Do An Attorney’S Actions Constitute His Client’S Intent?: The Seventh Circuit’S Broadening Of The Principles Of Waive, Alice Ward
Seventh Circuit Review
A defendant waives his right to an argument only when he intentionally chooses not to make that argument. Waiver precludes appellate review and extinguishes error. When a defense lawyer does not make an argument due to oversight or negligence, the defendant forfeits that right, and the defendant’s appeal of that issue is subject to plain error review. In United States v. Scott, the Seventh Circuit analyzed whether a criminal defendant had waived his rights to allocute and challenge his sentence of supervised release imposed at a revocation hearing. The district court judge imposed a sentence of thirty-six months supervised …

Sanctuary Jurisdictions: In A System Of Checks And Balances Who Has The Authority To Defeat Them?, Susana A. Sandoval Vargas
Seventh Circuit Review
During President Trump’s campaign, he vowed to deport the “bad hombres”—all immigrants with serious criminal records. His administration, however, is deporting more than just Mexican “criminals, drug dealers, and rapists.” The Department of Justice, under President Trump, has aggressively enforced federal immigration laws, invoking great fear in immigrant communities across the nation. In response to this hardline position on immigration enforcement, several jurisdictions throughout the United States declared themselves “sanctuaries,” or reaffirmed their already in-place sanctuary status. Generally, sanctuary jurisdictions limit the enforcement of federal immigration laws against immigrants with strong ties to the community that have no serious criminal …

You’Re Hot Then You’Re Cold, You’Re Yes Then You’Re No: How Inconsistency In The Courts Leaves Employers And Employees Vulnerable, Andrea Mireles
Seventh Circuit Review
While federal labor and employment laws try to categorize employers and employees, the lines remain blurry. Via unhelpful definitions, inconsistent application or ever-changing tests, employers and employees are often left vulnerable under these statutes—the employer because it is not clear whether he is liable under the law, and the employee because it is not clear whether he is protected under the law.
In this Note, I discuss the Seventh Circuit’s recent case regarding an indirect employer and how to establish an employment relationship under the ADA. This Note suggests that the Seventh Circuit did not properly apply a five-factor test …

However, Vinay Harpalani, a law professor at the University of New Mexico in the United States, believes that the Supreme Court will not accept it.
He said that the Supreme Court had just made a ruling on a similar issue five years ago. “It’s rare to reconsider this issue so quickly.” He said that although the previous case involved public universities and Article 14 of the Constitution. The amendment, this time involves private universities and Article 6 of the Civil Rights Law, but the legal principles are also equal protection clauses.
He also said that the "Student Fair Admissions Organization" …

Subtropical systems experience occasional severe floods, dramatically altering the phytoplankton community structure, in response to changes in salinity, nutrients, and light. This study examined the effects of a 1:100 year summer flood on the phytoplankton community in an Australian subtropical bay – Moreton Bay – over 48 weeks, from January to December 2011. Immediately after maximum flood levels were reached on the rivers flowing into the bay, the lowest salinity, and highest turbidity values, in more than a decade, were measured in the Bay and the areal extent of the flood-related parameters was also far greater than previous flood events. …

Biosensors are key components in engineered biological systems, providing a means of measuring and acting upon the large biochemical space in living cells. However, generating small molecule sensing elements and integrating them into in vivo biosensors have been challenging. Here, using aptamer-coupled ribozyme libraries and a ribozyme regeneration method, de novo rapid in vitro evolution of RNA biosensors (DRIVER) enables multiplexed discovery of biosensors. With DRIVER and high-throughput characterization (CleaveSeq) fully automated on liquid-handling systems, we identify and validate biosensors against six small molecules, including five for which no aptamers were previously found. DRIVER-evolved biosensors are applied directly to regulate …

Section of Cardiology
Background: The sinoatrial/sinus node (SAN) is the primary pacemaker of the heart. In humans, SAN is surrounded by the paranodal area (PNA). Although the PNA function remains debated, it is thought to act as a subsidiary atrial pacemaker (SAP) tissue and become the dominant pacemaker in the setting of sinus node disease (SND). Large animal models of SND allow characterization of SAP, which might be a target for novel treatment strategies for SAN diseases.
Methods: A goat model of SND was developed (n = 10) by epicardially ablating the SAN and validated by mapping of emergent SAP locations through …

Background: The prevalence of hypertension is increasing particularly among obese children and adolescents. Obese children and adolescents with hypertension are likely to remain hypertensive as they reach adulthood and hypertension is linked to an increased risk for cardiovascular disease. Twenty-four-hour ambulatory blood pressure monitoring (ABPM) has become one of the most important tools in diagnosing hypertension in children and adolescents and circadian patterns of blood pressure may be important disease-risk predictors.
Methods: A retrospective chart review was conducted in patients aged 6–21 years who underwent 24-h ABPM at Kentucky Children's Hospital (KCH) from August 2012 through June 2017. Exclusion criteria …

In 2018, the City of Toronto’s municipal election overlapped with a provincial election that brought a new government to office. While the municipal election ran for a protracted period from May 1 to October 22, the provincial election began on May 9 and ended about four weeks later, on June 7.On July 27, after only a few weeks in office, the provincial government tabled the Better Local Government Act (BLGA) and proclaimed the Bill into law on August 14.The BLGA reduced Toronto City Council from 47 to 25 wards and reset the electoral process, mandating that the election proceed under …

Effects Of Hierarchical Steepness On Grooming Patterns In Female Tibetan Macaques (Macaca Thibetana), Dong-Po Xia, Xi Wang, Paul A. Garber, Bing-Hua Sun, Lori K. Sheeran, Lixing Sun, Jin-Hua Li
Anthropology and Museum Studies Faculty Scholarship
Hierarchical steepness, defined as status asymmetries among conspecifics living in the same group, is not only used as a main characteristic of animal social relationships, but also represents the degree of discrepancy between supply and demand within the framework of biological market theory. During September and December 2011, we studied hierarchical steepness by comparing variation in grooming patterns in two groups of Tibetan macaques (Macaca thibetana), a primate species characterized by a linear dominance hierarchy. Using a focal sampling method, we collected behavioral data from two provisioned, free-ranging groups (YA1 and YA2) at Mt. Huangshan, China. We found …

The Opioid Crisis Or Climate Change: Which Is More Likely To Succeed Under The Tobacco Litigation Model?, Elizabeth W. De Leon
Texas A&M Law Review
Societal problems can occasionally have legal solutions, and several tools exist to implement change, including litigation and regulation. However, what elements make a societal problem more suitable for litigation or regulation? This Article examines four different societal issues (tobacco use, obesity, opioid addiction, and climate change) to determine whether litigation or regulation is the more appropriate route for success. The tobacco litigation serves as a successful example, while the fast food litigation serves as an unsuccessful example. Six signs of success are derived from the tobacco litigation: a large settlement agreement, evidence of corporate wrongdoing, change in public opinion, the …

Technologies for profiling samples using different omics platforms have been at the forefront since the human genome project. Large-scale multi-omics data hold the promise of deciphering different regulatory layers. Yet, while there is a myriad of bioinformatics tools, each multi-omics analysis appears to start from scratch with an arbitrary decision over which tools to use and how to combine them. Therefore, it is an unmet need to conceptualize how to integrate such data and implement and validate pipelines in different cases. We have designed a conceptual framework (STATegra), aiming it to be as generic as possible for multi-omics analysis, combining …
