatter, or wear out, but nevertheless cause real and sometimes catastrophic harm. Courts and commentators increasingly respond to this tension by asking whether these digital systems are “product-like” enough to be squeezed into existing strict liability frameworks. This Article argues that this is the wrong question.

The Article traces the historical foundations of strict products liability; explains why courts have traditionally excluded intangibles from its reach; and examines recent …

Access Denied: The Injustice Of Plra Exhaustion, Rachel Kincaid Jan 2026

Access Denied: The Injustice Of Plra Exhaustion, Rachel Kincaid

Marquette Law Review

Law students learn to “think like a lawyer” by studying appellate decisions that contain extensive reasoning and result from vigorous advocacy by lawyers on both sides. These well-reasoned decisions allow students to learn how to distill legal rules from judicial opinions: to focus on the rationale behind a court’s decision so that they might be able to predict how the court would deal with a different factual scenario. But this focus on extensively reasoned and argued appellate court opinions obscures the access-to-justice crisis plaguing our legal systems; most people cannot even afford to pay a lawyer to represent them, let …

A Matter Of Life And Death: Give Me All Of Your Money And I'Ll Give You Healthcare, Shilanka I. Lewis

Marquette Law Review

The Medicaid Estate Recovery Program (MERP) is a federal mandate requiring states to recover costs of long-term care and related services provided to Medicaid beneficiaries from their estates after death. This Article explores the core arguments supporting and opposing MERP, offering a balanced analysis of its ethical, legal, and economic dimensions. Proponents argue that estate recovery ensures fiscal responsibility by recouping taxpayer dollars and preventing wealth transfer from those who received public assistance to their heirs. Proponents contend that MERP upholds the principle that Medicaid is a need-based program and a payor of last resort. Conversely, critics argue that MERP …

Inside Out: Improving Large Model Safety, Wei Zhao Jan 2026

Inside Out: Improving Large Model Safety, Wei Zhao

Dissertations and Theses Collection (Open Access)

While Large Language Models (LLMs) and Multimodal Large Language Models (MLLMs) are at the frontier of current advancements in artificial intelligence, demonstrating remarkable capabilities across diverse applications, there are growing concerns about their reliability and security. LLMs remain vulnerable to adversarial attacks through carefully crafted prompts that circumvent safety mechanisms, while MLLMs face additional security challenges stemming from their multimodal nature. Despite considerable efforts in reinforcement learning from human feedback (RLHF) and supervised fine-tuning, existing safeguards have proven inadequate in addressing these critical vulnerabilities. This inadequacy stems from the fact that these models are inherently blackboxes that do not provide …

How Do Individual And Environmental Covariates Impact The Immune Response Of Deer Mice In Western Montana?, Rachel A. Throckmorton, Angela Luis Jan 2026

How Do Individual And Environmental Covariates Impact The Immune Response Of Deer Mice In Western Montana?, Rachel A. Throckmorton, Angela Luis

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Sin Nombre Virus (SNV) is an exceptional model system for studying wildlife disease because of how simple it is to capture, take samples, and obtain disease status from the primary host. Immune response is an important factor to consider when testing for SNV because it can affect susceptibility of the host as well as transmission of the virus. We examined individual and environmental conditions that may predict immune response and therefore possibly SNV transmission in wild populations. We investigated whether SNV infection status, reproductive status, sex, and season correlate with immune response through examining total white blood cell (WBC) counts …

Paradise Lost And Character Motivation: Sinful Behavior Or Inferiority Complex?, Esperanza Barrios Jan 2026

Paradise Lost And Character Motivation: Sinful Behavior Or Inferiority Complex?, Esperanza Barrios

Honors Theses

Sin is a concept that is always viewed through a religious perspective. But, through Paradise Lost, John Milton was able to bring further understanding towards human nature and one’s own sense of committing what’s perceived as sinful behavior without the veil of religion glazing over academics' understanding. In religious terms, sinful behavior is the idea of defying God’s commandments, but for this research, sinful behavior may be described as abnormal behavior that damages our best interests and relationships, usually for selfish gains. Each of Milton’s main characters, Satan, Adam, and Eve, fell from grace because all three damaged their relationship …

The Effects Of Vestibular Dysfunction On Cognition, Sai Puneeth Kothuru Jan 2026

The Effects Of Vestibular Dysfunction On Cognition, Sai Puneeth Kothuru

Honors Theses

Virtual Reality (VR) systems are being used more in education, entertainment, and research, but can produce motion sickness that could temporarily disrupt cognitive functioning. This study examined whether exposure to a VR roller coaster experience leads to short-term changes in cognitive flexibility, attention, spatial orientation awareness, and anxiety compared to a control condition. Participants were randomly assigned to a VR condition or a computer-based 2D viewing condition with identical roller coaster visual content. Participants completed three testing blocks: baseline, after exposure, and after a 10-minute recovery period. Cognitive flexibility and attention were assessed using the Trail Making Test (TMT), and …

Reclaiming The Constitution: "For There Is Always Light, If Only We're Brave Enough To See It", Palma Joy Strand, Gregory J. O'Meara S.J. Jan 2026

Reclaiming The Constitution: "For There Is Always Light, If Only We're Brave Enough To See It", Palma Joy Strand, Gregory J. O'Meara S.J.

Marquette Law Review

As citizens—and as lawyers—we are schooled to view the U.S. Constitution as what—indeed—“constitutes” us as a nation and as a people. As lawyers— and as citizens—we are also schooled to understand that the Constitution is law and that its meaning is to be ascertained through the process of law and by lawyers and judges. This Article builds on a popular constitutionalism frame to describe the profound limitations of restricting constitutional meaning-making to a legal enterprise performed primarily by judges—especially in regard to positive rights written into the Constitution but under-protected in constitutional law. In addition, litigation’s either–or mindset has come …

The First Amendment Right To Privacy, Alex Chemerinsky Jan 2026

The First Amendment Right To Privacy, Alex Chemerinsky

Marquette Law Review

The First Amendment is often considered to be in tension with privacy. This

Article is about the contexts in which it is not.

Although freedom of speech can pose challenges for privacy governance,

privacy is a core First Amendment value. Many important First Amendment decisions were motivated more by intuitions about privacy than any other interest. For each primary First Amendment liberty—the rights to speak, listen, associate, and practice religion—the Supreme Court has recognized not only a

substantive liberty but also the right to exercise it privately.

But although expressive privacy is an important First Amendment value, it

remains underrecognized, …

Re-Evaluating Deshany In An Era Of Gun Violence And Government Inaction, Bonnie Carlson Jan 2026

Re-Evaluating Deshany In An Era Of Gun Violence And Government Inaction, Bonnie Carlson

Marquette Law Review

In DeShaney v. Winnebago County Department of Social Services, the Supreme Court held that the State has no constitutional duty to protect individuals from violence committed by private third parties. An exception to this rule exists when the State has a special relationship to the plaintiff immediately preceding the harm. The DeShaney Court sharply proscribed the scope of the special relationship exception, holding that it only applies when the State has a plaintiff in custody. This effectively closes the door on relief for the vast majority of 42 U.S.C. § 1983 plaintiffs.

This Article proposes a new special relationship test …

Gerrymandering The Electoral College, Henry S. Noyes Jan 2026

Gerrymandering The Electoral College, Henry S. Noyes

Marquette Law Review

In Rucho v. Common Cause, the Supreme Court held that partisan gerrymandering is a nonjusticiable political question. The Court’s opinion admits that “[e]xcessive partisanship in districting leads to results that reasonably seem unjust.” The injustice is the ability of the majority party to use political gerrymandering to entrench itself as the governing party and to remain so, long after that party falls out of favor.

Although Rucho was an Elections Clause case, it is easily applicable to states’ exercise of their Electors Clause power. Republicans will wield this new, nonjusticiable power (and the concomitant political cover that it provides) …

Standalone Frisks, Elias Neibart, Bobby Levine Jan 2026

Standalone Frisks, Elias Neibart, Bobby Levine

Marquette Law Review

We all think we understand Terry v. Ohio. But we don’t. In fact, for decades, we’ve taken the wrong doctrinal lesson from Terry and its progeny.

Even though Terry discussed the constitutional standards surrounding “stop-and-frisks,” many of us have interpreted Terry as only permitting a “stop-and-then-a-frisk”—that is, a police officer is permitted to stop an individual on the suspicion that he is about to engage in criminal activity, and then, and only then, can that officer frisk the individual if he believes the suspect is armed and dangerous. But that’s not right. The Terry Court never said that. And …

Application Of Passive Samplers For Exploring Remedial Progress In The Torch Lake Aoc And Interlake Variability Of Pcbs, Cailin B. Bishop Jan 2026

Application Of Passive Samplers For Exploring Remedial Progress In The Torch Lake Aoc And Interlake Variability Of Pcbs, Cailin B. Bishop

Dissertations, Master's Theses and Master's Reports

This study evaluates changes in dissolved polychlorinated biphenyl (PCB) concentrations in Torch Lake, Michigan, an Area of Concern shaped by decades of legacy contamination and evolving restoration policy. Passive samplers deployed across sites and seasons (2024–2025) show total PCB concentrations ranging from below detection to 110 pg/L (mean = 16.8 pg/L), representing an approximate 90% decline since 2005. Comparisons with regional reference lakes indicate no statistically significant difference (p = 0.84), suggesting concentrations may approach background atmospheric levels despite continued variability. Congener profiles indicate a shift toward lower-chlorinated PCBs, though interpretation of higher-chlorinated congeners is limited by slow sorption kinetics. …

Multilayer Adaptive And Cooperative Control Of Pipeline Systems: From Local Loop Adaptation To Distributed Game-Theoretic Coordination, David Brattley Jan 2026

Multilayer Adaptive And Cooperative Control Of Pipeline Systems: From Local Loop Adaptation To Distributed Game-Theoretic Coordination, David Brattley

Dissertations, Master's Theses and Master's Reports

This dissertation presents a unified adaptive and coordinated control architecture for multi-station centrifugal pump pipeline systems operating under dynamic hydraulic conditions. Local controller adaptability is achieved using a variable-forgetting-factor Recursive Least Squares (RLS) algorithm, which continuously estimates process parameters to adjust controller gains in real time. To prevent excessive effort and controller-induced instability, a reinforcement-learning supervisory layer based on Q-learning is implemented to determine optimal adaptation-activation policies.

For pipeline systems with multiple pump stations, a game-theoretic coordination layer is introduced to balance discharge-pressure contributions, minimize pressure oscillations, and improve energy distribution across geographically distributed assets. Cooperative and non-cooperative strategies are …

Development And Calibration Of A 2-D Diesel Oxidation Catalyst Filter (Docf) Model With Spatially Varying Washcoats Using Spacims And Engine Loading Data, Thomas K. Price Jan 2026

Development And Calibration Of A 2-D Diesel Oxidation Catalyst Filter (Docf) Model With Spatially Varying Washcoats Using Spacims And Engine Loading Data, Thomas K. Price

Dissertations, Master's Theses and Master's Reports

Diesel engine exhaust contains regulated species, including carbon monoxide, hydrocarbons, nitrogen oxides, and particulate matter (PM). Meeting increasingly stringent emission standards typically requires multiple aftertreatment components, motivating the development of multifunctional devices that reduce system size, cost, and catalyst usage. Computational models are essential for guiding this design process; however, existing models primarily focus on single-function devices and rarely capture the behavior of multifunctional systems with multiple catalyst washcoats. This work presents a physics-based model of a wall-flow diesel oxidation catalyst filter (DOCF), a multifunctional device that integrates the roles of a diesel oxidation catalyst and a diesel particulate filter …

On The Vibrational Dynamics Of Wind Turbine Blades: The Oscillatory Response To Gust Pulses, And The Physical Mechanisms Behind Them, North A. Yates Jan 2026

On The Vibrational Dynamics Of Wind Turbine Blades: The Oscillatory Response To Gust Pulses, And The Physical Mechanisms Behind Them, North A. Yates

Dissertations, Master's Theses and Master's Reports

An easily noticed trend in the utility-scale wind turbine industry is that the size of the machines has continued to increase over time. While this may have benefits in terms of increasing the power generation for a single turbine, a major drawback is the rate with which the weight of the turbine blades grow. To ensure these larger machines can be utilized, efforts are being put forth to create lighter blades. This may fix the weight issue, but brings on a new one; these lighter blades can also be more flexible than previously studied ones. It is, therefore, vitally important …

Stolen Childhood: Picture Book Stories Of Indian Residential Schools, Maughn Rollins Gregory

Picture Books

In the nineteenth and twentieth centuries American and Canadian government agencies and Christian churches established Indian residential schools where hundreds of thousands of children were “reeducated” in English and Christianity. They were not allowed to use their native languages or given names, to practice their religions, or to communicate with their siblings or parents. They were made to work in crop fields, kitchens, laundries, and industrial workshops. Many were physically and sexually abused. Many never saw their families again. The nine picture books reviewed here are accounts of survivors of residential schools from eight different Indigenous nations. In addition to …
