The Meaning And Ambiguity Of Section Three Of The Fourteenth Amendment, Kurt T. Lash Jan 2024

The Meaning And Ambiguity Of Section Three Of The Fourteenth Amendment, Kurt T. Lash

Law Faculty Publications

The Fourteenth Amendment established the constitutional conditions for the readmission of those states which had attempted to secede from the Union during the American Civil War. Section Three of that amendment, when enforced under the powers granted by Section Five, prevented the leaders of the recent rebellion from returning to Congress, holding any state level office, or receiving any appointment by Democrat President Andrew Johnson, absent congressional permission. Its focus, in other words, was on rebellious disruption of state level decisionmaking and the potentially disruptive appointments by President Johnson. Whether Section Three accomplishes anything more remains unclear as a matter …

Duncan NRI Faculty and Staff Publications

Background: A hereditary condition primarily affecting the kidneys and heart has newly been identified: the RRAGD-associated autosomal dominant kidney hypomagnesemia with cardiomyopathy (ADKH-RRAGD). This disorder is characterized by renal loss of magnesium and potassium, coupled with varying degrees of cardiac dysfunction. These range from arrhythmias to severe dilated cardiomyopathy, which may require heart transplantation. Mutations associated with RRAGD significantly disrupt the non-canonical branch of the mechanistic target of rapamycin complex 1 pathway. This disruption hinders the nuclear translocation and transcriptional activity of the transcription factor EB a crucial regulator of lysosomal and autophagic function.

Summary: All identified RRAGD variants compromise …

Compassion Cartography: Mapping The Psychological Landscape Of Altruistic Equity And Effectiveness, Kyle Fiore Law Jan 2024

Compassion Cartography: Mapping The Psychological Landscape Of Altruistic Equity And Effectiveness, Kyle Fiore Law

Electronic Theses & Dissertations (2024 - present)

Psychologists and philosophers have often championed deliberative reasoning over empathy as a better approach to overcoming parochial biases and guiding altruistic equity and effectiveness. Advocates of the effective altruism (EA) philosophy even advise philanthropists to downregulate empathic responses to maximize the impact of their donations. However, recent research reveals that extraordinary altruists (XAs), such as those who donate organs to strangers, are driven primarily by empathy. This dissertation explores whether empathy necessarily impedes altruistic equity (impartial regard for others’ welfare) and effectiveness (prioritizing impact), revealing a more nuanced reality that challenges this perspective. Across two phases of research involving three …

The Role Of Familial Support And Gender In Asian American Students’ Stem Career Development: A Test Of Social Cognitive Career Theory, Xiao Ting Wang Jan 2024

The Role Of Familial Support And Gender In Asian American Students’ Stem Career Development: A Test Of Social Cognitive Career Theory, Xiao Ting Wang

Electronic Theses & Dissertations (2024 - present)

This study, based on Social Cognitive Career Theory (SCCT; Lent et al., 1994, 2000), investigated the role of familial support in the STEM career development of Asian American college students. Participants included 446 first-year undergraduate students who identified as Asian or Asian American and had not declared an academic major. Due to multicollinearity, four initial familial support variables—instrumental assistance, career-related modeling, verbal encouragement, and emotional support—were regrouped into two: performance motivation (instrumental assistance and verbal encouragement) and career mentoring (career-related modeling and emotional support). Structural equation modeling showed acceptable fit for a modified model, and the results partially supported the …

Stratifying The Social: The Race/Class Dialectic And The Fetishization Of Race In Our Neoliberal Contemporary, Steven D. Delmagori Jan 2024

Stratifying The Social: The Race/Class Dialectic And The Fetishization Of Race In Our Neoliberal Contemporary, Steven D. Delmagori

Electronic Theses & Dissertations (2024 - present)

This dissertation utilizes the lens of Social Reproduction Theory to examine the consequences of viewing race and racism and other systems of oppression like Patriarchy as separate or additive autonomous ontologies. Intersectionality Theory posits oppressions as independent systems that “add” or “intersect” onto oppressed subjects in particular circumstances. On the other hand, responding to Intersectionality Theory, Social Reproduction Theory understands systems of oppression as mutually constitutive social relations. Social Reproduction Theory therefore allows for a more thorough understanding of the relationship between racism and other systems of oppression and their own relationship to capitalism. Rather than theorizing these social relations …

Re-Globalizing Yorkville: The Languages On Shop Signs In A Non-Migrant Neighborhood, Lisabeth G. Dashman Jan 2024

Re-Globalizing Yorkville: The Languages On Shop Signs In A Non-Migrant Neighborhood, Lisabeth G. Dashman

Electronic Theses & Dissertations (2024 - present)

The term “linguistic landscape” is used to describe the usage and placement of language in public places of a specific geographic area, such as on buildings, street names, pedestrian notices, vehicular warnings, and advertising billboards. Studies of a space’s linguistic landscape typically involve an accounting and analysis of the visible signs and/or the presentation of bystanders’ or researchers’ thoughts and observations. This study instead probes the intentions of the sign creators: the owners of the façade sign and the business it advertises. The façade sign, often called the shop sign, is frequently the first image for a business that a …

Stakeholders’ Participation In Pcaob Audit Standard Setting, Xiaoshuai Yang Jan 2024

Stakeholders’ Participation In Pcaob Audit Standard Setting, Xiaoshuai Yang

Electronic Theses & Dissertations (2024 - present)

Lobbying is an integral part of the Public Company Accounting Oversight Board’s standard-setting process. Although the PCAOB has been drafting auditing standards for over 20 years, there is still much to learn about how stakeholder behavior in submitting comment letters to the PCAOB varies by interest group, comment period (concept release, proposal, and reproposal), the stakeholder’s position on the proposal, arguments used, and emotional strategies. This paper examines PCAOB Docket 034, which proposed audit report reforms, including the auditor’s disclosure of critical audit matters (CAMs). There was strong stakeholder participation and conflicting opinions when this standard was under discussion. To …

Progress And The Taking Of Indigenous Land, Ezra Rosser Jan 2024

Progress And The Taking Of Indigenous Land, Ezra Rosser

Scholarly Articles in Law Reviews & Journals

The taking of Indigenous land in furtherance of other societal goals is so ubiquitous and so fundamental to the American project that sometimes acts of dispossession are not even recognized as such. This Article argues that the generally accepted understanding of Hawaii Housing Authority v. Midkiff, a key case of the American takings law canon, is wrong because it overlooks Native Hawaiian claims to the land taken. Hawai‘i’s Land Reform Act allowed tenants a right to purchase land over the objections of the owner of the underlying property and in Midkiff the U.S. Supreme Court said that states had the …

Digital Bank Holidays, Hilary J. Allen Jan 2024

Digital Bank Holidays, Hilary J. Allen

Scholarly Articles in Law Reviews & Journals

The March 2023 run on Silicon Valley Bank spurred renewed debate about how to structure deposit insurance to best eliminate future bank runs. This Article argues, however, that deposit insurance cannot be relied upon to eliminate all bank runs, especially if technological developments create potential new bank run triggers that deposit insurance may not be responsive to. We may be expecting too much of deposit insurance, and so it is worth considering other tools that might be useful in responding to future bank runs and broader banking panics. One such tool is the “bank holiday,” last deployed in the United …

Why The Supreme Court Rejected The Prospect Theory Of Copyright Scope, Michael W. Carroll Jan 2024

Why The Supreme Court Rejected The Prospect Theory Of Copyright Scope, Michael W. Carroll

Scholarly Articles in Law Reviews & Journals

In Google LLC v. Oracle America, Inc. (“Google v. Oracle”), and again in Andy Warhol Found. for the Visual Arts, Inc. v. Goldsmith (“Warhol”), the parties and various amici presented the Court with a variety of arguments about the relationship between a copyright owner's right to make derivative works from a protected work and a user's right to make fair uses of that same work. At bottom, these arguments were about the proper, or even optimal, scope of copyright. This Essay argues that these arguments were instead grounded in a form of ““prospect theory” of copyright scope that would give …

Salt marshes exist at the terrestrial-marine interface, providing important ecosystem services such as nutrient cycling and carbon sequestration. Tidal inputs play a dominant role in salt marsh porewater mixing, and terrestrially derived freshwater inputs are increasingly recognized as important sources of water and solutes to intertidal wetlands. However, there remains a critical gap in understanding the role of freshwater inputs on salt marsh hydrology, and how this may impact marsh subsurface salinity and plant productivity. Here, we address this knowledge gap by examining the hydrologic behavior, porewater salinity, and pickleweed (Sarcocornia pacifica also known as Salicornia pacifica) plant productivity along …

Climate-Influenced Phenology Of Larval Fish Transport In A Large Lake, Spencer T. Gardner, Mark D. Rowe, Pengfei Xue, Xing Zhou, Peter J. Alsip, David B. Bunnell, Paris D. Collingsworth, Edward S. Rutherford, Tomas O. Höök

Michigan Tech Publications

Elucidating physical transport phenologies in large lakes can aid understanding of larval recruitment dynamics. Here, we integrate a series of climate, hydrodynamic, biogeochemical, and Lagrangian particle dispersion models to: (1) simulate hatch and transport of fish larvae throughout an illustrative large lake, (2) evaluate patterns of historic and potential future climate-induced larval transport, and (3) consider consequences for overlap with suitable temperatures and prey. Simulations demonstrate that relative offshore transport increases seasonally, with shifts toward offshore transport occurring earlier during relatively warm historic and future simulations. Intra- and inter-annual trends in transport were robust to assumed pelagic larval duration and …

Associations Of Antioxidant Consumption From Food And Supplement Sources On Cognitive Function In Older Adults, Kelly Knoll Jan 2024

Associations Of Antioxidant Consumption From Food And Supplement Sources On Cognitive Function In Older Adults, Kelly Knoll

Health Nutrition and Exercise Science

Oxidative stress, the imbalance of prooxidants and antioxidants, has been recognized as a possible risk factor for cognitive impairment. We postulate that increased dietary antioxidant consumption could help preserve cognitive function during aging. Dietary intake and cognitive function of 50 adults aged ≥65-years (66% women; aged 71.5±5.1 years) was assessed using Cronometer, an electronic nutrition analysis application, and the Saint Louis University Mental Status examination. The fisher’s exact test (p < 0.01) identified a significantly lower percentage of cognitive dysfunction (31.6%; 6 of 19 participants) among participants that met the Recommended Daily Allowances (RDAs) for the antioxidants, vitamin C, vitamin E, selenium, and manganese, and a higher percentage of cognitive dysfunction among those that did not meet the antioxidant RDAs (74.2%; 23 of 31 participants). However, mean cognitive scores differed insignificantly between those meeting RDAs (26.2 ±4.2 points) and those that did not (24.9 ±2.9 points; p = 0.07).

Justice William J. Brennan Jr.'S Teleological Jurisprudence And What It Means For Constitutional Interpretation Today, Susan D. Carle Jan 2024

Justice William J. Brennan Jr.'S Teleological Jurisprudence And What It Means For Constitutional Interpretation Today, Susan D. Carle

Scholarly Articles in Law Reviews & Journals

Observers commonly think of the Warren and Roberts Courts as polar opposites in their modes of constitutional interpretation. But how different are their approaches really? To be sure, the values that underlie the jurisprudence of the Warren and Roberts Courts are dramatically different, but their methodologies for constitutional adjudication are similar in a crucial respect: both Courts frequently employ a teleological approach. They look, in other words, to ends outside of the law to determine the direction in which constitutional law should be heading.

To prove this point, this Article examines the methods and values Justice William J. Brennan Jr. …

Brillouin Zones Of Integer Lattices And Their Perturbations, Herbert Edelsbrunner, Alexey Garber, Mohadese Ghafari, Teresa Heiss, Morteza Saghafian, Mathijs Wintraecken

School of Mathematical & Statistical Sciences Faculty Publications

For a locally finite set, 𝐴⊆ℝ𝑑 , the 𝑘 th Brillouin zone of 𝑎∈𝐴 is the region of points 𝑥∈ℝ𝑑 for which ‖𝑥−𝑎‖ is the 𝑘 th smallest among the Euclidean distances between 𝑥 and the points in 𝐴 . If 𝐴 is a lattice, the 𝑘 th Brillouin zones of the points in 𝐴 are translates of each other, and together they tile space. Depending on the value of 𝑘 , they express medium- or long-range order in the set. We study fundamental geometric and combinatorial properties of Brillouin zones, focusing on the integer lattice and its perturbations. Our …

Fuzzy Similarity Analysis Of Effective Training Samples To Improve Machine Learning Estimations Of Water Quality Parameters Using Sentinel-2 Remote Sensing Data, Alireza Taheri Dehkordi, Mohammad Javad Valadan Zoej, Ali Mehran, Mohsen Jafari, Amir Masoud Chegoonian Jan 2024

Fuzzy Similarity Analysis Of Effective Training Samples To Improve Machine Learning Estimations Of Water Quality Parameters Using Sentinel-2 Remote Sensing Data, Alireza Taheri Dehkordi, Mohammad Javad Valadan Zoej, Ali Mehran, Mohsen Jafari, Amir Masoud Chegoonian

Faculty Research, Scholarly, and Creative Activity

Continuous monitoring of water quality parameters (WQPs) is crucial due to the global degradation of water quality, primarily caused by climate change and population growth. Typically, machine learning (ML) models are employed to retrieve WQPs, but they require a large amount of training samples to accurately capture the data relationships. Even with sufficient training data, discrepancies still exist between values of predicted and in-situ WQPs. This study proposes a fuzzy similarity analysis (FSA) technique to enhance ML estimates of WQPs by using the prediction errors in effective training samples. The method was successfully applied to retrieve turbidity (Turb) and specific …

Using Problem-Based Exploratory Training To Improve Pilot Understanding Of Autopilot Functions, Jordy K.Van Leeuwen, Annemarie Landman, Eric L. Groen, Randall J. Mumaw, Olaf Stroosma, Marinus M.Van Paassen, Max Mulder

Faculty Research, Scholarly, and Creative Activity

Previous research indicated a need to improve pilot training with regard to understanding of autopilot logic and behavior, especially in non-routine situations. Therefore, we tested the effect of problem-based exploratory training on pilots’ understanding of autopilot functions. Using a moving-base flight simulator, general aviation pilots (n = 45) were trained to diagnose failures either without foreknowledge and guidance (exploratory group), without foreknowledge but with some guidance (exploratory-guidance group) or with foreknowledge and full guidance (control group). They subsequently performed six test scenarios in which their understanding of the effects of failures was tested by requiring them to deduce the failures …

Matrix Stiffness Sensing By Nascent Adhesions And The Role Of Riam In Adhesion Assembly, Nikhil Mittal Jan 2024

Matrix Stiffness Sensing By Nascent Adhesions And The Role Of Riam In Adhesion Assembly, Nikhil Mittal

Dissertations, Master's Theses and Master's Reports

Mechanical stiffness of the extracellular matrix (ECM) impacts many cellular functions such as proliferation, migration, and differentiation. ECM stiffness is sensed by a cell via integrin-based focal adhesions (FAs) by changing conformation and biochemical activities of molecules within FAs by the exchange of the force between the ECM and filamentous actin (F-actin). Cells in turn respond to this stiffness by generating traction force that plays an important role in many biological events such as tissue morphogenesis, stem cell differentiation, wound healing, and cancer cell metastasis. The stiffness of the extracellular matrix induces differential tension within integrin-based adhesions. Understanding stiffness sensing …

Computational Analysis Of Vascular Aneurysms, Seyedmostafa Rezaeitaleshmahalleh Jan 2024

Computational Analysis Of Vascular Aneurysms, Seyedmostafa Rezaeitaleshmahalleh

Dissertations, Master's Theses and Master's Reports

Vascular aneurysms, such as intracranial aneurysms (IAs) and abdominal aortic aneurysms (AAAs), pose significant health risks, particularly upon rupture. Disturbed hemodynamics, characterized by swirling flow patterns, can lead to cellular and structural changes that disrupt normal physiological processes and contribute to destructive vascular remodeling. Integrating hemodynamic analysis into clinical assessments of aneurysms has become crucial, especially through patient-specific computational fluid dynamics (CFD) simulations based on medical imaging. However, the complexity of CFD tools presents challenges in model creation and post-simulation analysis, limiting their accessibility to clinicians.
This project aimed to advance aneurysm management by exploring the role of intraluminal thrombus …

Analyzing American Voters’ Positive And Negative Responses To Ai-Generated Political Advertisements, Grace Schofield Jan 2024

Analyzing American Voters’ Positive And Negative Responses To Ai-Generated Political Advertisements, Grace Schofield

Honors

AI-generated political ads have entered the public sphere, but what responses do these ads get from American voters? If voters respond positively to the ads, those could be a viable path political campaigns can venture down. To determine voter responses, a survey will be delivered to a representative sample of the American voting population across age groups, gender, and political leaning, among other areas. Research showed that voters responded negatively to advertisements containing AI-generated imagery overall and were able to identify AI-generated images. They felt more negatively about advertisements when they believed the advertisements contained AI-generated imagery before their suspicions …
