Population Assignment Of Entrained Migratory Westslope Cutthroat Trout In North Idaho, Craig D. Wells
EWU Masters Thesis Collection
The Clark Fork-Pend Oreille River basin of northeastern Washington and the Idaho Panhandle historically supported a robust metapopulation of Westslope Cutthroat Trout (WCT) Oncorhynchus clarkii lewisi, a western native salmonid of high cultural and economic value. The construction of impassible hydroelectric dams and smaller in-stream barriers has prevented the return of migratory WCT to spawning tributaries, likely leading to the fragmentation of this metapopulation over the last 100 years. One such impassible barrier is Albeni Falls Dam near Newport, Washington. Completed without fish passage capabilities in 1955, Albeni Falls Dam has been of interest as a site for restoring fish …

Understanding The Mode Of Action Of Essential Oil Nanoemulsions To Inhibit Fusarium Growth And Mycotoxin Production In Cereal, Haiyang Jiang
Understanding The Mode Of Action Of Essential Oil Nanoemulsions To Inhibit Fusarium Growth And Mycotoxin Production In Cereal, Haiyang Jiang
Plant Sciences
Deoxynivalenol (DON) is a commonly occurred mycotoxin in cereal-based food, which is mainly produced by Fusarium spp. in the field. It is unfeasible to entirely avoid DON contamination in cereal grains with good agricultural practices. Therefore, it is of great importance to have a strategy for preventing DON contamination in our final food products. In recent years, utilization of plant extracts such as essential oils (EOs) as antifungal and mycotoxin inhibitory agents in foods have gained popularity. Depending on the EO type and chemical composition of EOs, the antifungal and mycotoxin inhibitory efficacies of different EOs might be varied. In …

This Article develops a novel concept in information technology called metasoftware. It then applies the concept of metasoftware to developing legal technology.
Metasoftware enables users to create the software of their choosing and stands in sharp contrast to traditional, functional software that is intended for a particular purpose or a defined range of tasks. Functional software is the default type of software that is currently produced and includes word processing, email, social networking, enterprise resource management, online marketplaces, and video game software. Metasoftware, by contrast, is not functional. Metasoftware presents the user with a blank slate upon which to build …

Noting that the First Amendment protects lies about the government made in the public square, this article explores whether lawyers’ free speech rights ought to be different from that of other speakers. The law holds lawyers to a more demanding standard of conduct than others when it comes to aspects of lawyers’ fiduciary relationships with courts and clients. But how much more demanding can the law be when it comes to lawyers’ speech — in this case, false political speech? Applying the current First Amendment framework, we question the bar’s assumption that lawyers’ speech outside of these contexts can be …

Trauma-Informed Forensic Mental Health Assessment: Practical Implications, Ethical Tensions, And Alignment With Therapeutic Jurisprudence Principles, Julie Goldenson, Stanley Brodsky, Michael L. Perlin
Articles & Chapters
The need for trauma-informed practice is well recognized across mental health and legal settings; however, relatively little has been written about its application in forensic mental health assessment. This paper focuses on trauma-informed assessment of criminal justice involved individuals, given the high rates of trauma exposure and related sequelae in this population. A trauma-informed lens allows forensic mental health examiners to assess examinees in the context of their developmental histories and lived experience. Such a lens also has implications for the entire assessment process in terms of interviewing, psychological testing, diagnostic conclusions, feedback, and the provision of testimony and educating …

Culture And Fair Use, Michael Goodyear

The intersections of race and copyright have been underexamined in legal scholarship, despite repeated calls for further scrutiny. The scholarship has so far focused primarily on identifying where copyright has fallen short in protecting the creative works of artists of color. This Article, instead, hopes to offer one viable solution for creating more inclusivity of different cultures in copyright: the approval of cultural adaptations under fair use.
Cultural adaptations—the transforming of preexisting works to reflect the cultural and social mores and norms of a different group—would appear on first glance to be prohibited as derivative works, which, under the Copyright …

The Illinois Biometric Information Privacy Act, more commonly known as “BIPA,” was the first statute to protect biometric privacy in the United States when it was passed in 2008. Although Texas and Washington have since passed their own biometric privacy laws, and other states have protected biometric information as part of more general data privacy legislation, BIPA remains the most powerful such law in the country due to being the only biometric privacy law to contain a private right of action. BIPA has also proven to be an important precedent for other states, such as New York, that are currently …

Cancer Related Cognitive Impairment In Breast Cancer Patients: Guidelines For Neuropsychological Evaluation And Management, Ali Al-Humadi
Graduate School of Professional Psychology: Doctoral Papers and Masters Projects
Current literature indicates there is still some debate regarding the scope and severity of cancer treatment related cognitive impairment (CRCI), with a wide variety of complex factors contributing to cognitive decline and discrepancies between objective findings and patient self-report. This paper aims to provide guidelines for neuropsychological evaluation, management, and rehabilitation of CRCI in breast cancer patients based on current research. This paper also aims to discuss current research on proposed mechanisms of action for CRCI, the cognitive domains affected in CRCI, and significant bio-psycho-social risk factors impacting CRCI.

Marine ecosystems have been used, impacted by, and managed by human populations for millennia. As ecosystem degradation has been a common outcome of these activities, marine management increasingly considers ecosystem restoration. Currently, there is no coherent data recording format or framework for marine restoration projects. As a result, data are inconsistently recorded and it is difficult to universally track progress, assess restoration's global effectiveness, reduce reporting bias, collect a holistic suite of metrics, and share information. Barriers to developing a unified system for reporting marine restoration outcomes include: reaching agreement on a framework that meets the needs of all users, …

Ocean Connectedness And Consumer Responses To Single-Use Packaging, Sohvi Nuojua, Sabine Pahl, Richard Thompson
School of Biological and Marine Sciences
Single-use packaging items constitute a large proportion of the plastic litter found in the marine environment. Consumer decisions contribute to the accumulation of this pollution in the environment. Here we undertook two studies to assess consumer responses to different types of single-use packaging. Moreover, we introduce a new measure of ocean connectedness adapted from nature connectedness measures and investigate its association with consumer response. In Study 1, 60 UK undergraduate students completed a packaging rating task and a survey on ocean connectedness in a laboratory environment. In the rating task pictures of bottled drinks with unique combinations of packaging recyclability …

Despite advances in sequencing, lack of standardization makes comparisons across studies challenging and hampers insights into the structure and function of microbial communities across multiple habitats on a planetary scale. Here we present a multi-omics analysis of a diverse set of 880 microbial community samples collected for the Earth Microbiome Project. We include amplicon (16S, 18S, ITS) and shotgun metagenomic sequence data, and untargeted metabolomics data (liquid chromatography-tandem mass spectrometry and gas chromatography mass spectrometry). We used standardized protocols and analytical methods to characterize microbial communities, focusing on relationships and co-occurrences of microbially related metabolites and microbial taxa across environments, …
Non-Chemical Weed Management In Annual And Perennial Organic Cropping Systems, Zachary Pull
Non-Chemical Weed Management In Annual And Perennial Organic Cropping Systems, Zachary Pull
Plant Sciences
Weedy pests, especially perennial weeds, are among the most challenging barriers to organic crop production. Improving non-chemical weed management tactics for established organic productions systems, like cool-season grains, and emerging crops like perennial flax could benefit producers. We compared three crop sequences for creeping perennial weed suppression in organic grains. Three years of alfalfa was associated with reduced densities and aboveground biomass of perennial weeds compared to sequences that alternated grain and cover crops. Interseeding cover crops with perennial flax for weed management was attempted, but neither flax nor cover established well. Flame weeding and cultivation in perennial flax were …
Genetic Dissection And Improvement Of Fusarium Head Blight Resistance In Durum Wheat, Runhao Wang
Genetic Dissection And Improvement Of Fusarium Head Blight Resistance In Durum Wheat, Runhao Wang
Plant Sciences
Fusarium Head Blight (FHB) is a destructive and complex fungal disease in wheat. Durum wheat, an economically important crop for pasta production, is under the severe impact of FHB. While numerous favorable QTL/genes have been identified in common wheat, there are fewer resistance resources found in durum wheat. An interspecific cross between FHB resistant hard red spring wheat (HRSW) and durum wheat cultivar ‘Riveland’ has been conducted for the introgression of resistance resources to durum wheat. Given the complex quantitative trait of FHB resistance in wheat, a recurrent selection population was constructed by crossing durum wheat cultivars and durum breeding …

Design is ascendant. Steve Jobs’s legendary obsession with design was widely regarded as Apple’s comparative advantage, and that lesson has not been lost on its competitors. Design thinking is a growth industry, in business and at universities, and design professionals continue to take on increasingly significant roles within firms. The increasing economic significance of design has been reflected in an explosion of design patent applications and increasing amount of design litigation.

Waste And The Governance Of Private And Public Property, Tara Righetti, Joseph Schremmer

Common law waste doctrine is often overlooked as antiquated and irrelevant to modern law as a result of contract, corporate law, trust and estate planning, and public law. At best, waste doctrine is occasionally examined as a lens through which to evaluate evolutions in modern property theory. We argue here that waste doctrine is more than just an historical artifact. Rather, the principle embedded in waste doctrine underpins a great deal of property law generally, both common law and statutory, as well as the law governing oil and gas, water, and public trust resources. Seen for what it is, the …

Convergence & Conflict : Reflections On Global And Regional Human Rights Standards On Hate Speech, Evelyn Aswad, David Kaye
Faculty Articles
What is hate speech under international human rights law? And how do key international adjudicators interpret the law governing it? This Article seeks to illuminate two countervailing and under-reported trends: on the one hand, a growing consensus among U.N. experts and treaty bodies concerning interpretations of “hate speech” prohibitions in international law; and on the other, a failure of several regional human rights bodies to develop approaches to hate speech that are consistent with the U.N.’s universal standards. The Article begins by analyzing the U.N.’s approach to freedom of expression and hate speech and examining how, in the last decade, …

The last decade has brought tremendous change to the Fourth Amendment, finally resulting in a ‘digital is different’ norm. We stand at an inflection point between a monolithic, analog past and a murky future of yet-unarticulated constitutional digital policing rules. It is a good time, then, to reflect upon how we came to be here and where we ought to go. This Essay first looks back to a monumental, majestic dissent: that of Justice Louis Brandeis in the 1928 decision of Olmstead v. United States. Every American, and especially every law student, ought to know that opinion, and judges …

Traumatic brain injury remains a leading cause of death and disability across the globe. Substantial uncertainty in outcome prediction continues to be the rule notwithstanding the existing prediction models. Additionally, despite very promising preclinical data, randomized clinical trials (RCTs) of neuroprotective strategies in moderate and severe TBI have failed to demonstrate significant treatment effects. Better predictive models are needed, as the existing validated ones are more useful in prognosticating poor outcome and do not include biomarkers, genomics, proteonomics, metabolomics, etc. Invasive neuromonitoring long believed to be a "game changer" in the care of TBI patients have shown mixed results, and …

The Fourth Amendment In The Age Of Autonomous Vehicles, Tracy Hresko Pearl

Autonomous vehicles exist at the intersection of two extremely turbulent areas of Fourth Amendment jurisprudence—traffic stops and emerging technologies—and have implications for virtually every major search and seizure doctrine developed over the last century. Complicating matters even further is the fact that car manufacturers are developing these vehicles at varying rates, meaning that vehicles with differing levels of automation are being introduced onto the consumer market at different (and often unpredictable) times. Each level of vehicle automation, in turn, poses unique issues for law enforcement. Semi-autonomous (Levels 2 and 3) vehicles make it extremely difficult for police to distinguish between …
