Indigenous Māori Defend Digital Sovereignty Over Big Tech’S Free Trade Rules, Jane Kelsey Apr 2026

Indigenous Māori Defend Digital Sovereignty Over Big Tech’S Free Trade Rules, Jane Kelsey

Indian Journal of Law and Technology

In 2016, Indigenous Māori in Aotearoa New Zealand challenged the Trans-Pacific Partnership Agreement (‘TPPA’) for breaching the colonial government (Crown) obligations to them under the 1840 Tiriti o Waitangi. This was lodged before a Tribunal particularly established to inquire into such breaches. In 2021, the Tribunal upheld that claim, finding that the TPPA e-commerce provisions failed to protect Māori identity and Indigenous knowledge. Since then, the Crown and Māori have sought means to reconcile these competing paradigms within the unequal power relations of a colonial government and Indigenous Peoples – denied the sovereignty affirmed to them in 1840. This case …

The Role Of Ai In Judicial Translation: Ensuring Access To Justice In Vernacular Languages, With Special Reference To Marathi, Bhushan Raut

Indian Journal of Law and Technology

This paper examines the role of artificial intelligence in judicial translation to enhance access to justice in India’s multilingual legal system, with a specific focus on Marathi. It situates judicial translation within the constitutional framework and Rule of Law theory, arguing that linguistic accessibility is essential to legal agency and fairness. Through doctrinal, empirical, and comparative analysis, the paper evaluates initiatives such as SUVAS, highlights gaps in vernacular availability of landmark judgements, and identifies challenges relating to accuracy, accountability, and legal semantics. It proposes a hybrid AI–human model and policy reforms to ensure reliable, scalable, and inclusive translation practices in …

The Illusory Normativity Of Rights-Based Ai Regulation, Yiyang Mei, Matthew Sag Apr 2026

The Illusory Normativity Of Rights-Based Ai Regulation, Yiyang Mei, Matthew Sag

Indian Journal of Law and Technology

Whether and how to regulate AI is now a central question of governance. Across academic, policy, and international legal circles, the European Union is widely treated as the normative leader in this space. Its regulatory framework, anchored in the General Data Protection Regulation, the Digital Services and Markets Acts, and the AI Act, is often portrayed as a principled model grounded in fundamental rights. This Article challenges that assumption. We argue that the rights-based narrative surrounding EU AI regulation mischaracterises the logic of its institutional design. While rights language pervades EU legal instruments, its function is managerial, not foundational. These …

Du Statut Juridique De L’Embryon Humain En Droit Libanais, Roula El-Husseini Begdache Apr 2026

Du Statut Juridique De L’Embryon Humain En Droit Libanais, Roula El-Husseini Begdache

Proche-Orient, Études juridiques

The legal status of the human embryo has not been specifically studied in Lebanon and is the subject of an uncertain regime resulting from scattered texts and very few court decisions. As the moment marking the beginning of human life remains debated, the recent issues relating to bioethics accompanying scientific advances, particularly in relation to reproductive medicine techniques and their corollaries, including surplus embryos, do not find clear-cut answers in Lebanese law. As scientific progress is at the heart of concerns relating to human life before birth, an abdication of legal experts in favour of doctors and ethics committees can …

La Réforme De La Justice Administrative Au Liban, Nadi Abi Rached Apr 2026

La Réforme De La Justice Administrative Au Liban, Nadi Abi Rached

Proche-Orient, Études juridiques

The Lebanese administrative judiciary is undergoing a profound crisis, exacerbated by the broader institutional disintegration affecting the country. This crisis appears rooted in deeper and more specific causes: an alleged original illegitimacy of the institution and the recurrent instabilities that have marked its development. Today, this branch of justice operates at a minimal level, remains dependent of the executive, and struggles to fully guarantee the right to a fair trial. Two reform proposals aim to address this situation. This article first seeks to reaffirm the historical legitimacy and institutional continuity of the administrative judiciary, thereby providing a sound basis for …

50 Years Of Constitutional Judicial Review In The United Arab Emirates: Key Features, Nisrine Abiad Apr 2026

50 Years Of Constitutional Judicial Review In The United Arab Emirates: Key Features, Nisrine Abiad

Proche-Orient, Études juridiques

On the 50th anniversary of the enshrinement of judicial review within the UAE Constitution, this paper explores its main features. The analysis of the constitutional provisions and the jurisprudence of the Federal Supreme Court reveals that constitutional judicial review in the UAE is intrinsically rooted in federalism as it is mainly designed as a tool preserving the adjudication of powers between federal and local authorities. It is nevertheless also destined by the Constitution for a wider purpose of constitutional justice endorsing the individuals and the courts as key players in its process.

The general conditions for the formation of the contract in the Lebanese case law The Lebanese lawmaker enacted the general conditions for the formation of the contract in Articles 186 and following of the Code of Obligations and Contracts. However, here as elsewhere, the legislative work had to be supplemented by case law. The analysis of the case law relating to the substantive conditions required for the formation of the contract, has allowed to identify the most significant points of litigation in this area, to list the solutions given by the courts and to infer their general guidelines. The Lebanese …

Le Secret Bancaire Libanais À L’Épreuve Des Contraintes De La Coopération Internationale, Youmna Zein Hayek Apr 2026

Le Secret Bancaire Libanais À L’Épreuve Des Contraintes De La Coopération Internationale, Youmna Zein Hayek

Proche-Orient, Études juridiques

The Banking secrecy law which was promulgated in 1956 is undoubtedly one of the pillars of the Lebanese banking system. The stringent provisions of the law require banks to maintain the absolute secrecy of their clients’ information, except in some limited cases. However, Lebanon has lately joined the global community’s effort to fight money laundering and terrorism financing including tax evasion. As a result, new laws were enacted whereby new circumstances trigger the release of the banking secrecy. This article examines the impact of the new laws and regulations on the scope of the Lebanese banking secrecy system.

La Réforme Du Code De Commerce Libanais : Impact Sur Le Fonctionnement Des Sociétés Anonymes, Patrick Soumrani

Proche-Orient, Études juridiques

Except for specific limited amendments, the Lebanese corporate law has remained unchanged for many years. Several drafts aiming to reform and modernize such law have been prepared since the 1990s. But it is only in 2019 that a new draft has been voted hastily by the parliament, and has entered into effect on the 1st of July 2019. The reform brings numerous advantages: it facilitates the functioning of limited liability companies and joint stock companies, introduces the single partner limited liability company, provides for specific provisions governing the GDRs, as well as companies’ mergers and splits, and sanctions penalty the …

Temporal Blind Spot Failure In Serverless Cloud Systems: How Ai Agents Cause Cloud Disasters, Aaron Burton Apr 2026

Temporal Blind Spot Failure In Serverless Cloud Systems: How Ai Agents Cause Cloud Disasters, Aaron Burton

Defensive Publications Series

This disclosure defines and documents Temporal Blind Spot Failure, a recurring agentic AI failure mode in which autonomous AI agents operating inside serverless cloud systems take actions that are locally rational but catastrophic across complex cloud environments. Temporal Blind Spot Failure is distinct from prompt injection, memory poisoning, and output hallucination. It occurs because the agent decides one step at a time and cannot see how its choices compound across the systems those choices touch. This disclosure establishes Temporal Blind Spot Failure as a named category of agentic AI failure modes, describes how it shows up across the model, the …

Deliberative Constraint-Field Multi-Agent Systems (Dcf-Mas): A Framework For Fate-Constrained, Narrative-Consistent Autonomous Workspaces, Johny Manuel-Devadoss Apr 2026

Deliberative Constraint-Field Multi-Agent Systems (Dcf-Mas): A Framework For Fate-Constrained, Narrative-Consistent Autonomous Workspaces, Johny Manuel-Devadoss

Defensive Publications Series

Contemporary multi-agent systems are predominantly designed around optimization, task decomposition, and explicit coordination protocols. While effective in structured environments, these paradigms struggle with long-horizon reasoning, irreversibility, and systemic constraints that are not directly observable. This paper introduces Deliberative Constraint-Field Multi-Agent Systems (DCF-MAS), a novel framework that reconceptualizes multi-agent coordination as a process of collective deliberation operating within latent constraint fields and irreversible state transitions. DCF-MAS departs from optimization-centric orchestration by introducing three foundational mechanisms: Shared Deliberative Substrates, Latent Constraint Fields, and Irreversible State Transition Engines. These mechanisms enable agents to reason collectively, adapt to hidden systemic limitations, and account for …

Speculative Media Delivery Protocol With Distributed Conditional Verification, Jinpeng Wang Apr 2026

Speculative Media Delivery Protocol With Distributed Conditional Verification, Jinpeng Wang

Defensive Publications Series

Generative AI interactions typically suffer from sequential processing bottlenecks, leading to significant delays between user input and media playback. Existing streaming protocols are reactive and cannot transmit data before a request is finalized, while standard synchronization techniques fail to address the underlying generation latency. A speculative media delivery protocol is disclosed to mitigate these delays. Multiple sealed media streams represent competing predicted responses that are pushed concurrently to a playback buffer. These streams are governed by a logic manifest containing combinatorial and temporal unlock conditions. A designated verifier node evaluates interaction states, such as silence detection or safety tokens, to …

Split-Chassis Architecture For Hdd Memories, N/A Apr 2026

Split-Chassis Architecture For Hdd Memories, N/A

Defensive Publications Series

A modular architecture for data storage devices is described that decouples the electronic control circuitry from the electro-mechanical storage assembly. The architecture utilizes two separate modules: a logic sled and a sealed media cartridge. The logic sled contains the active processing and driving components, while the sealed media cartridge houses the mechanical storage elements and specific calibration data. A compression connector links the two modules, facilitating field-repairability, simplified data recovery, and interface upgrades without discarding the storage media. This modular approach mitigates electronic waste and enhances the adaptability of magnetic storage systems.

College Students, Immigration, And The News: Navigating What Is Reliable News, Alexis Pineda-Bautista

Departmental Honors & Graduate Capstone Projects

People treat mainstream media as a trustworthy source, but mainstream media has recently come into question. Mainstream media’s ability to quickly deliver accurate information has been called into doubt and there has been an increase in partisan reporting (Bennett and Livingston, 2018 as cited in Besalú and Pont-Sorribes, 2021; Besalú and Pont-Sorribes 2021). This research aims to demonstrate how the public views the mainstream media’s ability to deliver reliable information, why some participants are turning towards social media as a news source, and how people use their personal experience to verify the validity of media claims.

In semi-structured interviews, 13 …

Aquinas, Wilson, And Continuity On Crime And Punishment, Brian M. Murray Apr 2026

Aquinas, Wilson, And Continuity On Crime And Punishment, Brian M. Murray

Catholic University Law Review

This Article compares the legal thought of James Wilson, a leading jurisprudential figure during the American Founding, and Thomas Aquinas, perhaps the most well-known medieval philosopher, on crime and punishment. It argues their theories are closer than the historical gulf between them suggests would be the case. Both limit the definition of crime to morally culpable acts involving public harm. Each considers redressing the public disorder crime causes as the primary justification for punishment. While Wilson defers to the English common law to emphasize protecting certain natural rights and to prevent crime, Aquinas points to his understanding of natural law …

Recognizing Metaphorical References To Sexual Assault Resistance And Represented Rape Myths In Coraline (2009), Braden Slater

Theses and Dissertations

Is there any value in children’s horror literature and film? Literary theorists have shown that children’s horror is uniquely positioned to be not only captivating and accessible, but also educational and hopeful for some young audience members. Like most fictional monsters, those presented in children’s horror can be read as metaphors for the fears and experiences people face in real life. Scholars have argued that engaging with this type of frightening media may help people confront challenging ideas and feelings from a place of safety. Building on this theoretical foundation, I perform a close reading of the 2009 film Coraline, …
