Defense Lawyering In The Progressive Prosecution Era, Jenny Roberts Jan 2024

Defense Lawyering In The Progressive Prosecution Era, Jenny Roberts

Hofstra Law Faculty Scholarship

The movement to elect so-called "progressive prosecutors" is relatively new, but there is a robust literature analyzing it from a number of angles. Scholars consider how to define "progressive prosecution," look at the movement through a racial justice lens, and examine it in the context of rural spaces, deportation, and the pandemic. One essay even offers a "progressive prosecutor's handbook." But what of the defense lawyer representing clients in a progressive prosecution jurisdiction? With the election of the new prosecutor, things may

have shifted from a highly-charged, adversarial relationship with a harsh law-and-order office to something quite different. Defenders in …

Fostering Multiliteracies And Engagement With Multimodal Texts In The Secondary English Language Arts Classroom, Amanda J. Hargis

Graduate Research Papers

This study underscores the potential of multimodal texts to enhance student engagement and understanding in high school English Language Arts classrooms. While student preferences for different text formats varied, challenges remain in how to connect classic literature to contemporary students. However, the integration of multimodal resources can offer valuable opportunities for enriching the learning experience. Future research and continued adoption of culturally sustaining pedagogies in instructional practices will be key to maximizing the benefits of multimodal texts in diverse educational settings.

The Effect Of Student Discussion Groups On Music Preference, Abby Steffen Jan 2024

The Effect Of Student Discussion Groups On Music Preference, Abby Steffen

Graduate Research Papers

The purpose of this study was to explore the effect of three different listening conditions on how students rate their preference of musical genre. The preferences of the students could then be analyzed and incorporated into daily teaching. The participants were fifth-grade students of the researcher. Students (N = 44) were divided into three groups: Listening Only, Small Group Discussion and Teacher Info. Students in the Listening Only group listened to a playlist of music representing ten genres and rated each genre on a scale from 1(I don’t like it) to 5 (I like it a lot). Students in the …

Environmental Information Avoidance Motives On A U.S. Campus, Mary Beth Deline, Laura N. Rickard, Jared V. Worwood, Pei Geng, Elisabeth Reed Jan 2024

Environmental Information Avoidance Motives On A U.S. Campus, Mary Beth Deline, Laura N. Rickard, Jared V. Worwood, Pei Geng, Elisabeth Reed

Iowa Journal of Communication

Although communication, broadly, is often identified as a key factor across campus sustainability initiatives, few studies have examined specific information behaviors that can affect reception of such efforts. We therefore seek to characterize motives for a key communication barrier to campus sustainability efforts: environmental information avoidance (IA), and to investigate whether these motives differ in relation to known or unknown information. This exploratory study thematically analyzed answers from an open-ended question on a questionnaire with faculty, staff and students on a U.S. university campus. We identified six environmental IA motives, ranging from information overload to efficacy constraints. Correlational analysis found …

An Unconventional Etiquette: Emily Post And Etiquette In Society, In Business, In Politics, And At Home., Jillian Klean Zwilling Jan 2024

An Unconventional Etiquette: Emily Post And Etiquette In Society, In Business, In Politics, And At Home., Jillian Klean Zwilling

Iowa Journal of Communication

In 1922, Emily Post published, Etiquette in Society, In Business, In Politics and at Home, which became a national bestseller. While other etiquette manuals had been written up to that point, none has been so successful and enduring in the American consciousness as Post’s. In this article, I explore the rhetorical strategies Post employed in creating a text that follows the conventions of an etiquette manual but breaks the convention of exclusivity generally associated with etiquette texts. I argue Post was successful because of her uniquely American approach to etiquette. The success of Post’s text can be attributed to her …

Book Review: From Thought To Action: Developing A Social Justice Orientation, Joy L. Daggs

Iowa Journal of Communication

In the second edition of From Thought to Action: Developing a Social Justice Orientation, Sanford helps to provide a framework for students’ first exposure to allyship and activism. In the preface of the book, Sanford (2024) articulates the three major purposes of the book, which include helping new allies, “a) focus on common humanity, b) feel less isolated on their social justice journey, c) figure out how to move from thought to action, either individually or collectively.” (p. xiv) The book could be used to supplement a course on Intercultural Communication, encouraging students to take their knowledge to collaborate with …

Cost Misperception And Voting For Public Goods, Corey Lang, Casey J. Wichman, Michael J. Weir, Shanna Pearson-Merkowitz Jan 2024

Cost Misperception And Voting For Public Goods, Corey Lang, Casey J. Wichman, Michael J. Weir, Shanna Pearson-Merkowitz

Environmental and Natural Resource Economics Faculty Publications

Public good provision is often determined through referendums by voters, who weigh benefits against costs. However, perceptions of benefits and costs may be incorrect, which could in turn lead to voter error and misallocation of public goods. Using real-world referendums, we evaluate voter perceptions of the private costs of providing public goods by conducting three exit polls of New England voters and an online survey of California voters. By comparing cost perceptions to actual tax incidence, we find pervasive evidence that voters misperceive costs. Fewer than 20% of voters in our samples reported perceived costs within 25% of estimated actual …

Evaluation Of Environmentally Friendly Products For Use Against Ixodes Scapularis And Amblyomma Americanum Ticks (Acari: Ixodidae), Chantal Sengsourinho Jan 2024

Evaluation Of Environmentally Friendly Products For Use Against Ixodes Scapularis And Amblyomma Americanum Ticks (Acari: Ixodidae), Chantal Sengsourinho

Open Access Master's Theses

Ticks are vectors of diseases and are a significant public health concern in the United States. Over the last several decades, two medically important species, the blacklegged tick (Ixodes scapularis) and the lone star tick (Amblyomma americanum) have rapidly expanded their geographic ranges. As the number of ticks increase, so does the chance for disease incidence - especially in areas where ticks were not previously present. Together, these two species carry multiple pathogens that can cause serious diseases including Lyme disease, ehrlichiosis, babesiosis, anaplasmosis, and several viral infections.

One of the most common methods for preventing …

An Autoethnographic Dialogue With Motherhood Literature, Maya Autret, Brad Van Eeden-Moorefield Jan 2024

An Autoethnographic Dialogue With Motherhood Literature, Maya Autret, Brad Van Eeden-Moorefield

The Qualitative Report

This autoethnography represents the first author’s journey as a mother and doctoral student researching mothers’ experiences in contending with the demands of work and family. Reading across different pockets of empirical motherhood literature (work-family conflict, contemporary motherhood, maternal gatekeeping, and intensive motherhood) I became troubled by how women’s realities were reflected. Pushing back against traditional methods that endorse separating my researcher identity from my maternal self, I draw on autoethnographic method to dialogue with this literature. This approach empowers me to speak out as a novice scholar uncomfortable with aspects of literature, while also navigating training in the use of …

Reexamination Of College Students’ Behaviors And Knowledge Of Recycling, Ella Hilbrant Jan 2024

Reexamination Of College Students’ Behaviors And Knowledge Of Recycling, Ella Hilbrant

Honors Program Theses

The motivation for and consistency of recycling behavior varies widely from person to person. For some, motivation stems from concern for the environment, while others lack motivation to recycle at all or will only recycle if convenient. Within college students, differences in motivation and recycling habits may depend on factors such as personal demographics, involvement in specific classes or student groups, recycling habits before college, etc. Recycling behaviors can also stem from environmental literacy, which is how individuals understand, process, and use environmental information needed to make informed, sustainable, and environmentally friendly decisions (Null et al. 2021). Furthermore, on-campus recycling …

Is You Is Or Is You Ain’T My Client? Navigating The Mysteries Of Prospective And Organizational Representation, Leonard Niehoff Jan 2024

Is You Is Or Is You Ain’T My Client? Navigating The Mysteries Of Prospective And Organizational Representation, Leonard Niehoff

Articles

Many years ago, I was trying a civil case that had stretched on for weeks in a federal court in Detroit. The counsel tables for both parties were covered with briefs, coffee cups, memoranda, books, water pitchers, examination outlines, yellow writing pads, and all the other litter that inevitably piles up during long trials. It appeared that we had moved in, just as at our actual homes it appeared that we had moved out.

"Guarding The Sanctity Of Choice And Privacy": Data Privacy And Abortion–The Next Frontier Of The Fourth Amendment, Ryan S. Houser Jan 2024

"Guarding The Sanctity Of Choice And Privacy": Data Privacy And Abortion–The Next Frontier Of The Fourth Amendment, Ryan S. Houser

Northwestern Journal of Technology and Intellectual Property

In the wake of the Dobbs decision, a seismic shift reverberates through the landscape of reproductive rights. As investigations into private healthcare decisions surge, states wield increasingly sophisticated tools to probe into the private lives of pregnant individuals, igniting a contentious debate on privacy and data security. The United States is entering a looming era where internet search histories, emails, text messages, and GPS data become ammunition in the arsenal of state-led investigations. Dubbed as “dragnet criminal surveillance tools,” these tactics will unleash a torrent of prosecutions, raising profound questions about the sanctity of personal information in the digital age. …

Abuse Of Dominance In Tech: Comparative Analysis Of Margin Squeeze Claims Against U.S., Eu, And Korean Telecommunications Firms, Alex Hyojung Roh

Northwestern Journal of Technology and Intellectual Property

Telecommunications network operators around the world are often characterized as natural monopolists. Only one or few telecommunications firms control nationwide networks through which all other ancillary service providers reach their customers. Many jurisdictions, including the United States, European Union, and Korea, seek to prevent such powerful market players from abusing their dominance by regulating their business conduct under competition law.

This Note focuses on the regulation of “margin squeeze,” whereby a dominant firm leverages its market power in one market with the intent to monopolize a separate but related market. The United States does not currently impose a standalone antitrust …

Staying A Jane Doe Post Dobbs And Roe: The Risk Modern Technology Poses With Archaic Abortion Restrictions, Grace E. Marino Jan 2024

Staying A Jane Doe Post Dobbs And Roe: The Risk Modern Technology Poses With Archaic Abortion Restrictions, Grace E. Marino

Northwestern Journal of Technology and Intellectual Property

Dobbs v. Jackson Women’s Health Organization sent shockwaves across the nation, overturning years of precedent and marking a pivotal moment as Roe v. Wade receded from current legal standing. This consequential abortion case immediately ignited controversy, prompting states to swiftly enact laws prohibiting abortion. Beyond the immediate implications for the health and safety of those seeking abortions, the new legal landscape poses additional risks. Since the era when abortion was last illegal, rapid technological advancements have transformed the American societal landscape, resulting in daily surveillance of its citizens. The convergence of technological progress, societal dependence on technology, and the absence …

A Tort For The Digital Age: False Light Invasion Of Privacy Reconsidered, John C.P. Goldberg, Benjamin C. Zipursky Jan 2024

A Tort For The Digital Age: False Light Invasion Of Privacy Reconsidered, John C.P. Goldberg, Benjamin C. Zipursky

Faculty Scholarship

In his famous 1960 article, William Prosser identified four privacy torts: Disclosure of Private Facts, False Light Invasion of Privacy, Appropriation of Likeness, and Intrusion Upon Seclusion. Although each was recognized in the Second Torts Restatement and by various courts, the false light tort seems to have foundered. Indeed, starting in the late 1980s, prominent courts rejected it and many academics have expressed grave misgivings about it. Often interpreted as a kind of ‘defamation lite,’ the tort seems to its critics an ill-defined wrong that clever lawyers invoke to evade important limitations on defamation liability.

Designing Equitable Media Literacy Interventions For Critical Youth Agency, Bobby Foster, Paul Mihailidis, Patrick R. Johnson, Shannon Burth, Melissa Tully, Srividya Ramasubramanian, Emily Riewestahl

Journalism Faculty Publications and Presentations

In recent years, young people engaged in political discourse and civic action online. U.S.-based social movements centered on equity issues, such as Black Lives Matter, Dreamers, and March for Our Lives, engaged young people in shaping and publicizing the goals of these movements through digital platforms. Increasingly in communities at the margins, young Americans need digital and media literacy skills to supplement contentious education restrictions within the United States, as with many state bills curtailing the teaching of LGBTQIA+ histories and critical race theory. With these considerations in mind, our team conducted a national study of impactful media literacy in …
