“Fly Me To The Moon . . . & Back”: The Intricate Interplay Between Copyright Law And Space Law, Marco Franzoso Jan 2025

“Fly Me To The Moon . . . & Back”: The Intricate Interplay Between Copyright Law And Space Law, Marco Franzoso

Fordham Intellectual Property, Media and Entertainment Law Journal

This research focuses on the intricate interplay between two branches of law: copyright and space law. Through various scenarios, some real and some hypothetical, it underlines the inefficacy of the terrestrial copyright principle, namely the lex loci protection, when applied to outer space endeavors. In outer space, the law where the infringement arises is useful only when the jurisdiction is clear, which is on board of registered space objects; however, that is not even the case for all space objects. On board poli-jurisdictional entities, such as the ISS, the lex loci protectionis fails to provide a clear legal framework, at …

Transformative Experiences, Anticipatory Regret, And Informed Consent, Elizabeth Lanphier, Shannon Fyfe Jan 2025

Transformative Experiences, Anticipatory Regret, And Informed Consent, Elizabeth Lanphier, Shannon Fyfe

Scholarly Articles

Regret risk is not consistently part of information sharing within informed consent. Yet two kinds of decisions that often invoke concerns about future regret, abortion and sterilization, raise considerations for the role of regret in clinical decision-making and informed consent, particularly regarding decisions about potentially transformative experiences. We distinguish between first-personal and second-personal anticipatory regret and argue that first-personal anticipatory regret can play a productive role, but second-personal anticipatory regret can function in ways that are pernicious. Introducing second-personal anticipatory regret into medical informed consent processes is, we argue, not only not required for informed medical decision-making, but impermissible within …

Postmodern Communication Ethics, Sarah Bullard Jan 2025

Postmodern Communication Ethics, Sarah Bullard

Integrated Studies

Abstract

This paper explores how postmodernism shifts communication ethics, cultural norms, and perspectives. It explores how postmodernism disrupts established ideas of ethical responsibility, identity, power, and truth. Some of the important issues examined include the decentered self, multiculturalism, and the challenges of decision-making about moral values today. The work also has a strong reliance on Michel Foucault and Seyla Benhabib, to think about how the shifting of social norms and relations of power produce certain kinds of communication.

This paper also explores the tension between specificity and flexibility with respect to moral values in multiple contexts and cultures of postmodernism, …

Website Accessibility Of Largest Health Insurers In Medicare Advantage Market, Alicia Stephan

Yale Medicine Thesis Digital Library

Website accessibility is essential to ensure equitable healthcare access, especially for individuals with disabilities. This study evaluated the accessibility of health insurance websites for the ten largest Medicare Advantage insurers by market share. Using three free, publicly available automated accessibility checkers—WAVE, Axe-Core, and Skilltide—we systematically identified five URLs per insurer based on specific webpage keywords. These tools adhere to the Web Content Accessibility Guidelines (WCAG) Version 2.1 Level AA, the technical standard referenced in the most recent U.S. legislation.A total of 1,223 accessibility errors were identified across 50 webpages, with Skilltide detecting the most errors (588), followed by WAVE (502) …

Evaluating Nebulizer Efficiency For Phage Therapy In Drug-Resistant Pseudomonas Infections, Daniel Thompson Jan 2025

Evaluating Nebulizer Efficiency For Phage Therapy In Drug-Resistant Pseudomonas Infections, Daniel Thompson

Yale Medicine Thesis Digital Library

Background

The global rise of multidrug-resistant (MDR) Pseudomonas aeruginosa necessitates novel therapeutic approaches, particularly for patients with cystic fibrosis (CF). Bacteriophage therapy, delivered via inhalation, offers a targeted and potentially transformative treatment for pulmonary infections caused by MDR pathogens. This study aimed to evaluate the effects of nebulizer type and bacteriophage morphology on viable phage recovery and aerosol particle size distribution, hypothesizing that nebulizer-phage compatibility significantly influences the delivery of viable phages to the lower respiratory tract.

Methods

We conducted an in vitro study utilizing two clinically relevant nebulizer systems: the Pari LC Plus jet nebulizer and the Altera eFlow …

Cosmic Redemption And Christology: The Timeless Christ-Hymn Of Colossians, Rinah Fiol Jan 2025

Cosmic Redemption And Christology: The Timeless Christ-Hymn Of Colossians, Rinah Fiol

Beets Paper Contest

The letter to the Colossians, a nominally Pauline letter whose authorship is disputed, presents an intricate message about the supremacy of Christ and the cosmic reconciliation He mediates. Specifically, it contains a beautiful Christ-hymn in Col. 1:15-20, which holds critical implications for viewing the identity of Christ and the scope of redemption. In examining scholarly conversations on the language and message of the Christ-hymn, these questions can be more fully understood and applied to Christian life regardless of time and place.

Redefining Intellectual Property Protection: Nfl Plays In The Digital Age, Michael Touma Jan 2025

Redefining Intellectual Property Protection: Nfl Plays In The Digital Age, Michael Touma

Washington Law Review Online

American copyright law is fluid. Its changes have mirrored evolutions in society, be they technological, cultural, or economic. At its core, copyright law exists to promote the progress of the arts and sciences; yet, the law’s outdated nature leaves many creations on the outside looking in. The last substantial copyright legislation to pass through Congress was the Copyright Act of 1976, which was nearly fifty years ago. Much has changed since, including vast technological improvements, new and emerging interests in American society, and now global economic drivers. One industry that meets these characteristics and is not currently afforded protection is …

All Electronic Theses and Dissertations

This literature review investigates the causes, effects, and intervention of Problematic Smartphone Use (PSU) in students. Teachers and leadership at the district and state levels concur that strategies and policies must be formulated to address students’ needs as they wade through a social world altered by technology. The matter, at its core, is the antecedents for technology misuse and how the addiction to technology might be interrupted. This thesis provides a review of 31 articles on PSU within the context of school and academia. PSU can be predicted by needs not being met, specifically needs pertaining to choice, self-efficacy, and …

Interactive Read Aloud Planning Template For The Story, The Letter From The Book Frog And Toad Are Friends, Lauren Dehmer, David Wolff

OER Materials

This is a read-aloud planning template for the story The Letter from the book Frog and Toad are Friends, which holds five stories. The goal of the assignment is to create an effective read-aloud. Research supports these as they can expose children to new words and language structures (Burkins & Yates, 2021). Cunningham et al. (2023) also explain interactive read-alouds as a way to “immerse students in rich content.” The author was given a list of stories from the anthology, The 20th Century Children’s Book Treasury: Picture Books and Stories to Read Aloud, from instructor Dr. David Wolff, who …

Gen Z Sexual And Gender Fluidity In Us Scripted Television, Traci B. Abbott Jan 2025

Gen Z Sexual And Gender Fluidity In Us Scripted Television, Traci B. Abbott

English and Media Studies Faculty Publications

This essay addresses the rise in sexual and gender-fluid characters in scripted US television targeting the Gen Z audience (born 1997–2012), based on their moniker as the “queerest” generation, with over 20% of younger US and international respondents identifying as LGBTQ in polls, the majority as sexually fluid (bi/pansexual) or non-binary (genderfluid/genderqueer). By analyzing six series (2019–2023) marketed as “authentically” Gen Z, I argue this shift invests in Gen Z’s “hip” attitude towards such fluidity the same way Caldwell argues that 1990’s diversification of the televisual audience produced a “programming agenda…that cultivates and rewards distinction in ethnic, racial, and class …

Debating Member-Checks Of Exceptional Human Experiences, James Houran, Everton De Oliveira Maraldi, Beth M. Houran Jan 2025

Debating Member-Checks Of Exceptional Human Experiences, James Houran, Everton De Oliveira Maraldi, Beth M. Houran

International Journal of Transpersonal Studies

This integrative essay reflects on member-checking and engaged research approaches in the study of exceptional human experiences (EHEs)—subjective accounts that often challenge conventional views of consciousness and physical reality. Member-checking, or inviting research participants to review data or interpretations, can improve credibility by aligning research with their lived experience. While benefits include transparency and insight, risks include confirmatory bias, emotional distress, power asymmetries, and logistical complexity. The evolving nature of EHEs further complicates participant validation. We therefore advocate a six-level "fit-for-purpose" system to balance rigor with ethical care and responsiveness. We also explore digital, asynchronous, and AI-assisted strategies to enhance …

Teaching In The Transpersonal Paradigm, Christopher M. Bache Jan 2025

Teaching In The Transpersonal Paradigm, Christopher M. Bache

International Journal of Transpersonal Studies

This article explores the transpersonal dynamics of teaching by presenting two core themes of The Living Classroom: 1) the synchronicities and energetic resonances that radiated invisibly around me as my spiritual practice deepened over time and 2) the “learning fields” that surround well-taught courses—fields of collective consciousness that can trigger new insights and powerful transformations in our students.

Millennium School: An Experiment In Transpersonal Education For Early Adolescents, Jenny Wade Jan 2025

Millennium School: An Experiment In Transpersonal Education For Early Adolescents, Jenny Wade

International Journal of Transpersonal Studies

This article describes the design, curriculum, culture, and values of an experiment in transpersonal education for young adolescents, the Millennium middle school in San Francisco, CA. The overarching design of the school was to help children exiting the latency period of child development, who exhibit the rudiments of Wade’s Authentic consciousness or Maslow’s Self-actualization motive stage, consolidate that level rather than losing it, as the vast majority do, because of social pressures that make earlier stages of development more adaptable in most contemporary societies. Early adolescence is a time when peer pressure, individuation from the family, and puberty are strong …

Teaching For Transpersonal Learning, Paul F. Cunningham Jan 2025

Teaching For Transpersonal Learning, Paul F. Cunningham

International Journal of Transpersonal Studies

This article addresses the “why,” “what,” and “how” of teaching for transpersonal learning. Why transpersonal education is relevant for addressing modern social problems and the global ecological crisis, what it is like to teach for transpersonal learning, and how transpersonal learning becomes transformative are discussed. Three promising options in technology and consciousness studies for transpersonal learning—transpersonal media, multistate studies, and entheogenic education—are described and the challenges of introducing transpersonal education into academic settings and assessing educational (student) learning outcomes are reviewed. The relevance of Mezirow’s Transformation Theory to transpersonal educational psychology, with special attention to ecological perspective transformation, is then …

An Exploration Of Brainstorming Methods And Their Influence On Creativity In Secondary Visual Arts, Melody K. Shryock Jan 2025

An Exploration Of Brainstorming Methods And Their Influence On Creativity In Secondary Visual Arts, Melody K. Shryock

All Electronic Theses and Dissertations

This thesis explores the impact of structured brainstorming methods on creativity in visual arts among middle school students, a period marked by the shift from concrete to abstract thinking. Creativity often declines during adolescence due to social awareness and limited exposure to creative strategies. Literature was reviewed on how techniques like SCAMPER and Mind Mapping help students overcome design fixation and develop original artistic solutions. Drawing on historical and contemporary perspectives, the research emphasizes the value of divergent thinking, student autonomy, and a supportive classroom environment. Challenges in assessing artistic originality are discussed, including the subjective nature of evaluation and …

The Effect Of Covid-19 Lockdowns And Social Isolation On Adolescence, Madeleine J. Bakken Jan 2025

The Effect Of Covid-19 Lockdowns And Social Isolation On Adolescence, Madeleine J. Bakken

All Electronic Theses and Dissertations

Adolescents around the world were impacted by social isolation resulting from the COVID-19 pandemic. Students experienced sudden school closures and isolation from classmates resulting in increased screen time, the erosion of social skills, lower academic motivation, and a period of unstructured and unfamiliar learning (Hong et al., 2022; Kannan & Veazie, 2023; Leventhal & Morishta, 2024; Menzies et al., 2024; Warford, 2019). Current research is working to measure the impact and severity of these factors. Early findings suggest that students are academically and emotionally behind where their predecessors were pre-COVID (Menzies et al. 2023; NWEA Connection, 2024). Educators and mental …

Citizenship And Education: Teaching Controversy In Secondary Civics Education, Brian K. Ward Jan 2025

Citizenship And Education: Teaching Controversy In Secondary Civics Education, Brian K. Ward

All Electronic Theses and Dissertations

This thesis explores how contemporary political and ideological disputes shape secondary civics education in the United States, with particular attention to the tensions between parental rights, state authority, and the professional duties of teachers. Through a review of the intellectual history, policy and legal developments, and education literature, this review addresses how civics educators navigate their responsibilities amid increasing polarization and controversy over curriculum. The reviewed literature emphasizes instructional strategies that support students in engaging critically with contentious topics through inquiry, deliberation, and structured dialogue. These methods not only promote civic understanding but also prepare students for meaningful participation in …

The Impact Of Administrator-Led Walkthroughs On Teacher Self-Efficacy, Kerri Templeton Jan 2025

The Impact Of Administrator-Led Walkthroughs On Teacher Self-Efficacy, Kerri Templeton

Theses, Dissertations and Capstones

This qualitative phenomenological study explored how administrator-led instructional walkthroughs influence teacher self-efficacy in one public school district located in West Virginia. Guided by Bandura’s (1977) framework of self-efficacy, the research examined the lived experiences of teachers and administrators who participated in regularly scheduled walkthroughs as part of a district-wide instructional leadership initiative. Data were collected through open-ended surveys with PK–12 teachers and administrators and analyzed using inductive thematic analysis to identify patterns and themes related to the perceived impact of the walkthrough process.

Findings revealed that when walkthroughs were conducted with clear purpose, relational trust, and consistent, meaningful feedback, they …

Adolescence In A Minor: A Preliminary Investigation Into The Centrality Of Music-Related Self-Defining Memories In Narrative Identity Development, Katharine Caviness Jan 2025

Adolescence In A Minor: A Preliminary Investigation Into The Centrality Of Music-Related Self-Defining Memories In Narrative Identity Development, Katharine Caviness

Psychology Honors Papers

Adolescence and emerging adulthood are critical periods for identity development, during which music often serves as a powerful tool for emotional expression, social connection, and autobiographical meaning-making. This study investigates the role of music-related self-defining memories (SDMs) in shaping and reflecting narrative identity and explores whether these processes differ between individuals with varying levels of musical engagement. Twenty undergraduate students (10 music majors, 10 non-music majors) from a liberal arts college participated in semi-structured interviews about a music-related SDM from adolescence. Participants completed the Centrality of Event Scale (CES) and Likert ratings of memory valence and importance. Thematic analysis revealed …
