Theses and Dissertations

Failing To Protect The Vulnerable: The Dangers Of Institutional Complicity And Enablers, Amos N. Guiora
Utah Law Faculty Scholarship
Criminal liability has typically been reserved for those who have both actus reus and mens rea. Omission liability is infrequent in modern criminal codes. Despite wide public support for aiding those in peril, Western democracies have historically refused to impose any penalty upon those who fail to aid someone in danger.
However recent high profile abuse scandals—including those of the USA gymnastics team, University of Michigan and the Catholic Church have caused scholars and policymakers to rethink these assumptions. In recent years, some jurisdictions have slowly come to criminalize those who witness another in peril and fail to provide aid. …

Healthcare Altruism And Dysconscious Healthism In The Delivery Of Integrated Healthcare Services To Individuals Who Are Deaf, Hard Of Hearing, And Deafblind, Jaime A.B. Wilson, Michael John Gournaris
JADARA
Healthcare altruism and dysconscious healthism are terms proposed to recognize the barriers to healthcare access faced by not only individuals with hearing loss but also all minority populations. The implications of an integrated healthcare model to provide services to individuals who are d/Deaf, hard of hearing, or DeafBlind (D/HH/DB) are explored. Unique insights are then offered regarding existing barriers to healthcare access and the next steps.

Mechanisms Linking Socioeconomic Status And Academic Achievement In Early Childhood: Cognitive Stimulation And Language, Lucy A. Lurie, Mckenzie P. Hagen, Katie A. Mclaughlin, Margaret A. Sheridan, Andrew N. Meltzoff, Maya L. Rosen
Neuroscience: Faculty Publications
There is a strong positive association between childhood socioeconomic status (SES) and academic achievement. This disparity may, in part, be explained by differences in early environmental experiences and language development. Cognitive stimulation—including language exposure, access to learning materials, caregiver involvement in children's learning, and variety of experiences—varies by SES and may link SES to language development. Childhood language development in turn is associated with academic achievement. In the current longitudinal study of 101 children (60–75 months), SES was positively associated with cognitive stimulation and performance on language measures. Cognitive stimulation mediated the association between SES and children's language. Furthermore, children's …

Business Law Beyond Business, Shawn Bayern
Business Law Beyond Business, Shawn Bayern
Scholarly Publications
The law of modern business entities is poorly understood from a comprehensive perspective. This area of law has changed significantly in the last several decades in ways that have gone largely unnoticed. The lack of attention is unfortunate because developments in the law of business-entity governance have implications for many other areas of law, beyond what are normally conceived as business-law subjects. Modern organizational statutes create something new to the legal system: a legal entity that is governed only or mainly by an operating agreement and that is capable of holding basic legal rights and forming fundamental legal relationships (like …
Decadal Disparities In The Election Of Women To State Legislatures, Jude C. Platz
Decadal Disparities In The Election Of Women To State Legislatures, Jude C. Platz
Munn Scholars Awards
Over a century has passed since the first women were elected to state legislature positions in 1894. Research shows that women are more successful in these positions as they have greater chances of bridging party lines and are more likely to enact policies representative of diverse needs. Despite this, women today account for the majority of the population but less than one-third of state legislature positions nationwide. Research seeking to understand this gap is limited; hence, there is a need for increased studies regarding what factors contribute to more women being elected to these positions. This study uses a dynamic …

Effects Of Strong Oxidants Present In Acer Spp. On Hemolysis Methemoglobin Production In Equine Erythrocytes, Gabrielle Mcgeorge, Jeffrey Lehman
Undergraduate Honors Thesis Projects
Maple toxicosis is a deadly condition affecting equines after they have ingested wilted leaves of the genus Acer (i.e., maple species). It is characterized by hemolytic anemia and methemoglobinemia. Although the toxins responsible for causing toxicosis have not been identified, they are thought to be strong oxidants. The objective of this study is to determine the effect of eight compounds (galloyl derivatives) found in Acer spp. on hemolysis and methemoglobin production in bioassays with equine erythrocytes. Seven of the compounds are known constituents of Acer spp. that are commercially available. One of the compounds--acertannin--was isolated and characterized from leaf extracts …

Reconstruction Of Historical Surface Mass Balance, 1984–2017 From Greentraacs Multi-Offset Ground-Penetrating Radar, Tate G. Meehan, H.P. Marshall
Geosciences Faculty Publications and Presentations
We present continuous estimates of snow and firn density, layer depth and accumulation from a multi-channel, multi-offset, ground-penetrating radar traverse. Our method uses the electromagnetic velocity, estimated from waveform travel-times measured at common-midpoints between sources and receivers. Previously, common-midpoint radar experiments on ice sheets have been limited to point observations. We completed radar velocity analysis in the upper ∼2 m to estimate the surface and average snow density of the Greenland Ice Sheet. We parameterized the Herron and Langway (1980) firn density and age model using the radar-derived snow density, radar-derived surface mass balance (2015–2017) and reanalysis-derived temperature data. We …

Geosciences Faculty Publications and Presentations
Revealing the timescales of metamorphic and anatectic processes is central to our understanding of tectonic evolution of collisional orogens. High‐temperature migmatites and leucogranites are well exposed in the Himalayan orogenic core, making it an ideal region to study the timing and duration of partial melting and melt crystallization of the orogen. Here, we report an integrated and comprehensive data set of petrography, U‐Pb age, and trace element data for zircon from a pelitic granulite and associated leucosomes of the Greater Himalayan Sequence (GHS) in the Yadong area, eastern Himalaya. Zircon grains with complex internal structure retain variable ages ranging from …
Interprofessional Approach To Medication Reconciliation In The Hospitalized Medicare Patient., Misty Robertson
Interprofessional Approach To Medication Reconciliation In The Hospitalized Medicare Patient., Misty Robertson
Doctor of Nursing Practice Projects
Background
Poor medication reconciliation processes in acute care hospitals, combined with poor communication across the healthcare team, and a failure to bring specialized pharmacy resources to the team can be attributed to adverse drug events that in turn result in hospital readmissions within 30 days of discharge (Sutherland, David-Kasdan, Beloff, Mueller, Whang, Bleday, & Urman, 2016).
Project Design
The aims of project included: 1. Utilize an interprofessional team that included, nursing, pharmacy, RN care management, and physicians to develop hospital policy and procedures for medication reconciliation, 2. How The Supreme Court Can Improve Educational Opportunities For African American And Hispanic Students By Ruling Against Harvard College’S Use Of Race Data, Genevieve Kelly
University of Michigan Journal of Law Reform Caveat
Students for Fair Admissions v. Harvard has not only exposed ways in which Harvard College’s admissions office unfairly assesses Asian American applicants, but it has also revealed that Harvard’s fixation on race per se can disadvantage the very African American and Hispanic students best positioned to bring instructive and underrepresented perspectives to the college. The facts show that Harvard’s “tips” and “one-pager” system values African American and Hispanic students for their ability to boost Harvard’s racial profile more than for their actual experiences confronting racial discrimination. This Comment explains how, by ruling against Harvard (and without overruling Grutter or Fisher …

An Analysis Of Dyslexia Legisation And Implementation Guidelines In Midwestern States, Josephine A. Denning
Honors Thesis
The purpose of this thesis is to describe dyslexia legislation and implementation guidelines in South Dakota and selected surrounding states. Dyslexia has been defined as a language-learning disability that affects a person's reading and writing skills negatively.
Federal legislation, The Individuals with Disabilities in Legislation Act (2004), identifies dyslexia as a specific learning disability; however, distinguish dyslexia from a broader category. Legislation and requirements are being recently passed in multiple states, affecting dyslexia policy. This thesis will provide an overview of the legislation and guidelines of dyslexia in Midwest region. Best practices in assessment and instruction for dyslexia have been …
Negotiating Multilingual Writer Identity In The Dissertation: International Perspectives On Language And Writing Practices, A. Brooke Boulton
Negotiating Multilingual Writer Identity In The Dissertation: International Perspectives On Language And Writing Practices, A. Brooke Boulton
Education Doctorate Dissertations
Globalization and internationalization of higher education have perpetuated the dominance of English as the language of production and reproduction in doctoral education. English dominance considers the status of English as a lingua franca in academia. Multilingual students for whom English is not the first language must engage in complex language and writing practices to meet university and publication standards, globally. As writing is identity work, students must negotiate thought and writing in two or more languages to achieve meaningful self-expression and to represent authentic, authoritative voices in English. Data representing students from 17 different countries and speaking 14 different languages …

Statistical Analysis Of A Joint Stochastic Model For Recurrent Competing Risks, Longitudinal Marker, And Health Status, Lili Tong
Theses and Dissertations
Joint modeling approach has been applied in many applications in biomedical, reliability, and social-economic research. For example, in clinical trials and medical research, different kinds of patient information are gathered over time, such as recurrent competing risk events (e.g., relapses of different types of tumor), longitudinal marker (e.g., tumor size), and health status (e.g., if a patient is dead or not). These data are usually correlated, joint models enable the analysis of these correlated data. This dissertation proposes a class of joint dynamic models for simultaneously modeling the three types of processes: a recurrent competing risk (RCR) process, a health …

Building Community Among International Students Through Purposeful Selection Of Fictional Literature, Michael Robert
Theses and Dissertations
Purposefully selecting text is a longstanding challenge for teachers of multinational, adult learners enrolled at language schools. International students come from diverse cultural backgrounds, have been educated in different academic systems, are of different ages, and have separate interests; therefore, it is difficult for teachers to effectively select text to meet this disparate student group’s needs. The purpose of this action research investigation was to identify an effective strategy to select reading material that fosters student engagement through a shared reading interest.
This action research investigation used exploratory qualitative methods in a constructivist grounded theory approach. I conducted semi-structured interviews …
Relationship Of General Athletic Performance Markers To Intra-Team Ranking Of Sport Performance, Steven Keith Scruggs Ii
Relationship Of General Athletic Performance Markers To Intra-Team Ranking Of Sport Performance, Steven Keith Scruggs Ii
Theses and Dissertations
A foundational principle in sport science involves applying an evidence-based approach to training and development of athletes. The primary objective is to provide an effective training program, while monitoring general athletic performance (GAP) development (i.e., athlete-monitoring), ensuring intended adaptations are occurring. Much of the literature has focused on GAP markers (e.g., physical qualities related to strength, speed, power, agility, and endurance) which are only suggested to influence competitive sport performance (SP) outcomes (e.g., yards per carry, batting average, hitting percentage, rank or placement, etc.; B. Alejo, personal communication, July 13, 2019). This gap in the literature should be filled via …
