Unconscionability And Poverty, Mark G. Kelman Jan 2024

Unconscionability And Poverty, Mark G. Kelman

SMU Law Review Forum

Matthew Desmond made the claim in Evicted, his powerful work on housing insecurity, that those concerned with alleviating poverty should focus not merely on ensuring that poor people have higher disposable incomes, but on countering the exploitative price gouging that depresses the value of whatever income they have. This suggests the possibility that it might be a worthwhile anti-poverty strategy for courts to use the unconscionability doctrine to regulate exploitative contracts.

Three main issues follow from considering this possibility: (1) Do the poor actually pay more for goods of the same quality? (2) If they indeed pay more, do …

Investigating The Movement And Foraging Ecology Of Reef Manta Rays (Mobula Alfredi) In The Chagos Archipelago, Joanna Harris Jan 2024

Investigating The Movement And Foraging Ecology Of Reef Manta Rays (Mobula Alfredi) In The Chagos Archipelago, Joanna Harris

School of Biological and Marine Sciences Theses

Reef manta rays (Mobula alfredi) are large zooplanktivorous elasmobranchs of the family Mobulidae. The species is dispersed throughout the Indian and West Pacific Oceans in small, isolated populations that tend to have a limited home range. Individuals within a population regularly visit specific locations to routinely engage in activities such as feeding, where they often exhibit aggregation behaviour. The species face a multitude of anthropogenic threats throughout their range, the most significant of which are target and bycatch fisheries from which they can be most at risk at aggregation sites. Due to their unsustainable depletion, particularly in the Indian Ocean, …

Using Remote Sensing To Track Complex Sinuous Ripple Migration On A Barchan Dune In Herschel Crater, Mars, Elizabeth Visick Jan 2024

Using Remote Sensing To Track Complex Sinuous Ripple Migration On A Barchan Dune In Herschel Crater, Mars, Elizabeth Visick

School of Geography, Earth and Environmental Sciences Theses

Dunes on Mars are known to migrate, in particular ripples have also been found to migrate. This is known to have occurred in eastern, western and southern Herschel Crater, but it was not known if this was true for Central Herschel Crater. Central Herschel Crater is of particular interest as the dunes found there were deemed indurated. However, since the release of HiRISE (2023) satellite images it is clear that these dunes are in fact very much the opposite. These dunes were actively migrating and presented some unique superimposed ripples. With this, we set out to measure the migration of …

Resilience Thinking And The Influence Of Street-Level Bureaucrats On The Implementation Of Eu Environmental Policies In Overseas Territories: Lessons From Gibraltar., Jaime Sanchez-Garcia

School of Geography, Earth and Environmental Sciences Theses

The policy implementation literature has provided important insights on how policy formulation processes affect the achievement of policy goals and how street-level bureaucrats (SLBs) involved in policy implementation utilise coping mechanisms to overcome shortages in resources, expertise and other local constraints. However, it has struggled to provide a systematic analysis of how contextual factors influence the work of SLBs or the implications of their coping mechanisms for the functioning of implementation systems, particularly in smaller countries and non-states territories, where mismatches between policy requirements and resources are more acute. This thesis addresses these knowledge gaps by examining the implementation of …

The Impacts Of Crassula Helmsii On Northwest European Freshwater Macroinvertebrates, Samuel Tasker Jan 2024

The Impacts Of Crassula Helmsii On Northwest European Freshwater Macroinvertebrates, Samuel Tasker

School of Biological and Marine Sciences Theses

Crassula helmsii (New Zealand pygmyweed) is an Australasian aquatic plant which has invaded European freshwaters since the 1950s, provoking widespread concern amongst conservationists. The ecological impacts of C. helmsii invasion remain unclear, however, particularly with respect to macroinvertebrates. The main aim of this thesis is therefore to determine how Crassula helmsii impacts recipient macroinvertebrate assemblages in small lentic waterbodies across its invasive range. To this end, I surveyed small lentic waterbodies across the UK, Belgium and the Netherlands, including invaded and ecologically similar uninvaded sites in each region, assessing the impacts of C. helmsii invasion on macroinvertebrates using a suite …

A Definition Of A Heywood Case In Item Response Theory Based On Fisher Information, Jay Verkuilen, Peter J. Johnson

Publications and Research

Heywood cases and other improper solutions occur frequently in latent variable models, e.g., factor analysis, item response theory, latent class analysis, multilevel models, or structural equation models, all of which are models with response variables taken from an exponential family. They have important consequences for scoring with the latent variable model and are indicative of issues in a model, such as poor identification or model misspecification. In the context of the 2PL and 3PL models in IRT, they are more frequently known as Guttman items and are identified by having a discrimination parameter that is deemed excessively large. Other IRT …

Background: Shared plate eating (SPE), defined as two or more individuals eating directly from the same plate or bowl, is a common household food consumption practice in many Low- and Middle-Income Countries (LMICs). Examination of household engagement in SPE remains largely unexplored, highlighting a gap in research when interpreting dietary information obtained from these settings. The dearth of research into SPE can be attributed to the inherent limitations of traditional dietary assessment methods which constrain their usability in settings where SPE is common.

Objective: In this expository narrative, we describe what SPE is when it is practiced in an LMIC …

Nonsyndromic hearing loss (NSHL) is a genetically diverse, highly heterogeneous condition characterised by deafness, and Gasdermin E (GSDME) variants have been identified as directly inducing autosomal dominant NSHL. While many NSHL cases associated with GSDME involve the skipping of exon 8, there is another, less understood pathogenic insertion variant specifically found in Chinese pedigrees that causes deafness, known as autosomal dominant 5 (DFNA5) hearing loss. In this study, we recruited a large Chinese pedigree, conducted whole‐exome and Sanger sequencing to serve as a comprehensive clinical examination, and extracted genomic DNA samples for co‐segregation analysis of the members. Conservation …

Occupational Therapy’S Role In Addressing The Mental Health Of Transitioning Postsecondary Students, Katie Koxlien, Amorelle Upton, Kiley Washnieski

Critically Appraised Topics

There is an increasing concern for mental health in university students transitioning to postsecondary education. For the purposes of this study, we were concerned with the overall mental health of university students, not specific to diagnosed mental illnesses. Mental health is “a state of mental well-being that enables people to cope with the stresses of life, realize their abilities, learn well and work well, and contribute to their community” (World Health Organization, 2022, para. 1). This may impact the individual’s ability to function on a daily basis and interact with others within their educational setting. The role of a student …

Computer Science Faculty Research & Creative Works

Wireless Sensor and Actuator Networks (WSANs) are an effective technology for improving the efficiency and productivity in many industrial domains and are also the building blocks for the Industrial Internet of Things (IIoT). To support this trend, the IEEE has defined the 802.5.4 Time-Slotted Channel Hopping (TSCH) protocol. Unfortunately, TSCH does not provide any mechanism to manage node mobility, while many current industrial applications involve Mobile Nodes (MNs), e.g., mobile robots or wearable devices carried by workers. In this article, we present a framework to efficiently manage mobility in TSCH networks, by proposing an enhanced version of the Synchronized Single-hop …

The proliferation of sensor-equipped smartphones has led to the generation of vast amounts of GPS data, such as timestamped location points, enabling a range of location-based services. However, deciphering the spatio-temporal dynamics of mobility to understand the underlying motivations behind travel patterns presents a significant challenge. his paper focuses on how individuals' GPS traces (latitude, longitude, timestamp) interpret the connection and correlations among different entities such as people, locations or point-of-interests (POIs), and semantic contexts (trip-purpose). We introduce a mobility analytics framework, named Mobilytics designed to identify trip purposes from individual GPS traces by leveraging a “mobility knowledge graph” (MKG) …

Real-Time Analysis Of Encrypted Dns Traffic For Threat Detection, Marta Moure-Garrido, Sajal K. Das, Celeste Campo, Carlos Garcia-Rubio

Computer Science Faculty Research & Creative Works

Domain Name System (DNS) tunneling is a well-known cyber-attack that allows data exfiltration - the attackers exploit this tunnel to extract sensitive information from the system. Advanced Persistent Threat (APT) attackers encapsulate malicious traffic in a DNS connection to elude security mechanisms such as Intrusion Detection System (IDS). Although different techniques have been implemented to detect these targeted attacks, their rise induces a threat to Cyber-Physical Systems (CPS). The DNS over HTTPS (DoH) tunnel detection is a challenge because the encrypted data prevents an analysis of DNS traffic content. In this paper, we present a novel detection system that identifies …

Computer Science Faculty Research & Creative Works

Mild cognitive impairment (MCI) is recognized as a precursor to Alzheimer's disease (AD), a progressive and irreversible neurodegenerative disorder of the brain. The neurodegeneration of brain connectivity networks plays a pivotal role in the development and progression of MCI. Traditionally, brain networks are generated using coarse-grained brain regions, where the regions serve as nodes and their functional or structural connections are used as edges. Recently, a novel finer scale brain folding patterns named 3hinge gyrus (3HG) was identified, which is defined as the conjunctions coming from three directions on gyral crests. 3HGs have been shown playing an important role in …

Expropriation Of Shares Via The Corporate Constitution, Stephen Bull Jan 2024

Expropriation Of Shares Via The Corporate Constitution, Stephen Bull

Research Collection Yong Pung How School Of Law

Company constitutions sometimes include powers to effect compulsory share acquisitions from members. Where these are introduced into the constitution after incorporation, the amendment, like all constitutional alterations, must be able to satisfy the common law “bona fide test” in order to be valid. The content of this test has been much debated since the first cases a century ago, and differences in view have emerged from the English and Australian courts. While there is no local case law on such expropriations per se, the High Court recently confirmed for the first time the applicability in Singapore of the common law …
