Solving A Global Legal Problem Of Corporate Social Responsibility Reporting: A Multidisciplinary Approach To Making It Effective, Benedict Sheehy, Ying Chen, Maria Roszkowska-Menkes

Denver Journal of International Law & Policy

Over the decades, corporate social responsibility (CSR) has become increasingly important, expanding its reach across the globe. CSR does a number of tasks: it provides a governance framework for business, a business practice, and increasingly, a form of regulation. From a legal point of view, CSR is a form of soft law evolving into hard law. This Article explores that evolution focusing on mandatory CSR reporting understanding it as law. Such reporting is a critical regulatory tool in pressuring and holding business organizations accountable for sustainability in their operations. Through examining CSR reporting as phenomena of wide interest, the Article …

Voter Approval Of Bond Referendums: The Role Of Bond Amount And Ballot Characteristics, Andrew Bechard, Corey Lang, Shanna Pearson-Merkowitz

Environmental and Natural Resource Economics Faculty Publications

Municipal and state governments are often constitutionally bound to ask voters to approve new government debt through voting on bond referendums. Generally, politicians expect voters to balk at higher-cost bonds and be more willing to approve lower-cost bonds. However, there is minimal research on how the amount of a bond affects voter support. We implement a survey experiment that presents respondents with hypothetical ballots, in which the cost of proposed bonds, the number of bonds on the ballot, and the order in which they are presented, are all randomized. Our results suggest that support is not responsive to the amount …

Procedural Pluralism: A Model For Enforcing Internal Administrative Law, Daniel Epstein Jan 2024

Procedural Pluralism: A Model For Enforcing Internal Administrative Law, Daniel Epstein

UC Law Constitutional Quarterly

Much of our federal administrative law relies upon supposedly mandatory procedures that agencies often ignore. So, can the administrative state achieve legitimacy if it is bound by laws that it rarely, if ever, complies with? New data shows that agencies simply ignore administrative procedures without recourse because compliance ultimately depends on who holds power in the administrative state––not congressionally delegated rules or procedures imposed by the President. This article refutes the prevailing assumption that, as the sole powerholder of the entire executive department, the President is responsible for the current state of administrative non-compliance and underenforcement because the President decides …

Rethinking The "No-Duty" Rule: How Deshaney Can Be Reformed To Enable Objective, Coherent Analysis And Protection For More Victims Of Crime, Annaliese Brellis Jan 2024

Rethinking The "No-Duty" Rule: How Deshaney Can Be Reformed To Enable Objective, Coherent Analysis And Protection For More Victims Of Crime, Annaliese Brellis

Journal of Criminal Law and Criminology

“Failure-to-protect” cases, situations in which crime victims do not receive reasonably relied-upon police protection, receive troubling treatment under the law. This problem originated with the Supreme Court case DeShaney v. Winnebago County Department of Social Services, which held that litigants cannot bring a substantive due process claim for failure-to-protect cases. In doing so, the Court espoused a distinction between state action and inaction that relied upon unsound assumptions about state obligations and paltry factual analysis. DeShaney is troublesome because it provides only two situations in which failure-to- protect cases can be successful: physical, involuntary police custody and the state-created-danger …

Decoding U.S. Tort Liability In Healthcare's Black-Box Ai Era: Lessons From The European Union, Mindy Duffourc, Sara Gerke Jan 2024

Decoding U.S. Tort Liability In Healthcare's Black-Box Ai Era: Lessons From The European Union, Mindy Duffourc, Sara Gerke

Faculty Scholarly Works

The rapid development of sophisticated artificial intelligence (“AI”) tools in healthcare presents new possibilities for improving medical treatment and general health. Currently, such AI tools can perform a wide range of health-related tasks, from specialized autonomous systems that diagnose diabetic retinopathy to general-use generative models like ChatGPT that answer users’ health-related questions. On the other hand, significant liability concerns arise as medical professionals and consumers increasingly turn to AI for health information. This is particularly true for black-box AI because while potentially enhancing the AI’s capability and accuracy, these systems also operate without transparency, making it difficult or even impossible …

An Updated Practical Guide To Taking And Defending Depositions, Gary Gildin Jan 2024

An Updated Practical Guide To Taking And Defending Depositions, Gary Gildin

Faculty Scholarly Works

The deposition offers a singular opportunity to handcuff the deponent to an irreversible script. Consequently, both the attorney taking the deposition and defending counsel must prepare for and conduct the deposition with equal if not greater care than the trial.

Traditionally, lawyers have used the deposition to discover facts relating to the legal elements and the credibility, perception, and recollection of the witness. However, recent breakthroughs in neuroscience as to how the brain makes decisions have revealed a different genre of evidence that will drive how the trier of fact will decide the case. Today an attorney taking a deposition …

Benefits Transparency, Samantha Prince Jan 2024

Benefits Transparency, Samantha Prince

Faculty Scholarly Works

Recently, several states and cities have enacted equal pay laws in a push for pay transparency in job postings to inform and help reduce wage gaps. Some of these laws also require a description of the employee benefits that the company offers. However, none of these laws require a detailed description of said benefits, even though employee benefits on average make up 24% of an employee’s compensation.

Businesses can choose how much to disclose with respect to their benefits and they may even engage in what this author calls “benefits washing”—a practice where companies provide vague or misleading information about …

Grid Reliability In The Electric Era, Joshua C. Macey, Shelley Welton, Hannah Jacobs Wiseman Jan 2024

Grid Reliability In The Electric Era, Joshua C. Macey, Shelley Welton, Hannah Jacobs Wiseman

Faculty Scholarship

The United States has delegated the responsibility of keeping the lights on to a self-regulatory organization called the North American Electric Reliability Corporation (NERC). Although NERC is a crucial example of industry-led governance—and regulates in an area that is central to our economy and basic human survival—this unusual institution has received scant attention from policymakers and scholars. Such attention is overdue. To decarbonize its economy, the United States must enter a new “electric era,” transitioning many sectors to run on electricity while also transforming the electricity system itself to run largely on clean but intermittent renewable resources. These new resources …

Prosecuting Police, Guyora Binder, Anthony O'Rourke, Rick Su Jan 2024

Prosecuting Police, Guyora Binder, Anthony O'Rourke, Rick Su

Journal of Criminal Law and Criminology

Prosecutors face criticism for prosecuting too many minority members and too few police. Recently, some reformers have won prosecutorial elections by pledging to change these priorities. Yet scholars have identified two impediments to police prosecutions. First, county prosecutors often answer to suburban voters indifferent to the excesses of city police. Second, prosecutors depend on those police to investigate their cases and to endorse them as effective. This Article argues that the influence of residents and police on prosecutorial decisions depends on the political geography of a prosecutor’s office. As a result, whether a prosecutor’s office is “city-based,” “regional,” or “state-appointed” …
