Should Kentucky Adopt A Formal Statewide Framework To Address The Local Fiscal Effects Of Tax-Exempt Public Universities On Host Communities?, Trina Shields, Catie Baumstark Jan 2026

Should Kentucky Adopt A Formal Statewide Framework To Address The Local Fiscal Effects Of Tax-Exempt Public Universities On Host Communities?, Trina Shields, Catie Baumstark

MPA/MPP/MPFM Capstone Projects

Kentucky’s public universities provide significant educational, economic, and workforce development benefits to the Commonwealth. However, because these institutions are exempt from local property taxes, questions arise about the fiscal effects on the communities that host them. While the benefits generated by universities extend beyond municipal boundaries, the fiscal effects of tax-exempt property are often concentrated within host communities. As universities expand their campuses and acquire additional property, local governments may face increased demands for public services without a corresponding increase in property tax revenue.

This study examines whether Kentucky should adopt a formal statewide framework to address the local fiscal …

Defamation, Privacy, And The First Amendment: Cases & Problems (3rd Ed.), George Biashvili Jan 2026

Defamation, Privacy, And The First Amendment: Cases & Problems (3rd Ed.), George Biashvili

Books

I created this resource in anticipation of teaching my Torts II class, which will primarily explore defamation and privacy torts. Though I searched for a suitable coursebook, I found that none contained all of the opinions I consider essential for teaching the nuances and complexities of these subjects. Additionally, I wanted to spare my students the exorbitant price tags associated with traditional law school texts. Hence, I assembled a collection of relevant privacy and defamation cases that align with the objectives of my course. Each case is accompanied by a set of questions to further stimulate class discussion. Where I …

Formal Neutrality And Unequal Liability: How Algorithmic Aversion Distorts Liability For Algorithmic Torts, Gao, Jingkang Jan 2026

Formal Neutrality And Unequal Liability: How Algorithmic Aversion Distorts Liability For Algorithmic Torts, Gao, Jingkang

Santa Clara Law Review

The shift in the cause of machine-induced harm from mechanical failures to algorithmic decision- making is challenging the applicability of products liability. Because algorithms now operate machines analogously to humans, a doctrinally coherent response is to subject algorithmic torts to a negligence framework that evaluates the reasonableness of decisions rather than the content of algorithms. This approach offers a theoretically grounded, formally neutral, and normatively appealing solution. In practice, however, it may result in unequal liability. Even under a negligence regime, algorithmic decision- makers may face systematically greater liability if injured parties are more inclined to pursue litigation against algorithmic …

Constitutional Structures In Private Law And The Example Of Waste Law, Fraley, Jill M. Jan 2026

Constitutional Structures In Private Law And The Example Of Waste Law, Fraley, Jill M.

Santa Clara Law Review

This Article proposes three criteria for when a private law mechanism performs a structural constitutional function: when it constrains present authority in the name of future stability, when it disperses enforcement to avoid centralized authority, and when it has structural entrenchment to avoid ordinary displacement. While many private law doctrines contain constitutional resonances or echo rights, the core of constitutional law is the power structure—a precondition for the protection of those rights. Constitutional structures have three key components: self-binding through time, separation and diffusion of power, and entrenchment beyond ordinary politics. For a private law doctrine to do more than …

What Ai Can’T Say: Oral Competence In Legal Education, Ho, Cynthia M. Jan 2026

What Ai Can’T Say: Oral Competence In Legal Education, Ho, Cynthia M.

Santa Clara Law Review

This Article brings together two critical conversations rarely considered in tandem – the impact of generative AI (GenAI) on legal education and the need for more practical skills – and argues for a shared solution centered on oral communication skills. Law schools have historically devoted substantial attention to teaching students how to write like lawyers, but not how to speak like one. Although a long-standing imbalance, the widespread use of GenAI in written work provides an additional urgent reason to place more emphasis on oral assignments.

This Article argues that doctrinal classes offer an underused, scalable opportunity to develop oral …

An Iterative & Analytical Hybrid Deep Learning Framework For Enhanced Brain Tumor Detection And Segmentation In Mri Video Scans, Swati V. Sakhare

Mansoura Engineering Journal

The critical need for accurate and robust brain tumor detection in MRI video scans is for early diagnosis and treatment planning operations. However, the existing methods suffer from several limitations, such as not being able to capture spatio-temporal features, handling class imbalances, and generalizing across datasets with diverse characteristics. To address these challenges, I propose a hybrid deep learning framework that integrates multiple advanced techniques to enhance the detection and segmentation of brain tumors. My approach starts by using the 3D CNN-LSTM (ResNet3D-LSTM) to extract spatio-temporal feature, which utilizes ResNet3D for spatial detail extraction and LSTM for temporal coherence across …

“Twist But Don’T Break:” Constellating Past And Present Barriers In Black Queer Multimodal Publishing That Shift Text Into Subtext; Addressing Acceptance Into Queer Creative Communities And The Void Of Black Voices Within, Kae Ann Dennert-Frederick

Cal Poly Humboldt theses and projects

What does it look like to reframe our understanding of intersectional work? Looking at multimodality I will walk through the multiple frameworks by asking how Black Queer publishing of Young Adult fiction uses visuals to describe what cannot be said and what choices are made to show community structure and language, while also having to adapt for publication standards. I have researched this by looking into examples of Queer publishing (any representation of queerness in a form of publishing—in the text and sometimes in the authors' identity), as well as authors’ use of visuals to say what cannot be said …

The Influence Of Dissenters And Social Control On Consensus And Entitativity, Hunter Pons Jan 2026

The Influence Of Dissenters And Social Control On Consensus And Entitativity, Hunter Pons

IdeaFest 2026

This pilot study examines how dissent and social control influence perceptions of consensus and entitativity within groups. Drawing on social identity theory and subjective group dynamics, participants (N = 53) were exposed to varying levels of dissenters (1 vs. 10) and social control (present vs. absent). Results showed that consensus did not vary by condition but significantly predicted entitativity. Findings support the role of consensus in shaping group entitativity; a future study will test the relationship between consensus and group identification, mediated by entitativity and social identity uncertainty. Null effects suggest limitations in sample and contextual relevance.
