What Sort Of ‘Inclusion’ Is Continuing Professional Development Promoting? An Investigation Of A National Cpd Programme For Inclusive Physical Education, Kyriaki Makopoulou, Dawn Penney, Ross Neville, Gary Thomas
Research outputs 2014 to 2021
Inclusion is positioned at the forefront of global educational reform. The study reported focused on a national Continuing Professional Development (CPD) programme for Inclusive Physical Education (IPE) in England. The research was designed to critically explore how CPD providers (i.e. tutors) variously conceptualised and practiced inclusion in the context of running a day-long CPD course for physical education teachers. Using qualitative methodology, data were collected via course observations (n = 27), informal interviews with tutors (n = 10), and a tutor questionnaire (n = 18). Findings suggest that although tutors’ theoretical interpretations of inclusion were largely consistent …

Rethinking The Classification Of Games And Sports In Physical Education: A Response To Changes In Sport And Participation, Justen O'Connor, Laura Alfrey, Dawn Penney
Research outputs 2022 to 2026
Background Through changing the way games are represented, classification systems have increased possibilities for teaching game forms beyond structured adult and singular official versions of popular sports. At the time of inception, the four-game form approach to classification (target, net/wall, striking/fielding, and invasion games) enabled modified, small sided conditioned games to be adapted to suit individual attributes, whilst reinforcing a core set of tactical and technical elements for transfer. With global shifts in patterns of sport participation, it is timely to review this dominant classification frame and the role it plays within physical education (PE). Purpose This paper proposes changes …

Research outputs 2022 to 2026
The aim of this scoping review is to understand the extent of issues of resilience implied by the interactions of older people with financial, social, and health related technologies. Older people aged 60+, technology use or non-use, and issues of resilience studied over the last four years (2019-2022) demarcate the scope of this review. Key exclusion criteria are older adults living in long-term care facilities, nursing homes, care homes and hospital in-patients. It also excludes studies on the perspectives of older peoples’ clinicians. The review will be carried out according to the Joanna Briggs Institute (JBI) scoping review methodology. The …
Contributing Factors Of Success For Middle School Agriculture Teachers, Sara Hughes
Contributing Factors Of Success For Middle School Agriculture Teachers, Sara Hughes
Murray State Theses and Dissertations
The changing dynamics of middle school agriculture education requires research into the causes for some teachers and chapters to succeed while others do not. The reasons for success may be varied and related to many different factors. The aim of this study is to determine how programs perform at high levels, what factors help them achieve success, and the role that evaluation may play in the process. The types of evaluation used for middle school agriculture teachers in Georgia will also be analyzed.
Georgia High School Counselor Perceptions Of Careers In The Agricultural Field, Meredith Arrington
Georgia High School Counselor Perceptions Of Careers In The Agricultural Field, Meredith Arrington
Murray State Theses and Dissertations
The word “farmer” somehow still evokes that stereotypical image of an old man in overalls wearing a straw hat and holding a pitchfork. Agriculture is our nation’s largest employer, but agriculture careers still have that stigma of being backbreaking manual labor that yields a low income and is reserved for those less educated or uneducated. At the secondary education level, this type of skewed perception by school counselors can have an impact on their abilities to counsel students who are seeking college or career advice. To meet the demands of our growing population, agricultural careers have evolved to become highly …
Benedicto Sáenz 'Libera Me': Occidentalisms In Latin America Nineteenth-Century Sacred Music, Andrés R. Amado
Benedicto Sáenz 'Libera Me': Occidentalisms In Latin America Nineteenth-Century Sacred Music, Andrés R. Amado
School of Music Faculty Publications
This article uses concepts of Occidentalism and the musical analysis of a funerary responsory by nineteenth-century Guatemalan composer Benedicto Sáenz (1807-1857) to examine possible reasons why music from nineteenth-century Latin America remains relatively neglected in the region and beyond, unlike the better explored repertoires from colonial times and from the twentieth and twenty-first centuries. Based on Latin American postcolonial notions of Occidentalism as the construction of the Western Hemisphere by Western Europe in the sixteenth and seventeenth centuries, and analysis of Sáenzs responsory Libera Me within the context of changing political, social, and musical trends in nineteenth-century Guatemala, I argue …

College of Nursing Faculty Research and Publications
Background
Caesarean section (CS) is an intervention to reduce maternal and perinatal mortality, for complicated pregnancy and labour. We analysed trends in the prevalence of birth by CS in Ghana from 1998 to 2014.
Methods
Using the World Health Organization’s (WHO) Health Equity Assessment Toolkit (HEAT) software, data from the 1998-2014 Ghana Demographic and Health Surveys (GDHS) were analysed with respect of inequality in birth by CS. First, we disaggregated birth by CS by four equity stratifiers: wealth index, education, residence, and region. Second, we measured inequality through simple unweighted measures (Difference (D) and Ratio (R)) and complex weighted measures …

Accruing evidence reveals best practices for how to help individuals living with Sickle Cell Disease (SCD); yet, the implementation of these evidence-based practices in healthcare settings is lacking. The Sickle Cell Disease Implementation Consortium (SCDIC) is a national consortium that uses implementation science to identify and address barriers to care in SCD. The SCDIC seeks to understand how and why patients become unaffiliated from care and determine strategies to identify and connect patients to care. A challenge, however, is the lack of agreed-upon definition for what it means to be unaffiliated and what it means to be a "SCD expert …

In the 2021 legislative sessions, Republican state lawmakers introduced a glut of preemption bills aimed at giving states more power over the administration of local government operations, signifying a new, deeper level of state interference into the inner workings of cities and counties. . . . Entering the 2021 legislative sessions, Republican state lawmakers used their power to respond to the events of 2020 – the pandemic, the racial justice movement, the presidential election, and what they perceived to be local government overreach (Brownstein 2021) – by introducing a surge of preemption bills aimed at appropriating the machinery of local …

Interest is growing in seaweed cultivation and sequestration as a carbon dioxide removal strategy. This white paper explores the barriers to seaweed permitting for carbon sequestration in California, including a complex, costly, and time-consuming lease and permitting process. Other states in the U.S., namely Maine and Alaska, have permitting systems designed to be more supportive of seaweed cultivation. This paper describes the legal framework for seaweed cultivation permitting in California and discusses the permitting systems in Maine and Alaska. The paper then explores possible reforms to streamline California’s permitting process, while maintaining appropriate environmental and other safeguards.

Don't Let The Digital Tail Wag The Transformation Dog: A Digital Transformation Roadmap For Corporate Counsel, Michele M. Destefano, Tellmann P. Bjarne, Daniel Wu

Due in part to the COVID-19 pandemic, enhancements in technology, as well as shifts in the macroeconomic and socioeconomic dynamics of globalization, Digital Transformation (DT) has become an enterprise-wide imperative for most multinational companies (MNCs). As a result, legal departments are being challenged to embrace enterprise DT and start their own departmental DT journeys. Despite these trends, there is little scholarship and research about how MNC legal departments are addressing the DT challenge. How are General Counsel (GCs) currently approaching DT? Is what they are doing effective and value-accretive? And importantly, how should GCs approach DT to best generate value? …

In the spring of 2009, the United States was mired in the greatest recession it had faced since the Great Depression. In March, the Dow Jones Industrial Average had fallen to 6,594.44, a total decline of 53.4 percent from its peak in the fall of 2007. The official unemployment rate was over 9 percent and still trending upward, eventually exceeding 10 percent. With the support of Congress, the Federal Reserve (the Fed) and other financial regulators had launched an array of initiatives to contain the fallout of what had become a global financial crisis. These interventions, including a massive recapitalization …

The recent emergence of Joint Statement Initiatives (JSIs) – that is, negotiating initiatives among a subset of the World Trade Organization (WTO) membership – has reignited the debate over law-making in the WTO. As things stand, the WTO operates on the basis of a widespread expectation that consensus needs to be achieved for any decision to be taken. Agreements that produce rights and obligations only among a subset of the membership (‘plurilaterals’, or Annex 4 agreements) are also subject to the consensus rule and thus remain exceptional. Are JSIs the first move towards redressing the current equilibrium in favour of …

Mindful Debiasing: Meditation As A Tool To Address Disability Discrimination, Elizabeth F. Emens

Antidiscrimination law is at a critical juncture. The law prohibits formal and explicit systems of exclusion, but much bias nonetheless persists. New tools are needed. This Article argues that mindfulness meditation may be a powerful strategy in the battle against disability discrimination. This Article sets out eight reasons that disability bias is particularly intractable. The Article then draws on empirical, philosophical, and scholarly sources to identify mechanisms through which mindfulness meditation can address these dynamics. The Article concludes by presenting concrete doctrinal implications of bringing mindfulness to bear on disability discrimination. This Article thus contributes to the established fields of …

Law’S Contributions To The Mindfulness Revolution, Elizabeth F. Emens

These are phenomenally challenging times. Mindfulness is a tool that can help lawyers support themselves, each other, their clients, and their collaborators in the hard work needed to build community and take action. For these and other reasons, mindfulness has made major inroads into law and legal institutions. Law firms, law schools, and courthouses offer training in mindfulness meditation to support the cognitive clarity and emotional self-regulation necessary for the demanding work of analyzing problems, resolving conflicts, overcoming bias, and doing justice. A growing literature, from empirical social science to legal scholarship, catalogs these and other benefits of mindfulness for …

Copyrights and patents are differently structured intellectual property rights in different kinds of entities. Nonetheless, they are widely regarded by U.S. scholars as having the same theoretical underpinnings. Though scholars have sought to connect philosophical theories of property to intellectual property, with a particular interest in the labor theory of John Locke, these explorations have not sufficiently probed copyrights’ and patents’ doctrinal differences or their philosophical implications for the theories explored. This Article argues that a defining difference between copyrights and patents has normative significance for the framework of Lockean property theory: namely, that copyright law treats independent creation as …

This Article analyzes the interaction between the burden of proof and evidentiary discovery rules. Both sets of rules can affect incentives for prospective injurers to invest in evidence technology (i.e., ex ante investments that increase the quantity and quality of evidence in case an accident occurs). This interaction becomes acutely important in the private international law setting, where jurisdictions are split on the question whether the burden of proof should be treated as a substantive or procedural matter. When a tort occurs in Europe, but the case is litigated in American courts, treating the burden of proof as a procedural …

This paper addresses “floors” – minimum substantive international protections, and “ceilings” – maximum substantive international protections, set out in the Berne Convention and subsequent multilateral copyright accords. While much scholarship has addressed Berne minima, the “maxima” have generally received less attention. This Comment first describes the general structure of the Berne Convention, TRIPS and WCT regarding these contours, and then analyzes their application to the recent “press publishers’ right” promulgated in the 2019 EU Digital Single Market Directive. Within the universe of multilateral copyright obligations, the Berne maxima (prohibition of protection for facts and news of the day), buttressed by …

Proof that a defendant actually copied from a copyrighted work is a critical part of a claim for copyright infringement. Indeed, absent such copying, there is no infringement. The most common method of proving copying involves the use of circumstantial evidence, consisting of proof that a defendant had “access” to the protected work, and a showing of “similarities” between the copy and the protected work. In inferring copying from the combination of such evidence, courts have for many decades developed a framework known as the “inverse ratio rule,” which allows them to modulate the level of proof needed on access …
