Clinical Reasoning Education In The Clerkship Years: A Cross-Disciplinary National Needs Assessment, Jonathan G Gold, Christopher L Knight, Jennifer G Christner, Christopher E Mooney, David E Manthey, Valerie J Lang
Faculty, Staff and Students Publications
BACKGROUND: Improving clinical reasoning education has been identified as an important strategy to reduce diagnostic error-an important cause of adverse patient outcomes. Clinical reasoning is fundamental to each specialty, yet the extent to which explicit instruction in clinical reasoning occurs across specialties in the clerkship years remains unclear.
METHOD: The Alliance for Clinical Education (ACE) Clinical Reasoning Workgroup and the Directors of Clinical Skills Courses (DOCS) Clinical Reasoning Workgroup collaborated to develop a clinical reasoning needs assessment survey. The survey questionnaire covered seven common clinical reasoning topics including illness scripts, semantic qualifiers, cognitive biases and dual process theory. Questionnaires were …

A Precision Medicine Agenda In Traumatic Brain Injury, Jovany Cruz Navarro, Lucido L Ponce Mejia, Claudia Robertson
Faculty, Staff and Students Publications
Traumatic brain injury remains a leading cause of death and disability across the globe. Substantial uncertainty in outcome prediction continues to be the rule notwithstanding the existing prediction models. Additionally, despite very promising preclinical data, randomized clinical trials (RCTs) of neuroprotective strategies in moderate and severe TBI have failed to demonstrate significant treatment effects. Better predictive models are needed, as the existing validated ones are more useful in prognosticating poor outcome and do not include biomarkers, genomics, proteonomics, metabolomics, etc. Invasive neuromonitoring long believed to be a "game changer" in the care of TBI patients have shown mixed results, and …

How Do Digital Lives Affect Resident Mental Health In The Digital Era? Empirical Evidence Based On Chinese General Social Survey, Yan Chen, Mengyang Wei, Jaime Ortiz
Faculty, Staff and Students Publications
Having good mental health means we are better able to connect, function, cope and thrive. The widespread application of digital technology in daily life provides new ways and promising tools for residents to maintain their mental health. Given the importance of mental health for everyone, and the fact that mental health problems are prevalent worldwide, this study discusses how digital lives affects the mental health of residents. The results suggest that digital lives are significantly and positively associated with mental health. Mechanisms analysis identifies personal perceptions (self-rated physical exercise and subjective wellbeing) as the important paths for digital lives to …

INTRODUCTION: Adequate physical activity is an integral requirement for achieving cardiovascular health. Physical inactivity is the fourth leading cause of death worldwide. Hence, it is important to identify racial/ethnic groups that are less likely to achieve sufficient physical activity levels, and to address barriers to meeting physical activity requirements.
METHODS: Cross-sectional data from the 2006-2015 National Health Interview Survey (NHIS) were used to compare self-reported sufficient physical activity among different racial/ethnic groups: non-Hispanic (NH) Whites, NH Blacks, NH Asians, and Hispanics in the United States. Sufficient physical activity was defined as ≥ 150 minutes per week of moderate-intensity physical activity, …

Synthetic Assembly Dna Cloning Of Multiplex Hextuple Luciferase Reporter Plasmids, Alejandro Sarrion-Perdigones, Yezabel Gonzalez, Koen J T Venken
Faculty, Staff and Students Publications
Multiplex hextuple luciferase assaying allows monitoring the activity of five experimental pathways against one control at the same time. To perform multiplex hextuple luciferase assaying, six orthogonal luciferase reporter units are needed of which five are pathway-specific and one acts as a control for normalization. To ensure stoichiometric delivery of all six luciferase reporters in every transfected cell, synthetic assembly DNA cloning is used to stitch together all six luciferase reporter units into a single vector. Here, we provide a detailed three-step synthetic assembly DNA protocol to generate multiplex hextuple luciferase reporter plasmids for any five cellular signaling pathways of …

Paying For Energy Peaks: Learning From Texas' February 2021 Power Crisis, Colleen M. Baker, James W. Coleman
Faculty Journal Articles and Book Chapters
From February 14–19, 2021, winter storm Uri blanketed Texas with extreme cold. Tragically, the severe temperatures overwhelmed the state’s power system. Texas’ power grid ended up more than 20 Gigawatts short of the electricity Texans needed 2 – more power than all of California produces on an average day. Over two-hundred lives were lost3 and an estimated $295 billion in damage resulted.4 Yet many had long regarded Texas’ electric power system, and its regulation, as a model for others. What happened? That question is the focus of this article. This article first provides an overview of the severe power outages …

Experts predict that the use of smart contracts and other applications of blockchain technology could revolutionize the manner in which we do business. Blockchain technology promises the elimination of middlemen, increased trust and transparency, and improved access to shared information and records. Thus, it is no surprise that companies and entrepreneurs are developing blockchain solutions for an array of markets, ranging from real estate to health care. But can this new technology revolutionize tax administration?
This Article is the first to consider blockchain technology’s role in addressing the shortcomings of our current administration system— namely, a large tax gap, high …
The "Anti-Deference" Device: Article 18 Of The European Convention On Human Rights, Jeffrey D. Kahn
The "Anti-Deference" Device: Article 18 Of The European Convention On Human Rights, Jeffrey D. Kahn
Faculty Journal Articles and Book Chapters
This article makes two principal arguments. First, the limitation on restricting rights that is established by Article 18 of the European Convention on Human Rights is the mirror image of the margin of appreciation doctrine created by the European Court of Human Rights. As such, exploring the metes and bounds of Article 18 aids our understanding of that judicially created doctrine. Parts II and III explore this connection and the origins of this limitation on Member States.
The second argument is a practical application of the first one. Russian accession to the Convention and membership in the Council of Europe …

What Do Good Lawyers Know That The Rest Of Us Don't? Introducing First-Year Law Students To 'Legal Realism', Gregory S. Crespi
Faculty Journal Articles and Book Chapters
This short article presents the general outlines of a lecture that I usually give to my first-year contract law students, at about the end of their first week of classes, to get them started thinking about the process of judicial decision-making, and about the “legal realist” perspective regarding that process.
Western Herbalism: What Drives Individuals Within Rhode Island To Study This Ancient Healing Modality?, Kyla Shea
Student Publications
People globally rely on herbal practices as their main form of healing, yet few people in the West understand how to properly identify and effectively use herbs. This loss of knowledge regarding traditional healing practices was done so intentionally during enslavement and colonization, resulting in exploitation and misinterpretation of herbal practices. By reclaiming this knowledge, it is not only a way to improve the health of communities and the land, but it is also a way of reclaiming ancestral traditions and connection with oneself. Furthermore, this research paper explores the complexities of Western herbalism and determines what drives individuals within …

Emerging Technology’S Language Wars: Smart Contracts, Carla L. Reyes
Faculty Journal Articles and Book Chapters
Work at the intersection of blockchain technology and law represents a highly interdisciplinary area of inquiry. Often, researchers, law-makers, lawyers, and other stakeholders unnecessarily debate issues because of linguistic misunderstandings. As the third of four studies examining the impact of clashes of linguistic meaning on law and policy around emerging technologies, this Essay uses smart contracts as a case study to demonstrate the real legal harm that arises from a failure to communicate. Specifically, this Essay uses techniques from corpus linguistics to reveal the inherent value conflicts embedded in definitional differences and debates as to whether the law should “accommodate” …
Cognitive Biases Incidence In College Students Of A Midwestern Institution, Camilo A. Castelblanco Riveros
Cognitive Biases Incidence In College Students Of A Midwestern Institution, Camilo A. Castelblanco Riveros
Modern Psychological Studies
Cognitive biases, including the misinformation effect, cognitive dissonance, and confirmation bias, are misleading ways of reasoning that can alter our perception of reality. Using questionnaires, this study investigated the extent to which these biases are present in the student community of a Midwestern University. It was hypothesized that a moderate proportion of individuals would show cognitive biases based on the literature and previous experiments. Furthermore, it was expected that participants would employ multiple strategies to justify their behavior and thought processes. With a qualitative design, 81 undergraduate students participated in the study. The research design was observational and statistical analysis …
The Effect Of Photographs On The Narrative Believability Of Positively And Negatively Framed Stories, Camryn E. Backman, Tammy L. Sonnentag
The Effect Of Photographs On The Narrative Believability Of Positively And Negatively Framed Stories, Camryn E. Backman, Tammy L. Sonnentag
Modern Psychological Studies
Countless news articles are published in print or digital form each day, creating a need to understand what makes stories attractive and believable. Salacious, oftentimes negative, news stories tend to effectively grab readers’ attention (Entman, 1993; Serani, 2011), and when the news stories are accompanied by photographs, readers’ interest in the articles is promoted (Knobloch et al., 2003). However, the extent to which negatively framed stories are perceived as believable is largely unknown. The current study examined whether a story’s valence (i.e., positive or negative) affects the believability of news articles, particularly in the presence of a photograph. It was …

Lay Perceptions Of Treating Mental Illness With Psychedelic Assisted Therapy, Dèjah Barksdale, Emily Pica
Modern Psychological Studies
With roughly 44.7 million individuals struggling with mental health problems, it is important that new methods of treatment are explored. Currently, the primary method of treatment is Selective Serotonin Reuptake Inhibitors (SSRIs) for disorders such as: anxiety, depression, and post-traumatic stress disorder (PTSD), but they also provide many detrimental side effects and only decrease symptomology for a short period of time. However, the interest and enthusiasm of many researchers has led to uncovering the true benefits of utilizing psychedelic drugs as a leading treatment for mental health problems. Participants (N = 474) were given a questionnaire regarding their knowledge of …

What’S Your Snapscore? Correlations To Personality, Narcissism, And Anxiety, Samantha Chambers, Scott P. King
Modern Psychological Studies
Snapchat is a popular social media network, but considerably less researched than other more established platforms. The purpose of this study was to examine how the amount of Snapchat use is correlated to personality, narcissism, and anxiety. We hypothesized there would be positive correlations between Snapchat usage and narcissism, extroversion, and anxiety. Using data from a convenience sample of participants recruited from Amazon Mechanical Turk, Pearson’s correlations and t-test analysis provided insight on these connections. There were significant positive correlations between Snapchat usage and narcissism, anxiety, and extraversion, but t-test analyses revealed that the users with low Snapscores had higher …
Are We Giving Them A Fair Chance? Racial Stereotypes And The Juvenile Justice System, Cali K. Bloem, Ashley A. Hansen-Brown
Are We Giving Them A Fair Chance? Racial Stereotypes And The Juvenile Justice System, Cali K. Bloem, Ashley A. Hansen-Brown
Modern Psychological Studies
Prior research indicates that there are racial disparities throughout the criminal justice system and that decision-makers may use stereotypes when determining guilt and deciding on sentences for juveniles. This study looked at sentence disparities between White and Latinx juveniles, as well as potential stereotypes that could be used in decision-making. There were no differences in sentence length and severity between the White and Latinx offender. Additionally, the likelihood of the offender receiving a lesser or greater sentence as an adult did not differ among conditions. Our results also showed that participants with prior juror experience used less stereotypical language in …

Facebook, Crime Prevention, And The Scope Of The Private Search Post-Carpenter, Connor M. Correll
Georgia Law Review
The Fourth Amendment of the U.S. Constitution protects people “against unreasonable searches and seizures.” The private search doctrine provides a notable exception to the Fourth Amendment, providing that the government may reconstruct a search previously performed by a private party without first obtaining a warrant. The U.S. Supreme Court developed the private search doctrine prior to the advent of the internet; however, modern technology has changed the way that individuals live. What was once done entirely in private is now done alongside ever-present third parties, such as cell phones and virtual assistants.
Facebook and other social media sites complicate Fourth …
Off-Label Innovations, David A. Simon
Off-Label Innovations, David A. Simon
Georgia Law Review
Modern medicine faces many significant problems. This Article is about two of them. The first is that approved drugs have many potential therapeutic uses that are never identified, investigated, or developed. The second is the routine practice of physicians prescribing approved drugs for unapproved uses—so-called “off-label” uses. These problems seem very different. Failure to invest in potential new uses is an innovation problem: firms lack incentives to research and develop new uses of old drugs. The problem of off-label uses, on the other hand, is one of safety and efficacy: off-label uses are risky because they are not supported by …
No [Concrete] Harm, No Foul? Article Iii Standing In The Context Of Consumer Financial Protection, Annefloor J. De Groot
No [Concrete] Harm, No Foul? Article Iii Standing In The Context Of Consumer Financial Protection, Annefloor J. De Groot
Georgia Law Review
In the U.S. Supreme Court’s 2016 decision in Spokeo, Inc. v. Robins, the Court held that a bare procedural violation of a federal consumer protection statute is not enough to satisfy Article III’s standing requirement because the alleged injury is not sufficiently concrete. This decision resulted in a sizeable circuit split regarding standing under the Fair Debt Collection Practices Act, with some circuit courts interpreting the holding as narrowing the scope of standing for consumer protection claims, and others maintaining a broader interpretation, allowing plaintiffs to obtain redress for violations of consumer financial protections laws.
In its 2021 ruling in …
The Double-Side Of Deepfakes: Obstacles And Assets In The Fight Against Child Pornography, Abigail Olson
The Double-Side Of Deepfakes: Obstacles And Assets In The Fight Against Child Pornography, Abigail Olson
Georgia Law Review
Deepfake technology recently took the internet by storm. Although they can be used for both innocuous and nefarious purposes, deepfakes overwhelmingly depict people who appear to be creating nonconsensual pornography. The rise of deepfake technology must be accounted for in the existing federal legal framework, specifically in cases implicating images of children. While deepfakes’ malicious uses ought to be criminalized, exceptions should be made to use deepfake technology as a tool to enforce and deter purveyors of child pornography. This Note explores what the emerging legal framework addressing deepfakes should look like and considers the importance of using the “flipside” …
The Impact Of Social Capital On U.S. Based Destination Marketing Organizations And Interorganizational Relationships, Jeremy Fairley
The Impact Of Social Capital On U.S. Based Destination Marketing Organizations And Interorganizational Relationships, Jeremy Fairley
Electronic Theses and Dissertations, 2020-2023
Previous literature echoes the notion that destination marketing organizations (DMOs) play a critical role in ensuring a desired tourism development scenario. To date, the performance measurement of destination marketing organizations is paralleled to financial indicators or operations, ignoring the presence and quality of relationships among DMOs and tourism stakeholders. Based on the premise of social capital theory, it is argued that social capital and the inter-organizational relationships between DMOs and tourism stakeholders can influence the success of tourism efforts in a destination, which in return is a contributing factor to the DMOs success as an organization. Furthermore, broader literature indicates …
The Antecedents Of Program Satisfaction And Program Loyalty For Hotel Reward Programs, Jill Plumer
The Antecedents Of Program Satisfaction And Program Loyalty For Hotel Reward Programs, Jill Plumer
Electronic Theses and Dissertations, 2020-2023
Hotel reward programs have been in existence for three decades. These programs were originally established as a customer relationship management tool to reward loyal guests for their patronage. Over time, there have been indications that the programs that are intended to inspire loyalty to the company have actually inspired loyalty to the program itself. The aim of this study was to analyze the antecedents of program satisfaction and program loyalty in hotels to determine the relationship between the program attributes and the impact on program loyalty. Switching costs were also analyzed to determine if they played a moderating role in …
Employing A Network Perspective To Study Hazardous Events In Tourism: Tourism Connections, Island Preferences, And Tourism Market Concentrations In The Hawaiian Islands (2015-2021), Frida Bahja
Electronic Theses and Dissertations, 2020-2023
The purpose of this study was to employ a network perspective to detect fluctuations in tourism (at the level of tourism areas and by inbound tourism markets) that co-occur with hazardous events. Specifically, the study focuses on the Air Travel Tourism (ATT) network of the Hawaiian Islands and its changes with the incidence of nine hazardous events from 2015 to 2021. The three main aspects of the ATT network, which include tourism connections, island preferences, and concentrations of inbound tourism markets were analyzed for a total of eighty-four monthly and seven annual network models. The results suggest that the network …

White Injury And Innocence: On The Legal Future Of Antiracism Education, Osamudia James
Faculty Publications
In the wake of the “racial reckoning” of 2020, antiracism education attracted intense attention and prompted renewed educator commitments to teach more explicitly about the function, operation, and harm of racism in the United States. The increased visibility of antiracism education engendered sustained critique and opposition, resulting in executive orders prohibiting its adoption in the federal government, the introduction or adoption of over sixty state-level bills attempting to control how race is taught in schools, and a round of lawsuits challenging antiracism education as racially discriminatory. Because antiracism so directly runs afoul of norms underlying American antidiscrimination law, including anticlassification, …

Social Justice As Desistance: Rethinking Approaches To Gender Violence, Deborah M. Weissman
Faculty Publications
Part I of this Article describes most domestic violence intervention programs (DVIPs) as they currently function with regard to gender violence. It critiques the structure of these programs, their close partnership with criminal legal system actors, perceived deficiencies, and it identifies missed opportunities to provide meaningful intervention strategies with those who have harmed. It demonstrates the ways that laws, regulations, and policies governing DVIPs constrain most programs from moving beyond established practices informed by punitive approaches to address the structural conditions that situate gender violence within a political economic framework.
Part II begins with a brief overview of the research …

Regulating Big Tech is now a matter of intense public debate. We ask how well Big Tech companies fulfill their role as gatekeepers of the public square. We ponder whether their dominant market positions merit an antitrust response. We assess their culpability and complicity in spreading online misinformation and hate. However, in the many normative debates over how Big Tech should use its power, the source of that power remains largely unexamined.
Big Tech, like Big Tobacco before it, is an industry founded on addiction. Although typically “free” to use, the world’s largest digital platforms exploit users’ dopamine pathways to …

Judges And Mass Incarceration, Carissa Byrne Hessick
Faculty Publications
This Article argues that judges—long overlooked in contemporary explanations of mass incarceration—have played a central role both through affirmative decisions that increased punishment and through failures to act as a check on prosecutorial power. It traces how judicial choices such as imposing the trial penalty, deferring to sentencing guidelines, allowing coercive plea bargaining, expanding pretrial detention, and adopting narrow or delayed statutory interpretations have structurally reshaped the criminal justice system to favor conviction and incarceration. The Article then proposes practical steps trial judges could implement immediately to reverse these trends, including reducing reliance on pretrial detention, eliminating the trial penalty, …
