The Right To Abandon, Lior Strahilevitz Feb 2009

The Right To Abandon, Lior Strahilevitz

Coase-Sandor Institute for Law & Economics Research Paper Series

The common law prohibits the abandonment of real property. Perhaps it is surprising, therefore, that the following are true: (1) The common law generally permits the abandonment of chattel property; (2) The common law promotes the transfer of real property via adverse possession; and (3) the civil law permits the abandonment of real property. Because the literature on abandonment is disappointingly sparse, these three contrasts have escaped sustained scholarly analysis and criticism. This paper aims to provide a comprehensive analysis of the law of abandonment. After engaging in such an analysis, the paper finds that the common law’s flat prohibition …

Italy: The Case For Division, Sara Jane Micali Feb 2009

Italy: The Case For Division, Sara Jane Micali

Pell Scholars and Senior Theses

This work is a comparative thesis between northern and southern Italy, particularly on the socio-economic and geo-political differences that divide the country. Differences in areas such as historical background, geography, economy, tourism, social trends, and politics have separated the country into two distinctly dissimilar parts, the north and the south. With evidence of the industrial north in comparison to the agricultural south, as well as the introduction of “third Italy”, the economic differences between the country are clear. Similarly, the traditions of the south keep them far behind the modern north and the influence of both the Lega Nord and …

Challenging Colorblind Education: A Descriptive Analysis Of Teacher Racial Attitudes, Melanie S. Hinojosa, Amanda Moras Feb 2009

Challenging Colorblind Education: A Descriptive Analysis Of Teacher Racial Attitudes, Melanie S. Hinojosa, Amanda Moras

Sociology Faculty Publications

Research suggests that many public school teachers are not prepared to deal with the growing number of diverse students in the schools. Questions are raised by researchers about the ability of the current teaching force to adequately meet the needs of the growing number of students of Color in the schools. Small-scale qualitative studies find that many White teachers feel unsure of their ability to teach students of Color, tend to hold stereotypical beliefs about urban students and/ or students of Color, and tend to use cultural deficiency models for explaining their academic performance. To date, no quantitative studies have …

“Corrective Surgery” And The Americans With Disabilities Act, Jeannette Cox Feb 2009

“Corrective Surgery” And The Americans With Disabilities Act, Jeannette Cox

School of Law Faculty Publications

This Article challenges the assumption that the Americans with Disabilities Act (ADA) requires persons with disabilities to undergo corrective surgery as a precondition to membership in the ADA's protected class. This issue is ripe for discussion because current efforts to amend the ADA, although not focused on the corrective surgery issue, will unsettle the current doctrine underpinning many courts' conclusions that an individual's decision to forgo available medical technology bars her from relief under the ADA. The article aims to make two contributions. First, it argues that the ADA's focus on reshaping cultural responses to disability suggests that individuals need …

Decent Colonialism? Pure Science And Colonial Ideology In The Netherlands East Indies, 1910–1929, Andrew Goss Feb 2009

Decent Colonialism? Pure Science And Colonial Ideology In The Netherlands East Indies, 1910–1929, Andrew Goss

History Faculty Publications

This article examines changes within the Dutch civilising mission ideology after the decline of the Ethical Policy. Support of pure science, scientific knowledge that supposedly transcended ideology and politics, allowed the colonial administration to continue to project their rule as decent and moral, even as conflict and repression dominated colonial politics in the 1920s. The argument starts with the construction of pure science after 1910, under the care of J.C. Koningsberger, out of the research traditions at the Department of Agriculture. It next examines the creation of institutions and agendas of pure science. And finally it analyses the absorption of …

The juridico-symbolic violence, which includes or excludes the survivors of the Holocaust and wartime rape in Bosnia from the legal category of a witness, shapes the reader's bodily engagement with texts. The MA program of Gender and Women's studies and the institutional networks with the English and Comparative Literature and Law department at AUC have facilitated my reading of three main texts: a novel about wartime rape in Bosnia S.: A story about the Balkans, a particular world map rendering of the former Yugoslavia, and the judicial opinions found in a landmark case regarding wartime rape in Bosnia, Kunarac. My …

Faith And Fortune In The Post-Colonial Classroom, Stefano Harney, Stephen Linstead Feb 2009

Faith And Fortune In The Post-Colonial Classroom, Stefano Harney, Stephen Linstead

Research Collection Lee Kong Chian School Of Business

The place of spirituality, religion, faith and cynicism in management education has received increasing attention in the past decade. From the point of view of teaching focused on critical engagement with practice, they are sometimes viewed as obstacles to practice. In this article we use resources from post-colonial thought and global critical race theory to suggest the opposite—that faith and cynicism can be understood as forms of critique issuing from the student perspective and that we might learn from these critiques as a way to reconfigure persistent dilemmas in the critique of the Enlightenment that trouble critical management approaches. We …
