Toward A Framework For A Law Of Electronic Intangibles Liability, James M. Beck, Alexander M. Deguire

Marquette Law Review

Products liability law was built for a world of gears, levers, and physical failure. It now confronts a marketplace dominated by software, data, algorithms, and artificial intelligence—objects that do not break, shatter, or wear out, but nevertheless cause real and sometimes catastrophic harm. Courts and commentators increasingly respond to this tension by asking whether these digital systems are “product-like” enough to be squeezed into existing strict liability frameworks. This Article argues that this is the wrong question.

Driven by the digital economy and intensifying global competition, corporate innovation has become a core driver of sustainable growth. Topmanagement members are key strategic decision-makers, and their individual characteristics critically influence the formulation and implementation of innovation strategies. While existing studies have examined the impact of topmanagement’s cognitive and psychological traits on innovation performance, significant gaps remain in understanding how their routine behavioral preferences—particularly running, a globally prevalent exercise—affect innovation performance through psychological mechanisms. Conceptually, this thesis engages visually with Magical Realism as pioneered by Colombian writer, Gabriel Garcia Marquez, as well as the symbolic color fields of Colombian painter Alejandro Obregon, and the narrative portraiture of Spanish illustrator, David de las Heras, by situating my personal narratives within broader themes of memory, color symbolism and faith-based art. Emerging technologies such as artificial intelligence, cyber capabilities, autonomous weapons, and advanced robotics are reshaping the conduct of hostilities and, in particular, the process of targeting in armed conflict. Drawing on historical analogies of technological adaptation in warfare, this article applies a framework of “waning” and “emerging” factors to analyze the evolving relationship between the law of armed conflict (“LOAC”) and technological innovation. The discussion focuses on three critical dimensions of targeting: the places where conflict occurs, the actors engaged in conflict, and the means and methods employed. As citizens—and as lawyers—we are schooled to view the U.S. Constitution as what—indeed—“constitutes” us as a nation and as a people. As lawyers— and as citizens—we are also schooled to understand that the Constitution is law and that its meaning is to be ascertained through the process of law and by lawyers and judges. This Article builds on a popular constitutionalism frame to describe the profound limitations of restricting constitutional meaning-making to a legal enterprise performed primarily by judges—especially in regard to positive rights written into the Constitution but under-protected in constitutional law. Although freedom of speech can pose challenges for privacy governance,

privacy is a core First Amendment value. Many important First Amendment decisions were motivated more by intuitions about privacy than any other interest. Does the Fourth Amendment protect against governmental seizures of an individual’s digital property? The answer depends on whether government action constitutes a meaningful interference with digital property. Back to the Fourth Amendment considers the Founders’ intentional choice to use two separate words, search and seizure, to protect against governmental overreach. The Article advances an approach to the seizure analysis that protects against governmental seizures of digital property—by encouraging the Court to look at whether the government access meaningfully interfered with an owner’s right

Application Of Passive Samplers For Exploring Remedial Progress In The Torch Lake Aoc And Interlake Variability Of Pcbs, Cailin B. Bishop

This study evaluates changes in dissolved polychlorinated biphenyl (PCB) concentrations in Torch Lake, Michigan, an Area of Concern shaped by decades of legacy contamination and evolving restoration policy. Passive samplers deployed across sites and seasons (2024–2025) show total PCB concentrations ranging from below detection to 110 pg/L (mean = 16.8 pg/L), representing an approximate 90% decline since 2005. Comparisons with regional reference lakes indicate no statistically significant difference (p = 0.84), suggesting concentrations may approach background atmospheric levels despite continued variability. Congener profiles indicate a shift toward lower-chlorinated PCBs, though interpretation of higher-chlorinated congeners is limited by slow sorption kinetics. …

As space agencies prepare to return to the moon, an emphasis is being placed on establishing a sustained human presence that requires permanent structures and supporting infrastructure, making site preparation a critical factor. Michigan Technological University’s Planetary Surface Technology Development Lab has developed a novel low-mass surface compaction tool for use on a site preparation vehicle in collaboration with Colorado School of Mines. Testing in vacuum is necessary to simulate a relevant environment, which is required to increase the technology readiness level of this tool to TRL 5. Traditional 2D cell culture systems provide a controlled environment for studying cellular mechanisms, but they fail to emulate the complex 3D structure and mechanical stimuli present in native tissue. This study aimed to develop a tunable in vitro environment that more closely mimics the extracellular matrix by integrating porcine gelatin hydrogels with electrospun nanofiber scaffolds to support 3D cell growth. Gelatin crosslinked with microbial transglutaminase (mTG) was synthesized and optimized to create a viscous substrate capable of supporting cell movement and growth, while polycaprolactone nanofibers with aligned, mesh, and honeycomb morphologies were fabricated to introduce structural anisotropy similar to connective …

This dissertation presents a unified adaptive and coordinated control architecture for multi-station centrifugal pump pipeline systems operating under dynamic hydraulic conditions. Local controller adaptability is achieved using a variable-forgetting-factor Recursive Least Squares (RLS) algorithm, which continuously estimates process parameters to adjust controller gains in real time. To prevent excessive effort and controller-induced instability, a reinforcement-learning supervisory layer based on Q-learning is implemented to determine optimal adaptation-activation policies.

For pipeline systems with multiple pump stations, a game-theoretic coordination layer is introduced to balance discharge-pressure contributions, minimize pressure oscillations, and improve energy distribution across geographically distributed assets. Phase change materials (PCMs) are of interest in spacecraft thermal control because their latent heat capacity can provide passive thermal buffering during transient or cyclic heat loads. PCM behavior is often treated using idealized assumptions such as repeatable phase transition temperatures, consistent thermal accessibility across cycles, and full latent recovery. However, practical PCM behavior may be affected by non-ideal phenomena such as supercooling, interfacial resistance, and degradation of internal transport accessibility. For LGBTQ+ employees, research has indicated they feel othered, isolated, and unwelcome within their work communities. In other settings, social networks have been shown to provide stability and a sense of belonging that increases factors associated with mental health, such as self-care, stress moderation, and increased coping behaviors. Because of this, we examined the social networks of self-identified LGBTQ+ sports officials utilizing egocentric network analysis to better understand the influence of LGBTQ+ officials’ social networks on their feelings of safety and confidence and decisions to continue officiating. Research purpose: This study was a critical analysis of the lived experiences of three American university professors who served as volunteer citizen diplomats in a bi-lateral U.S. State Department sport exchange program with North Macedonian volleyball coaches.
