Say It Once, Say It Twice: Abrogating The Rebuttal Requirement Of The Prior Consistent Statement Hearsay Rule, Natashja Atherton May 2025

Say It Once, Say It Twice: Abrogating The Rebuttal Requirement Of The Prior Consistent Statement Hearsay Rule, Natashja Atherton

Pepperdine Law Review

Federal Rule of Evidence 801(d)(1)(B) limits the introduction of a witness’s prior statements during court proceedings, even if those statements are consistent with the witness’s in-court testimony. A witness’s previous declarations can only be solicited if (a) the adversarial party directly attacks the witness’s credibility and (b) the offered prior consistent statement directly rebuts the basis of the attack. This Comment refers to these restrictions as the “rebuttal requirement” of Rule 801(d)(1)(B) and argues for its revocation to make statements substantially consistent with a witness’s in-court testimony admissible, subject to the other rules of evidence, regardless of whether the witness’s …

Critical Praxis For Transnational Movement-Lawyering, Kelsey Jost-Creegan May 2025

Critical Praxis For Transnational Movement-Lawyering, Kelsey Jost-Creegan

Pepperdine Law Review

This Article seeks to identify new ways to respond to critiques of international human rights practice as hierarchy-reproducing, extractive, and imperialist. It proposes one model for how human rights lawyers can better work in solidarity with oppressed communities organizing around common grievances: transnational movement-lawyering. While the framing of community-led lawyering has become rapidly popularized in the human rights field, work remains to ensure that this theoretical and discursive shift translates into a transformation of the day-to-day mechanics of human rights practice. This Article seeks to identify concrete ways to apply critical theory and participatory methodologies to human rights practice. Part …

Polyrelativity, Frederic Gilles Sourgens May 2025

Polyrelativity, Frederic Gilles Sourgens

Pepperdine Law Review

Energy transition has a governance problem. And much of the literature fails to address this problem. That is, it discusses who should make energy transition decisions (the President, Congress, state governments, etc.). But this perspective misses the core substantive problem: how should we share the benefits and burdens of transition? Without answering this energy transition “how” question, any answer to “who” risks appearing as arbitrary decision-making. In this Article, I am the first to submit that we can solve this “how” question using the property-law doctrine of correlative rights. Energy-transition governance is what political economists call “polycentric.” It requires different …

Communication And Development May 2025

Communication And Development

Communication Research Trends

In the mid-1970's, a long-time career officer with the United States Agency for International Development evaluated his experience in a book entitled We Don't Know How To Do It. This title summarises well the present-day quandaries in the field of development communication.

The drive for world development began after World War II with great optimism. The United States, flushed with a recent crusading victory, looked back proudly at its own :ndustrial and agricultural development and was convinced that this was just a new challenge for 'American know-how'. Europe, too, though rebuilding from war, was conscious ofitself as the apex of …

Navigating Difficult Conversations And Recognizing Persons Of Concerns: Confrontation, De-Escalation, And Threat Awareness, Mike Zegadlo May 2025

Navigating Difficult Conversations And Recognizing Persons Of Concerns: Confrontation, De-Escalation, And Threat Awareness, Mike Zegadlo

May Institute

A student angry about their grade, a peer not pulling their weight, a supervisor sharing criticism; all can trigger anxiety and stress. Human beings experience physiological responses to stressful encounters that inhibit our ability to communicate, problem solve and listen when it’s most important to do so. Targeted attacks, like active shooters incidents, are not spontaneous, sudden events which occur without warning. They are predictable and, consequently, preventable. Students, co-workers or others may exhibit risk factors or observable behaviors that would indicate they may be on the “pathway to violence.”

In this interactive presentation, participants will be introduced to methods …

Family Perspectives

This paper explores the impact of poverty on academic achievement in children. It begins by outlining the general effects of poverty before delving into its specific consequences for educational outcomes. Findings indicate that poverty significantly affects self-esteem and family relationships, which, in turn, contribute to lower academic performance among children. Additionally, the paper proposes underlying causes for these outcomes and potential interventions. These insights are supported by a diverse range of data, highlighting the urgent need to address this critical issue.

Suicidal Ideation Of Queer Adolescents, Haley Kamikawa May 2025

Suicidal Ideation Of Queer Adolescents, Haley Kamikawa

Family Perspectives

Suicide is the second leading cause of death in youth ages 15-29 around the world. This literature review examines some of the reasons why adolescents are likely to experience suicidal ideation and emphasizes why queer adolescence are at a much greater risk for suicidal ideation (Li Kitts, 2005; McDermott et al., 2018; Wichstrøm & Hegna, 2003). Bullying and lack of parental support were found to be the greatest contributors for queer adolescence experiencing suicidal ideation (Czyz et al., 2018; Sultana et al., 2023; Wedell, 2024). Bullying and lack of parental acceptance has been found to increase levels of emotional distress …

Reassessing Policy Responses To Irregular Migration In Receiving Democracies: A Process-Tracing Analysis Of Transactional Migration Governance, Otoniel Ramos May 2025

Reassessing Policy Responses To Irregular Migration In Receiving Democracies: A Process-Tracing Analysis Of Transactional Migration Governance, Otoniel Ramos

Student Research

This policy brief analyzes the growing use of transactional migration agreements (TMAs) by receiving democracies—bilateral arrangements that exchange financial or diplomatic concessions for the external enforcement of migration control. While politically expedient, TMAs often generate long-term strategic liabilities: they reduce state control over enforcement outcomes, expose receiving states to coercive leverage by partner states, and weaken normative commitments to transparency and rights protection. Using analytic process tracing and formal modeling, this paper identifies four recurring mechanisms by which TMAs evolve into systems of asymmetric dependence. It then evaluates three alternative policy frameworks—Exit Doctrine, Legal Category Reform, and a Structured Conditionality …
