LEGAL ANTHROPOLOGY: AN INTRODUCTION offers an initial overview of the challenging debates surrounding the cross-cultural analysis of legal systems. Equal parts review and criticism, the author outlines the historical landmarks in the development of the discipline, identifying both strengths and weaknesses of each stage and contribution. LEGAL ANTHROPOLOGY suggests that future progress can be made by treating as the distinguishing feature of law the perceived fairness of structural inequalities of social systems, rather than the traditional emphasis upon sanction or dispute resolution.

The Conservation Biology Of Berberis Holstii Engl. In Nyika National Park, Malawi, Cecilia Promise Maliwichi Nyirenda

Biological resources are particularly important in resource-limited countries where utilisation demands challenge conservation efforts. The study focussed on Berberis holstii, a plant resource on high demand in northern Malawi restricted to Nyika National Park. The uses, distribution, habitat characteristics, demography and seed germination requirements of this important species were investigated. Uses were investigated by means of ethnobotanical interviews. The species distribution in the park was mapped employing GIS. Habitats were characterised employing multivariate methods implemented in the programmes PC-ORD and PRIMER. Demographic studies employed matrix projections to characterise representative populations. Finally, laboratory germination trials allowed determination of light, cold stratification …

The existing body of literature on community-based natural resource management suggests that local institutions are a mainstay, particularly for the management of plants and animals upon which communities depend for livelihood. However, evidence from the Mufurudzi resettlement scheme in Zimbabwe refutes this assertion. This paper examines the effectiveness of local religious institutions in the management of forest and woodland resources at the micro-level. In this setting, communities were “grafted;” that is, their members were arbitrarily selected for resettlement without consideration for the diversity of their cultural backgrounds or whether they were neighbors to one another prior to resettlement. Cultural differences are produced and maintained in numerous relations as spaces and places are. Spaces such as nation-states are made and organized hierarchically through historical agency within the parameter of unbalanced power interactions. They are imagined, contested, and enforced through processes in which multiple sociopolitical structures are implicated. In the de-territorialized age, the ways in which people "confound or reinforce the established spatial orders either through physical movement or through their own conceptual and political acts of re-imagination" are central for any research on people's dynamic acts of cultivating, identifying, and communicating processes (Gupta and Ferguson 17). Franz Boas proposed almost one hundred yeas ago that cranial plasticity explained the differences in cranial form between European-born immigrants and their American-born children. Plasticity refers to the idea that the body responds to environmental forces during growth and development. If the environment does affect cranial growth and development, than differences should be seen in populations living under different ecological conditions. In this study anthropometric measurements will be used to test for differences in head and face measurements of members of the Blackfeet Nation using multivariate statistics. This Article explores the relationship between legal and biological parenthood. It examines how neither history, nor biology, nor moral philosophy dictate a legal regime in which parenthood must be based on biological connection, but that attractionto a biological (or"bionormative")regime remains strong. In explaining why, it suggests that much of what attracts people to bionormativity is not biology itself, but the way in which a biological regime constructs parenthood as a private, exclusive, and binary enterprise. It is these ancillary qualities of bionormativity that people may care the most about. Today, a variety of forces put pressure on these ancillary qualities …

What Do We Have Against Parents?: An Assessment Of Judicial Bypass Procedures And Parental Involvement In Abortions By Minors, Wade Schueneman

It is the established law of the land that minors enjoy a limited right to terminate unwanted pregnancies. States may restrain the exercise of this right by requiring parental consent or notification, but they must allow minors an opportunity to bypass consent requirements. This Note examines the history and present state of judicial and nonjudicial bypass mechanisms. It details the constraints and requirements imposed by state and federal constitutions, assesses the current landscape of parental involvement statutes, and provides prescriptive analysis as to how states might choose to refine and improve their bypass mechanisms to better protect parental rights.

The purpose of this project was to use a social constructivist approach to understand the perception of risk by mothers making the choice to give birth at home in Missoula, Montana. Social constructivism assumes that knowledge about risk is filtered through “social and cultural frameworks of understanding” (Lupton and Tulloch 2002, 321). The information gained from participants in this study was interpreted as a representation of the individual’s culture, including their beliefs, values and upbringing, as well as the influences of the individual’s social network which can include family members, spouses, friends, and community members. The purpose of this study was to understand the essence of becoming a Reiki practitioner and Reiki’s relationship to an individual’s personal health. The phenomenological research perspective utilized in this study allowed the data to speak for itself and represented the essence of Reiki and Reiki practitioners in Missoula, Montana. Ten Reiki practitioners were interviewed about their personal experience with Reiki. Interviewees were all volunteers, over the age of 18, who were trained in Reiki II or higher and had more than three years of experience practicing Reiki. Participants had practiced Reiki either on themselves or someone else regularly, which …

Colour symbolism permeated the world of indigenous North America. This symbolism was often tied to the cosmos where the earth was viewed as a quadrilateral disk and each of the four cardinal directions was linked with a colour array such as red, white, black, and blue. We suggest that the recurring use of certain colours and colour contrasts comprised a suite of long-term historical practices that were essential for reproducing certain views about the world and about being in the world. Further, the rendering of colour had a plasticity that allowed it to enter a discourse about daily life that …

Tribal commerce created the current highways that stretch from coast-to-coast in North America today. The roads that are traveled by semi-trucks full of cargo, grocery produce, and all manner of commercial goods are on top of the ancient trade routes Natives have traveled for centuries. Unfortunately, the history and sophistication of Native commercial activities have been largely suppressed and left out of the story of the North American continent as Euro-Americans rewrote the continent’s history to reflect the glorification of colonization. The Ethics Of Intercultural Approaches To Indigenous Studies: Conjoining Natives And Palestinians In Context, Steven Salaita

Salaita argues that the project of Indigenous Studies is inherently comparative, citing numerous examples of productive intercultural scholarship, he explores historical, cultural, and politicalrelationships among Native North Americans and Palestinian Arabs to illuminate some of the ways that comparison offers the potential for new directions in both scholarly and activist communities. He contextualizes this analysis with a broader discussion of the ethics of scholarship in Indigenous Studies, paying special attention to the relationship of nationalistic commitment to intercultural methodologies.

An explicitly methodological case study conducted for a multidisciplinary symposium on the Atlantic relationships of pre- and (post-)Katrina Louisiana illustrates some methods that geographers might usefully contribute to an emergent Atlantic Studies. Three general types of method apply to a substantive question related to the hurricane that struck on the morning of 29 August 2005: Is (post-)Katrina New Orleans emerging as a Hispanic place in contrast to its predominant pre-Katrina associations with the Black and French Atlantics? Through exploration and analysis of economic, historical and political factors stemming from the authoritarian period (1973-1990) to the present day, this project offers an interdisciplinary explanation of the emergence of the "Penguin's Revolution" in Chile. In May-June 2006, 700,000 high school students paralyzed the Chilean education system by protesting in the streets, taking over schools and not attending classes. Students organized under the Coordinating Assembly of Secondary Students (ACES) demanded that the government take responsibility for providing universal high quality and equal education. The roots of student discontent lie in the multi-dimensional education crisis, generated by the semi-privatized, decentralized educational …
