Authoritarian Transfers, Günter Frankenberg, Fernanda G. Nicola Oct 2025

Authoritarian Transfers, Günter Frankenberg, Fernanda G. Nicola

University of Miami Law Review

The rapid proliferation of foreign agent laws globally has become a hallmark of rising authoritarianism, with these laws weaponized to suppress dissent and stifle civil society. While the post-World War II study of legal transplants focused on liberal legal orders, the rise of authoritarian regimes has introduced a new dimension: the transnational movement and adaptation of authoritarian legal frameworks, or authoritarian transfers. This Article fills a critical gap by developing an analytical framework to distinguish authoritarian transfers from democratic ones, using transfer theory, a central theme in comparative law that explores how laws travel, adapt, and transform within new social …

Faculty Research 2025

Wiedemann-Steiner syndrome (WDSTS) is a rare genetic cause of intellectual disability that is primarily caused by heterozygous loss-of-function variants in the gene encoding the histone lysine methyltransferase 2A (KMT2A). Prior studies have shown successful postnatal amelioration of disease phenotypes for Rett, Rubinstein-Taybi, and Kabuki syndromes, which are related Mendelian disorders of the epigenetic machinery. To explore whether the neurological phenotype in WDSTS is treatable in utero, we created a mouse model carrying a loss-of-function variant placed between 2 loxP sites. Kmt2a+/LSL mice demonstrated core features of WDSTS including growth retardation, craniofacial abnormalities, and hypertrichosis as well as hippocampal memory defects. …

The Article addresses the appropriate construction of the statute’s reach, the enforcement proceedings instituted by the SEC under this provision, and the Commission’s failure to fulfill its legislative directive to adequately enforce this statute and Rule 13a-14 promulgated thereunder. In its implementation of the CEO and CFO certification requirement, the SEC has brought relatively few enforcement actions during over a two-decade period. Its enforcement with respect to CEOs …

Brewbaker And The Undermining Of Criminal Antitrust Enforcement, Itiel J. Wainer Oct 2025

Brewbaker And The Undermining Of Criminal Antitrust Enforcement, Itiel J. Wainer

University of Miami Law Review

In United States v. Brewbaker, a Fourth Circuit panel overturned a criminal conviction under § 1 of the Sherman Act, holding that a bid-rigging conspiracy between direct competitors constituted a hybrid “dual distribution” arrangement subject to the rule of reason rather than per se illegality. The court’s rationale rested on the existence of a separate vertical relationship between the parties, even though that relationship served only as consideration for the horizontal agreement to rig bids.

This Comment argues that Brewbaker rests on three doctrinal errors: misclassifying established bid-rigging tactics as a “new” restraint simply because the payoff took a …

Low -Voltage Distribution Network Topology Identification Method Based On Manifold Density Peak Clustering, Shaokui Yan, Haili Ding, Jiayi Qiu, Ziwen Gu, Chun Huang

Journal of Electric Power Science and Technology

To address the problem of frequent errors and changes in the topology relationship of low-voltage distribution networks that reduce the accuracy of topology identification,a topology identification method based on manifold density peak clustering is proposed. The method consists of two stages:feature extraction and feature clustering. In the feature extraction stage,a manifold learning algorithm reduces feature redundancy and preserves the arbitrary shape distribution features of voltage data by manifold learning algorithm of extracting low-dimensional embeddings. In the feature clustering stage, based on low-dimensional manifolds of voltage data, the density peak clustering algorithm groups similar low-dimensional manifolds into the same cluster and separates different ones into distinct …

Method For Generating Medium And Long -Term Photovoltaic Output Scenarios Based On Generative Adversarial Networks, Tingji Guan, Pingping Luo, Jikeng Lin, Chaoli Zhang

Journal of Electric Power Science and Technology

A new method for generating medium and long-term photovoltaic output scenarios based on generative adversarial networks is proposed to address the problem of high variable dimensions in generating annual photovoltaic output sequence scenarios.Firstly, the fuzzy C-means clustering (FCM) algorithm is used to divide daily meteorological states, and the temporal nature of daily meteorological information is simulated based on generative adversarial networks. Then,a state division network is introduced, and a state generative adversarial network is constructed to simulate the distribution pattern of meteorological states during the week.Photovoltaic output sequence scenarios are generated by layering from weekly and daily scales. Finally, historical meteorological and photovoltaic output data from …

Department of Medicine Faculty Papers

Tetanus and diphtheria (tetanus/diphtheria) infections are rare in the United States (U.S.), but adequate vaccination is essential to prevent disease and associated morbidity and mortality. Compared with U.S.-born persons, immigrant and refugee adults have lower completion rates for tetanus/diphtheria vaccination series. However, most electronic health record (EHR)-generated recommendations only advise tetanus/diphtheria vaccines every 10 years for persons ≥18 years. This analysis compared documented completion of tetanus/diphtheria 3-dose vaccination series with EHR-generated recommendations for immigrant and refugee patients at three U.S. health systems seen during 2017-2022. The EHR documented complete 3-dose tetanus/diphtheria vaccine series for 28 % of 50,829 adult immigrant …

Identity Styles Moderate The Role Of Insecure Attachment Dimensions On Internalizing Behaviors, Hans Saint-Eloi Cadely, William Vega, Joe F. Pittman, Sue K. Adams

Human Development and Family Science Faculty Publications

The present study examined how identity styles and romantic attachment dimensions predict internalizing problems among 456 college students. Results indicated that the diffuse-avoidant identity style was positively associated with depressive symptoms, whereas the normative identity style was negatively related to generalized anxiety. Anxious attachment was positively related to both internalizing problems, and avoidant attachment was related positively only to depressive symptoms. Interaction results revealed that a stronger diffuse-avoidant identity style strengthened the relationship between anxious attachment and depressive symptoms. A stronger informational identity style led to a significant association between the avoidant dimension and both internalizing behaviors. Lastly, for those …

A Formidable Female Network: The Role Of Women In William Henry Fox Talbot’S Establishment Of Early Photography, Rose Teanby Phd

Art Inquiries

This paper explores how women assisted William Henry Fox Talbot (1800-1877) to establish his Photogenic Drawing and Calotype photographic processes in Great Britain and Europe. Utilising preserved contemporary correspondence as a primary source of unedited transcribed conversations, the genesis of photography can be revisited from an alternative viewpoint of extensive familial collaboration. Letters between Talbot and his female relatives exposed a sophisticated network of interconnected mid 19th century social elite, providing multiple opportunities for informal advocacy and timely dissemination of the new scientific art.

Epistolary exchanges from 1839 to 1858 provide new insights into women’s subtle, less visible influence …

The British Photographic Industry And The Roles Of Women 1840-1920: A Survey, Michael Pritchard

Art Inquiries

This essay surveys the role of women within the British photographic industry to 1920 and attempts to quantify the numbers involved, their roles and how they were perceived by contemporary commentators. In common with so much of nineteenth century arts and sciences women are rarely present having been excluded by legal constraints on wealth and property, from the membership of professional bodies, and by being ignored by the contemporary press, this essay provides substantive numbers emphasising their significance.

Personal Jurisdiction And The Declaration Of Independence, Ryan C. Williams Oct 2025

Personal Jurisdiction And The Declaration Of Independence, Ryan C. Williams

Duke Law Journal

The Declaration of Independence accuses King George III of having "obstructed the Administration of Justice, by refusing his Assent to Laws for establishing Judiciary powers." But despite the seemingly natural resonance of this particular charge with the legal profession, legal scholars have given remarkably little attention to the controversy that provoked this particular complaint. This Article traces the colonists' complaint to a somewhat surprising and unexpected source—a dispute about personal jurisdiction.

During the late eighteenth century, administrative officials responsible for overseeing Britain's North American possessions sought to eliminate the use of the custom of foreign attachment by colonial court systems. …

The Second Amendment's Catholic Problem, Jared Danaher Oct 2025

The Second Amendment's Catholic Problem, Jared Danaher

Duke Law Journal

After New York State Rifle & Pistol Association v. Bruen, history is the touchstone of Second Amendment analysis. Thus, this Note explores an understudied part of America's long and complicated history with weapons: Catholic disarmament. By undertaking a detailed historical analysis of three Catholic disarmament measures in the late colonial United States, this Note attempts to determine what the history means for present day firearms law. It concludes that even though courts frequently cite America’s history of Catholic disarmament, they rarely use it in a historically accurate way. Modern courts use Catholic disarmament to justify weapons bans on people …
