The Devil In The Details: Sex Work Legalization, Sexual Violence, And Moral Subjectivity, Molly Hauf
Departmental Honors Projects
Prostitution legislation has re-emerged in public and academic discourse in recent decades after relative silence on the issue since the mid-twentieth century, spurred by Sweden’s adoption of prostitution decriminalization - the first known legislation criminalizing the buyers of sex (rather than the sellers) to be actualized in legislation. Since then, scholarship examining the population-level effects of such legal changes has found evidence that changes in legislation affect rates of sexual violence, although the causal credibility and generalizability of some of this scholarship is disputed. Additionally, much of the previous scholarship examining this question used relatively small sample sizes that include …

Automated In Situ Segmentation Of Sugarcane Roots, Joseph Salas-Leon
Computer Science and Engineering Theses - Archive
Sugarcane roots are not understood and previous methods of collecting and processing data have proved to be laborious and time consuming. Using Minirhizotrons, Researchers observe and photograph roots without disturbing the soil and are useful for studying root growth over time. Software such as Rhyzovision exists to allow quick processing of root images. These software tools require clean or well annotated images of only the roots to provide accurate information. Current annotations of the images are done manually and requires a Scientist with domain knowledge of roots to accurately annotate the root images. We are employing the use of CNN …
Algorithmic Adjudication And Constitutional Ai—The Promise Of A Better Ai Decision Making Future?, April G. Dawson
Algorithmic Adjudication And Constitutional Ai—The Promise Of A Better Ai Decision Making Future?, April G. Dawson
SMU Science and Technology Law Review
Algorithmic governance is when algorithms, often in the form of AI, make decisions, predict outcomes, and manage resources in various aspects of governance. This approach can be applied in areas like public administration, legal systems, policy-making, and urban planning. Algorithmic adjudication involves using AI to assist in or decide legal disputes. This often includes the analysis of legal documents, case precedents, and relevant laws to provide recommendations or even final decisions. The AI models typically used in these emerging decision-making systems use traditionally trained AI systems on large data sets so the system can render a decision or prediction based …

Generative Ai In The Attorney-Client Relationship: An Exercise In Critical Revision And Client Management, Michael L. Smith
SMU Science and Technology Law Review
Discussions of generative AI in legal practice and education often assert that this technology will lead to a sea change in legal writing, research, and revision. While some of the more breathless proclamations deserve skepticism, there’s little doubt that this technology may generate new forms of headaches for those in the legal field—particularly once it’s in the hands of clients or opposing counsel who wish to use this technology to save the time, money, and effort required for complex legal tasks.
This essay proposes an exercise template for law students that illustrates how generative AI technology may be misused or …

Tailoring Biometric Innovation To Privacy Law In The Retail Industry, Bailey White
SMU Science and Technology Law Review
Biometric data technology is trending in retail. Retailers utilize biometric data to improve their bottom line through virtual try-on technology (VTOT), contactless payment methods, fingerprint scanners, and more—albeit at potentially steep prices. Many types of biometric technology used in retail fall under strict U.S. state privacy laws, exposing businesses to serious legal and financial consequences. This Comment provides an analysis of the current state of biometric data privacy law in the U.S., focusing on Illinois’ Biometric Information Privacy Act (BIPA), California’s Consumer Privacy Act (CCPA), Privacy Rights Act (CPRA), and more. This Comment also identifies proposed legislation, relevant case law, …

Over the past several years, startups that once seemed destined for greatness have failed or collapsed because of fraud committed by the founders. Most notable are the Theranos and FTX business collapses, which culminated in the convictions of two infamous entrepreneurs, Elizabeth Holmes and Sam Bankman-Fired, respectively. Startup innovators are not alone when it comes to morally dubious behavior. According to Retraction Watch, nearly 5000 papers published in science & engineering journals were retracted in 2022. Research misconduct allegations eventually led to the resignation of Stanford University President Marc Tessier-Lavigne in July 2023. The research scandal at Stanford received lots …

Neither Here Nor There: Redefining “Presence” For A Virtual Criminal Justice System, Brandon M. Draper
SMU Science and Technology Law Review
The coronavirus (“COVID-19”) pandemic dramatically altered how the criminal justice system operated by adding virtual options to traditionally in-person proceedings. The impact of the criminal justice system’s failure to include virtual jury trials among these options was shocking, but not surprising: jury trial rates across the country dropped close to zero percent and several in-custody defendants died from COVID-19 before a jury could determine their guilt or innocence. After the pandemic, criminal courts across the country made many of these virtual options permanent, but only for non-evidentiary proceedings and other non-jury trial settings. The failure to include criminal jury trials …

In 2022, Clemson Libraries formed an Inclusive Description Task Force to research and present recommendations to the administration on a libraries-wide plan for inclusive description practices. This chapter outlines the steps the task force took to complete its charge. It discusses the creation of an annotated bibliography and collections audits to identify problematic language, as well as connecting with other institutions to learn from existing practices. The task force intentionally went beyond cataloging to bring together their university colleagues responsible for description in Special Collections and Archives, Historic Properties, and the libraries’ digital collections. The final report presents recommendations for …

The Supreme Court’s 2022 decision in Dobbs v. Jackson Women’s Health Organization was a pivotal moment that reshaped the landscape of abortion policy and delivery of abortion care in the United States. To create a space for critical reflection on the implications of Dobbs for the teaching and learning of abortion care in both medical and legal education, the authors engage in a dialogue highlighting the varied perspectives of professionals and professionals-in-training in both the medical and legal professions. As new attacks on reproductive autonomy continue at both state and federal levels, we foreshadow a tumultuous landscape for abortion policy …

Following the Supreme Court's decision in Dobbs v. Jackson Women's Health Organization and a series of restrictive state laws post-Dobbs, physicians in many states now face difficult choices between evidence-based practice and criminal penalties. Previously, when deciding whether to provide abortion care, concern for the health of the patient was paramount. Now, fear of criminal penalties drives decision-making for physicians practicing in many areas of the country, including our home state: Missouri. For certain life-threatening complications, termination of pregnancy is warranted, but since Dobbs, physicians have been delaying these potentially lifesaving procedures for fear of criminal repercussions. Behavioral research on …

In Silent Covenants: Brown v. Board of Education and the Unfulfilled Hopes For Racial Reform, the late Derrick Bell refined his theory of racial progress in the United States by merging his interest convergence and racial sacrifice theses into a theoretical “two-sided coin” he called “racial fortuity.”1 Bell’s original interest convergence thesis posited that racial progress for Blacks would only occur if their interests in obtaining equality for themselves and the interests of the dominant White establishment in granting such equality “converged.”2 This theory famously underpinned Bell’s interpretation of Brown and the Supreme Court’s eagerness to overturn …

Protein aggregation is linked to many chronic and devastating neurodegenerative human diseases and is strongly associated with aging. This work demonstrates that protein aggregation and oligomerization can be evaluated by a solid-state nanopore method at the single molecule level. A silicon nitride nanopore sensor was used to characterize both the amyloidogenic and native-state oligomerization of a model protein ß-lactoglobulin variant A (βLGa). The findings from the nanopore measurements are validated against atomic force microscopy (AFM) and dynamic light scattering (DLS) data, comparing βLGa aggregation from the same samples at various stages. By calibrating with linear and circular dsDNA, this study …

Designing Sanctuary, Rick Su
Designing Sanctuary, Rick Su

In recent decades, a growing number of cities in the United States have adopted “sanctuary policies” that limit local participation in federal immigration enforcement. Existing scholarship has focused on their legality and effect, especially with respect to our nation’s immigration laws. Largely overlooked, however, is the local process through which sanctuary policies are designed and the reasons why cities choose to adopt them through city ordinances, mayoral orders, or employee handbooks. This Article argues that municipal sanctuary policies are far from uniform, and their variation reflects the different local interests and institutional actors behind their adoption and implementation. More specifically, …

Congress last reformed the nation’s current tax penalty regime ap-proximately three decades ago, long before the rise of big data and the advent of predictive analytics. With predictive analytics now gaining preeminence and its accuracy constantly improving, it is time for Congress to weave this technological innovation into the fabric of the Internal Revenue Code and, more specifically, the civil tax penalty regime. Doing so would enhance taxpayer compliance, augment transparency, and simultaneously ease many administrative burdens commonplace under the tax law.
“I Still Live!” Daniel Webster And The Politics Of Commemoration In The Age Of Disunion, Michael James Larmann
“I Still Live!” Daniel Webster And The Politics Of Commemoration In The Age Of Disunion, Michael James Larmann
Graduate Student Theses, Dissertations, & Professional Papers
This dissertation explores the political afterlife of American statesman Daniel Webster (1782- 1852) from 1852 to 1865. It explores two distinct yet interconnected theaters of politics in antebellum America: the politics of memory and the politics of commemoration. Webster’s followers engaged in the politics of memory by resurrecting their statesman in the national arena. Defenders, detractors, and partisans contested Webster’s memory to claim power and legitimacy during the sectional crisis in the 1850s and during the Civil War in the 1860s.
The physical monument in Boston was the epicenter for a second political theater, the politics of commemoration. Following the …

This paper presents the design of a new type of magnetic constant torque mechanism. The constant torque is shown to be created over a prescribed ±65° stroke length and is shown to be highly uniform. The value of the constant torque is adjustable through the relative axial motion of the rotors. The constant torque is created using a simple magnet arrangement which makes use of the axial transverse-flux path of one rotor's magnetic field relative to the azimuthal field flow of the fixed secondary rotor. It is shown that the use of segmented magnets introduces torque ripple.

Emerging adulthood is a critical developmental period, especially for identity– the development of our sense of who we are internally and relative to others. This research sought to investigate one understudied aspect of identity development: political identity. Five questions guided this research: first, is political identity related to broader identity development? Second, does political identity development differ based on political ideology (liberal, moderate, conservative)? Third, do individuals’ self-identified political turning point events differ based on political ideology? Fourth, how is political identity development related to political turning point narratives? Fifth, how does meaning making interact with political identity development and …
