The Unconstitutional Attempt To Criminalize Naming Ice Agents, Noah C. Chauvin

Faculty Articles

Some members of Congress propose to make it a crime to publish the name of a federal official with the intent of obstructing that official’s law or immigration enforcement duties. This Essay considers whether the lawmakers’ bill, the Protecting Law Enforcement from Doxxing Act, is consistent with the First Amendment. It is not.

Marital Status And Human Rights, Jessica Tueller Jan 2026

Marital Status And Human Rights, Jessica Tueller

Faculty Articles

Although human rights law has established a clear prohibition on discrimination based on marital status, this prohibition is vastly underutilized. This Article argues that increased attention to human rights law's prohibition on marital status discrimination, accompanied by clearer, more consistent, and more robust analysis of this phenomenon, is needed to ensure that everyone whether they choose to remain unmarried or to marry, whether they file for divorce or are widowed-continues to have and enjoy the same human rights and fundamental freedoms as any other person throughout their lifetime. This Article specifically recommends a focus on harmful marital status stereotypes that …

Generative Ai And The Purpose Of Legal Scholarship, Michael L. Smith Jan 2026

Generative Ai And The Purpose Of Legal Scholarship, Michael L. Smith

Faculty Articles

What does generative artificial intelligence mean for the future of legal scholarship? The topic has been the talk of the town around academic watercoolers. Some legal scholars have tried their hand at producing legal scholarship using generative Al. The accompanying commentary is varied, but advocates for the technology suggest that generative Al may become a common tool for legal scholars, leaving those who refuse to adapt at a severe disadvantage.

In this article, I contemplate a world in which legal scholars routinely use generative Al to produce academic writing. I argue that an instrumental view of legal scholarship's value-a view …

The Rhetoric Of Law In Executive Order No. 12,333, Noah C. Chauvin Jan 2026

The Rhetoric Of Law In Executive Order No. 12,333, Noah C. Chauvin

Faculty Articles

Scholars have long disputed the extent to which Congress may permissibly regulate the nation's foreign intelligence apparatus. Positions in this debate range from the view that Congress and the President share power over intelligence to the opinion that intelligence matters fall within the President's exclusive Article II authority. This Article examines the extent to which the text of Executive Order No. 12,333-the intelligence community's governing charter-supports the most expansive conceptions of presidential authority over intelligence matters. It concludes that the Order is best understood as recognizing Congress's power to pass laws governing the conduct of intelligence-laws that preclude executive refinement …

Meat Is Dead, Melissa D. Mortazavi Jan 2026

Meat Is Dead, Melissa D. Mortazavi

Faculty Articles

The legal and cultural landscape surrounding meat in the United States is evolving as plant-based alternatives, GMO farm animals, and cell-cultivated meat move from test tube to table. While global demand for meat rises amid environmental, ethical, and resource challenges, cell-cultivated meat emerges as a scientifically viable alternative, offering identical nutritional value without the drawbacks of conventional livestock production. Despite federal regulatory approval from USDA and FDA, multiple states have enacted unusually restrictive laws—including bans— targeting cell-cultivated meat. These are motivated largely by economic protectionism, but also deeper cultural anxieties tied to tradition and identity. This Article argues that food …

Decluttering The Orbital Commons: A Proposal For The Regulation Of Privately Created Space Debris, Rose W. Cobey Jan 2026

Decluttering The Orbital Commons: A Proposal For The Regulation Of Privately Created Space Debris, Rose W. Cobey

Journal of Air Law and Commerce

Space is one of the only resources shared by every person in every country at all times. The problem of space debris is therefore one that affects everyone living on our planet. Scientists and politicians have warned about crowding, collisions, and murky liability for decades, and each of these issues will only worsen without intervention. Space debris has caused damage on Earth since the Space Race, and it now endangers people and property in orbit. We are at an ever-increasing risk of building a wall around our planet and locking ourselves inside. In the last ten years, a new wrinkle …

Void In Space: How Loper Bright And The Major Questions Doctrine Affect The Federal Communications Commission’S Regulatory Authority Of Orbital Debris, Hernan Valles

Journal of Air Law and Commerce

Since the dawn of the space race, countries have been reaching for the stars. Recently, companies have joined the race. The space race and technological advancement of near-Earth orbital satellites have caused a buildup of debris in near-Earth orbit. The exponential increase of orbital debris in Earth’s orbit threatens the environmental system of the planet, the safety of astronauts aboard the International Space Station, the structure of other spacecraft, and modern economies relying on operational satellites to provide rapid communication, navigation, and weather forecasting information.

Yet there is a void among U.S. regulators in setting rules that mitigate orbital debris …

Outer Space Employment Tax And Grounded Enforceability: A Node-Based Approach Under International Space Law, Binbin Guo Jan 2026

Outer Space Employment Tax And Grounded Enforceability: A Node-Based Approach Under International Space Law, Binbin Guo

Journal of Air Law and Commerce

As commercial space activities move from state-led exploration to market operations, outer space is changing from a mission space into a workspace. As a result, the traditional connecting point for employment taxes, centered on the workplace, begins to lose force. This Article develops the concept of outer space employment taxation and argues that its key issue is not taxation in orbit, but enforceability. International space law does not directly provide the tax base, tax rates, or specific withholding rules. But through state responsibility, authorization and continuing supervision, and registration coupled with jurisdiction and control, it already provides institutional interfaces through …

Critical Feminist Editorial Praxis: My Tenure As The First Journal Editor Of Color Of Communication Monographs, Srivi Ramasubramanian Jan 2026

Critical Feminist Editorial Praxis: My Tenure As The First Journal Editor Of Color Of Communication Monographs, Srivi Ramasubramanian

Media Studies - All Scholarship

In this essay I theorize about Critical Feminist Editorial Praxis, which envisions journal editing as a site for scholar-activism. I use the term activism because to counter the hegemonic whiteness and coloniality of Communication knowledge requires active efforts to go against the taken-for-granted processes and practices. Journal editing is a significant location for interventions because this is often where we learn what is considered cutting-edge scholarship within our discipline. This significance is especially clear when the journal in question is a flagship publication of a leading professional organization. As I end my tenure as the first editor of color of …

Media Studies - All Scholarship

Campus activism by student leaders has historically played a significant role in social movements. Within contemporary contexts, media is an important site through which campus student leaders raise awareness, share relevant information, distribute online petitions, and shape public discourses on various social issues. Media literacy is an essential skill for student leaders to be effective in their activist initiatives and be able to cope with the inevitable pushback through trolling and cyberbullying that such activism would likely bring up. This survey (N = 855) with college student leaders across three universities explores how they rate themselves on media literacy skills, …

Spa 309 - Spanish Advanced Grammar, Beatriz Lado, Evelyn Duran-Urrea, Tania Avilés

Open Educational Resources

This syllabus is a work in progress developed by Tania Avilés, Evelyn Durán Urrea, and Beatriz Lado. We adapt the traditional grammar-focused course to introduce the study of the Spanish language through a critical sociolinguistic and language-education lens. This approach responds more directly to the needs of our students, many of whom speak language varieties that have historically been stigmatized or marginalized and are training to become Spanish-language teachers.

Students will examine the structure and grammar of Spanish across key domains, including phonetics, morphology, syntax, semantics, pragmatics, discourse, and variation. At the same time, the course situates this structural knowledge …

“He Will Always Love Me”: Authentic Romance And Reciprocal Love In Otome Games, Elena Yifei Zhao, Nick Bowman Jan 2026

“He Will Always Love Me”: Authentic Romance And Reciprocal Love In Otome Games, Elena Yifei Zhao, Nick Bowman

Media Studies - All Scholarship

This study investigates how players construct and articulate emotionally meaningful relationships in otome games. Drawing from 293 open-ended responses from Chinese players, a thematic analysis identified six recurring themes: authentic romance, companionship, shared experience, integration into daily life, game features, and personal growth. The most dominant theme, authentic romance, reveals that players often describe otome boyfriends as emotionally responsive partners who provide validation, support, and affection. Functional descriptions of gameplay mechanics were notably disconnected from other themes (primarily emotional engagement themes). A follow-up analysis of the most popular otome games in the same …

Economic Value Of Agro-Meteorological Services: A Review Of The International Literature, Joseph Manzvera, Kwabena Asomanin Anaman Jan 2026

Economic Value Of Agro-Meteorological Services: A Review Of The International Literature, Joseph Manzvera, Kwabena Asomanin Anaman

All Rsif Scholars' Publications

Introduction:

The increasing frequency and intensity of climate-induced extreme weather events, such as droughts, have significantly reduced agricultural productivity worldwide. Enhancing access to agro-meteorological services can mitigate these impacts by improving farmers’ decision-making and adaptive capacity. However, their economic value remains poorly understood, especially in African countries where meteorological services are provided as public goods. Demonstrating their value is critical to stimulate investment and strengthen climate-resilient agriculture.

Methods:

This study reviews and synthesises empirical evidence on the economic value of agro-meteorological services through a systematic literature review and meta-analysis of international studies. Both peer-reviewed and grey literature were analysed to …

Agriculture uses most of the world’s fresh water. Given that the worldwide population is expanding at an alarming rate, more land cultivation is apparently in demand. As a result, much more water would be required to irrigate cultivable lands. However, fresh water is becoming scarce at a faster rate due to climate uncertainties and over-exploitation. Several controlled irrigation techniques, such as drip and sprinkler irrigation, have been introduced to safeguard water resources. However, these techniques do not readily meet crop water demands and often end up causing overapplication of water. Under these circumstances, smart precision irrigation is the best solution. …

Implementation of agroecological innovations tends to be long-term processes, withthe practices of one year often linked to those of previous years. However, previousstudies have focused on understanding drivers of adoption at farm level, with adoptionmeasured at a point in time. In this study, we use a decade of panel data from thePermanent Agricultural Survey in Burkina Faso from 2010 to 2020 and machine learningapproaches, to model adoption rates of agroecological innovations at the provinciallevel as an autoregressive process. This modeling approach allows us to exploit the timeseries nature of our dataset to forecast future adoption rates. Our results showcase thepotential …

Establishing and maintaining 5G mmWave vehicular connectivity poses a significant challenge due to high user mobility that necessitates frequent triggering of beam switching procedures. Departing from reactive beam switching based on the user device channel state feedback, proactive beam switching prepares in advance for upcoming beam switching decisions by exploiting accurate channel state information (CSI) prediction. In this paper, we develop a framework for autonomous self-trained CSI prediction for mmWave vehicular users where a base station (gNB) collects and labels a dataset that it uses for training recurrent neural network (RNN)-based CSI prediction model. The proposed framework exploits the CSI …

The vision of smart agriculture depends on systems that can autonomously integrate distributed sensor data to support on-farm decisions such as precision irrigation and nutrient management. In variable-rate irrigation (VRI), this requires timely, high-resolution information to generate management zones that adapt to within-field variability throughout the season. However, current practice often relies on static zone maps and centralized processing, both of which are poorly suited to dynamic field conditions where sensors may fail, or drift and internet connectivity is often limited in resource-constrained environments. This study presents a reliability-aware edge-learning pipeline for weekly VRI zone prediction using federated learning (FL). …

Digital twins have emerged as a paradigm in precision and personalized medicine, enabling data-driven modeling of individuals to support tailored interventions. While most existing work focuses on patient-oriented twins, little attention has been given to modeling the provider’s role, particularly in clinical communication. In this study, we present GRACE (Generalized RAG-Enhanced Conversation Framework), a framework for constructing a provider digital twin (ProDT) that emulates key aspects of clinicians’ communicative and cognitive behavior. GRACE integrates three modules: a physician-informed dialog script generation and optimization module for provider-patterned conversation, a Retrieval-Augmented Generation (RAG) pipeline for factual grounding and timely knowledge updating, and …

Paying Up To Uncle Sam: Fbar Penalties, The Eighth Amendment’S Excessive Fines Clause, And A New Circuit Split, Christopher J. Nasta Jan 2026

Paying Up To Uncle Sam: Fbar Penalties, The Eighth Amendment’S Excessive Fines Clause, And A New Circuit Split, Christopher J. Nasta

Western New England Law Review

The Bank Secrecy Act requires those with foreign financial accounts to file a Report of Foreign Bank and Financial Accounts (FBAR) with the United States Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN). Those who do not file are subject to a variety of criminal and civil penalties.

The Eighth Amendment of the United States Constitution provides that excessive fines cannot be levied by the American government against individuals. How does this apply to those with foreign financial accounts who willfully choose not to file the required reporting forms with the United States government? A circuit split has arisen …

Tempering Trademark Tactics: Alloying Anti-Slapp Laws With Massachusetts’ Proven Petition Principles, Brian A. Pattengale

Western New England Law Review

Legitimate criticism of corporate actions or rights creates a free speech dilemma. When speech implicates or even indirectly relates to a trademark, costly litigation can arise where a plaintiff trademark holder is positioned to, or even obliged to, bury a defendant with numerous attendant claims only tangentially related to substantive trademark issues. If those claims are well-pled, the trademark holder succeeds in defeating constitutional speech rights unless the defendant mounts First Amendment defenses against the attendant claims at great cost.

Where a defendant’s speech—trademark or otherwise—is of public value, such lawsuits have been termed strategic lawsuits against public participation (SLAPPs). …

When To Bite Back: Queerness, Resistance, And Reclamation Of The Monstrous Identity In Andrew Joseph White’S Hell Followed With Us, Aster J. Mehigan Mx. Jan 2026

When To Bite Back: Queerness, Resistance, And Reclamation Of The Monstrous Identity In Andrew Joseph White’S Hell Followed With Us, Aster J. Mehigan Mx.

English

Who gets the right to define morality? Who gets to define what is monstrous? Frankenstein’s Creature, the vampires of Lost Boys, The Craft’s head witch Nancy Downs; these characters follow a pattern through the decades of those alienated from society, in this case being written with queer subtext, being deemed as monstrous. These queer monsters become the villains of the story, causing chaos, death and destruction in their wake, seeking revenge against a world that ostracizes them. The 2022 dystopian YA horror of Hell Followed With Us by Andrew Joseph White challenges the villanized monstrous identity through its transgender protagonist …

Clinical Challenges Associated With Enhancing Hypertension Among The Underserved African American Population, Ashley Richardson Jan 2026

Clinical Challenges Associated With Enhancing Hypertension Among The Underserved African American Population, Ashley Richardson

Doctor of Nursing Practice (DNP) Scholarly Projects

Background

African Americans face a significantly higher prevalence of hypertension, tend to develop complications at younger ages, and have disproportionately higher mortality rates. Key social determinants of health (SDoH)—including food deserts, unequal access to healthcare, and geographic disparities in healthcare resources—contribute to these ongoing inequities. Addressing both systemic and individual barriers is crucial for effective hypertension management.

Objective

This study aims to assess the effectiveness of a culturally relevant, community-based intervention designed to reduce both systolic and diastolic blood pressure among Black adults with uncontrolled hypertension.

Methods

Quality improvement (QI) initiatives typically employ multicomponent, equity-focused models. The primary components of …
