Displaced Worker Angst And Far Right Populism, Thomas E. Lambert
Displaced Worker Angst And Far Right Populism, Thomas E. Lambert
Faculty and Staff Scholarship
Background
Nothing causes more anguish and frustration than downward social mobility such as that experienced by less-educated workers and especially by displaced workers. Those who lose economic status lose more than income because they become so socially isolated that they are further frustrated through loneliness (Case and Deaton 2020). Hanna Arendt points out that lonely men are susceptible to authoritarian influence (1973, p. 475).
There is yet another aspect to the downward social mobility of low skilled men, namely that they are losing ground not only relative to social norms but also relative to the wages of low-skilled women. In …

Aim/Purpose The teaching of appropriate problem-solving techniques to novice learners in undergraduate software development education is often poorly defined when compared to the delivery of programming techniques. Given the global need for qualified designers of information technology, the purpose of this research is to produce a foundational template for an educational software development methodology grounded in the established literature. This template can be used by third-level educators and researchers to develop robust educational method-ologies to cultivate structured problem solving and software development habits in their students while systematically teaching the intricacies of software crea-tion. Background While software development methodologies are …

A machine is described as an assembly that has a drive system installed or is planned to have a drive system installed and that is constituted of linked elements or components, at least one of which moves, that are connected for a particular application (ISO12100). Different types of risks are present in machines, and exposure to them can cause harm or even death. When risk has been adequately reduced, machinery safety considers a machine's ability to complete its intended duty throughout its life cycle. A literature review was carried out using “safety of machinery” as a keyword, which produced an …
Content Moderation Regulation As Legal Role-Scripting, Sari Mazzurco
Content Moderation Regulation As Legal Role-Scripting, Sari Mazzurco
Faculty Journal Articles and Book Chapters
Lawmakers and scholars concerned with content moderation regulation typically appeal to "analogies" to justify or undermine different forms of regulation. The logic goes: law should afford individuals due process rights against speech platforms because speech platforms are "like" speech governors as a matter of objective reality. Other common analogies include common carriers, publishers, distributors, shopping malls, and bookstores. Commentators attempt to invoke social roles to understand what the content moderation relationship is, what behaviors are "right" and "wrong" within it, and how law should police behavioral deviations. But they do so without relying on foundational sociology theory that explains what …

Generative AI is booming. This technology offers amazing opportunities for growth in various business sectors and creates the opportunity for swift progress on medical innovations, climate change, world hunger, and innumerable other areas. AI also poses a number of challenges, though, such as replacing human workers and exacerbating pernicious biases. Another major concern about generative AI is singularity-the idea that this technology could surpass human intelligence and subjugate us or render us extinct. Although some commentators discount this possibility, the fact that AI experts such as Geoffrey Hinton, Sam Altman, and Elon Musk share the singularity concern should at least …

Cardozo Arts & Entertainment Law Journal
The note explores the legal challenges faced by creators of fan remakes of delisted video games under the Digital Millennium Copyright Act (DMCA) and proposes potential solutions to address these issues. It argues that expanding exemptions for such works and adopting a statutory licensing regime could provide a legal framework that balances the rights of copyright holders with the creative interests of fan creators. The analysis emphasizes the need for reforms to prevent overly broad enforcement of copyright protections and to incentivize fair use considerations.
Bias Notification Duty, Eldar Haber, Shai Stern
Bias Notification Duty, Eldar Haber, Shai Stern
Cardozo Arts & Entertainment Law Journal
Algorithms are often tainted with bias that could negatively affect subjects' lives in many aspects. But while policymakers and scholars tend to focus their attention on methods to fix the bias within the algorithm or its output, they neglect a crucial piece of the puzzle: when companies discover bias and fix it in the algorithmic output, they do so behind the scenes. While such a move might debias the output, society remains in the dark about its existence or how it might have affected the outcome. Society thus misses a unique opportunity to study social and cognitive biases that shape …
The New Frontier For Bankruptcy: Crypto, Lindy Lofton
The New Frontier For Bankruptcy: Crypto, Lindy Lofton
Cardozo Arts & Entertainment Law Journal
The note examines the regulatory challenges posed by the rise of cryptocurrency platforms like Celsius and FTX, which have faced significant financial difficulties and bankruptcy. These platforms operate similarly to traditional banks and brokerages but lack the same regulatory oversight, leaving customers vulnerable without protections like FDIC insurance. The note argues that adopting legislation akin to the Banking Act of 1933 or the Securities Investor Protection Act (SIPA) could provide necessary safeguards, such as insurance mechanisms similar to FDIC or SIPC. However, the decentralized nature of cryptocurrency and opposition from the crypto community pose challenges to implementing such regulations. The …
Trademark Fair Use Is No Joke, Christine Haight Farley
Trademark Fair Use Is No Joke, Christine Haight Farley
Cardozo Arts & Entertainment Law Journal
The article critiques the Supreme Court's decision in Jack Daniel's Properties v. VIP Products, arguing that the Court missed an opportunity to clarify the relationship between trademark law and the First Amendment. While the Court acknowledged the importance of protecting parodies, it failed to develop a comprehensive framework for balancing trademark rights with free speech. Instead, it introduced a narrow rule that limits the application of the Rogers test, potentially undermining speech protections in trademark disputes. The article contends that the Court's reliance on the likelihood of confusion test is insufficient to address the broader First Amendment implications of …
What Recent Scrutiny Surrounding New Jersey's Newborn Screening Program Is Missing: Comment On The Reproductive And Social Justice Issues The Program Illuminates, Dylan Blanchard
Cardozo Arts & Entertainment Law Journal
The note critiques New Jersey's Newborn Screening Program, highlighting its constitutional and social justice implications. While the program is a vital public health measure, its retention of newborn blood samples without informed consent and subsequent use by law enforcement raises significant Fourth Amendment concerns. The analysis argues that the program disproportionately impacts minorities and perpetuates systemic racism in the criminal legal system, as biometric data from these samples can be used to bypass probable cause requirements.

Regulatory Approaches To Consumer Protection In The Financial Sector And Beyond: Towards A Smart Disclosure Regime?, Nydia Remolina, Yvonne Ai-Chi Loh, David Hardoon
International Journal on Consumer Law and Practice
Consumer and data protection policies often focus on consent and information disclosure. The purpose of these regulatory strategies is the protection of consumers by reducing some contracting failures, such as asymmetries of information and a lower bargaining power, especially in transactions involving complex issues such as financial products and sensitive personal data. In the past, regulators have responded to privacy and consumer protection by adopting what this article refers to as an “imperfectly informed regime”, in which consumers do not receive full information about the risks associated with their decisions, even if they are still protected through a variety of …
Impact Of Social Media Influencers On Consumer Choice: A Case Study Of Reviews By Youtubers, Faisal Fasih
Impact Of Social Media Influencers On Consumer Choice: A Case Study Of Reviews By Youtubers, Faisal Fasih
International Journal on Consumer Law and Practice
Consumer participation is vital for businesses, especially in online markets, because potential customers cannot physically check the product. One of the standard options is to watch the review on YouTube, a source of a host of information, including consumer-related products. However, it also provides a fertile ground for disseminating misinformation, including fake reviews of consumer goods, because the contents of the information are unverified. Fake reviews can create information asymmetry, lead to the dismissal of genuine reviews, and ultimately reduce market competition. Therefore, one would have expected that the popularity of YouTube would decrease as a source of information access. …

A Tail Without The Head: A Non-‘Competition’ Law Market Study On The Cab-Aggregator Industry Devoid Of Consideration Of Its Consumers, Nikita Shah, Yaatri Shah
International Journal on Consumer Law and Practice
The cab-aggregator industry in India has recently come under the scrutiny of the competition watchdog due to the alleged violations being committed in this burgeoning market. One such reason is the imposition of surge prices by cab aggregators, which despite being a longstanding practice in economics has off late shown several anti-competitive tendencies. In response to these concerns, the Competition Commission of India on 9th September 2022 released a “Market Study on Cab-aggregator Industry with Special Emphasis on Surge Pricing”. This study was perceived as an effort to address the unresolved anti-competitive issues that were not thoroughly examined in the …
The Emerging Name, Image, And Likeness Industry And The Perils Of Appropriating "Entrepreneurial" Collegiate Athletes' And "Vengeful" Minors' Property Interests - Historical And Empirical Guidance From Courts' Rights Of Publicity, Misappropriation, And Breach Of Contract Decisions, Willy E. Rice
Faculty Articles
From the late-1880s to the early-2020s, universities and the collegiate sports industry exploited millions of "college kids" as well as their parent investors by preventing "entrepreneurial athletes" from monetizing their names, images, and likenesses (NILs). Yet, during the same era, the collegiate-athletics industry like the movie and music industries appropriated young people's NILs and pocketed billions of dollars. In 2021, the Supreme Court decided NCAA v. Alston and embraced the Ninth Circuit's ruling in O'Bannon v. NCAA. Ostensibly, these decisions and thirty plus state NIL statutes terminated the "official" exploitation of students. Currently, entrepreneurial students and some parents may commercialize …

Fusion And Integration Pipelines For Optical And Chemical Imaging Data For Clinical Interpretation In Ex-Vivo Diagnosis, Mohd Rifqi Rafsanjani, Karin Jirstrom, Arman Rahman, Jochen H.M. Prehn, William Gallagher, Aidan D. Meade
Conference Papers
In the realm of ex-vivo diagnosis, the integration of optical and chemical imaging data has emerged as a transformative approach, offering a comprehensive understanding of biological specimens at a molecular level. Chemical imaging of human tissue specimens provides an all-digital label-free approach to imaging in objective histopathology, though it requires reference to gold standard pathological (e.g. haematoxylin and eosin (H+E) stained) images for pathological interpretation. Optical imaging techniques, such as microscopy and spectroscopy, provide detailed spatial information, capturing morphological features with high resolution. Concurrently, chemical imaging methods, including mass spectrometry and Raman spectroscopy, offer insights into molecular composition. The challenge …

Conference Papers
The rapid advancement of imaging technologies in pathology has ushered in an era of data-intensive diagnostic workflows, generating large volumes of data that demand sophisticated segmentation and compression techniques. Chemical imaging approaches offer an all-digital objective approach to pathological analysis, though image segmentation is required for efficient computation. Convolutional autoencoders are highly connected deep learning networks which can learn salient features within imaging data for the purposes of compression, data recovery, development of classifiers and/or segmentation. In this study an objective analysis of a U-Net convolutional autoencoders for unsupervised image segmentation is conducted with respect to haematoxylin-eosin based ground-truth diagnostic …

Mycobacterium avium Complex (MAC) are species of the non-tuberculous branch of the Mycobacteria family that is responsible for the development of pulmonary lung disease in immunocompromised individuals. One of the first lines of defence from the host involve a specialised group of tissue macrophages that reside in the lung alveolar space called alveolar macrophages (AM). They have specialised functions that are suitable for recognition of foreign invaders and the ability to tackle these threats though means of a robust immune response. Alternatively, they also feature as key components in a fairly destructive uncontrolled inflammatory response which is the root cause …

Invasive Macroalgae In Native Seagrass Beds: Vectors Of Spread And Impacts, Louise Firth, Andy Foggo, Thomas Watts, Antony Knights, Stacey Deamicis
School of Biological and Marine Sciences
Background and AimsWorldwide, invasive species are spreading through marine systems at an unprecedented rate with both positive and negative consequences for ecosystems and the biological functioning of organisms. Human activities from shipping to habitat damage and modification are known vectors of spread, although biological interactions including epibiosis are increasingly recognized as potentially important to introduction into susceptible habitats.MethodsWe assessed a novel mechanism of spread – limpets as transporters of an invasive alga, Sargassum muticum, into beds of the seagrass Zostera marina – and the physiological impact of its invasion. The association of S. muticum with three limpet species and other …

In recent years, there has been growing recognition of the threats to health posed by loneliness. One of the main strategies that has been recommended to address this is social prescribing (SP). This typically involves general practitioners (GPs) and other health practitioners directing clients who are experiencing loneliness and related conditions to take part in social activities—typically in recreational and community contexts. However, evidence for the effectiveness of SP is mixed—leading some to suggest that enthusiasm for it might be misplaced. In this review, we argue that a core problem with most existing approaches to SP is that they lack …
Impact Of Traditional Education And Learner-Centered Education On Standardized Tests, Courtney Marie Winslow
Impact Of Traditional Education And Learner-Centered Education On Standardized Tests, Courtney Marie Winslow
Walden Dissertations and Doctoral Studies
There is a current shortage of approximately 45,000 nurses and nursing faculty to train student nurses, a number that is projected to grow. One proposed method to combat the shortage is to transition from traditional lecture-based classrooms to a learner-centered approach. Asking or requiring faculty to transition an entire nursing program from one teaching method to another without supporting data could be a waste of valuable time and resources. It could also prove detrimental to a program if students were unable to pass the NCLEX-RN exam, and a program was forced to close. The current study examined whether there was …

Emotional Eating, Nutritional Knowledge, And Socioeconomic Status As Predictors Of Body Mass Index, Tifani Buss
Walden Dissertations and Doctoral Studies
Obesity is an ill-health condition that can lead to other ill-health conditions such as cardiovascular disease, high blood pressure, asthma, type 2 diabetes, and some types of cancer. Obesity is also a condition that does not discriminate regarding age, gender, or race/ethnicity. In light of obesity’s status as a global epidemic, efforts for prevention and intervention treatments are needed to improve individuals’ health and quality of life. The purpose of this quantitative study was to examine emotional eating, nutritional knowledge, and socioeconomic status, as predictors of body mass index (BMI). These factors were examined through the lens of general strain …
Senior Mental Health Clinicians’ Understanding Of Their Self-Efficacy While Providing Services At Community-Based Agencies, Rukiya Symister
Senior Mental Health Clinicians’ Understanding Of Their Self-Efficacy While Providing Services At Community-Based Agencies, Rukiya Symister
Walden Dissertations and Doctoral Studies
Many mental health clinicians strive to provide their clients with rehabilitative and psychotherapy services resulting in a client gaining stable income and housing. However, the role of a senior mental health clinician (SMHC) is not without its challenges of trying to balance their well-being while dealing with increased coworker turnover, demanding caseloads, and limited access to community resources to provide clients with getting their lives back on track, thereby impacting clinicians’ understanding of their self-efficacy. Much of the research on self-efficacy has focused on mental health clients, mental health graduate students, and mental health trainees, often leaving out the lived …
The Impact Of Human Attachment To A Pet Bird On Psychological Well-Being, Kathryn Marie Trautmann
The Impact Of Human Attachment To A Pet Bird On Psychological Well-Being, Kathryn Marie Trautmann
Walden Dissertations and Doctoral Studies
Few studies have addressed human attachment to a pet bird and psychological well-being, and the research that has been conducted is largely anecdotal and anthropomorphic perspectives on human relationships with birds. In this quantitative study, the relationships between humans and their birds were explored using Bowlby's attachment theory and Fredrickson and Losada's broaden and build theory. The study consisted of a randomized experiment, in which individuals were randomly assigned to either an attachment (n = 81) or detachment (n = 88) group. The security priming manipulation was used to prime the groups. The attachment group was asked to list things …
