A Critique Of Guardianship Theory From The Perspective Of Catholic Thought: The Tension Between The Duty To Protect And Preservation Of Legal Autonomy, Lucia A. Silecchia
Scholarly Articles
In recent times, guardianship law has been gaining much public attention – for a variety of reasons. With a steadily aging domestic and international demographic, an increasing number of people contemplate how they will be cared for if they lose capacity. A new variety of alternatives to guardianship have been adopted by states to allow for “supported“ decision- making in numerous ways, while various forms of limited guardianship have emerged as alternatives to the traditional “one size fits all” model of plenary guardianship prevalent in the past. In addition, some advocate abolishing guardianships entirely, believing them to be an affront …
Why Equity Follows The Law, Adam J. Macleod
Why Equity Follows The Law, Adam J. Macleod
Scholarly Articles
Renewed attention to equity in higher education is welcome because true equity helps us to reason together well. When administered correctly, the jurisprudence of equity models civil discourse and, therefore, can teach us how to carry out civic engagement reasonably. Equitable interpretation of the law teaches us how to understand each other charitably. And equity’s deference to law teaches us how to reason well together about our practical problems. Law is the practical reasoning that we do together. Equity serves the ends of justice by serving law, rather than undermining it. These functions of equity in adjudication point toward a …
U.S. Bankruptcy Courts Balance The Statutory Protections Of Stakeholders With The Needs Of Discovery In Foreign Bankruptcy Proceedings, Conor Carman
Bankruptcy Research Library
(Excerpt)
Chapter 15 of title 11 of the United States Code (the "Bankruptcy Code") establishes methods for managing insolvency cases that encompass debtors, assets, claimants, and other parties across multiple nations. Section 1521(a)(4) allows courts to grant discovery relief. To determine whether to grant discovery relief, courts balance the right to discovery relief with stakeholder interests. As part of a U.S. courts’ analysis, it considers principles of comity to support a foreign bankruptcy proceeding.
This memorandum discusses the statutory availability for discovery relief under chapter 15, limitations on discovery imposed by courts to protect stakeholder interests, comity, and how courts …

Service Of A Subpoena Through Alternative Means: Social Media, Tayler Eynon
Bankruptcy Research Library
(Excerpt)
Service of a subpoena via a means besides personal service, i.e., "alternative service," has been "routinely authorized" under Rule 45 of the Federal Rules. The functional purpose of requiring delivery is to "ensure receipt," which then allows the enforcement of a subpoena to be consistent with due process. With the development of new means of communication, however, an emerging issue has become whether service of a subpoena via social media may provide similar "evidence of actual receipt." Many courts have read Rule 45 broadly to allow for service of a subpoena through social media if certain fundamental requirements are …

(Excerpt)
When a creditor seeks to amend a proof of claim after the bar date has passed with an amount different to that provided in the original proof of claim, courts engage in an equitable analysis of multiple factors to determine whether to grant or deny the motion to amend. Under certain circumstances, Bankruptcy Rule 9006(b)(1) gives creditors an opportunity to file a proof of claim after the bar date has passed.

Decolonizing Yoga: Historical Perspectives And Contemporary Practices, Archana Ram
Decolonizing Yoga: Historical Perspectives And Contemporary Practices, Archana Ram
Honors Undergraduate Theses
Over the last few decades, yoga has become a multi-billion-dollar industry in the West. This industry is typically represented by glossy photographs of thin white women in physical postures. Given its religious origins in South Asia, this mass marketing of yoga has raised important questions about Western commodification and cultural appropriation. As a result, counter-movements have emerged to “Take Back Yoga” and “Honor the Cultural Roots of Yoga.” This thesis analyzes a range of critical-constructive responses to the commodification and colonization of yoga. It focuses on two case studies: Susanna Barkataki, an American yoga teacher of Indian descent, and Kallie …

Computer Science: Faculty Publications and Other Works
Zero Involvement Pairing and Authentication (ZIPA) is a promising technique for auto-provisioning large networks of Internet-of-Things (IoT) devices. In this work, we present the first successful signal injection attack on a ZIPA system. Most existing ZIPA systems assume there is a negligible amount of influence from the unsecured outside space on the secured inside space. In reality, environmental signals do leak from adjacent unsecured spaces and influence the environment of the secured space. Our attack takes advantage of this fact to perform a signal injection attack on the popular Schurmann & Sigg algorithm. The keys generated by the adversary with …

Synergistic Cytotoxicity Effect Of Ultrasound And Plasma Microbubble In Glioblastoma 3d Tumor Sphere Model, Janith Wanigasekara, Patrick J. Cullen, Brijesh Tiwari, James F. Curtin
Articles
The combined application of ultrasound (US) and plasma microbubble (PMB) is a promising technology against glioblastoma (GBM). Here, we determined the effects of US and PMB (alone and combined) on U-251 MG GBM and A431 epidermoid carcinoma spheroids under different conditions. The synergistic treatment of US- and PMB-induced tumor sphere cell death in a time-, dose-, treatment frequency-, and reactive oxygen species dependent manner, while multiple treatments augmented this effect. Synergistic treatments significantly reduced three-dimensional GBM spheroid regrowth and cell proliferation while inducing cytotoxicity, spheroid shrinkage, and damage to the tumor microenvironment. PMB-induced cytotoxicity throughout the tumor sphere, likely via …

Traffic analysis on highways at the macroscopic level is very similar to the analysis of the spread of infectious diseases, namely the susceptible-infected-recover (SIR) model. We propose the SIR model with a control variable. The dynamics with fixed control and stability of the model are analyzed. Sensitivity analysis was also carried out. Variable control is applied as an effort to regulate or change the duration of the green light at an intersection. We obtain an optimal control strategy when the control is time-dependent. Numerical results show the positive impacts of implementing the control to susceptible vehicles and treatment for congested …
